RE: APPROVE SITE SPECIFIC DEVELOPMENT PLAN AND SPECIAL REVIEW PERMIT FOR AN
AGRICULTURAL FACILITY (STORAGE OF SUGAR BEETS) IN THE A (AGRICULTURAL)
ZONE DISTRICT - THE WESTERN SUGAR COMPANY
WHEREAS, the Board of County Commissioners of Weld County, Colorado,
pursuant to Colorado statute and the Weld County Home Rule Charter, is vested
with the authority of administering the affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners held a public hearing on the
11th day of August, 1993, at the hour of 10:00 a.m. in the Chambers of the Board
for the purpose of hearing the application of The Western Sugar Company, 1302 1st
Avenue, P.O. Box 9, Greeley, Colorado 80631, for a Site Specific Development
Plan and Special Review Permit for an agricultural facility (storage of sugar
beets) in the A (Agricultural) Zone District on the following described real
estate, to-wit:
Part of the Ez E; of Section 18, Township 7
North, Range 65 West of the 6th P.M. , Weld
County, Colorado
WHEREAS, said applicant was represented by Tony Zitterkopf, and
WHEREAS, Section 24.4.2 of the Weld County Zoning Ordinance provides
standards for review of said Special Review Permit, and
WHEREAS, the Board of County Commissioners heard all of the testimony and
statements of those present, has studied the request of the applicant and the
recommendations of the Weld County Planning Commission and all of the exhibits
and evidence presented in this matter and, having been fully informed, finds that
this request shall be approved for the following reasons:
1. The submitted materials are in compliance with the application
requirements of Section 24.7 of the Weld County Zoning Ordinance.
2. It is the opinion of the Board of County Commissioners that the
applicant has shown compliance with Section 24.4.2 of the Weld
County Zoning Ordinance as follows:
a. The proposal is consistent with the intent of the Weld County
Comprehensive Plan Urban Growth Boundary Goals and Policies.
The proposed land use is located in both the Town of Ault's
and the Town of Eaton's Urban Growth Boundary, and both towns
indicated the proposal did not conflict with their interests.
b. The proposed use is an agricultural service establishment and
is provided for as a Use By Special Review in the A
(Agricultural) Zone District.

c. The uses permitted will be compatible with the existing
surrounding land uses and with the future development of the
surrounding area as permitted by the Weld County Comprehensive
Plan, the Town of Ault, and the Town of Eaton.
d. No overlay districts affect the site.
e. Special Review Permit Development Standards will provide
adequate protection of the health, safety, and welfare of the
neighborhood and County.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the application for a Site Specific Development Plan and
Special Review Permit for an agricultural facility (storage of sugar beets) in
the A (Agricultural) Zone District on the hereinabove described parcel of land
be, and hereby is, granted subject to the following conditions:
1. The attached Development Standards for the Special Review Permit
shall be adopted and placed on the Special Review plat prior to
recording the plat. The plat shall be delivered to the Department
of Planning Services and be ready for recording in the Weld County
Clerk and Recorder's Office within 15 days of approval by the Board
of County Commissioners.
2. The Special Review activity shall not occur nor shall any building
or electrical permits be issued on the property until the Special
Review plat is ready to be recorded in the office of the Weld County
Clerk and Recorder.
3. The applicant shall obtain a recorded exemption to create the parcel
upon which the activity is proposed to take place. In lieu of the
recorded exemption, the applicant may wish to reword the lease to
state that they have the USE of the land, rather than the parcel of
land itself.
4. The applicant shall obtain an emissions permit from the Air
Pollution Control Division, Colorado Department of Health, for
fugitive dust and odors. If an emissions permit is determined to be
not necessary by the Colorado Department of Health, then the
applicant shall supply a letter indicating this.
5. The applicant shall obtain adequate toilet facilities for the site.

