RESOLUTION RE: APPROVE SITE SPECIFIC DEVELOPMENT PLAN AND SPECIAL REVIEW PERMIT FOR A RECREATIONAL FACILITY (ROPING ARENA) IN THE A (AGRICULTURAL) ZONE DISTRICT - ROD AND JAN STAUDINGER WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners held a public hearing on the 8th day of January, 1992, at the hour of 10:00 a.m. in the Chambers of the Board for the purpose of hearing the application of Rod and Jan Staudinger, 24507 Highway 392, Greeley, Colorado 80631, for a Site Specific Development Plan and Special Review Permit for a recreational facility (roping arena) in the A (Agricultural) Zone District on the following described real estate, to-wit: Part of the SE*, Section 18, Township 6 North, Range 64 West of the 6th P.M. , Weld County, Colorado WHEREAS, Rod Staudinger, applicant, was present, and WHEREAS, Section 24.4.2 of the Weld County Zoning Ordinance provides standards for review of said Special Review Permit, and WHEREAS, the Board of County Commissioners heard all of the testimony and statements of those present, has studied the request of the applicant and the recommendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter and, having been fully informed, finds that this request shall be approved for the following reasons: 1. The submitted materials are in compliance with the application requirements of Section 24.7 of the Weld County Zoning Ordinance. 2. It is the opinion of the Board of County Commissioners that the applicant has shown compliance with Section 24.4.2 of the Weld County Zoning Ordinance as follows: a. This proposal is consistent with the Weld County Comprehensive Plan's Agricultural Goals and Policies. The uses permitted will be directly related to agriculture and will not remove any prime agricultural land from production. b. The permitted use is consistent with the intent of the Agricultural Zone District and is provided for in the Weld County Zoning Ordinance as a Use by Special Review. c. The permitted uses will be compatible with the existing surrounding land uses which include pasture, irrigated agricultural production and rural residences. The permitted uses will be compatible with the future development of the area which is expected to remain agricultural. e. The subject parcel is located in the Flood Hazard Overlay District according to Firm Map #080266 0635C. Special Review Development Standard #9 addresses this issue. No other overlay districts affect the site. f. Special Review Development Standards will provide adequate protection of the health, safety and welfare of the neighborhood and County. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the application for a Site Specific Development Plan and Special Review Permit for a recreational facility (roping arena) in the A (Agricultural) Zone District on the hereinabove described parcel of land be, and hereby is, granted subject to the following conditions: 1. The applicant shall submit evidence that a Commercial Access Permit has been obtained from the State of Colorado, Division of Highways. A copy of the permit and the conditions of that permit shall be submitted to the Department of Planning Services' staff. 2. Within 180 days of approval of this request by the Board of County Commissioners, the applicant shall construct adequate toilet facilities served by an individual sewage disposal system installed according to the Weld County Individual Sewage Disposal Regulations. 3. Prior to recording the Special Review plat map the applicant shall amend the plat to show the boundaries of the floodplain in the Special Review area. 4. Within 30 days of approval by the Board of County Commissioners: a. the applicant shall submit written evidence that the facility is in compliance with Colorado Guidelines for feedlot runoff containment and that Weld County Environmental Protection Services has approved the feedlot runoff containment plan. b. an I.S.D.S. evaluation on any existing septic systems shall be necessary, prior to issuing the required septic permits on the existing systems. 5. The attached Development Standards for the Special Review Permit shall be adopted and placed on the Special Review plat prior to recording the plat. The plat shall be delivered to the Department of Planning Services and be ready for recording in the Weld County Clerk and Recorder's Office within 15 days of approval by the Board of County Commissioners. 920021 SPECIAL REVIEW PERMIT - STAUDINGER PAGE 3 6. The Special Review activity shall not occur nor shall any building or electrical permits be issued on the property until the Special Review plat is ready to be recorded in the office of the Weld County Clerk and Recorder. The Site Specific Development Plan and Special Review Permit is for a recreational facility (roping arena) in the A (Agricultural) Zone District as submitted in the application materials on file in the Department of Planning Services and subject to the Development Standards stated herein. 2. Approval of this plan may create a vested property right pursuant to Section 90 of the Weld County Zoning Ordinance. 