RE: APPROVE INTERGOVERNMENTAL AGREEMENT FOR PROVISION OF COMMUNICATIONS,
RECORDS, AND CRIMINAL JUSTICE INFORMATION SYSTEMS AND AUTHORIZE CHAIRMAN
TO SIGN
WHEREAS, the Board of County Commissioners of Weld County, Colorado,
pursuant to Colorado statute and the Weld County Home Rule Charter, is vested
with the authority of administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with an Intergovernmental Agreement
for Provision of Communications, Records, and Criminal Justice Information
Systems between the City of Greeley and the County of Weld, Colorado, commencing
May 3, 1993 and ending December 31, 1998, with the further terms and conditions
being as stated in said agreement, and
WHEREAS, after review, the Board deems it advisable to approve said
agreement, a copy of which is attached hereto and incorporated herein by
reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the Intergovernmental Agreement for Provision of
Communications, Records, and Criminal Justice Information Systems between the
City of Greeley and the County of Weld, Colorado, be, and hereby is, approved.
BE IT FURTHER RESOLVED by the Board that the Chairman be, and hereby is,
authorized to sign said agreement.
The above and foregoing Resolution was, on motion duly made and seconded,
adopted by the following vote on the 3rd day of May, A.D. , 1993.

RESOLUTION NO. 14 , 1993
A RESOLUTION AUTHORIZING THE MAYOR OF THE CITY OF GREELEY TO ENTER
INTO AN INTERGOVERNMENTAL AGREEMENT WITH WELD COUNTY FOR PROVISION
OF COMMUNICATIONS, RECORDS, AND CRIMINAL JUSTICE INFORMATION
SYSTEMS.
WHEREAS, the operation and maintenance of a communication
dispatch center, criminal records management and criminal justice
information system are proper governmental functions of both the
City and the County; and
WHEREAS, both parties desire to enter into an intergovern-
mental agreement so as to combine their communication dispatch
centers, criminal records, and criminal justice information systems
for the purposes of economy, efficiency, and enhanced public safety
services; and
WHEREAS, the intergovernmental agreement is intended to define
the rights and responsibilities of the City and the County with
regard to the respective duties of the parties to said agreement;
and
WHEREAS, the City Council believes it is in the best interest
of the public health, safety and welfare of the citizens of the
City of Greeley to combine these common information and services
for enhanced service to the community.
NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF GREELEY, COLORADO AS FOLLOWS:
1. The Mayor is hereby authorized to enter into the attached
intergovernmental agreement with Weld County to combine dispatch
centers, criminal records and criminal justice information systems
to better serve the public interest.
2 . This Resolution shall become effective immediately upon its
passage.

INTERGOVERNMENTAL AGREEMENT
FOR PROVISION OF COMMUNICATIONS, RECORDS,
AND CRIMINAL JUSTICE INFORMATION SYSTEMS
THIS AGREEMENT, made and entered into this 3rd day of May, 1993, by and
between the CITY OF GREELEY, by and through the City Council of the City of
Greeley, Colorado (hereinafter referred to as "City") , and the COUNTY OF WELD,
COLORADO, by and through the Board of County Commissioners of Weld County,
Colorado (hereinafter referred to as "County") .
WITNESSETH:
WHEREAS, the operation and maintenance of a communications dispatch center,
criminal records management, and criminal justice information system are proper
governmental functions of both the City and the County, and
WHEREAS, both parties desire to enter into an intergovernmental agreement
so as to combine their communication dispatch centers, criminal records, and
criminal justice information systems for the purposes of economy, efficiency, and
enhanced public safety services, and
WHEREAS, the City has submitted a proposal that the County has accepted,
and
WHEREAS, this Agreement is intended to define the rights and
responsibilities of the parties hereto with respect to the respective duties of
the parties hereto, and
WHEREAS, the City and the County are authorized to enter into this
Agreement, by virtue of Section 29-1-203, C.R.S. ; Article II, Section 2-3, Weld
County Home Rule Charter; and the City of Greeley Charter, Section 3-7.
NOW, THEREFORE, in consideration of the following mutual promises and
covenants, the City and the County hereby agree as follows:
1. Contract Representatives: City and County shall each designate, in
writing, Contract Representatives to serve as contract managers and
spokespersons for the respective entities.
2. Facilities: The County shall provide space in the building at 915
Tenth Street at no cost to house the communications dispatch center,
records area, and centralized equipment for the criminal justice
information system. Said facility shall be known as the Weld County
Regional Communications Center (hereinafter referred to as
"Center") .
3. Provision of Utilities to Facilities: The County agrees to provide
water, sewer, gas, and electricity for the Center at no charge to
the City. The County will provide budget for current level of
County telephone service and City will provide budget for City
telephone service.

4. Equipment and Furniture: The City and the County shall provide the
existing equipment and furniture currently in their respective
communication dispatch centers for the new Center. Ownership shall
remain with each of the respective entities for existing equipment.
Any new equipment purchased shall be owned by the City of Greeley.
Exhibit F attached shall be equipment inventory of City and Exhibit
G shall be equipment inventory of County.
5. Repair, Maintenance, and/or Renovation of Facilities: The County
agrees to repair, maintain, and/or renovate the Center whenever
necessary as determined by the respective entities. County agrees
to renovate the Center prior to October 1, 1993, to accommodate the
combined Center at County cost. The County agrees to provide
interior janitorial maintenance, housekeeping supplies, and
preventative maintenance of the Center at no cost to the City.
6. County-wide Emergency Service Dispatching Services: The City agrees
to provide county-wide emergency service communications services to
all police, fire, and ambulance agencies specified in Exhibit A.
The City agrees to maintain all radio equipment utilized by the
Center, including all tower and radio transmission and receiving
equipment, to facilitate the receipt of E-911 calls, and to dispatch
appropriate emergency response agencies, per the policies and
procedures established by the Greeley Police Department with input
from the County and/or the Advisory Board.
The City agrees to answer county PBX switchboard calls after hours
to include all hours except Monday through Friday, 7:30 a.m. to 5:30
p.m. , excepting County holidays. During after hour coverage, the
City will page on-call County and court employees as required. The
County shall pay for and maintain the County PBX system.
7. Criminal Justice Information System: The City agrees to install and
maintain a criminal justice information system including a computer-
aided dispatch, records management system, jail automated system,
and case information system for the District Attorney. The system
to be installed is the Tiburon system, Option B, more fully
described in Exhibit B. The system and equipment shall be licensed
in the name of the City.

8. Criminal Records Management: The City agrees to provide criminal
records management services for the Weld County Sheriff, including,
but not limited to, automated dictation system, incident reporting,
records operations, excluding booking and arrest records. Records
shall be located in the Center. The Sheriff shall designate a
deputy custodian for all Weld County Sheriff records in a separate
document who shall be responsible for the safekeeping and
maintenance of such criminal records.
9. Weld County Communications Advisory Board: The Weld County
Communications Advisory Board shall continue to operate as currently
constructed per its by-laws, which are attached as Exhibit C, with
the exception that one police and one fire representative from the
City of Greeley shall be added to the Advisory Board by the Board of
County Commissioners. City shall provide staff services to the
Advisory Board.
10. E-911 Board: The City, via the Communications Director or designee,
shall perform the administrative duties of the Weld County E-911
Board per the by-laws of said board, which are attached as Exhibit
D.
11. Radio Maintenance: Radio equipment shall be maintained by the City
at the same level as provided in the current radio maintenance
agreement, a copy which is attached as Exhibit E.
The City agrees to maintain all records and data pertaining to the
performance of radio maintenance. The County shall provide and
maintain existing computer program known as the "Radio Network
Management" system at no cost to the City to assist in management of
radio network.
12. Licensing and Compliance with Applicable Laws: The City shall
maintain all current FCC licenses for all radio frequencies in the
County radio system in the name of Weld County.
The City agrees to comply with all applicable federal, state,
county, and local laws, rules, regulations, ordinances, orders, and
decrees in effect at the time of execution of this Agreement. The
parties agree that later-enacted laws, rules, regulations,
ordinances, orders, and decrees may require modification of this
Agreement. The City agrees to indemnify, defend, and hold harmless

the County, by and through the Board of County Commissioners of Weld
County and its employees against any claim or liability arising from
the City's violation of any such applicable laws, rules,
regulations, ordinances, orders, or decrees, to the extent provided
(or limited) by law.
13. Records: Certain records held by the City or Weld County as they
relate to this Agreement may be considered open records, pursuant to
Colorado Statute.
14. Employment Status: It is expressly agreed and understood the City
is in all respects an independent contractor as to the work and that
the City and its employees are not agents, servants, or employees of
the County. All employees of the City shall work exclusively for
the City and shall not be considered employees of the County nor
shall they be eligible for County benefits. This Agreement
specifies the nature and extent of the work to be done by the City,
but the method utilized to accomplish the work shall be the
respozrsibiiity of the City. The County assumes no liability for
City employees who may be injured while working in the Center owned
by the County. City assumes no liability for County employees
working in the Center.
15. Contracting: The City may contract services to be performed
hereunder. The City shall advise the County of all contracts
involved in providing County services herein. No contract shall,
under any circumstances, relieve the City of its liability and
obligation under this Agreement; and despite such contracting, the
County shall deal through the City, and contractors, will be dealt
with as workers and representatives of the Contractor. The City may
not contract emergency service dispatching services without County
approval.
16. Non-Liability: The City and the County agree that in no event shall
either the County or the City be liable or responsible to each
other, or to other persons due to any stoppage or delay in work
herein provided for, where such stoppages or delays result from acts
of God, fire, war, legal, or equitable proceeding, or any other
cause which is outside the control of the City or the County.
17. Hours of Operation by City of Center: The Center shall be
operational every day of the year, twenty-four hours per day.

18. Staffing of Facilities: The City shall adequately staff the center
to ensure that the work described in this agreement is
satisfactorily completed.
The County agrees that the City shall have the sole right to select
or to terminate the City's employees. The County shall designate by
resolution the person designated as the person in charge of the
Center as the County's Director of Communications, but such person
shall sign a waiver of County employment rights and benefits prior
to starting the employment. The City shall supervise County staff
in the Center until October 1, 1993, via the Communications
Director, or until County employment is terminated.
The City agrees to consider for employment current communication and
records staff interested in being hired by the City. Eligibility
for hiring of employees by the City shall be based solely upon the
City's testing and selection process. No current county employee is
guaranteed a position with the City.
The City's employees shall not claim any County right or benefit as
a condition of their employment in the performance of this contract.
The County hereby represents to the Contractor that pre-existing
County benefit plans for County employees involved in communications
and records activities will terminate prior to their employment by
the City, and the City will have no liability or obligation of any
kind for any such benefit plan except the County agrees to pay off
appropriate vacation and sick leave compensable balances to the
employee or at the employee's written option, payment will be made
to the City and corresponding leave credit will be granted to the
employee as a City employee in lieu of payment.
The City's employee benefit programs shall be used for the City's
employees. Any employment transition benefits from County
employment to City employment shall be as agreed between the City
and County. The County shall have no liability or obligation of any
kind for any such benefit plan.