DEVELOPMENT STANDARDS
THE WESTERN SUGAR COMPANY

1. The Site Specific Development Plan and Special Review Permit is for the
storage of sugarbeets in the A (Agricultural) Zone District as submitted
in the application materials on file in the Department of Planning
Services and subject to the Development Standards stated herein.
2. Approval of this plan may create a vested property right pursuant to
Section 90 of the Weld County Zoning Ordinance.
3. All liquid and solid wastes shall be stored and removed for final disposal
in a manner that protects against surface and groundwater contamination.
4. Any required emissions permit shall be obtained from the Air Pollution
Control Division, Colorado Department of Health, for fugitive dust and
odors.
5. No permanent disposal of wastes shall be permitted at this site.
6. Fugitive dust shall be controlled on this site.
7. The maximum permissible noise level shall not exceed the industrial limit
of 80 dB(A) , as measured according to 25-12-102, Colorado Revised
Statutes.
8. Adequate toilet facilities shall be provided for the employees. Portable
toilets are prohibited.
9. An individual sewage disposal system is required for the proposed facility
and shall be installed according to the Weld County Individual Sewage
Disposal Regulations.
10. No on-site disposal of produce of any type shall be permitted at anytime.
Produce shall be handled and stored at the facility in such a manner so
that no nuisance is created by odor, blowing of debris, fugitive dust, or
spoiled produce on or around the facility.
11. An Individual Sewage Disposal System Permit must be finalized and approved
by an Environmental Protection Specialist within one (1) year of the
application date.
12. All construction activities that disturb more than five acres are required
to obtain a stormwater discharge permit from the Colorado Department of
Health, Water Quality Control Division.

13. Trucks delivering sugar beets to the site shall not exceed the posted
weight limit on the bridge to the north of the site on Weld County Road
39.
14. The approach through the radius at the site entrance and exit shall be
paved.
15. All construction on the property shall be in accordance with the
requirements of the Weld County Building Code Ordinance.
16. The property owner or operator shall be responsible for complying with the
Design Standards of Section 24.5 of the Weld County Zoning Ordinance.
17. The property owner or operator shall be responsible for complying with the
Operation Standards of Section 24.6 of the Weld County Zoning Ordinance.
18. Personnel from the Weld County Health Department and Weld County
Department of Planning Services shall be granted access onto the property
at any reasonable time in order to ensure the activities carried out on
the property comply with the Development Standards stated herein and all
applicable Weld County Regulations.
19. The Special Review area shall be limited to the plans shown herein and
governed by the foregoing Standards and all applicable Weld County
Regulations. Major changes from the plans or Development Standards as
shown or stated shall require the approval of an amendment of the Permit
by the Weld County Planning Commission and the Board of County
Commissioners before such changes from the plans or Development Standards
are permitted. Any other changes shall be filed in the office of the
Department of Planning Services.
20. The property owner or operator shall be responsible for complying with all
of the foregoing Development Standards. Noncompliance with any of the
foregoing Development Standards may be reason for revocation of the Permit
by the Board of County Commissioners.

A public hearing was conducted on August 11, 1993, at 10:00 A.M. , with the

The following business was transacted:
I hereby certify that pursuant to a notice dated July 7, 1993, and duly
published July 29, 1993, in the Windsor Beacon, a public hearing was
conducted to consider the request of The Western Sugar Company for a Site
Specific Development Plan and Special Review Permit for an agricultural
facility (storage of sugar beets) in the A (Agricultural) Zone District.
Lee Morrison, Assistant County Attorney, made this a matter of record.
Greg Thompson, Planning Department representative, entered the favorable
recommendation of the Planning Commission into the record as written.
Tony Zitterkopf was present representing the applicant. Chairman Harbert
explained that, in the case of a tie vote, Commissioner Kirkmeyer would
cast the deciding vote after reviewing the record. In response to a
question from Commissioner Webster, Mr. Zitterkopf said all Development
Standards and Conditions of Approval are agreeable. There was no public
testimony offered concerning this matter. Commissioner Webster moved to
approve the request of The Western Sugar Company for a Site Specific
Development Plan and Special Review Permit for an agricultural facility
(storage of sugar beets) in the A (Agricultural) Zone District, based on
the recommendations of the Planning staff and the Planning Commission,
with the Conditions of Approval and Development Standards as entered into
the record. The motion was seconded by Commissioner Baxter, and it
carried unanimously.
This Certification was approved on the 16th day of August, 1993.