3. The applicant shall remove, handle, and stockpile manure from the livestock area in a manner that will prevent nuisance conditions. The manure piles shall not be allowed to exist or deteriorate to a condition that facilitates excessive odors, flies, insect pests, or pollutant runoff. The manure storage site shall have a water-tight surface which does not permit seepage or percolation of manure pollutants into the ground. 4. All liquid and solid wastes shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 5. No permanent disposal of wastes shall be permitted at this site. 6. Wood shavings, saw dust, and waste materials shall be handled, stored, and disposed of in a manner that controls fugitive dust, blowing debris, and other potential nuisance conditions. 7. Fugitive dust shall be controlled on this site. 8. The maximum permissible noise level shall not exceed the light industrial limit of 70 dB(A) , as measured according to 25-12-102, Colorado Revised Statutes. 9. A Flood Hazard Development Permit is required for all new construction and substantial improvements of existing structures. 10. Access from Highway 392 shall be covered with an all-weather surface. All other areas, excluding the arena, shall be seeded and maintained using adaptive grasses. 11. The property shall be maintained in compliance with the Colorado guidelines for feedlot runoff containment. 12. All construction on the property shall be in accordance with the requirements of the Weld County Building Code Ordinance. 920021 DEVELOPMENT STANDARDS - STAUDINGER Page 2 13. The property owner or operator shall be responsible for complying with the Design Standards of Section 24.5 of the Weld County Zoning Ordinance. 14. The property owner or operator shall be responsible for complying with the Operation Standards of Section 24.6 of the Weld County Zoning Ordinance. 15. Personnel from the Weld County Health Department and Weld County Department of Planning Services shall be granted access onto the property at any reasonable time in order to ensure the activities carried out on the property comply with the Development Standards stated herein and all applicable Weld County Regulations. 16. The Special Review area shall be limited to the plans shown herein and governed by the foregoing Standards and all applicable Weld County Regulations. Major changes from the plans or Development Standards as shown or stated shall require the approval of an amendment of the Permit by the Weld County Planning Commission and the Board of County Commissioners before such changes from the plans or Development Standards are permitted. Any other changes shall be filed in the office of the Department of Planning Services. 17. The property owner or operator shall be responsible for complying with all of the foregoing Development Standards. Noncompliance with any of the foregoing Development Standards may be reason for revocation of the Permit by the Board of County Commissioners. 18. The public address system, or any other type of sound magnification device, shall not be used before 8:00 a.m. or after 11:00 p.m. 19. Webster Also present: Acting Clerk to the Board, Shelly Miller Assistant County Attorney, Lee Morrison Planning Department representative, Brian Grubb The following business was transacted: I hereby certify that pursuant to a notice dated December 9, 1991, and duly published December 19, 1991, in The New News, a public hearing was conducted to consider the request of Rod and Jan Staudinger for a recreational facility (roping arena) in the A (Agricultural) Zone District. Lee Morrison, Assistant County Attorney, made this a matter of record. Brian Grubb, Planning Department representative, recommended the Resolution of the Planning Commission and the Planning staff's recommendation be entered into the record as written. Mr. Grubb mentioned a memo from Clerk to the Board's Office concerning a phone call from Mrs. Rex Lawson, surrounding property owner, stating concerns about the proposed facility. Mr. Morrison explained the options to Rod Staudinger, applicant, being there were only three Commissioners present. Mr. Staudinger said he would like to proceed, but he would like to see the memo. Mr. Morrison read the memo into the record and said Mrs. Lawson had made comments at the Planning Commission meeting. In response to Mrs. Lawson's concerns, Mr. Staudinger said there has been no overnight camping associated with the roping arena. He said the facility is basically for jackpot team roping, and the bathroom facilty was inspected and approved by Wes Potter, Health Department representative. He said the cattle are penned only on weekends and the facility is kept clean. He said there will be only one roping event per week, and 4-H groups and FFA groups will be using the facility on Saturday afternoons for gymkhanas. Mr. Staudinger said he is in compliance, and the access has been inspected and approved by the State. In response to a question from Commissioner Lacy, Mr. Staudinger said he has received his permit from the State