19. Term: The City and the County agree that the duration of this
Agreement shall begin upon date of signature of both parties and
extend until December 31, 1998. The parties hereto further agree
that this Agreement is automatically renewable at the end of its
term of another sixty-month period at the City's and the County's
option. Annually the City and County shall negotiate mutually
acceptable annual costs. A new cost shall be negotiated each year
for the Agreement between the parties_. A_ notice_ to not renew the_
agreement must be received by the other party eighteen months prior
to expiration.
20. Compensation: In consideration of the execution of this Agreement,
the County agrees to pay to the City the following amounts:
During the period from date of the signature of this Agreement until
October 1, 1993, any out-of-pocket costs of the City in relationship
to the operation of the Center. Amounts incurred shall be billed
monthly and paid within thirty days of receipt of bill.
During the period of October 1, 1993, to December 31, 1993, the
County shall pay for operation of the Center a total of $169, 844
paid in monthly installments of $56,614.66 and comprised of the
following:

During the period of January 1, 1994, to December 31, 1994, the
County shall pay for operation of the Center $904,372 paid in
monthly installments of $75,364.33 and comprised of the following:

County shall receive any cost reimbursement from user agencies for
radio repair or AirLife services. The County shall be responsible
for all billings and collections for such revenue sources.
Consumable supplies, such as computer paper, ribbons, etc. , shall be
paid by the user.
The County shall pay any and all costs of acquiring and installing
the criminal justice information system per attached Exhibit B.
The City shall pay all outside vendor costs above and bill the
county monthly. For purposes of Section 20 of Article X of the
Colorado Constitution, revenue and expenditure limits of this
contract shall be considered expenses of Weld County only and not
the City's. The amount paid by the County to the City shall be an
abatement of City expenses and not revenues.
The City shall bill the County monthly as of the first of the month
for the above costs. All billings by the City to the County shall
be paid within 30 days by the County unless the County notified the
City in writing of any disputed amount.

21. Deficiencies in Service: Any deficiencies in service should be
brought to the attention of the Director of Communications for
resolution. If deficiencies in service are not resolved by the
Director of Communications, County or center users shall bring the
service issue to the attention of the Greeley Police Chief. In the
event that the County determines deficiencies in the service and
work provided by the City are not being resolved by the Director of
Communications and/or Chief of Police, the County shall notify the
City in writing as to the precise nature of any such deficiencies.
Within ten (10) working days of receipt of such notice, the City
shall correct or take reasonable steps to correct the deficiencies
complained of including, if necessary, increasing the work force and
equipment or modifying the policies and procedures used by the City
in performing services pursuant to this Agreement. If the City
fails to correct or take reasonable steps to correct the
deficiencies within ten (10) working days, the County may declare
the City in default and terminate this Agreement upon eighteen
months' notice prior to termination.
22. Reporting: At least quarterly, the Communications Director shall
make an oral report to the Weld County Commissioners on the status
of the Center.
23. Assignment of Contractor's Duties and Obligations: The City and the
County agree that the duties and obligations in this Agreement are
non-transferable or assignable without prior written consent of the
City and the County.
24. Notice: Any written notice to be given hereunder by either party to
the other party shall be affected by certified mail, return receipt
requested. Notice to the City shall be sufficient if made or
addressed to the Greeley City Manager, 1000 Tenth Street, Greeley,
Colorado, 80631. Notice to the County shall be sufficient if made
or addressed to the Board of County Commissioners of Weld County,
915 Tenth Street, Greeley, Colorado, 80631. Either party may change
the address for notice to it by giving written notice of such change
in accordance with the provisions of this section.
25. Entire Agreement: This Agreement and the attached Exhibits
constitute the entire Agreement between the City and the County, and
neither the City nor the County shall be bound by any requirement
which is not specifically stated in this Agreement.

26. Waiver of Immunity/Third Party Liability: No portion of this
Agreement shall be deemed to constitute a waiver of any immunities
which the City or the County or their officers or employees may
possess, nor shall any portion of this Agreement be deemed to have
created a duty of care on the part of either part to any persons not
a party to this Agreement.
27. Non-Appropriation: No portion of this Agreement shall be deemed to
create an obligation on the part of the City or the County to expend
funds not otherwise appropriated in each succeeding year.
28. Severability: If any section, subsection, paragraph, sentence,
clause or phrase of this Agreement is for any reason held or decided
to be invalid or unconstitutional, such a decision shall not effect
the validity of the remaining portions. The parties hereto declare
that they would have entered into this Agreement and each and every
section, subsection, paragraph, sentence, clause, and phrase
thereof, irrespective of the fact that any one or more sections,
subsections, paragraphs, sentences, clauses, or phrases might be
declared to be unconstitutional or invalid.
29. Applicable Law: This Agreement shall be interpreted, construed, and
governed by the laws of the State of Colorado.
30. Amendments: Amendments which are consistent with the purposes of
this Agreement may be made in writing duly executed by the parties
hereto and in accordance with the City and County rules and
regulations and all other applicable laws and ordinances.
31. Ownership: The City shall have ownership of all computer hardware,
software, and equipment acquired for purposes of the center from
date of inception of this contract. Ownership of jail management
and prosecution system of the criminal justice information system
shall transfer to the County from the City at time of termination of
this contract.
32. Dispute Resolution: In the event of a dispute over service or
contract interpretation, a panel of three persons shall be
appointed. The City shall appoint one member, the County shall
appoint one member, and one member will be agreed upon by both City
and County to comprise the panel. The first step shall be a

mediation process. If no resolution of the issue is reached, the
second step shall be an arbitration process. Both steps by the
panel shall be non-binding upon the City and County; however, both
the City and County shall enter into this process in good faith to
resolve the pending issue.

1.0 EXECUTIVE OVERVIEW
Proposal Introduction
Tiburon is pleased to present this proposal for a fully integrated Criminal Justice
Information System to support the automation needs of Weld County. With this
proposal Tiburon is providing several requested options for support of the proposed
Criminal Justice Information System in Weld County.
Option Al enables the County to implement our proposed software products on the
County's existing IBM mainframe computer system, using DB2 for relational data
base management support. With this option, provisions are included to implement
Tiburon's Justice Data Link products with CAD/2000, RMS/2000, DACIS and
JMS/2000 on the County mainframe. Option A2 provides a plan to implement a
subset of these facilities and applications by installing the Justice Data Link,
RMS/2000 and JMS/2000, with interfaces to the County's existing Computer Aided
Dispatch and Prosecutor Case Management systems.
Option B enables the County and the City of Greeley to consider a consolidated
approach to justice and public safety automation by implementing Tiburon's Justice
Data Link products, with CAD/2000, RMS/2000, DACIS and JMS/2000 on a
combined network of IBM RISC System/6000's and the City's DEC VAX 3100's.
These proposed facilities have been in operation in a wide variety of Public Safety
and Criminal Justice environments around the country and reflect the years of
experience that Tiburon has gained through working with some of the most complex
law enforcement, corrections and justice agencies in the country today.
The following information is provided as an overview of the background, products
and skills that Tiburon delivers to this important project in Weld County.

Before November of 1989, Tiburon and PSW3 were two separate organizations, each
a recognized leader in the public safety and criminal justice community. Tiburon,
Inc. was formed in 1980 with the objective of providing the most comprehensive
records management systems available for Police, Fire, Emergency Medical, Court
and Correctional agencies. PSW3 was also formed in 1980, specializing in computer
aided dispatching and message switching systems for Police, Fire, and Emergency
Medical agencies.
The 1989 merger of Tiburon and PSW3 created a new company with over ten years
of experience with public safety systems, renowned for our commitment to reliability,
performance, and client service.
Tiburon's Corporate headquarters is located in Fremont, California. Tiburon

2.0 FUNCTIONAL OVERVIEW
The following information is provided as a Functional Overview of the principal
systems which make up the proposed Tiburon Criminal Justice Information System
for Weld County.
Each system is described with overviews of the modules proposed for Weld County.
Each module description includes a general overview of the baseline functionality,
as well as a description of any customization requirements which have been
identified.
2.1 Justice Data Link
Tiburon recently developed a family of data storage/sharing products which were
introduced as the Tiburon (JDL) Justice Data Link. These products were designed
to offer a fully integrated approach to justice automation by providing facilities to
efficiently and effectively link independent justice applications in an integrated
Criminal Justice Information System.
Principal Design Objectives:
A number of very important design objectives were established in developing
Tiburon's integrated justice facilities. Key objectives include:
Maximize operational autonomy at the agency level
Enhance inter-agency data sharing
Establish external network access for all users
Provide immediate access to subject status data

Standard Functions:
In an effort to address the critical requirements of an integrated justice system,
Tiburon developed the Justice Data Link (JDL).
The JDL facilities are designed to address each of these considerations so that
multiple agencies in any jurisdiction can enjoy all of the benefits of shared data,
without sacrificing to any degree their ability to develop and manage their own
individual application and data base environment. The Tiburon Justice Data Link
accomplishes this via its integrated facilities described below.
Tiburon's Justice Data Link provides the framework in which all judicial applications
may fully interact. (Please refer to the following diagram.) This data access facility
provides an interactive information bridge for all inter-agency data transfers within
the organization, as well as for all data transfers from outside of the organization.
This facility will provide any authorized user in the entire judicial organization access
to data elements commonly used throughout the judicial process.
Inter-Agency Data Base (IDB)
Operating under facilities of the Justice Data Link, data elements specific to
one agency within the organization are managed strictly at the agency-
application level, while critical data elements frequently accessed across the
organization are also stored in the Inter-Agency Data Base.
The IDB typically contains the central Master Name File with historical
information about all individuals of interest to the criminal justice
organization, as well as the Central Warrant file of all arrest processes
initiated in the organization. It is the common reference point for all
criminal justice data bases in the organization.
The IDB will be available to all authorized users. Because of its general use,
the form and format of data in this component of the system is considered
"universal"; the naming conventions, code values, and structures are common
across the system.

The specific contents of the Inter-Agency Data Base will be defined as part
of a system specification process. The suggested information contents are as
follows:
Master Name Record - Name, sex, race, date of birth, general physical
descriptions- and- system-wide identification- and- reference- (CIS)-
numbers.
Identification Numbers - Agencies may provide agency specific
(unique) cross-reference numbers. In addition, there may be any
number of non-unique ident numbers on file. These non-unique
numbers may include Social Security, Driver License, State ID, etc.
Alias Names - The system will automatically create alias records for
variances in name, sex, and date of birth. Aliases may be entered
directly by contributing systems or by on-line transactions.
Case References - All activity in the IDB will be based upon activity
in the individual agency systems. Case References are added which
identify the agency, the agency case number, date/time, charges (if
applicable) and the action being taken.
Addresses and Telephone Numbers - Addresses and telephone
numbers can be associated with the person through Case References.
These are also identified by agency, case number, and date/time. Any
number of addresses and telephone numbers may be stored.
Subject in Process Status - Current status information is contributed
-- this generally applies only to significant changes in a subject's
judicial status such as in custody, released, probation, etc.
Warrants and Warrant Activity - Copies of warrants are stored in the
IDB along with the current status and general activity associated with
the warrant.

Hazards and Flags - Any of the contributing agencies may attach
special flags_or hazard notes to a subject's record. A notification of
activity will be provided to the contributor on any system's contact with
the individual. Records can be marked as "display" or "non-display" to
control user viewing.
Agency Designated Information Module - Each agency may attach
special agency information modules to a subject's record.
Information in the Inter-Agency Data Base is available to all authorized users
and is automatically/dynamically updated as a byproduct of agency
application transactions. This information is accessible by name, alias and by
key identifiers such as driver license number, social security number, FBI
number, etc.
This system includes the most complete name processing routines available.
It includes particle processing (i.e., la, el, abu, etc.), multiple surnames
(i.e., Gonzales-Rodriguez), phonetic encoding, common name directories,
soundex processing, and weighted search capability.
The system also provides a unique facility for linking new information with a
subject already in the system. As subject information is entered, the system
automatically conducts a near match analysis using a combination of name,
physical descriptors, and identification numbers. This is a weighted search
facility which is controlled by a scoring table set up for each client agency.
When possible matches are found, a Window is automatically opened on the
screen to display possible matches including both match and mismatch flags.
The user can then select the desired match or force a new subject/name
record to be created. This name preprocessing Window also displays critical
information about the subject such as warrants on file, hazards, or special
flags including parole/probation status.
If the subject is already known to the system, the user need only enter an
identification number to get the match list. The system will fill the screen
with all other required information such as the name, sex, race, date of birth,
address. This facility greatly reduces keystrokes, enhances data input
efficiency and maximizes data base integrity.