A regular meeting of the Weld County Planning Commission was held August 3, 1993,
in the Centennial Center, 915 Tenth Street, Room 350, Greeley, Colorado. The
meeting was called to order by the Chairperson, Judy Yamaguchi at 1: 30 p.m.

It was determined the election of officers would be scheduled for the next

LEGAL DESCRIPTION: Part of the E2 E2 of Section 18, T7N, R65W of the 6th
P.M. , Weld County, Colorado.
LOCATION: Approximately 1.5 miles east of the Town of Ault.
The applicant, explained this proposal would allow them to obtain a new site for
the storage of sugar beets . The intended location would be more rural and more
accessible to local growers. It will help eliminate the traffic in the Towns of
Ault and Galeton.

Richard Kimmel asked if they would haul to the Fort Morgan area. The applicant
said most likely not, but in an emergency and pending freight costs (Ft. Morgan
vs. Greeley) it might be a possibility.
The Chairperson asked if the applicant agreed with staff' s recommendation. Tony l;
asked if Development Standard #8 could be altered because this facility would not
operate continually through the year. He thought the requirement for permanent

toilet facilities was a bit excessive. John Pickle explained this requirement
was initiated at the State level. No other alternatives other than a possible
"vault" system exist.
Shirley Camenisch felt the bridge, over the haul route should be addressed. Greg
Thompson explained Weld County Engineering had no concerns. She asked about
alternate accesses if breakdowns of the vehicles occur. Tony explained the
access would be widened and an access to the south also exists.
The Chairperson asked if there was anyone in the audience who wished to speak for ig
or against this application. No one wished to speak.
Richard Kimmel moved Case Number USR-1020, Western Sugar, be forwarded to the
Board of County Commissioners with the Planning Commission's recommendation for
approval. Shirley Camenisch seconded the motion.
The Chairperson asked the secretary to poll the members of the Planning
Commission for their decision. Richard Kimmel - yes; Tom Rulon - yes; Juliette
Kroekel - yes; Shirley Camenisch - yes; Judy Yamaguchi - yes. Motion carried
unanimously.

APPLICANT: Gerrity Oil and Gas Corporation
REQUEST: A Site Specific Development Plan and a Special Review permit for a 4
water separation facility in the A (Agricultural) zone district.
LEGAL DESCRIPTION: Part of the NE4 of Section 32, T3N, R65W of the 6th
P.M. , Weld County, Colorado.
LOCATION: Southwest of the intersection of Weld County Road 28 and Weld County
Road 41.
Shirley Camenisch moved Case Number USR-1021, Gerrity Oil and Gas Corporation,
be continued indefinitely because the Weld County Health Department has
determined that a Certificate of Designation will be required for the proposed
facility. The applicant feels this is not necessary and has referred the
situation to the Attorney General for their comment and review. The Attorney
General has not offered comment on this case as of August 3, 1993.

1. The Site Specific Development Plan and Special Review permit is for the
storage of sugarbeets in the A (Agricultural) zone district as submitted in
the application materials on file in the Department of Planning Services
and subject to the Development Standards stated hereon.
2. Approval of this plan may create a vested property right pursuant to
Section 90 of the Weld County Zoning Ordinance.
3. All liquid and solid wastes shall be stored and removed for final disposal
in a manner that protects against surface and groundwater contamination.
4. Any required Emissions Permit shall be obtained from the Air Pollution
Control Division, Colorado Department of Health for fugitive dust and
odors.
5. No permanent disposal of wastes shall be permitted at this site.
6. Fugitive dust shall be controlled on this site.
7. The maximum permissible noise level shall not exceed the industrial limit
of 80 dB(A) , as measured according to 25-12-102, Colorado Revised Statutes.
8. Adequate toilet facilities shall be provided for the employees. Portable
toilets are prohibited.
9. An individual sewage disposal system is required for the proposed facility
and shall be installed according to the Weld County Individual Sewage
Disposal Regulations.
10. No on-site disposal of produce of any type shall be permitted at anytime.
Produce shall be handled and stored at the facility in such a manner so
that no nuisance is created by odor, blowing of debris, fugitive dust, or
spoiled produce on or around the facility.
11. An Individual Sewage Disposal System permit must be finalized and approved
by an Environmental Protection Specialist within one (1) year of the
application date.
12. All construction activities that disturb more than five acres are required
to obtain a stormwater discharge permit from the Colorado Department of
Health, Water Quality Control Division.

