Box 300397 Denver, Colorado 80203 Mr. Cervi: We have reviewed the plan for repair of Pond B outlined in your letter of May 5, 1992, and the attached letter from Mr. Crowe. The following comments summarize our evaluation: 1. The proposed remediation plan offers no specific dates for valve repair or liner testing. We require a schedule for all aspects of the plan. 2. The time period offered to empty Pond B is much too lengthy. We require that Pond B be actively emptied by pumping, and the contents transferred to an approved facility. This process should begin immediately, and be accomplished by June 1, 1992. 3. We find no written methodology for testing the liner. We require a written document, outlining this methodology. Further, the results of the liner evaluation when completed, must be forwarded to this office for review and concurrence. In summary, we find the proposed plan does not adequately address the issues of non-compliance in an effective and timely manner. Mr. Cervi, the situation which exists at Roggen Disposal is a very serious potential health hazard and must be addressed aggressively and immediately. Consequently, you have until May 14, 1992, to address our concerns as outlined in this letter, and to begin pumping and transfer of the contents of Pond B. 4 Mr. Mike Cervi Roggen Disposal HAND DELIVERED May 11, 1992 Page 2 A follow-up inspection will be conducted on May 15, 1992. We have made arrangements for a pump to begin emptying Pond B at the Roggen Disposal on Thursday, May 14th. We will make every effort to meet your deadline of June 1, for completion of the job. We have not submitted written methodology for testing the liner because, as laymen, we do not know what those tests would involve. We shall ask Cecil Crowe, as a licensed engineer, to conduct appropriate tests on the liner as soon as that operation is feasible and I assume he will follow standard procedures in the testing process. We shall ask him to prepare a written methodology for you. The damaged valve serving Pond B has been repaired. We are faxing a copy of this letter to you today and will follow that with a hard copy by U. S. mail. The Hazardous Materials and Waste Management Division (the Division) of the Colorado Department of Health has reviewed the Cervi/Roggen Disposal, Inc. May 5, 1992 letter. The Division offers the following comments regarding the proposed remediation plan. 1. A schedule for all aspects of the remediation plan should be provided (valve repair, liner testing, etc.) . 2. Pond B should be actively emptied by pumping. The evaporation and aeration process is too lengthy. Pond B should be emptied in a matter of weeks not months. The pond continues to leak and the potential for impact the environment and human health exists. 3. The methodology for testing the liner should be specified, presented in a document and approved by Weld County and Division. Results of the liner testing should be forwarded to the County and the Division for review and concurrence. Following is our plan for remedying the concerns expressed in the letter. 1. Pond B will continue to be emptied by evaporation and an aeration system will be installed to accelerate the evaporation. An assessment will be made of the pond's liner by a Professional Engineer, registered in the State of Colorado. 2. The damaged valve serving Pond B will be repaired. 3 . A minimum three (3) feet of freeboard will be maintained in the approved pond. 4. The engineer who will evaluate the liner as soon as the pond is dry is Cecil Crowe of Alpha Engineering, Fort Lupton, Colorado. We estimate that it should be dry by September 1, 1992 I am enclosing a copy of the letter we received from Cecil Crowe following our request to him to assist us in taking care of the situation as outlined in your letter. Box 300397 Denver, Colorado 80203 Mr. Cervi: In response to the certified letter dated April 22, 1992 I suggest that you state that you will take the following action; 1 . We will continue to empty pond B by evaporation and would in stall an aeration system to accelerate the evaporation with your approval. 2. The damaged valve serving pond B will be repaired. 3. A minimum of three (3 ) feet of freeboard will be maintained in the approved pond. 4. We have contacted Cecil Crowe of Alpha Engineering, Fort Lupton, Colorado to evaluate the liner as soon as the pond is dry. We estimate that it should be dry by September 1 , 1992 if we are allowed to install the aeration equipment. 5. If aeration equipment is installed in both pond B and C it will be possible to continue to operate the facility while pond B is being drained. I am enclosing an item from the Greely Tribune, Wednesday, April 15, 1992 that states that we had the second wettest March in the last 100 years. We can prepare a plan for the aeration equipment in about a week if it is approved to use it. I will be back in Fort Lupton on Wednesday May 6, 1992. Sincerely: Cecil R. Box 300397 Denver, Colorado 80203 Weld Cod"r4 Planning Mr. Cervi: I am in receipt of a report from Trevor Jiricek of our office, regarding the inspection of your facility on April 15, 1992 and April 16, 1992. This report, along with laboratory analysis from monitoring well adjacent to Pond B, indicate that the liner in Pond B is damaged. In addition, you indicate that a valve serving Pond B is damaged. A review of the file indicates that this violation has been reported to you at least as early as April 1991. Indeed, you indicated in your letter to Commissioner Lacey of April 15, 1991, that you were taking action to empty the Pond in question, so as to assess the liner condition. I feel our approach in this matter has been quite reasonable. It appears that you however, have not proceeded with your plans for repair in a timely manner. The operation of this site in its current state, is in violation of the Colorado Solid Waste Diposal Sites and Facilities Act Regulations. You are also in violation of Development Standards #4, #12, and #17 of USR-481:81:27. Please be advised that our office requires the following action: 1. Pond B must be emptied and an assessment be made of the liner by a Professional Engineer, registered in the State of Colorado. 2. The damaged valve serving Pond B must be repaired. 3. A written plan for repair must be submitted to our office within ten (10) days of receipt of this letter. This plan must indicate name of Engineer, reasonable date for assessment, and reasonable date for repair, etc. 5. We understand that it might be impossible to maintain three (3) feet free board while Pond B is being drained. In this case, you may have to consider a temporary, voluntary closure of your facility. You are required to respond within ten (10) days of receipt of this letter. Failure to respond will result in further legal action, which may include recommendation of revocation of USR-481:81:27.