Inter-Agency Data Interpreter (IDI)
A facility of the Justice Data Link referred to as the Inter-Agency Data
Interpreter provides full inter-agency data communications between all agency
applications in the organization. The Inter-Agency Data Interpreter is a
translation facility which translates data structures between local system
formats and universal formats.
This data translation capability maximizes the true flexibility of the Tiburon
CJIS solution by enabling any agency, regardless of the application or system
platform, to participate fully in the overall CJIS network. Through this
translation facility, data generated by one criminal justice agency may be
shared directly with other agencies in the judicial process. Therefore, all
agencies (authorized users) have access to data at the Inter-Agency (Central)
Data Base level, as well as at the agency level.
External Data Interface (EDI)
The Justice Data Link will also provide users with access to external systems
and data bases, such as the CCIC, NCIC, and NLETS, etc., through the
External Data Interface. Using this facility, any authorized user on the CJIS
network (i.e., district attorney, dispatcher, jail booking officer, investigator,
etc., can perform single or multiple queries which simultaneously access local,
state and national data bases.
Customization:
Based upon the nature of the Justice Data Link facilities, a certain degree of
system tailoring is required to support the necessary data interfaces. Standard
interfaces like CCIC, NCIC, etc., are included as part of the normal JDL
software tailoring effort.
Other County-wide interfaces include the ability to perform inquiries into the
County Motor Vehicle Registration file and other Weld County
Administrative applications like Building & Grounds and Personnel/Payroll.

2.2 Computer Aided Dispatch System (CAD/2000)
The Tiburon Computer Aided Dispatch System (CAD/2000) provides dispatch and
control services to support a broad range of Law Enforcement, Fire Protection, and
Emergency Medical Services in a single or multi-jurisdictional communications
environment.
This system was originally installed at the San Francisco Police Department in 1983
to operate on an IBM System/370 computer with interfaces to State, regional and
local systems, as well as supporting a network of over 300 Motorola KDT-480
Mobile Data Terminals. It was subsequently transferred from the System/370
platform to the System/88 for the Indianapolis/Marion County (MECA)
Metropolitan Emergency Communications Agency, where it supports over 20
different jurisdictions from over 60 different PSAPs.
Now also available on the IBM RISC System/6000 computer, CAD/2000 can be
implemented in a distributed processing environment, whereby the processing load
and responsibility can be shared between single, (or redundant) CAD sewers and
the independent dispatch workstations on the network. The CAD server retains
responsibility for overall system coordination and acts as the file server for all critical
CAD data. The individual CAD workstations provide a graphical user interface
(GUI) in support of the dispatch process. The workstations provide local data
retention of all active incidents, control the display of unit and incident status
information, support geographic file processing and provide a wide range of data
entry validation and "help" support.

CAD/2000 provides a range of standard on-line inquiries and reports. To
supplement these on-line functions, Tiburon offers a comprehensive ad hoc
report-generation facility, the PC-based Activity Reporting System(ARS/PC).
Using ARS/PC, the user is able to create a variety of predefined and ad hoc
inquiries/reports for single or multiple agencies being dispatched through
CAD/2000.
ARS/PC generates two primary categories of reports:
Flexible List Reports
This facility allows the user to define a wide range of "lists" of data elements,
including the data to be displayed and the display sort sequence desired.

2.3 Police Records Management System (RMS/2000)
The Tiburon Records Management System (RMS/2000) is designed to support
records processing from the entry of a event for dispatch through closing and
assignment of a final disposition. It is structured to maintain historical as well as
current event information.
RMS/2000 focuses on record keeping for locations, persons, property, vehicles and
events, and makes this information available through on-line inquiries and/or
reports. It is divided into a series of components and data subsystems, each of which
concentrates on a specific area of the data base.

Following are descriptions of the principal RMS/2000 components which have been
proposed to Weld County. Each module description is followed by a summary of

Incident System
Standard Features:
The RMS/2000 Incident System receives its initial input from a closed
dispatch event on a CAD system, and is the primary/focal point of
RMS/2000. It includes a set of information on each activity which results in
a Case Report Number being assigned. The following are the types of

Warrant Tracldng
Standard Features:
The Tiburon Warrant Tracking System provides for the centralized
management of warrant storage and warrant processing. It can be used to
track local warrants, as well as those from outside jurisdictions. Local
Warrants are automatically added to the Master Name Index, so that name
inquiries automatically include a warning flag if a warrant is on file for an
inmate.
All activities against a warrant are stored as a series of activity records.
Activity records include information such as warrant execution, magistrate
hearing, attempt to serve, arrest, etc.
The system produces a series of reports including Warrant Aging, Warrants
by Agency, Warrant Activity, Clearance Lists, Warrant Abstracts, and Warrant
Notices.
Customization:
The External Data Interface facilities of the Justice Data Link will be utilized
to provide data upload capabilities for transferring warrant information to
CBI.
Modifications will be made to the Tiburon Warrant System to accommodate
minor accounting. requirements, including a $2.00 processing fee per warrant,
plus associated mileage charges and any extradition charges.

Special Intelligence
Standard Features:
The Intelligence File is designed to maintain confidentiality of sensitive
information. The names of informants, for example, might reside in the
Intelligence File. The names of individuals under investigation, particularly
sensitive investigations involving well-known persons, might also reside in this
file.
Due to the sensitive nature of this information, special security provisions are
made. This system is controlled so that only specific terminals may actually
access the intelligence records. Information in the Intelligence system is
retrieved using a unique reference number which has been assigned to the
individual.
Normally, an inquiry into a record containing intelligence information will not
reveal the existence of an intelligence flag to the inquiring terminal. Only
non-intelligence information is returned (i.e., Citations, FI's, Incident
References, etc.). If the only information on file for the individual or the
address is the intelligence record, a "no record on file" response is returned.
If an inquiry or update is performed, a flag is automatically set to advise the
investigator of the action. The investigator is informed of the date, time,
terminal, and operator for all departmental contacts. This includes Field
Interview (FI) cards, arrests, citations, or any other departmental contact.

Special Flags
Standard Features:
The RMS/2000 Special Flags subsystem provides a mechanism to record
caution and hazard information relating to an individual or location. This

information is displayed whenever a name or location search is made; thus,
the investigator is alerted to danger before approaching a person or building.
Special Flags are also used to indicate persons and locations to be monitored
by the system. Remarks may also be added to the flagged name and location
records. A suspense entry is created whenever an inquiry or update is made
against a flagged record. These suspense entries allow the user to generate
a report displaying all activity for flagged records.
Customization:
None identified.
Civil Process
The RMS/2000 Civil Process system is used to record and monitor civil
documents received by the agency for service. Information from the
document is entered in the system and may be retrieved by name or case
number. Persons to be served are recorded in the Persons module. A report
is available which provides counts of cases received and cleared for a given
month.
As documents are received, they are entered into the system and a Document
Control Number (DCN) is assigned. Upon entry, a Document Control Card
may be printed which contains basic information including the DCN. The
Document Control Card is attached to the document and is used as a
"turnaround" form for collecting activity information. Documents may be
filed by name or by Control Number.
Customization:
A number of modifications will be required for the Civil Process System.
All names entered into Civil Process will need to be automatically added to
the Master Name File of the Inter-Agency Data Base and all locations will

need to be automatically added to the Location System. This will provide a
history of all civil processing activity for an individual or location. Facilities
will be added to automatically post Flags on names and locations to reflect
any active civil process involvement.
TRAVIS facilities (described below) will be made available to generate
letters and forms.
Civil Processing Activity Reports will be developed to display routing
information for processing activity.
Civil Accounting functions will be added to the activity tracking transactions.
These accounting facilities will be designed to record related charges for each
civil document, maintain a person's current balance and any payments
received, track any prepayment of service, handling credits or refunds, and
record document fees and mileage charges. Billing statements will be
generated either as documents are served or monthly. Facilities will also be
provided to transfer data to the County Accounting System.
Civil Tracking facilities will also be added to track information involved in the
Sheriffs sales of assets, including real and personal property and seized assets.
General Inquiries
Standard Features:
Much of the value and power of the Records Management System comes
from the inquiries that cross multiple files and subsystems. RMS/2000
includes an inquiry capability which is designed to provide standardization in
format and usage yet retain maximum flexibility in the selection of search and
inquiry parameters.
The RMS/2000 General Inquiries include "standard" inquiries by name,
location, vehicle, property, and so on. Inquiries designed for specialized uses
such as Mobile Digital Terminals that have condensed/summarized formats,
are also available.

Name Search - utilizes phonetic, partial, and Soundex processing
applied on a weighted search basis. Basic name data is returned, and

Property Search - retrieves property records by serial number, OAN,
category, article, make_and/or model. This inquiry accesses Property
Files (Incident), Pawn (Alpha) and Gun (Alpha) files.
Field Contact Inquiry - retrieves information from Field Contacts
and/or Citation Files by location, description, date/time range, etc.
Location Search - retrieves address related information by street
address, partial address, address range, or commonplace name
(including partial common place name).
Vehicle Search - retrieves vehicle-oriented information on license plate
(including partial with wild cards) Vehicle Identification Number,
and/or vehicle descriptors such as make, model, style, color, etc.
Incident Selection - retrieves incident-oriented records by Incident
Number, reporting district, date (or date range), time (or time range),
officer, and/or nature of call. It can also be used as an Audit Trail of
all report numbers assigned. The output includes report number, date,
time, type ofincident, location, officer, clerk, and initial disposition.
Remarks - Throughout the system are provisions for including
user-defined key words/codes whenever remarks or comments are
used. This transaction retrieves all records containing the key
word/code requested. For example, an inquiry on "Hells Angels"
would retrieve all records entered with the user-defined key word
"Hells Angels".

Investigative Case Management
Standard Features:
In much the same manner as the Crime Analyst, the Investigator has access
to a wide range of RMS/2000 facilities including the complete details of
Incidents, Property and Evidence, Bookings, and offender records. In
addition, a series of RMS/2000 functions are dedicated to the management
of investigative cases.
RMS/2000 starts tracking cases the moment an incident is added to the
system. If the case type indicates that investigative follow-up is necessary, the
system will keep alerting Investigative Management until the case is assigned
or otherwise disposed of. Thereafter, the system can be used to assign and
track "follow-up" and all case activity.
The Investigative Case Management subsystem provides for the tracking of all
cases which are subject to follow-up investigation. It includes assignments as

Crime Analysis System
Standard Features:
The Crime Analysis System (CAS) is used to store and process information
on "targeted" crimes. This information includes data transferred from the
Incident data base, reports from other agencies, Field Contacts (FI's) and
information derived through analysis. From this data base, the system
conducts a pattern analysis to locate developing crime patterns based upon
Crime Cluster Areas. The system has an extensive Modus Operandi
capability for profiling incidents, persons, and vehicles. This system is
integrated with the other components of RMS/2000 including Special
Registrants, Parole/Probation subjects and other known criminals.
Multiple levels of Crime Analysis are supported within RMS/2000. In
addition to the CAS subsystem, ad hoc facilities are available for searching
any and all RMS/2000 files on any data field, combinations of data fields,
partial keys, and data presence/absence indicators. These facilities provide
relational capabilities, enabling an analyst to draw relations between different
types of information. The search and the output data can be saved and used

be set and the system will generate a report of all items that have fallen
below the minimum stock level.
Supplier master records are also established for each item tracked. The
system tracks store(warehouse)locations,re-order points,generates suggested
shopping lists, and tracks all requisitions, purchase orders, back orders, items
received/distributed, as well as all inventory adjustments.
When stock is issued, the system recalculates the number of items on hand.