13. Trucks delivering sugar beets to the site shall not exceed the posted
weight limit on the bridge to the north of the site on Weld County Road 39.
14. The approach through the radius at the site entrance and exit shall be
paved.
15. All construction on the property shall be in accordance with the
requirements of the Weld County Building Code Ordinance.
16. The property owner or operator shall be responsible for complying with the
Design Standards of Section 24.5 of the Weld County Zoning Ordinance.
17. The property owner or operator shall be responsible for complying with the
Operation Standards of Section 24.6 of the Weld County Zoning Ordinance.
18. Personnel from the Weld County Health Department and Weld County Department
of Planning Services shall be granted access onto the property at any
reasonable time in order to ensure the activities carried out on the
property comply with the Development Standards stated hereon and all
applicable Weld County Regulations.
19. The Special Review area shall be limited to the plans shown hereon and
governed by the foregoing Standards and all applicable Weld County
Regulations. Major changes from the plans or Development Standards as
shown or stated shall require the approval of an amendment of the Permit by
the Weld County Planning Commission and the Board of County Commissioners
before such changes from the plans or Development Standards are permitted.
Any other changes shall be filed in the office of the Department of
Planning Services.
20. The property owner or operator shall be responsible for complying with all
of the foregoing Development Standards. Noncompliance with any of the
foregoing Development Standards may be reason for revocation of the Permit
by the Board of County Commissioners.

Dear Mr. Thompson:
I spoke with you on August 6, 1993 regarding the recommendations from the Weld County
Department of Planning Services staff relative to Western Sugar Company's plan to develop
a new site to store sugar beets. In particular, we discussed the need for a stormwater
discharge permit relative to construction activities that disturb more than 5 acres. The beet
storage site will include about 10 acres. However, much less than one acre will actually be
disturbed by construction activities.
I discussed the planned construction activities and applicability of construction stormwater
permitting on August 9 with Ms. Kathy Dolan of the Colorado Department of Health. She
stated that the regulations do not apply since construction activities will disturb less than 5
acres, and that a Permit for Stormwater Discharges Associated with Construction Activity
is not needed. Ms. Dolan said that she would not write a letter but that she would call you
regarding this matter.
Based upon discussion with Ms. Dolan,we will not pursue a Stormwater Permit. Please call
us if you need further information or have any questions.

Your application and related materials for the request described above are
complete and in order at the present time. I have scheduled a meeting with f
the Weld County Planning Commission for August 3, 1993, at 1:30 p.m. This f
meeting will take place in the County Commissioners' Hearing Room, first
floor, Weld County Centennial Center, 915 10th Street, Greeley, Colorado.
It is recommended that you and/or a representative be in attendance to
answer any questions the Planning Commission members might have with
respect to your application.
It is the policy of Weld County to refer an application of this nature to
any town or municipality lying within three miles of the property in
question or if the property under consideration is located within the
comprehensive planning area of a town or municipality. Therefore, our
office has forwarded a copy of the submitted materials to the Ault and
Eaton Planning Commission for their review and comments. Please call

sign at the point at which the driveway (access drive) intersects a

In regards to your questions regarding USR-1020, during harvest, traffic from
the north will primarily be single—axle trucks with gross weights of 26,000 to
30,000 pounds. Traffic from the south will be primarily tandem—axle trucks
with gross weights of 40,000 to 48,000 pounds. During campaign our rehaul
trucks will be empty entering from the south, loaded and then leaving back to
the south. These will be five—axle semi trucks with 85,000 pound GVWR.
We do not have any plans to pave the approach to the pileground, but we are
open to any suggestions that you may have.