Highway Department, and sand and a water truck have been purchased for dust control. Mr. Staudinger said the only overnight camping that has taken place has been friends of the family here for the Greeley Rodeo. Mr. Morrison and Mr. Grubb clarified the Galeton Fire Protection District must legally respond to emergency calls at the arena. After further comments, Mr. Staudinger said his PA system only goes to 50 decibels, and the limit is 70 decibels or under. (Change to Tape 092-02) Barnard Geisick, surrounding property owner, said he is not opposed to the facility; however, he would like to see some restrictions concerning the PA system and the parking area. Mr. Staudinger said he was not aware there were problems, but he would be willing to comply with conditions. LEGAL DESCRIPTION: Part of the SE4 of Section 18, T6N, R64W of the 6th P.M. , Weld County, Colorado. LOCATION: North of Highway 392 and approximately 1/2 mile east of Weld County Road 49. Dave Melusky, Attorney, representative for Rod and Jan Staudinger, explained that this request is to allow Mr. Staudinger to use his agricultural property for a roping arena from April through the end of summer, for roping, steer wrestling and other rodeo activities. It is consistent with the use around it. There are no other roping arenas close, and they feel there is a need due to the number of LXH� 4311 c- SUMMARY OF THE WELD COUNTY PLANNING COMMISSION MEETING September 17, 1991 Page 2 requests for use of the facility for practice and events . Bud Clemons asked if they had seen the recommendation from the Planning staff and asked if they had any problems or questions. Dave Melusky said they questioned Condition of Approval #3. At this time, Mr. Staudinger has cattle in pasture on the property (not in excess of what's allowed) and they should not have to conform to the feedlot requirements. Brian Grubb explained that in conversation with Wes Potter, this was a State requirement and there is no distinction as far as how many head of livestock were on the property. Wes Potter is not present today to defend this position. Rod Staudinger said he has 20 head of steers out in pasture except during the events when they are in confinement, used for roping and then turned back out again. As far as the waste is concerned, it isn' t any different than any other parcel of ground around the country where cattle run on grass, so there would be no residue stockpiling up in a corral, or a confined area. Bruce Barker, Assistant County Attorney, explained the Colorado guidelines for feedlot run-off containment. This is something the applicant will have to comply with regardless of whether the Planning Commission includes it in the Use by Special Review, or not. However, if included in the Use by Special Review and there' s a violation of those regulations and guidelines , the Board of County Commissioners could then review it at a "Show Cause" hearing. He explained you don' t have to change your mode of operation just because this is a requirement. Leaving the Condition of Approval intact would not be as severe as taking it out. Don Feldhaus asked about the response from the Galeton Fire Department. Dave Melusky said they had been amazed. He thought the County Attorney was writing a memo in response. Shirley Camenisch asked if anything had been done about the commercial access permit. Dave Melusky explained they had submitted the application and the Highway Department indicated over the phone that they didn' t anticipate it would be a problem, given the numbers that were involved. Don Feldhaus asked what type of growth Rod Staudinger expected. Rod Staudinger said he anticipated none. He did not want to be any bigger. Jean Hoffman asked about restroom facilities on the property. Rod Staudinger said this had been addressed and they were in compliance. Shirley Camenisch asked about the distance the restrooms were from the arena area. Rod said they were about 250 to 300 feet. The Site Specific Development Plan and Special Review permit is for a recreational facility (roping arena) in the A (Agricultural) zone district as submitted in the application materials on file in the Department of Planning Services and subject to the Development Standards stated hereon. 2. Approval of this plan may create a vested property right pursuant to Section 90 of the Weld County Zoning Ordinance. 3. The applicant shall remove, handle, and stockpile manure from the livestock area in a manner that will prevent nuisance conditions . The manure piles shall not be allowed to exist or deteriorate to a condition that facilitates excessive odors, flies, insect pests , or pollutant runoff. The manure storage site shall have a water-tight surface which does not permit seepage or percolation of manure pollutants into the ground. 4. All liquid and solid wastes shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 5. No permanent disposal of wastes shall be permitted at this site. 6. Wood shavings, saw dust, and waste materials shall be handled, stored, and disposed of in a manner that controls fugitive dust, blowing debris, and other potential nuisance conditions. 