2.4 District Attorney Case Information System (DACIS)
Tiburon's District Attorney Case Information System (DACIS) provides a variety of
Case Tracking and Report Generation facilities to support the automation
requirements of a modem Prosecuting Attorney's office.
Functional Overview:
Following is a brief description of the principal DACIS functions and facilities which
have been proposed for Weld County. The functional overview is followed by a
summary of the customization requirements that have been identified for the County
District Attorney's Office. •
Case Tracking
DACIS provides facilities to establish a Prosecutor Master Record with
associated subordinate records for each case being tracked by the Prosecuting
Attorney.
Key records include:
Prosecution Case Record (PMR) - The PMR is the focal point for
each prosecution case. This record contains basic prosecution and
defendant details.
Charge Record - Each charge is recorded in a separate record; each
ultimately carrying its own disposition.
Events - All activity against a PMR is recorded as a series of event
records. These records are in sequence by event date.
Narrative - Any amount of free-form narrative records may be
attached to a PMR. These are sequenced on a first in, first out basis.
Persons of Interest - These records contain witnesses and other
persons of interest to the case.

can be initialized (i.e., screen pre-filled) with data from the JMS and RMS
data bases. These transfer facilities allow data collected through JMS
Arrest/Booking System (i.e., details on the defendant, charge information,
etc.) to be transferred into DACIS, as well as witness data from the RMS
Incident System.
Event Scheduling
Once a case has been initiated, all activity for the case is scheduled and
tracked using case event records. Each event has an activity code defining
the activity, the date/time and the disposition of the event. An event is
considered "open" until a disposition code and associated date/time are
entered. Events containing disposition information are considered
"completed".
Open events are used to control the prosecution calendar and schedule
prosecutor tasks and activities.
Subpoena, Witness and Document Processing
Any number of persons, i.e., witnesses, officers, etc., may be associated with
a case. Witness records are used to print subpoenas, witness letters,
documents, etc. The system has the ability to print this information by case
or by a date range. The printing of selected documents may be suppressed
on a record by record basis.
Through facilities of the Justice Data Link, Subpoenas may be routed directly
to officers. These facilities provide automatic acknowledgements to the
sender, when read and can be used to automatically post associated court
events to the officer's duty roster.

( There are several transactions available in DACIS for generating detailed and
statistical reports or for making general inquiries into the DACIS data base.
The following is a summary of some of the key inquiry transactions:
• A complete summary of information can be returned for a specific
PMR number, or a range of PMR numbers, or for a date range of
scheduled events.
•
A calendar can be prepared of all pending court events for a given
date range. A specific type of event can also be given as part of the
selection criteria.
•
A report for a given PMR number can be generated that includes the
master record, along with the defendant's custody status, associated
narrative records, and summaries of all events and charges.
•
A list of events can be returned based upon selection parameters that
include a date range (event date or disposition date), type of event,
type of disposition, arresting officer, detective and prosecutor. The
output can be sorted by date, event, name, or prosecutor.
Customization:
Existing Summary Reports will be modified to insure that all required case
information is included on the DA's Case Summary Report. This conditional
report will be modeled after the DA's existing Case Summary report and will
include at a minimum, defendant data, docket/case numbers, prosecutor,
disposition data, charge information, and sentence summary/condition data.
A significant portion of the DA's cases (i.e., over 50%) are initiated without
an arrest. JDL data transfer facilities will be expanded to allow the transfer
of case information from the RMS Incident/Warrant System, without a
Booking/Arrest.
Transactions will be developed to utilize TRAVIS facilities (described under
RMS/2000) to maintain/generate documents, including charging documents,
disposition letters, forms, etc., based upon the data collected in the DACIS
case, event and persons files. These facilities will allow documents to be
generated based upon conditional factors of one or multiple related cases, the

person's involvement, etc. They will also allow free-form text to be
incorporated with text generated from TRAVIS.
As with RMS/2000, modifications will include the accommodation of both a
mailing address and physical address for subjects entered into the DACIS
system.
A special screen will be added for tracking DUI cases. This screen will
automatically be displayed by the system if DUI is entered as the charge type.
Charge records will be extended to accommodate an unlimited number of
revisions to the charge/sentence data and more extensive sentence and
sentence condition data.
A Check Fraud module will be developed as part of the DACIS system,
allowing detailed information to be tracked on each fraudulent check. This
facility will provide full cash-drawer accounting of monthly payments, handling
restitution, administrative fees and automatically generating receipts. It will
provide facilities to distribute restitution to individual victim accounts. An
interface to the Weld County Accounting System will be provided to track
balances due to victims, produce checks and record the collection of
administrative fees.
A variety of reports will be developed to address the County's Check Fraud
Case Document and Management Reporting requirements.
Through the External Data Interface facilities of the Justice Data Link,
inquiry capabilities will be established allowing District Attorney personnel to
make inquiries into the Colorado District Attorney's Council (CDAC) system.
An interface will also be established for uploading data to CDAC and for
uploading charge dispositions to CBI through CDAC.

2.5 Jail Management System (JMS/2000)
The Tiburon Jail Management System (JMS/2000) is a comprehensive system
supporting the operational and management functions of the modern correctional
facility.
The Tiburon Jail Management System is designed to support large, high volume jail
operations. It is currently installed in a number of correctional facilities across the
country supporting single-facility jails with as few as 50 inmates, as well as multi-
facility jails with inmate populations exceeding 2,500 inmates.
JMS/2000 provides facilities to track inmates and head counts, support bookings and
record checks, and produce court lists and other reports required to effectively
manage the day-to-day operations of the jail. Management information is a

Event Processing
Standard Features:
The Tiburon Jail Management System provides an extremely powerful Event
Processing System to track all activity in the Jail Facility. Event records may
be used to schedule/track all key activity, including medical appointments,
court appearances, and facility/floor/cell transfers, etc.
Each Event record can track the date/time the inmate is scheduled for the
activity, the date/time the event actually begins, the date/time the activity is
scheduled to be complete, as well as the actual date/time the event is
dispositioned -- providing a complete audit trail of all inmate activity.
Scheduled events are used to feed a Dynamic Reminder Facility. The facility,
more commonly referred to as the Jail Nag List, automatically gathers all
pending events every hour which are scheduled for disposition in the next
hour and routes those events to the officer(s) responsible for their disposition,
providing each officer with a very valuable reminder list of all
scheduled/pending events under their responsibility. Pending events continue
to appear on the reminder list until properly dispositioned.
At any point the officer may print an activity log of past or pending events,
by inmate, by date, or date range, by event type, and by facility, floor and cell.

Interest was expressed in eventually looking at establishing a Bar Code
Reader interface for the Event Processing facilities. This future enhancement
would enable EVENT records to be initialized using County-supplied bar
code readers and wrist-bands.

Standard Features:
JMS/2000 provides an on-line facility for the data entry and inquiry of jail
booking information. This booking facility is the central point for the
collection and control of information on an inmate. Inmates may be admitted
under different types of bookings, including in-custody, out-of-custody,
weekender, work release, etc.
Short Form Booking facilities are also provided for repeat offenders, and
offenders being booked/released on personal recognizance.
As part of the booking process, the system provides facilities for Jail
personnel to conduct records checks into the Inter-Agency Data Base (Master
Name and Warrant Files) to determine if the subject is known to the agency
and/or if there are outstanding warrants or other flags on the individual.
With the External Data Interface of the Justice Data Link, the system will
provide Super-Query facilities allowing booking officers to simultaneously
query local County, as well as state CCIC and the NCIC data base(s), all from
a single query.
When an individual is admitted into the jail, demographic (i.e., physical
descriptions, alias and identification) information is entered. Charge
information, as well as arresting agency information, can also be gathered
during the booking process.
A preliminary classification record can also be established as part of the
booking record. This information can be supplemented by the classification
officer as a more thorough assessment is completed.
Integrated Charge/Case Tracking facilities are used to attach any number of
charge/hold/detainer records to a specific booking record. Each charge
summary contains summary data, arresting authority, charge information
including charge/offense codes, levels, and literal translations, warrant
information, court information including court of jurisdiction and judge, and
court date/time, probation status, disposition and sentence data.

As part of the Charge/Case Tracking system, JMS/2000 includes facilities to
record bail/bond information for each charge. This information includes
bond number, amount and type, as well as the agency posting bond/bail.
Receipts are automatically generated when bail is posted, and management
reports are available to track the funds associated with daily bail/bond
transactions.
The Event Processing facilities described below are used to record specific
court actions for an inmate. The event record includes the court of
jurisdiction, the charge number, and the associated court date/time.
The system has provisions for carrying both a "true" name and a "booked"
name -- if the booked name is different from the true name, it is treated as
an alias. Additional aliases may be added to the record at any time.
If hazard, medical attention, keep separate or other similar information is
known, it can be added to the booking record. Facilities are also provided to
record a complete medical screening of the inmate, as well as to record all
property confiscated (i.e., money, valuables and clothing) at booking.
These facilities are described in later sections of this document.
The Inmate History file is kept up-to-date with the latest information on the
inmate. It is used to initialize (pre-fill) the booking screen, as a basis for
inmate classification, and to produce an inmate "Admission Sheet"
The system is designed to capture the data as early in the process as possible
and automatically update all appropriate JMS files. For example, the booking
process automatically updates any or all of the following JMS/2000 facilities:
• The Jail Head Count is adjusted, unless the person was already in
custody on another charge.
• The Jail Roster reflects the person's name, location, (i.e., holding,
booking, Main Jail, etc.)
• The Jail Activity Report is adjusted to reflect the admission.
• The CourtList reflects-the inmate's scheduled appearance.
• The Inmate's Event history is adjusted to reflect the admission.