1. The structure located just north of the facility on WCR 39 is Weld
County structure 39/80.SA. This structure was inspected on March 15,
1991. This is a posted bridge with posting of 13 tons single axle,
20 tons tandem axle, and 21 tons triple axle. The applicant should
indicate the direction and the approximate weight of the trucks
hauling to the facility either from the north or from the south. We
are asking that no overweight vehicles hauling from the north on WCR
39 go across the posted bridge. They can find other routes around
the bridge to the facility.
2. We would like to see a paved approach through the radius to
accommodate the trucks pulling in and out of the facility. This
would save breaking the edge of the asphalt or cracking it next to
the pavement.

APPROVED FOR THE FOLLOWING REASONS:
1. The submitted materials are in compliance with the application requirements
of Section 24.7 of the Weld County Zoning Ordinance.
2. It is the opinion of the Department of Planning Services' staff that the
applicant has shown compliance with Section 24.3 of the Weld County Zoning
Ordinance as follows:
The proposal is consistent with the intent of the Weld County
Comprehensive Plan Urban Growth Boundary Goals and Policies. The
proposed land use is located in both the Town of Ault' s and the Town
of Eaton's Urban Growth Boundary and both towns indicated the proposal
did not conflict with their interests.
The proposed use is an agricultural service establishment and is
provided for as a Use By Special Review in the A (Agricultural) Zone
district.
The uses permitted will be compatible with the existing surrounding
land uses and with the future development of the surrounding area as
permitted by the Weld County Comprehensive Plan, the Town of Ault, and
the Town of Eaton.
No overlay districts affect the site.
Special Review Permit Development Standards will provide adequate
protection of the health, safety, and welfare of the neighborhood and
County.
This recommendation is based, in part, upon a review of the application materials
submitted by the applicant, other relevant information regarding the request, and
responses from referral entities.

The Department of Planning Services' staff recommendation for approval is
conditional upon the following:
1. The attached Development Standards for the Special Review permit shall be
adopted and placed on the Special Review plat prior to recording the plat.
The plat shall be delivered to the Department of Planning Services and be
ready for recording in the Weld County Clerk and Recorder's office within
15 days of approval by the Board of County Commissioners.
2. The Special Review activity shall not occur nor shall any building or
electrical permits be issued on the property until the Special Review plat
is ready to be recorded in the office of the Weld County Clerk and
Recorder.
3. The applicant shall obtain a Recorded Exemption to create the parcel upon
which the activity is proposed to take place. In lieu of the Recorded
Exemption, the applicant may wish to reword the lease to state that they
have the USE of the land, rather than the parcel of land itself.
4. The applicant shall obtain an adequate water supply for the site.
5. The applicant shall obtain an Emissions Permit from the Air Pollution
Control Division, Colorado Department of Health for fugitive dust and
odors. If an Emissions Permit is determined to be not necessary by the
Colorado Department of Health, then the applicant shall supply a letter
indicating this.
6. The applicant shall obtain adequate toilet facilities for the site.

1. The Site Specific Development Plan and Special Review permit is for the
storage of sugarbeets in the A (Agricultural) zone district as submitted in
the application materials on file in the Department of Planning Services
and subject to the Development Standards stated hereon.
2. Approval of this plan may create a vested property right pursuant to
Section 90 of the Weld County Zoning Ordinance.
3. All liquid and solid wastes shall be stored and removed for final disposal
in a manner that protects against surface and groundwater contamination.
4. Any required Emissions Permit shall be obtained from the Air Pollution
Control Division, Colorado Department of Health for fugitive dust and
odors.
5. No permanent disposal of wastes shall be permitted at this site.
6. Fugitive dust shall be controlled on this site.
7. The maximum permissible noise level shall not exceed the industrial limit
of 80 dB(A) , as measured according to 25-12-102, Colorado Revised Statutes.
8. Adequate toilet facilities shall be provided for the employees. Portable
toilets are prohibited.
9. An individual sewage disposal system is required for the proposed facility
and shall be installed according to the Weld County Individual Sewage
Disposal Regulations.
10. No on-site disposal of produce of any type shall be permitted at anytime.
Produce shall be handled and stored at the facility in such a manner so
that no nuisance is created by odor, blowing of debris, fugitive dust, or
spoiled produce on or around the facility.
11. An Individual Sewage Disposal System permit must be finalized and approved
by an Environmental Protection Specialist within one (1) year of the
application date.
12. All construction activities that disturb more than five acres are required
to obtain a stormwater discharge permit from the Colorado Department of
Health, Water Quality Control Division.
13. An adequate water supply shall be obtained for the site.