7. Fugitive dust shall be controlled on this site. 8. The maximum permissible noise level shall not exceed the light industrial limit of 70 dB(A) , as measured according to 25-12-102, Colorado Revised Statutes. 9. A Flood Hazard Development permit is required for all new construction and substantial improvements of existing structures. 10. Access from Highway 392 shall be covered with an all-weather surface. All other areas, excluding the arena, shall be seeded and maintained using adaptive grasses. 11. Barker, Assistant Weld County Atty Refusal by Galeton Fire Protection District to Subject Provide Emergency Medical Services tor Accinents in the Louise of nvelftb Puibua,iL Lu U.S.R. 955. It is my understanding that pursuant to the Galeton Fire Protection District ' s August 15, 1991, letter, that the District plans to refuse to respond to accidents in the course of events held pursuant to U.S.R. 955 on the property owned by Rod and Jan Staudinger. A copy of Galeton' s letter is attached hereto. Section 32-1-1002 ( 1 ) (c) , C.R.S . , states an additional power for the board of any fire protection district is " (c) to undertake and to operate as part of the duties of the fire protection district and ambulance service, and emergency medical service, a rescue unit, and a diving and grappling service; " (emphasis added) . Frankly, I do not see how the Galeton Fire Protection District can legally refuse to respond with emergency medical services to accidents in the course of events which occur on property within the District. Please note that the word "duties" is underlined in the above stated section. I underlined this word because it emphasizes the fact that once the District undertakes the task of providing emergency medical services, it then is obligated to provide that service to all taxpayers, regardless of what they may be doing on their property. I would think that the Galeton Fire Protection District would understand that to intentionally refuse to respond to accidents which occur during certain events on property located within its District in all likelihood constitutes an intentional tort. The normal immunities which are provided by the Colorado Governmental Immunities Act and the normal official immunity for board members may not apply for that decision. They are proposing to use the present facility for recreational rodeo and horse events, including practice and jackpot events, special events and other related events. The total acreage of the Staudinger's property is ten (10) acres, with one (1) acre being used for the arena area, one (1) acre being used for parking, and the remaining eight (8) acres continuing in its present use, including dryland pasture, barn and corral and residence. The property will remain in compliance with existing agricultural zoning restrictions, with respect to the number of animal units allowed on their acreage. The thirty (30) to fifty (50) head of steers for the events will be provided by the Staudingers from their current livestock inventory and it is possible that an additional twenty five ( 25) to forty (40) head may be brought in and used for the events and then removed from the premises. NEED FOR USE Presently there are not any similar facilities available in the immediate area and there is a need for one. The Staudingers have received numerous inquiries, not only for staged events, but for a use of the arena for practice. EXISTING USES ON SURROUNDING PROPERTIES All of the surrounding area is zoned agriculture; there is one individual residence in the surrounding square mile area in addition to the Staudinger's private residence. The proposed use of this facility for rodeo/horse events is a use that is consistent with the use of all of the surrounding area. DISTANCE TO RESIDENTIAL STRUCTURES IN EACH DIRECTION The nearest residence to the east is s mile, to the west i mile, to the north 1 mile and to the south 1,000 feet. MAXIMUM NUMBER OF USERS, PATRONS The expected normal operation of the facility will be two (2 ) to four (4) sessions a week, with the possibility of additional sessions for special events. The sessions will consist of steer roping, steer wrestling events and barrel racing. The estimated number of users and spectators at any one time is fifty (50) . Other normal uses will be for practicing the above events and for training. NUMBER OF EMPLOYEES AND HOURS OF OPERATION It is not anticipated that there will be any paid employees and the proposed schedule of operation is Wednesday evenings, Friday evenings and Saturday or Sunday afternoons. WATER SOURCE FOR PROPOSED USE The water source for the property is North Weld County Water District. The only anticipated use of water would be for livestock, and adequate stock tanks will be provided. Water used for dust control will be from waste water irrigation applied by a water truck that will be sufficient for wetting down the arena, parking area and driveway to control any dust problems. The entrance and driveway