Standard occupancy reports are available to quickly identify overcrowding
situations, based upon the data that is being dynamically collected in the Jail
Roster.
Facilities are included to produce fingerprint cards and other arrest/booking
forms.
When implemented with Tiburon's Records Management System under the
Justice Data Link, Booking/Arrest data captured in either system may be
passed to the other, minimizing or eliminating redundant data entry between
the Sheriffs Office and the Jail.
Name Preprocessing facilities are integrated into the booking process to
provide on-line name verification. These facilities automatically (in the
background) scan the Master Name File of the County's Inter-Agency Data
Base for close matches on any individual entered into the system.
If the system finds a close match on personal identifiers such as name, sex,
race, date of birth, social security number, operator license number, etc., the
system automatically displays the possible matches to the booking officer for
further analysis.
If the system finds an exact match, it automatically attaches the existing MNI
Number to the new booking record. If no match is found, the system
automatically establishes a new MNI number for the individual and adds the
number to the booking record.
If the individual is identified in the system, the booking process is greatly
expedited in that much of the booking information will be automatically
entered by the system. If the person is unknown to the system, a temporary
or permanent identification number, i.e, Jail ID (JID) may be assigned
(manually or by the system) as the person is "booked".
As an option, Tiburon's Jail Booking and Release facilities can also be
implemented with an automated Fingerprint Identity Verification System.
This interface allows the booking and/or releasing officer to retrieve a

subject's digitized fingerprint template utilizing standard JMS booking/release
facilities. Using the digitized fingerprint, the system allows the officer to
complete an booking identity verification routine prior to completing the
booking or release process.
During the identity verification process, the inmate's finger is placed on a
fingerprint scanner. The system automatically verifies the identity of the
inmate by scanning his/her fingerprint and comparing it to the digitized
template on file with the inmate's master record.
Customization:
Minor modifications will be made to the JMS/2000 Booking facilities to
accommodate the Juvenile Booking requirements. These facilities will be an
extension to the existing Adult Booking facilities, through the addition of
record(s) to collect guardian and risk assessment data. The system will be set
up to automatically check the offender's birth date and flag the booking
officer if the offender is a juvenile at the time of booking.
Modifications will be necessary to support court ordered felony summons
processing. A record will be established to collect felony summons data
independent of the standard adult and juvenile booking records.
Bond Accounting functions will be added to the Charge/Case Tracking
facilities described above. These facilities will account for all daily cash bond
receipts, and will generate a daily report showing the associated fees for each
bond and the funds owed to the Court and County Treasurer.
The system will also generate (print) the required checks associated with
Bond Accounting.
An interface can be established between the JMS Booking System and a
County-supplied video-mugshot system. This interface will be designed to
integrate the photo capture step into the JMS booking process insuring that
JMS booking data can be automatically downloaded to the video-mugshot
system (eliminating redundant data entry) and insuring that a flag is
automatically set in the booking facilities indicating that a photo is on file and
when it was captured.

Release Processing
Standard Features:
The standard JMS/2000 system includes a Composite Sentence Record on
each inmate. This sentence management facility continually recalculates the
best possible release date for an inmate, for all charges under a specific
booking record, based upon credit for good time, work time, etc.
The Event Processing Facilities described below in this document are used to
schedule and track all inmate work-related activities and to post debits/credits
for work time, good time and miscellaneous time against the composite
sentence record.
As part of the release process, the system provides facilities for Jail personnel
to conduct records checks into the Inter-Agency Data Base (Master Name
and Warrant Files) to determine if there are new outstanding warrants or
other flags on the individual. With the External Data Interface of the Justice
Data Link, the system will provide Super-Query facilities allowing releasing
officers to simultaneously query local County, as well as state CCIC and the
NCIC data base(s), all from a single query.
Release processing facilities automatically examine the Charge Records of all
inmates who are in custody. On-line queries are provided to generate a list
by date range, which can be divided into two sections:

The system is specifically designed to prevent the release of an inmate, unless
all charges have a valid disposition, or reason for release. The Event
Processing facility is utilized to record the actual inmate release. When the
release event is entered, the system automatically verifies that all charges,
holds, detainers and events have proper dispositions and checks for any other
custody records for the inmate. Only after all charges, holds, detainers and
events are properly cleared and no other in-custody records are found, will
the system allow the inmate to be released.
Upon releasing an inmate from the jail, the system will automatically build an
audit record of the exact date and time of the release and require the
releasing officer to post the reason for the release, who the inmate is being
released to and the officer responsible for the release.

Inmate Property Management
Standard Features:
The Tiburon Jail Management System automates the management and
control of both confiscated inmate property and Jail property issued to each
inmate.
The system maintains an inventory of the personal property taken from an
inmate during the booking process or received from outside the facility during
the term of incarceration.
The property control facility provides records for describing two classes of
property: valuables and clothing. These property records track the property
number used to store valuables, and a storage rack (location) number used
to store clothing. Receipts are automatically generated which include
signature lines for both inmate and property clerk use.

Working from the court event data posted in the JMS/2000 Event Processing
System, Tiburon's standard Court Tracking facilities provide daily schedules
of court events, by morning appearances, afternoon appearance, or both.

On-line Custody queries are provided to immediately locate any inmate in
custody.
Tiburon's Jail Event Processing facilities are used to track all inmate

jurisdiction, the date/time scheduled for court, the date/time scheduled for
return from court, the date/time of actual departure and the actual date/time
of return.

Inmate Money Accounting
Standard Features:
Facilities are included in Tiburon's standard JMS/2000 product for activating
an inmate's account as part of the booking process or at any time following
booking. The amount of money received from the inmate is deposited in this
account through an inmate money tracking facility. Subsequent money
transactions are also recorded utilizing these same facilities. These
transactions include money received (i.e., from visitors, mail, work programs,
etc.) and money disbursed (i.e., commissary, bail, release, etc.). Any
transaction which debits or credits an inmate's account automatically
generates a set of receipts for inmate and officer signature.
A transaction listing (audit trail) is available showing all debits and credits to
each inmate account. The system also produces an Inmate Balance Report,
which is a summary of account balances for each inmate who has an active
account in the system.
In addition to individual inmate money tracking, the system provides full
inmate trust fund accounting. The facility tracks money maintained at the
Jail, as well as money maintained by the treasurer (off-site). These
accounting facilities are used to track money in the following trust funds:
Inmate Property Trust - Money taken from inmates at booking, or
•
received from outside sources (i.e., visitors, mail, etc.) for deposit in
individual inmate accounts.
• Unclaimed Money Trust - Money left on account when an inmate is
released, as well as money found in the Jail's common area.
• Commissary Trust - Money received from the Inmate Property Trust
for commissary purchases and used to operate the commissary
operation.
Welfare Trust - Profits from the commissary, pay telephones, etc.,

which are typically used for the purchase of welfare packages for
indigent inmates.

These trust fund accounting facilities provide transactions to move money
between each of the various trust fund accounts, between the jail safe and
trust fund accounts, as well as between the trust fund accounts and the jail's
cash drawer(s). A Balance Report provides, on a shift basis, the beginning
and ending balances, as well as all cash and non-cash adjustments (debits and
credits) for each of the trust fund accounts.
Customization:
Modifications will be made to the Inmate Money Accounting facilities to
generate checks for inmates being discharged with more than $5.00 on
account and vouchers for inmates with less than $5.00 on account.
These same check processing facilities will enable checks to be generated for
commissary purchases.
The system will be designed to accept input from magnetic tape for bank
statement reconciliation.

Historical classification records and preliminary classifications (completed at
booking) can be maintained on-line allowing them to be used in the
evaluation process.
Cell assignments can be made directly on the classification record,
automatically scheduling inmate movement (transport) records in the Event
Processing system. The Event Processing system can then be used to
automatically notify the sending and receiving officers of the move or
schedule the move for any point in the future. Classification conflicts are
flagged to advise the classification officer of any improper cell placements.
Automated facilities are included in the Classification System for providing
a suggested classification. This objective (system-generated) classification
facility is based upon an automated arithmetic calculation of assigned values
to data that is entered into the system. This system-generated classification
(security level) can then be overridden or accepted by the classification
officer. Once classified, reclassifications can be automatically scheduled in
the Event Processing System.
All updates to an inmate's classification level are automatically reflected on
the inmate's Jail Master Record, along with any new custody location.
Queries into the scheduled (pending) classifications/ reclassifications in the
Event Processing System provide the classification section with a complete list
of all inmates requiring a classification review.

Minor modifications will be required to adapt Tiburon's objective
classification facilities to match the criteria utilized in Weld County.

Standard Features:
The same facilities described above to track inmate events are also used to
schedule visit events in advance. A visit activity log can be generated for all
pending visits, by inmate, facility, floor or cell, date range, etc. showing all
scheduled visits and any remarks that were entered on the referenced pending
(scheduled) visit records.
JMS/2000 provides a list of authorized visitors (by inmate), as well as a list
of special authorized visitors for a particular facility (i.e., clergy, attorney,
etc.). Authorized visitors identified during booking or social worker
interviews may be changed at any point during the course of confinement.
The system maintains a record of each authorized visitor, with a subset of the
following data-elements:

• Relationship
• Address

As part of the visitor control process, the system provides facilities for Jail

Medical Services
Standard Features:
The Tiburon Jail Management System provides two medical facilities. Am_
inmate's observed medical condition may be entered at the time the person
is admitted. This medical screening facility allows the admissions officers to
collect information on the attitude, medical and mental condition of the
inmate as part of the booking process. Data collected typically includes
answers to specific screening questions, date of the exam, who administered
the exam, etc.
In addition, an extended facility is provided to maintain an inmate's overall
medical history. Each medical record contains information on the medical
service provided, its start and end dates, the department, agency or clinic
providing the service, the individual providing the medical service and their
medical class (i.e., doctor, nurse, etc.), the reason for the service (i.e.,
diagnosis), the prescribed medication, its dosage and frequency, and a free-
form remarks field.
This extended medical information is also available at admission and
classification, for users with proper security authorization.

Commissary Processing
Standard Features:
The JMS/2000 Commissary System includes requisition facilities enabling
commissary workers to enter up to 10 items per inmate request. This facility
automatically validates that the inmate has not exceeded his/her allotted
commissary privileges, that the requested limits of each item do not exceed
allowable quantities, that sufficient funds are available in the inmate's account

Processing of the request automatically debits the inmate's account by the

histories by inmate or by commissary line-item. Reports are also available to
provide information on commissary expenses, including salaries and taxes, etc.

described above, a full set of Ad hoc query facilities is provided through Tiburon's
Relational Data System (RDS), as well as through IBM's DB2 Relational Data Base
Management System, should the County make DB2 tools available to the users.
Functional Overview:
The following is a brief description of Ad hoc facilities available with Tiburon's RDS
product:
Relational Data System:
The RDS Ad hoc query/report writer facilities allow Tiburon application
users to select data and prepare reports from any Records Management
System, Jail Management System, or District Attorney Case Information
System data files. The facility provides an easy-to-use structured ouery
language which can be entered in a free-form fashion. This English-like
language allows queries/reports to be defined in a matter of seconds.
These ad hoc facilities provide a wide variety of data selection/reporting
features, including the ability to sort output, join multiple files, decode data
elements, perform arithmetic functions (including add, subtract, multiply,
divide and average) and if desired, create work files which may be saved,
added to and used in the future. These work files may be used as input data
to future RDS reporting processing activities.
In addition to these powerful selection options, RDS provides extensive report
formatting capabilities to define titles, center fields, add free-form column
headings, and control the structure of print lines. Statistical data is provided
at the end of all ad hoc reports which show the composite counts of all fields
defined as a selection criteria.
RDS provides commands to save, recall, delete and/or change ad hoc queries.
Using these commands, users can develop a library of ad hoc queries which
can be altered, processed and/or share&with other users.

Tiburon User Facilities

point out a number of user facilities which have been developed with the sole
purpose of maximizing the user-friendliness of the system. Among these facilities

Menu or Command-Line Processing: All transactions may be accessed
through a series of user-defined menus or simply by entering a four-letter
command.
On-line Help Facilities: Transaction descriptions and user instructions are
available on-line for every transaction.
Touch-Help: Valid edit codes for each data field are available simply by

Windows: Windows are utilized extensively throughout the system. Any
transaction can be accessed/performed within a window. The help facilities

Application Managed Function Keys: Commonly used transactions can be
accessed using a single function key, in lieu of the menu or command-line
facilities.
Message Recall: Through the use of a function key, a user may back through
the last six transactions performed.