14. Trucks delivering sugar beets to the site shall not exceed the posted
weight limit on the bridge to the north of the site on Weld County Road 39.
15. The approach through the radius at the site entrance and exit shall be
paved.
16. All construction on the property shall be in accordance with the
requirements of the Weld County Building Code Ordinance.
17. The property owner or operator shall be responsible for complying with the
Design Standards of Section 24.5 of the Weld County Zoning Ordinance.
18. The property owner or operator shall be responsible for complying with the
Operation Standards of Section 24.6 of the Weld County Zoning Ordinance.
19. Personnel from the Weld County Health Department and Weld County Department
of Planning Services shall be granted access onto the property at any
reasonable time in order to ensure the activities carried out on the
property comply with the Development Standards stated hereon and all
applicable Weld County Regulations.
20. The Special Review area shall be limited to the plans shown hereon and
governed by the foregoing Standards and all applicable Weld County
Regulations. Major changes from the plans or Development Standards as
shown or stated shall require the approval of an amendment of the Permit by
the Weld County Planning Commission and the Board of County Commissioners
before such changes from the plans or Development Standards are permitted.
Any other changes shall be filed in the office of the Department of
Planning Services.
21. The property owner or operator shall be responsible for complying with all
of the foregoing Development Standards. Noncompliance with any of the
foregoing Development Standards may be reason for revocation of the Permit
by the Board of County Commissioners.

Gentlemen:
The Western Sugar Company, P.O. Box 9, Greeley, Colorado 80631,
352-2756 and MIKA Ag. Corp. 1099 18 St #400, Denver, CO 80202,
295-0220 wish a special use review of that property described in
attachments. The following statements outline the use of the
described parcel as per section 24.7 of the Weld County Zoning
Ordinance:
1.) The land parcel will be used to receive, pile and store
sugarbeets purchased from beet growers in the area.
2.) The pile ground is needed to receive the crop from the
area's sugarbeet producers in an efficient manner and to pile
the beets into large enough piles so as to avoid high rates of
beet shrink and quality deterioration.
3.) Surrounding properties are agricultural; crop production,
cattle feeding. and water storage.
4.) The distance to residential structures:
East— across WCR 39; South— across WCR 80;
West— 1/2 mile; North— 1/4 mile.
5.) Twenty—five sugarbeet growers have beet contracts that
specify beet delivery to this site.
6.) A maximum of five employees will work at the site to
receive the crop. Normal hours of operation are 6:30 a.m. until
6:30 p.m. Beet harvest is scheduled from Sept. 15 until harvest
completion. Most of the beet crop will be received by Nov. 1.
Sugarbeets in storage will remain until needed for processing at
the factory in Greeley. Beets are to be trucked from the piling
site as needed on a 24 hour basis. Campaign is planned for
completion by Feb. 7.
7.) Water for employee use will be brought to the site in
containers.
8.) The access route for the site will be on WCR 39 in such a
place as to prevent trucks from sitting on the road.
9.) A maximum of 350 loads per day will be dumped at the site
in trucks ranging from two axles (single axles) to five axles
(semi tractor—trailers). GVWR will be up to 8500O pounds.
10.) Portable sanitary facilities that will be screened from
view from the road will be brought to the site when people are
working there. These will be cleaned regularly to ensure that
there will be no human waste deposited on site, and eliminate
the need for an underground human waste storage facility.
11.) The site will be covered by the Ault Fire Protection
District and there will also be fire extinguishers on site.
12.) No animals are to be on the site.
13.) No waste other than trash barrels in the scalehouse will
be on the site.
14.) The pile site will riot affect the natural storm water
drainage.