is gravel and the additional parking areas are pasture, and therefore dust problems will be minimal. ACCESS ROUTE TO BE UTILIZED FOR THE PROPOSED USE Access to the facility will be via Colorado Highway 392 east of Lucerne. The Colorado Highway Department has approved a commercial access permit for the facility. TYPE, SIZE, WEIGHT AND FREQUENCY OF VEHICULAR TRAFFIC Vehicular traffic will consist of pickups, horse/stock trailers and passenger cars, and the estimated number of vehicles per session is forty (40) . SEWAGE FACILITIES A regular restroom facility with a septic system will be available for patrons of the arena. The facility is a separate building already constructed on the site. (See map for exact location. ) FIRE PROTECTION MEASURES There are no plans for any additional structures at the facility. Fire extinguisher will be placed at strategic locations on the premises. TYPE AND SIZE OF ANY WASTE, STOCKPILE OR STORAGE AREAS Manure will be stockpiled on the premises and will be used for fertilizer of the dryland pasture acreage. STORM WATER RETENTION FACILITIES Runoff water and waste from the arena will flow south and west, and will run off into an existing runoff ditch to the south of the arena. TIME SCHEDULE AND METHOD OF REMOVAL AND DISPOSAL OF DEBRIS, JUNK AND OTHER WASTES Trash receptacles will be provided and placed for easy access by the users. A commercial trash removal company will be retained for weekly trash removal. cy. 'g n LANDSCAPING PLANS AND EROSION CONTROL Landscaping and erosion is not anticipated to be a problem, as the area is now in pasture and will continue to be used as pasture in the future. RECLAMATION PROCEDURES TO BE EMPLOYED UPON CESSATION OF THE USE Reclamation of the arena area will be the return of the area to pasture in the event the arena is abandoned. TIME TABLE FOR CONSTRUCTION AND START-UP The arena has already been constructed for the private use of the Staudingers and they would like to start the public use of the facility in August of 1991, as the season for these events are held in the summer months in this area. STATEMENT RE: WELD COUNTY COMPREHENSIVE PLAN The Staudinger's feel that the proposed use is consistent with the Weld County Comprehensive Plan for the following reasons: 1. The "use" does not remove "prime" agriculture land from use. The arena is located on a piece of land that is not irrigated. 2 . The arena has not destroyed any natural features and will provide a more productive use of this tract of land. 3 . The traffic impact will be acceptable. During the week, the impact will not be excessive and on weekends, the impact will not be major as the normal traffic will be less. 4 . The proposed facility will provide a clean, recreational use with a minimum amount of improvements and impact. CONSISTENCY WITH THE INTENT OF THE DISTRICT The proposed use is consistent with the intent of the Agricultural Zoning District. The use is non-industrial and will have a minimal affect on the agricultural area. Through this Use By Special Review process, there will be adequate controls. WHAT EFFORTS HAVE BEEN MADE TO CONSERVE AGRICULTURAL LAND This particular piece of land is dryland pasture and with the exception of the arena area will remain as pasture. PROVISIONS FOR THE PROTECTION OF HEALTH, SAFETY & WELFARE OF THE NEIGHBORHOOD The users of the facility for the most part will be members of the immediate community who are involved in rodeo, ranching and agricultural activities. Gravel will be used in the arena and parking area to assist with dust control and a water will also be used to control any dust problems. Insect control will be taken care of as needed by spraying. If emergency assistance is needed, the facility is served by the Galeton Fire Protection District and Weld County Ambulance Service. COMPATIBILITY WITH EXISTING SURROUNDING LAND USES The surrounding area is used for various agricultural related enterprises and this is also an agricultural use of the land. FUTURE COMPATIBILITY WITH SURROUNDING AREA It is not anticipated that the use of the area will change from agriculture in the near or far future. This property is located eight (8) miles from the northeast Greeley City limits and most of Greeley's development has been to the west and that is not expected to change. FLOOD PLAIN, GEOLOGIC HAZARD, AIRPORT OVERLAY The nearest river is greater than ten (10) miles from the property and the property does not lie in the flood plain. There are no geologic hazards that are known at this time and the property does not lie in an airport overlay. PROOF OF WATER SUPPLY A letter from North Weld County Water District is attached, stating that they will be able to supply the water needs for livestock (and dust control) . Since the existing width along this property is apparently 30 feet north of the centerline, additional width to meet the projected need should be protected by reservation or dedication, as permitted by County regulations. An Access Permit will be necessary for this property due to the change of use of the property