WELD COUNTY COMMUNICATIONS ADVISORY BOARD BY-LAWS
Many of the law enforcement, fire and Emergency Medical Services
(EMS) radio systems in Weld County are being replaced and upgraded
in connection with the Colorado State Division of Criminal Justice
Program.
As a result of this program, it has become apparent that an urgent
need exists to develop and implement a county-wide radio network,
and, in connection therewith, to develop and implement rules,
procedures, and guidelines for the use of such a network.
Therefore, a Board, which is representative of the users of the
network, is created to deal with these matters.
ARTICLE I: BOARD
A. NAME AND PURPOSE
1 . The Weld County Communications Advisory Board is hereby
created to advise in the development and maintenance of
a county-wide emergency radio network and, in connection
therewith, to develop and implement rules, procedures and
guidelines for use of such network or channels.
2 . The Board shall also serve as liaison to any other law
enforcement, fire and EMS agencies of the state, other
public safety organizations, and any other organizations
deemed necessary in telecommunications planning.
B. MEMBERSHIP
1 . The Board shall consist of twelve voting members. In
order to ensure county-wide representation, the
membership should be representative of each user of the
system.
a. The incorporated municipalities are divided into
four zones, with a police chief to be selected from
existing Police Departments from each zone to
represent the corresponding municipalities. The
zones are established as follows:
ZONE 1 : Ault, Windsor, Johnstown, Milliken.
ZONE 2 : LaSalle, Evans, Kersey, Eaton.
ZONE 3 : Ft. Lupton, Lochbuie, Platteville.
ZONE 4 : Firestone, Frederick, Dacono.

b. The fire districts will be divided into three zones ,
with a representative of the district or department
(preferably a fire chief) to be selected from each
zone to represent the corresponding districts or
departments. The zones are established as follows :
ZONE A: LaSalle Fire District, Milliken Fire
District, Johnstown Fire District, Frederick-
Firestone Fire District, Ft. Lupton Fire District,
Gilcrest Fire Department, Platteville Fire District,
Western Hills Fire District, Hudson Fire District,

Keenesburgh, Prospect Valley) .
ZONE B: Ault-Pierce Fire District, Nunn Fire
District, Windsor-Severance Fire District, Eaton

ZONE C: This is an at-large representative for fire
and can be selected from any one of the fire
districts listed in Zone A and Zone B, excluding
those departments that are currently selected as
Zone A and Zone B representatives.
c. The Sheriff will represent the Weld County Sheriff's
Office as a standing representative.
d. The Weld County Ambulance Service Director will
represent the ambulance services operation in Weld
County as a standing representative.
e. The District Attorney's Office is a standing
representative and will represent the District
Attorney's Office and the County Coroner.
f. The Weld County Road and Bridge Department will
designate a standing representative for both Road
& Bridge and Engineering.
g. The Commissioner Coordinator of Communications
Services will be the Chairman of the Advisory Board
and will represent all other county agencies.
h. The Director of Communications will be a non-voting,
standing member of the Advisory Board.

C. TERMS OF APPOINTMENTS
1 . Non-standing voting membership on the Board shall be for
a term of three years and in compliance with provision
of the Weld County Home Rule Charter Sec 16-8 (2) .
2 . All appointments for non-standing voting memberships will
be made by the Board of County Commissioners and all
Board members shall continue in their office until their
successor is appointed.
3 . Whenever a vacancy, other than routine expiration of
appointment, arises on the Board due to resignation,
death, or for any other reason, the secretary will notify
in writing the Board of County Commissioners and request
that another member be appointed to serve out the
remainder of the unexpired term. Nominations for this
appointment shall be made by the Advisory Board to the
Board of County Commissioners .
D. MEMBER ABSENCE
1 . Whenever a non-standing member of the Advisory Board
fails to attend two consecutive regular meetings during
the current year or has three unexcused absences in a
year, at the Board's request, the secretary will submit
to the member a written memorandum of the attendance
record of said member at least 48 hours prior to the next
regularly scheduled meeting. The member's appointment
to the Advisory Board shall be deemed terminated if no
written response is received by the next regularly
scheduled Board meeting. If the member responds , in
writing, he shall have an opportunity at the regularly
scheduled meeting to present evidence as to why he has
failed to meet attendance requirements and the Advisory
Board shall then either dismiss the matter, terminate his
membership, or continue for further consideration. The
Board of County Commissioners will be notified of the
action within seven (7) days and the procedure for
appointment of a new member shall commence according to
the procedures as set forth under Section C. 3 . of these
By-Laws. The terminated member may request, in writing,
within seven (7) days of the decision of the Advisory
Board, that the matter be considered in a hearing de novo
by the Board of County Commissioners. The terminated
member and representatives of the Advisory Board shall
have the opportunity to present evidence and question
witnesses in a hearing before the Board and the Board
shall announce its decision whether or not to affirm,
overrule, or remand to the Advisory Board for further

evidence at the conclusion of the hearing or within a
reasonable time thereafter. The decision of the Board
of County Commissioners shall constitute final
administrative action.
E. OFFICERS
1 . The Chairman will be the Commissioner Coordinator of
Communications Services.

3 . Special and/or Executive Session meetings may be called
by the Chairman or upon request of three members of the
Board. Notice of special meetings is to be by personal
telephone confirmation_ or personally acknowledged by
radio or teletype contact or by mail , provided notice is
given 24 hours prior to the meeting date.
4 . Emergency meetings may be called when deemed necessary
by the Chairman.
5. A quorum shall consist of not less than seven voting
members of the Board. A quorum will be necessary at any
meeting where the agenda includes:

6. The concurring vote of a majority of those present and
voting shall be required to report favorably any reports
or recommendations to the Board of County Commissioners.
Votes to abstain shall neither be considered a "yes" nor
a "no" vote.
7 . A tied vote (six yes and six no votes) of the Board shall
automatically defeat the issue voted on.
8 . Robert's Rules of Order shall prevail to the extent they
are not in conflict with specific provisions of these by-
laws.
9 . Executive sessions shall conform to statute (1973 ) CRS
29-9-101, PUBLIC MEETINGS.
a. All meetings of any board, commission, committee or
authority of a political subdivision of the state
supported by law in its activities in whole or in
part with public funds are declared to be public
meetings and open to public at all times, except
that such groups, by majority consent of members
present, may go into executive session for
consideration of documents or testimony given in
confidence but shall not make final policy decisions
nor shall any resolution, rule, ordinance,
regulation, or formal action or any action approving
a contract or calling for the payment of money be
adopted or approved at any session which is closed
to the general public.
b. Any action taken contrary to the provision of
subsection 1 of this section shall be null and void
and without force or effect.

telephone service program. The purpose of these Bylaws is to establish the
operating procedures of that Board.

TWO-WAY COMMUNICATIONS SYSTEM MAINTENANCE
SCOPE OF WORK
This is a request for proposal for firm price quotations for the following
services to be provided in accordance with the attached Specifications:
TWO-WAY COMMUNICATIONS SYSTEM MAINTENANCE
Weld County, Colorado intends to award one (1) Contract as a result of this
invitation. The Contract includes: Two-way Communications System
Maintenance, as described in the Specifications, including any item not
specifically listed but that is an integral part of the communications
system.
The contractor shall be responsible for fault isolation up to the input or
output of any equipment that is not an integral part of this system. The
initial service call response for equipment that may be associated with, or
interfaced- with-, the- communications- system-, but- nut art inreegrel part of ulie
system, shall be covered under this contract at no charge to Weld County.
Subsequent request fan service_ for a continuing- problem with_ equipimmt_ of
facilities not included under this contract, or additional time spent by the
contractor assisting other subcontractors or vendors in fault isolation of
equipment or facilities not the responsibility of the contractor, shall be
considered as above contract and charged at the prevailing hourly labor rate.
All materials, supplies, and equipment furnished or services performed under
the terms of this Request for Proposal or subsequent contractual agreement
shall comply with the requirements and standards specified by the Williams-
Steiger Occupational Safety and Health Act of 1970, 29 U.S.C. § 651, et seQ. ,
Pub. Law 91-596, as well as with other applicable Federal, State, and local
codes , laws, rules, and regulations.

BIDDER QUALIFICATIONS
The County must have evidence of the bidder' s ability to provide the services
described in this request for proposal. Bidder must answer questions
regarding qualifications specified in the request for proposal during the
selection interview.
Bidder should provide past and present service references and a complete
resume of service capability and certifications/ratings.
PROCEDURES FOR SUBMITTAL
All proposals should be submitted to the Director of General Services on or
before Tuesday, November 27, 1990 at 10:00 a.m. (WELD COUNTY PURCHASING TIME
CLOCK) in the Purchasing Office located at 915 10th Street, Greeley,
Colorado, 80631, Room 301.
EVALUATION OF PROPOSALS
Upon receipt of all proposals, an evaluation team shall evaluate the firms
proposals and then shall interview and conduct physical inspection-oi service
facilities of the firms that, in the County' s opinion, can accomplish the
task outlined in the request for proposal. Pricing will not be the sole
determining factor for vendor selection.
After interviewing the selected firm or firms, the Board shall take one (1)
of two (2) courses of action:
1. Request the firm to perform the task outlined in the request for
proposal.
2. Notify all parties submitting proposals that the constraints
identified in the interview process or in the evaluation of the
proposals makes it impossible to select any of the firms.
If the Board does not make a selection, it may request additional proposals
from other sources or determine that the restraints identified in the
evaluation process disallow the selection of any firm to perform the task
outlined in the proposal.
ADDITIONAL INSTRUCTION/INFORMATION
It is understood that the Board of County Commissioners reserves the right
to reject any and all proposals, to waive any informalities in the proposal
process, and- to- accept the- proposal that, in- the_ opinion of the Board, is in
the best interest of the Board and of the County of Weld, State of Colorado .

The successful firm shall indemnify and hold harmless Weld County against all
claims for royalties, patents, or for suits for infringement thereon, which
may be involved in providing the services requested.
Cost will not be the determining factor. The County reserves the right to
refuse the lowest bid, and select the overall best qualified bidder. All
factors relating to the bid will be carefully weighed. (See EXHIBIT "C")
The proposal shall be sent in a sealed envelope furnished by the Purchasing
Department of Weld County, Colorado. Six (6) copies of the proposal must be
submitted.
In submitting the proposal, the vendor agrees that the acceptance of any or
all of the bid by the County within a reasonable time or period constitutes
a contract. No delivery of service or payment for service shall take place
unless a contract has first been issued by the Director of General Services
of Weld County, Colorado, or the Board of County Commissioners.
Weld County reserves the right to request additional information from all
bidders in the evaluation process if clarification of proposal is necessary.
Proposer must be willing to agree to the following standard contract
provisions unless specified in writing as an exceptio$ in the proposal
submitted:
1. Contractor agrees that it is an independent contractor and that its
officers and employees do not become employees of County, nor are
they entitled to any employee benefits as County employees as the
result of the execution of this agreement.
2. Contractor shall indemnify County, its officers and employees
against liability for injury or damage caused by any negligent act
or omission of any of its employees or volunteers or agents in the
performance of the approved agreement and shall hold County
harmless from any loss occasioned as a result of the performance
of the contract by Contractor. The contractor shall provide
necessary workers compensation insurance at Contractor's own cost
and expense.
3. No officer, member or employee of County and no member or their
governing bodies- shall have- any- pecuniary- interest, direct or
indirect, in the approved agreement or the proceeds thereof. No
employee of Contractor nor any member of any employee's family
shall serve on a County board, committee or hold any such position
which either by rule, practice or action nominates, recommends ,
supervises Contractor' s operations, or authorizes funding of
Contractor.