15.) Trash will be removed from site as needed by Western
Sugar.
16.) No landscaping other than for the scale will be needed.
There is and will continue to be a cover crop of' alfalfa to
minimize any soil erosion.
17.) If the pileground is abandoned, the land will revert back
to farmland.
18.) The timetable for beginning construction is very critical.
Prior to this date, no satisfactory receiving station site could
be located. Western Sugar wishes to begin construction of the
scale facility as soon as a use approval is obtained. Beet
receiving is scheduled to begin Sept. 15, 1993. Western sugar,
user of the land, and MIKA Ag. Corp.. owner of the land submit
the following statements and documents.
1.) The proposed beet piling site will provide beet growers in
this part of the county an opportunity to economically market
their crop.
2.) This piling site is agriculturally related.
3.) Upon removal of equipment, the land will revert back to
crop production.
4.) Dust will be controlled by Envirotech dust control and
planted ground cover (alfalfa).
5.) Surrounding area is exclusively agriculturally related.
6.) Area is now zoned agricultural. There are no plans for
change.
7.) Special review area is not located in a flood plain,
geological hazard area, or in the Weld County airport overlay
district.
8.) See item 7 page 1 (no other water will be required).
9.) A copy of the lease agreement between Western Sugar and
MIKA Ag. Corp. is attached.
10.) No abnormal or excessive amount of noise will be created.
11.) The soil type is classified as a Thedalund Loam, 1 to 3
percent slope by the Soil Conservation Service. This is a
moderately deep, well drained soil on plains at elevations of
4900 to 5250 feet. It formed in residuum from shale. Included
in mapping are small areas of soils that have shale and
sandstone deeper than 40 inches. Typically the surface layer is
brown loam about 8 inches thick. The underlying material is
pale brown and very pale brown loam. Shale is at a depth of
about 28 inches.
Permeability and available water capacity are moderate. The
effective rooting depth is 20 to 40 inches. Surface runoff is
medium, and the erosion hazard is low.
This soil is suited to limited cropping. A suitable cropping
system is 3 to 4 years of alfalfa followed by 2 years of corn
and small grain and alfalfa seeded with a nurse crop.
Incorporating plant residue and manure improves tilth and
provides organic matter and plant nutrients.
Most irrigation methods are suitable, but the length of runs
should be short to prevent overirrigation. Light, frequent
irrigations are best. Sprinkler irrigation is desirable.

Commercial fertilizers increase yields and add to the value of
the forage produced.
In nonirrigated areas this soil is suited to winter wheat,
barley, and sorghum. Most of the acreage is planted to winter
wheat. The predicted average yield is 25 bushels per acre. The
soil is summer fallowed in alternate years to allow moisture
accumulation. Generally precipitation is too low for beneficial
use of fertilizer.
Stubble mulch farming, striperopping, and minimum tillage are
needed to control soil blowing and water erosion. Terracing
also may be needed to control water erosion.
The potential native vegetation is dominated by blue grama.
Several mid grasses, such as western wheatgrass and
needleandthread, are also present. Potential production ranges
from 1600 pounds per acre in favorable years to 1000 pounds in
unfavorable years. As range condition deteriorates, the mid
grasses decrease; blue grama, buffalograss, snakeweed, yucca,
and fringed sage increase; and forage production drops.
Undesirable weeds and annuals invade the site as range condition
becomes poorer.
Management of' vegetation on this soil should be based on
taking half and leaving half of the total annual production.
Seeding is desirable if the range is in poor condition.
Sideoats grama, little bluestem, western wheatgrass, blue grama,
pubescent wheatgrass, and crested wheatgrass are suitable for
seeding. The grass selected should meet the seasonal
requirements of livestock. It can be seeded into a clean, firm
sorghum stubble, or it can be drilled into a firm prepared
seedbed. Seeding early in spring has proven most successful.
Windbreaks and environmental plantings are generally not
suited to this soil. Onsite investigation is needed to
determine if plantings are feasible.
Rangeland wildlife, such as antelope, cottontail, and coyote,
are best suited to this soil. Because forage production is
typically low, grazing management is needed if livestock and
wildlife share the range. Livestock watering facilities also
are utilized by various wildlife species. The cropland areas
provide favorable habitat for pheasant and mourning dove. Many
nongame species can be attracted by establishing areas for
nesting and escape cover.
The underlying shale is the most limiting feature of this
soil. Neither septic tank absorption fields nor sewage lagoons
function properly. In places the underlying shale has high
shrink—swell potential. Environmental and beautification
plantings of trees and shrubs can be difficult to establish.