4. Contractor may not assign or transfer the approved agreement, any
interest therein or claim thereunder without the prior written
approval of County.
5. Payment of Contractor will be made only upon presentation of a
proper claim by Contractor subject to the approval of the County
Department or Agency for which the services have been performed.
6. County shall have access to Contractor's financial records for
purposes of contract reconciliation. Such records shall be
complete and available for contract reconciliation ninety (90) days
after final payment hereunder and shall be retained and available
for contract reconciliation purposes for five years (5) after final
payment hereunder.
7. County may terminate the approved agreement at any time by giving
Contractor a ten (10) day written notice of such sooner termination
and may be terminated at any time without notice upon a material
breach of the terms of the approved agreement by Contractor.
8. Time is of the essence in each and all the provisions of the
approved agreement.
9. No alteration or variation of the terms of the approved agreement
shall be valid unless made in writing and signed by the parties
hereto.
10. Contractor shall not be allowed or paid travel expenses unless set
forth in the approved agreement.
11_- Contractor_ assures that it will comply with Title VI of the Civil
Rights Act of 1964 and that no person shall, on the grounds of
race, creed, color, sex or national origin be excluded from
participation in, be denied the benefits of, or be otherwise
subjected to discrimination under the approved agreement.

1.0 fEOUIPncE TS
1.1 Compliance With Specifications. All Bidders, by submission of
their bids, agree to comply with all of the conditions,
requirements, and Specifications of this Request of Proposal
("RFP)", as stated or implied herein.
1.2 Omissions From RFP. Should Weld County omit anything from this
RFP which is necessary to a clear understanding of the work, or
should it appear that various provisions are inconsistent or in
conflict, then the Bidder shall secure written instructions from
the Director of Communications at least five (5) days prior to the
time and date of bid opening indicated in the advertisement for
RFP.
1.3 Alternation Of Documents. No change shall be made in the
phraseology of the RFP or additions to the terms mentioned
therein. Any additions, limitations, or provisions attached to
the bid may render it informal and cause its rejection.
Additionally, any alteration, erasure, or interlineation of the
bid may constitute cause for its rejection.
1.4 Bid Form And Signature. Bids must be submitted on the Bid Form
provided by Weld County. Bids submitted on any other form will
be considered non-responsive and will be rejected. The Bid Form
shall be signed by the individual or officer who is duly
authorized to bind the Bidder to the terms of its bid.
1.5 Preparation Of Bid Form. The Bid Form must be filled out in all
details, showing the bid price or prices. In cases of discrepancy
between the written price and that given in figures, the price
given in writing will be considered as the bid. In cases of
discrepancy between the unit price and the computed total price,
the unit price alone will be considered as representing the
Bidder's intention.
1.6 Conditional Bids. Conditional bids or those which take exception
to the Specifications will be considered non-responsive and will
be rejected. No telegraphic or telephonic modifications of bids
will be considered.

1.7 Submission Of Bids. Six (6) copies of the completed and signed
bid, including all required attachments, will be submitted for
each Contract bid in a sealed envelope prior to the hour specified
and at the address specified in the advertisement for RFP. No bid
shall be accepted from and no contract will be awarded to any
person, firm or corporation that is in arrears upon any obligation
to Weld County or that otherwise may be deemed irresponsible or
unreliable by Weld County.

1.8 Withdrawal of Bids. A bidder may withdraw its bid any time prior
to the bid opening.
1.9 Late Offers And Modifis_atiOns Or Withdrawals. Offers and
modifications of offers, or withdrawal thereof, received at the
office designated in the Request for Proposal after the exact hour
and date specified for receipt will not be considered.
1. 10 Any correspondence, questions or requests for bid documents and

1.11 Waiver. By submission of its bid, the Bidder shall represent and
warrant that it has sufficiently informed itself in all matters
affecting the performance of the work or the furnishing of the
labor, services, supplies, material, or equipment called for in
the Specifications; that it has checked its bid for errors and
omissions; that the prices stated in its bid are correct and as
intended by it and are a complete and correct statement of its
prices for performing the work or furnishing the labor, services,
supplies, materials, or equipment required by the Contract
Documents. The Bidder waives any claim for the return of its bid
security if, on account of errors or omissions claimed to have
been- made- by- it in- its- bid-, or for any- other cenauur it should-
refuse or fail to execute the Contract.
1. 12 The successful Bidder shall be required to furnish a Performance
Bond in an amount of One-Hundred Percent (100%) of the annual
contract amount. _Work shall be accomplished within the schedule
designated by Weld County.
1.13 Price Quoted. All prices must be quoted at a firm price. The
price quoted in any bid submitted shall include all items of
labor, materials, tools, equipment, and other costs necessary to
provide fully all services pursuant to the Specifications.
1.14 Options To Extend The Term Of The Contract. This contract is
renewable for two (2) additional years by mutual agreement of both
parties and by Weld County giving the Contractor written notice
of Weld County's intention to renew at least thirty (30) days
before the contract is to expire.
1.15 Documents Deemed Part Of Contract. The Request for Proposal,
Requirements, Instructions to Bidders, General Terms and
Conditions, Technical Specifications , Equipment Inventory and
addenda, if any, will be deemed a part of the Contract.

1.16 Time Far Execution Of Contract And _Filing Bond. The Bidder to
whom award is made shall execute a written Contract with Weld
County on the attached form of contract as provided by Weld County
and furnish a good and approved performance bond as herein
required within ten (10) days after receiving the Contract for
execution. If the Bidder to whom award is made fails to enter
into the Contract as herein provided and furnish the said bond,
the award will be annulled and an award may, at the discretion of
Weld County, be made to the Bidder whose bid is next most
acceptable in the opinion of Weld County, and such Bidder shall
fulfill every stipulation embraced herein as if it were the party
to whom the award was first made.
1.17 Investigations.
1.17.1 Bidders must satisfy themselves, by personal
investigation and by such other means as they deem
necessary or desirable, as to the location of and
conditions affecting the proposed services to be provided
and as to the cost thereof. Bidders shall become
familiar with all conditions, including the site, which
may affect the services to be provided under this
Contract.
1.17.2 The Contractor shall not incur any costs for the repair
or modification of any equipment covered under this
Contract that, at the time of award, is not in a good and
sound operating condition; minor adjustments or
specification variations excluded.
Any colts incurred by the Contract or to repair or
otherwise bring such equipment up to specifications, that
was obviously not in good and sound operating condition
prior to the award, shall be charged to Weld County as
above contract at the prevailing time and material rates.
Any work of this nature shall be authorized by Weld
County, either verbally or in writing, prior to the
Contractor effecting any such repairs.
1.18 Personnel Availability. By submitting its Bid, the Bidder
certifies that it and each of its subcontractors, if any, possess
an adequate supply of workers qualified to provide the services
specified herein.

2.0 GENERAL TERMS AND CONDITIONS
2.1 Intent Of Contract. The intent of the Contract is to provide for
the performance in every detail of the services specified. Unless
otherwise specified, the Contractor shall furnish all labor,
supervision, materials, tools, equipment, and incidentals
necessary to provide the services in a proper, thorough, skillful,
and workmanlike manner.
2.2 Definitions. As used throughout this Contract, the following
terms shall have the meanings set forth:
2.2.1 The term "the County" (or Weld County) shall refer to the
Weld County Regional Communications System, a division
of Weld County Government to include any user agencies
thereof. (Listing of current users attached as Exhibit
"A".)
2.2.2 The "Contractor" is the person or organization
identified as such in the Contract Documents and is
referred to throughout the Contract. Documents as if
singular in number. The term "Contractor" means the
Contractor or its authorized representative.
2.2.3 "Above Contract" shall mean any labor or material
charges for work performed that is not normally included
under the terms and conditions of the contract.
2.3 Performance Bond. The successful Bidder will be required to
furnish to Weld County, not later than ten (10) days after Notice
of Award, a performance bond in the amount of One-Hundred Percent
(1OOi) of_ the Contract price in such form and with such sureties
or guarantors as are satisfactory to Weld County. This
performance bond shall be executed to secure fulfillment of all
the Contractor's obligations under such Contract.
2.4 Tax Exemotioq. Unless otherwise indicated, the prices shown shall
not include taxes of any kind. Weld County Government is exempt
from Federal Excise Tax under the Internal Revenue Code. (Our
Registration Number is 846000813. )
The Weld County Government is exempt form sales and use tax by
authority of Department of Revenue Number 98-03551.
2.5 Items Omitted. Any items omitted from the Specifications which
are- clearly- necessary- for fully pro-viding the_ ae.tvises herein
specified shall be considered specified for such services.

2.6 Contract Period. Maintenance will commence on January 1, 1991 (or
upon receipt of written Notice to Proceed, if later) , to January
1, 1992, one (1) year, with the option of annual renewals by Weld
County for two (2) additional years.
2.7 jlotice To Proceed. Weld County will furnish Contractor written
direction to commence services hereunder entitle "Notice to
Proceed" within ten (10) days after receipt by Weld County of the
required performance bond, insurance certificates, permits, or
such other documentation which Contractor is required to submit
for Weld County approval prior to commencement of services under
this Contract. Weld County shall not be responsible for any costs
of any type whatsoever incurred by Contractor prior to the
issuance of the Notice to Proceed. The date of the Notice to
Proceed- shall be- the- official date- from_ which_ all_ scheduled
activities and requirements are computed, and will be the first
(1st) or fifteenth (15th) calendar day of the month.
2.8 jdentification Of Emvlovees. The Contractor shall be responsible
for requiring each employee engaged in the services to display
identification furnished by the Contractor.
2.9 Contract Changes.
2.9.1 This Contract may be amended in writing by mutual
agreement of both parties.
2.9.2 The Contractor will maintain units identical with any
units covered by this contract for the same monthly fees
and on the same terms and conditions set forth herein.
2.9.3 In the event of loss, damage or theft or removal from
service of any units, Weld County shall immediately
report said loss, damage or theft or removal to the
Contractor. In this event Weld County' s obligation to
pay service fees with respect thereto shall terminate at
the end of the month in which the Contractor receives
said iepoLt.
2.10 Interruption of Services. Weld County shall notify the Contractor
in the event of the failure of any unit. If the contractor fails
to repair the unit within a reasonable time, Weld County shall
notify the Contractor in writing. After said notice from Weld
County to the Contractor, the Contractor shall be liable for any
interruption or interference affecting the use of or transmission
through the equipment maintained to the extent of a pro rata
allowance based on the monthly service fee for the time such
interruption or interference is attributable to the fault of the

Contractor. The Contractor does not assume and shall have no
liability under this agreement for failure to provide or delay in
providing service for the equipment due directly or indirectly to
causes beyond the control and without the fault or negligence of
contract including, but not restricted, acts of God, acts of the
public enemy, acts of the United States, any State, Territory of
the United States, or any political subdivision of the foregoing,
acts of Weld County, its agents , employee or subcontractors,
fires, flood, epidemics, quarantine restriction, strikes, freight
embargoes. and unusually severe weather conditions.
2.11 Warranty - Guaranty. Until the completion of the services to be
provided herein, and acceptance by Weld County, the Contractor
warrants that the services performed under this Contract conform
to the Contract requirements and are free of any defect of
equipment, material, or workmanship performed by the Contractor
or any of its subcontractors or suppliers. Contractor shall refer
to Technical Specifications for any additional warranty
requirements which are incorporated herein by reference.
2. 12 Contractor's Liability Insurance. The Contractor agrees to obtain
and keep in force during the term of this Contract the coverage
described below relating to the "Work" with the owner named as an
additional insured in the insurance required by Section 2. 12.1
through 2.12.4. Such insurance shall be carried with companies
satisfactory to Weld County and licensed to do business in the
State of Colorado, and certificates evidencing such coverage shall
be furnished to Weld County prior to commencing any Work under
this Contract if requested by Weld County. A copy of each
certificate evidencing such coverage shall be mailed to Weld
County. These certificates shall contain a provision that
coverage afforded under policies will not be cancelled or
permitted to lapse unless at least thirty (30) days prior written
notice has been given to Weld County. Weld County reserves the
right to examine the Contractor's original insurance policies.
The insurance coverage which Contractor shall obtain and keep in
force is as follows:
2.12.1 Workmen's Compensation and/or Employer's Liability
Insurance as required under laws applicable to the Work
which shall cover all Contractor's employees engaged in
'the Work.

2.12.2 Comprehensive General Liability Insurance coverage with
limits not less than Five-Hundred-Thousand and No/100
Dollars ($500,000.00) per occurrence for Property Damage
with coverage extended to:
a. ) Premises - Operations.
b.) Independent Contractor (Contractors Protective) .
c. ) Contractual Liability covering the Contractor' s
indemnification obligation contained in Section
2.15, 'Hold Harmless" .
d.) Broad form property damage.
e.) Personal Injury Coverage extending to claims arising
from the Contractor's Work from:
(1) Contractor's Employee.
(2) Any other person.
2.12.3 Automobile Liability Insurance covering all owned,
hired, and non-owned automobiles used in connection with
the Work, with limits not less than Two-Hundred-Fifty-
Thousand and No/100 Dollars ($250,000.00) per person,
Five-Hundred-Thousand and No/100 Dollars ($500,000.00)
per occurrence for Bodily Injury, and Two-Hundred-Fifty-
Thousand and No/100 Dollars ($250,000.00) for Property
Damage.-
2.12.4 Such other insurance as Weld County may, from time to
time, require. The cost of which shall be allowable
under this Contract.
2.13 Subcontractor's Insurance
2.13.1 The Contractor shall specifically require its
subcontractors to obtain like insurance coverage to that
specified in Section 2.12.1 through 2.12.4, inclusive.
The subcontractor, prior to commencing Work, shall submit
,certificates evidencing coverage of such insurance to
Contractor.
2.14 Right To Subcontract. The Contractor shall have the right to
subcontract in whole or in part the service work called for by
this agreement. However, the Contractor shall not be relieved of
any liability under this agreement on account of a subcontract.
The Contractor will notify Weld County of the name and address of
each subcontractor.

2.15 Assignment. The Contractor shall not assign, transfer, convey,
sublet, or otherwise dispose of the Contract or its right, title,
or interest in or to the same or any part thereof without prior
written consent of Weld County endorsed thereon or attached
thereto. This does not prohibit the Contractor from
subcontracting any or all of this Contract. The Contractor
remains totally responsible for compliance of all terms and
conditions of this Contract.
2.16 Compliance With Laws And Reeulationg. All materials, supplies,
and services furnished pursuant to the Specifications shall be in
compliance with the laws and regulations of the State of Colorado.
Contractor shall, if requested by Weld County, supply
certification and evidence of such compliance. The Contract shall
be construed pursuant to the laws of the State of Colorado.
2.17 Suspension Of Work.
2.17.1 Weld County may order the Contractor, in writing, to
suspend, delay, or interrupt all or any part of the
services to be performed for such period of time as he
may determine to be appropriate for the convenience of
Weld County.
2.17.2 If the performance of all or any part of the service
is, for an unreasonable period of time, suspended,
delayed, or interrupted by an act of the Contractor in
the administration of this Contract, or by his failure
to act within the time specified in this Contract (or if
not time is specified, within a reasonable time) , an
adjustment shall be made for any increase in the cost of
performance of this Contract (excluding profit)
necessarily caused by such unreasonable suspension,
delay, or interruption and the Contract modified in
writing accordingly. However, no adjustment shall be
made under this clause for any suspension, delay, or
interruption to the extent (1) that performance would
have been so suspended, delayed, or interrupted by any
other cause, including the fault or negligence of the
Contractor, or (2) for which an equitable adjustment is
provided for or excluded under any other provision of
, this Contract.
2.18 Inspection And Acceptance.
2.18.1 Except as otherwise provided in this Contract,
inspection and tests by Weld County of material and
workmanship required by this Contract shall be made at
reasonable times and at the site of the work.

2.18.2 The Contractor shall, without charge (within the terms
and conditions of this Contract) replace any material or
correct any workmanship found by Weld_ County nor to-
conform to the Contract requirements, unless in the
public interest Weld County consents to accept such
material or workmanship with an appropriate adjustment
in Contract price.
2.19 Supervision. The Contractor shall supervise and direct the
services to be provided, using its best skill and attention. The
Contractor shall be solely responsible for all means, methods ,
techniques, sequences, and procedures and for coordinating all
portions of the services to be performed under the Contract.
2.20 FCC Records. Applications and statements of facts when required
by the Federal Communications Commission must be subscribed and
sworn to by the Communications Director, and Weld County is
responsible for meeting FCC requirements. However, the Contractor
will provide Weld County with forms, advice, and technical
assistance, including frequency, modulation and power
measurements, to aid in meeting these requirements.
3.0 ,SERVICE STANDARDS. The equipment will be serviced by the Contractor or
its subcontractor in accordance with these standards:
a. ) Original manufacturer parts or parts of equal quality will be
used-.
b. ) Oil, water, dust and foreign substances will be removed from the
equipment.
c.) The equipment will not be subject to mechanical abuse.
d. ) The equipment will be serviced at levels necessary to provide the
required communications.
e. ) Routine service procedures prescribed from time to time by the
manufacturer will be followed.
f.) All service work will be done by a qualified person or agency.
All techrficians who work on or repair the equipment will be fully
licensed as required by Federal, State and local rules and
regulations.

g. ) The Contractor shall assure that all equipment meets or exceeds
all manufacturer's original specifications as well as all
applicable Federal, State and local government rules and
regulations.
3. 1 Su000rt.
3.1.1 The Contractor shall supply an adequate number of
licensed technicians to be available to support this
Contract.
3.1.2 The Contractor shall be able to provide any technical
representative- and engineering backup to solve and
correct serious problems beyond the ability of a
journeyman level technician which may require field or
factory engineering resources.
3.1.3 The Contractor shall maintain sufficient number of
completely equipped mobile service units in addition to
shop facilities. The Contractor shall also maintain a
four-wheel drive mobile service unit for maintenance of
all outlying repeater stations.
3. 1.4 The Contractor shall be required to have a twenty-four
(24) hour, one number answering service.
3.1.5 The Contractor shall be required to have on inventory
adequate general and specialized test equipment to
maintain all equipment covered under the terms and
conditions of this contract.
3.1.6 The Contractor shall maintain a parts inventory of
sufficient quantity and variety to ensure rapid repairs
of no less than ninety-five percent (95%) of all
equipment failures. The Contractor shall incur all costs
associated with air or express shipments of any parts not
normally stocked that may be required to ensure rapid
repairs to equipment maintained under this contract.
3.2 Work Tickets. The Contractor will be required to comp_lata work_
tickets La separate ticket for each piece of equipment and a
separate ticket for each individual time that work is performed)
upon completion of any scheduled, unscheduled, emergency repairs
or service. Tickets shall be complete in detail as to the work
performed, parts replaced, make, model, serial number, type and
location of unit, etc. , so that no separate technical records
shall be required by Weld County.
A copy of each work ticket will be signed by Weld County employee
or representative responsible for that particular unit of

- communications equipment. Internal accounting and/or distribution
within Weld County organization is the responsibility of Weld
County.
The original work ticket for all contract and above contract work
shall be forwarded on a monthly basis, along with all appropriate
invoices, to Weld County billing address as provided to the
Contractor by Weld County.
Work tickets shall contain appropriate information to meet all FCC
certification and record keeping requirements.
3.3 Scope Of Work. The Contractor agrees to provide service for Weld
County of the equipment described within this Contract beginning
and ending on the dates specified. This Contract does not include
service of any transmission line, antenna, tower, tower lighting
or batteries. Service shall include the labor and parts required
to repair equipment which has become defective through normal wear
and usage. Service does not include the repair or replacement of
equipment which has otherwise become defective, including but not
limited to, damage caused by accidents, physical abuse or misuse
of the equipment, acts of God, and fires. Repairs of this nature
will be charged as above contract at the time and material rates
prescribed in this Contract.
Weld County shall be responsible for the availability of defective
equipment. The Contractor shall not be held responsible for
delays of repairs for equipment not available.
New equipment installations or change outs requested by Weld
County shall be charged at the time and material rates prescribed
in this Contract, negotiated on a case by case basis or charged
a flat rate for standard installations of specific categories as
defined within this Contract.
3.4 Time And Place of Work. Service and Installation/Removal work on
the base stations and other fixed equipment shall be performed at
the location of the equipment, and Weld County will provide heat,
light and power at these locations. Mobile units and removable
equipment will be delivered by Weld County to the place of service
indicated in Section four (4) of this Contract. Installations
will be scheduled with the Contractor at least five (5) working
days in advance of the installation time.
3 . 5 Fixed Antenna Systems. The Contractor shall be required to
inspect fixed antenna systems at the request of Weld County once
a year. Contractor will be required to replace worn antenna guy-
wires , hardware, weathered transmission line and effect ocher
repairs as necessary, subject to the approval of Weld County.

Such inspections and repairs will be figured as part of the annual
contract service fee.
3.6 Preventive Maintenance. The Contractor will perform preventive
maintenance and FCC checks upon completion of any service or
repairs to equipment. Preventative maintenance checks will be
performed on each piece of equipment at least once a year and any
defects or repairs will be scheduled for work. The contractor is
not responsible for preventative maintenance inspections when the
equipment cannot be made available for such an inspection.
4.0 Response Time. The following listed designations will identify the
response time required for any specific equipment: Response time is
defined as acknowledgement by the Contractor of a request for service
from Weld County either during or after normal working hours of the
Contractor. Additionally, the response times listed are to be used as
goals for the contractor to have a technician at the site of the
equipment failure. Response times are not to be construed as restoral
times.
4. 1 Response Time A. This will be the highest priority an
is required on system critical fixed equipment, i.e. -
Base Stations, Repeaters, etc. A goal of two (2) hours
is established for the arrival of a technician.
4.2 Response Time B. This is the second (2nd) highest
priority and is required on specific system noncritical
fixed equipment and on certain non-fixed equipment, i.e.
-emergency mobile equipment where lack of equipment
redundancy requires rapid restoration. A goal of four
(4) hours is established for the arrival of a technician.
4. 3 Response Time C. This is the lowest priority and is
applicable to the remainder of the fixed, mobile and
portable equipment. A goal of one (1) working day
response is established for this equipment.
4.4 Restoration of service should be accomplished within

4. 1 Location Of Work.
4. 1. 1 All fixed and associated equipment will be repaired at
the equipment location when so ever feasible. In the
event repairs to fixed and associated equipment would

prove to be impractical, upon consent of Weld County
fixed and associated equipment may be moved to the
contractor's facility for repair.
4.1.2 Mobile equipment repairs, removals and installations
will be quoted for two (2) locations at Greeley; 933
North 11th Avenue; 1399 N. 17 Avenue; 22 Grader Station
locations throughout Weld County, and at the Contractor' s
facility unless specified otherwise.
4. 1.3 Portable equipment will be repaired at the Contractor' s
facility. Delivery to and pickup from the Contractor' s
facility will be the responsibility of Weld County. Mail
delivery costs of these units to the Contractor' s
facility will be incurred by Weld County. Return mail
costs of repaired units will be incurred by the
Contractor. When/if mutually convenient to Weld County
and the Contractor, delivery and return of portable units
may be accomplished by the Contractor in conjunction with
the service calls to Weld County.