LEASE AGREEMENT

This agreement made this day of la&1983 between MIKA AG CORP, a Colorado
Corporation, (Lessor), and THE WESTERN SUGAR COMPANY, a Delaware Corporation,
(Lessee), WITNESSETH:
That in consideration of the covenants and agreements hereinafter set forth to be kept and
performed, Lessor has leased to Lessee, for a term and subject to the conditions set forth, the
following described parcel of land:
A parcel of land consisting of 10 acres, more or less located in the Northeast Quarter
(NE 1/4) of Section 18, Township 7 North, Range 65 West of the 6th P.M., Weld
County, Colorado,which tract is further identified on the Exhibit"A"attached hereto
and made a part hereof by reference.
In consideration of the leasing of said parcel of land, it is covenanted and agreed as follows between
the parties:
1. The rent shall be $ 400.00 per acre per year which shall be paid by Lessee to Lessor, or
his order, on or before the first day of May and every May 1 as long as this lease remains in effect.
2. Lessee will not use or permit said premises to be used for any purposes prohibited by the
laws and regulations of the United States, the State of Colorado, and the County of Weld. Lessee
shall use the premises only for a beet storage area and for no other purpose.
3. T Pccee will make no claim against the Lessor for or on account of any personal injury
sustained or any loss of damage to property howsoever caused which may arise out of the use or
occupancy by the Lessee of said premises, except as the same may be caused by the negligence of
Lessor. Lessee also agrees to save and hold Lessor harmless from every claim and demand,including
court costs and attorneys fees, made upon or against Lessor on account of the use and occupancy of
the leased premises by J Pccee, its agents, representatives and employees and customers.
4. The term of this lease shall be from May 1, 1993 to and including May 1, 1998. Lessee
or Lessor shall have the right to terminate said Lease at any time by giving Lessor or Lessee written
notice of such intention twelve (12) months in advance by mailing such notion by firs-class mail to
the address stated in Paragraph 11 below.
5. Any property or improvement placed on the said parcel of leased premises by the Lessee
is and shall remain the property of Lessee and shall be removed from the leased premises on or
before May 1, 1998. Upon the failure of Lessee to so remove such property, all such property
remaining on said leased parcel on May 2, 1998, shall remain on the leased parcel and shall become
the sole property of Lessor,or Lessor, at its election,may require I Pccee to remove any or all of such
improvements.
6. Lessee shall have the right to make necessary improvements,such as leveling,grading,and
drainage, provided such activities are approved by Lessor in advance of the work.
7. Upon termination of this lease, Lessee shall restore the leased premises to their condition
on the date hereof, including but not limited to all dikes and ditches, which restoration shall be
subject to the approval of Lessor. In case of any dispute as to the adequacy of this restoration, an
impartial arbitrator may be selected by the parties to settle the dispute.

8. During the term of this lease, Lessor shall have the right to use Lessee's scale located on
the leased premises. Upon termination of this lease, Lessor shall have the right of first refusal to
purchase said scale should Lessor desire to sell same.
9. During the term hereof, Lessee agrees to provide, at Lessee's sole cost and expense,
proper, suitable and adequate maintenance, customary for the area, of existing fencing and cable
across the access to the premises for the protection of the leased premises.
10. The Lessee or Lessor shall not assign this lease nor any right or interest therein to any
other party without the prior written consent of the other party to this Lease Agreement.
11. Any notice to Lessor shall be made by mailing, by certified mail, to Lessor at 1099 18th
Street, Suite 400, Denver, Colorado 80202, or to such other address as is furnished to Lessee by
Lessor; and any notice to Lessee shall be made by mailing, by certified mail, to Lessee's main office,
1700 Broadway, Suite 1600, Denver, Colorado 80290.
12. This lease agreement shall be fully binding upon and inure to the benefit of the parties
hereto, and their respective heirs, personal representatives, successors, and assigns.
13. Lessee shall furnish Lessor with certification of insurance and name the Lessor as an
insured party showing at all times general liability coverage of at least $1,000,000 and property
damage of at least $50,000.