causing an increase of more than 20% in traffic using the access. At this time, no "Approved Commercial Access Permit" has been issued by the Colorado Department of Transportation for this property. An application for an Access Permit has been forwarded to the office of the agent for the applicants. At such time that the application has been completed and returned to this office, a determination will be made whether or not the access permit can be issued, and the conditions of that permit. Changes In use or design not approved by the permit or the issuing authority may cause the revocation or suspension of the permit. I Appeals 1. Should the permittee or applicant chose to object to any of the terms or conditions of the permit placed therein by the Department, an appeal must be filed with the Colorado Transportation Commission within 60 days of transmittal of the permit for permittee signature.The request for the hearing shall be filed in writing and submitted to the Colorado Transportation Commission,4201 East Arkansas Avenue, Denver, Colorado 80222.The request shall include reasons for the appeal and may include recommendations by the permittee or applicant that would be acceptable to him. 2. The Department may consider any objections and requested revisions at the request of the applicant or permittee. If agreement is reached,the Department,with the approval of the local issuing authority(if applicable),may revise the permit' accordingly,or issue a new permit,or require the applicant to submit a new application for reconsideration.Changes in the original application, proposed design or access use will normally require submittal of a new application. 3. Regardless of any communications, meetings, or negotiations with the Department regarding revisions and objections to the permit,if the permittee or applicant wishes to appeal the Department's decision to the Commission,the appeal must be brought to the Commission within 60 days of transmittal of the permit. 4. Any appeal by the applicant or permittee of action by the local issuing authority when it is the appropriate local authority (under subsection 2.4), shall be filed with the local authority and be consistent with the appeal procedures of the local authority. 5. If the final action is not further appealed,the Department or local authority may record the decision with the County Clerk and Recorder. II Construction standards and requirements 1. The access must be under construction within one year of the permit date. However, under certain conditions a one year time extension may be granted if requested in writing prior to permit expiration. 2. The applicant shall notify the office specified on the permit at least 48 hours prior to construction.A copy of the permit shall be available for review at the construction site. Inspections will be made during construction. 3. The access construction within highway right-of-way must be completed within 45 days. 4. It is the responsibility of the permittee to complete the construction of the access according to the terms and conditions of the permit. If the permittee wishes to use the access prior to completion, arrangements must be approved by the issuing authority and Department and included on the.permit. The Department or issuing authority may order a halt to any unauthorized use of the access. Reconstruction or improvements to the access may be required when the permittee has failed to meet required specifications of design or materials. If any construction element fails within two years due to improper construction or material specifications,the permittee is responsible for all repairs. 5. In the event it becomes necessary to remove any right-of-way fence,the posts on either side of the access shall be securely braced with an approved end post before the fence is cut to prevent any slacking of the remaining fence.All posts and wire removed are Department property and shall be turned over to a representative of the Department. - 6. A copy of the permit shall be available for review at the construction site.If necessary;minor changes and additions shall be ordered by the Department or local authority field inspector to meet unanticipated site conditions. 7. The access shall be constructed and maintained in a manner that shall not cause water to enter onto the roadway,and shall not interfere with the drainage system in the right-of-way. 8. Where necessary to remove, relocate,or repair a traffic control device or public or private utilities for the construction of a permitted access,the work shall be accomplished by the permittee without cost to the Department or issuing authority,and at the direction of the Department or utility company.Any damage to the state highway or other public right-of-way beyond that which is allowed in the permit shall be repaired immediately. 9. Adequate advance warning is required at all times during access construction,in conformance with the Manual on Uniform Traffic Control Devices for Streets and Highways.This may include the use of signs,flashers,barricades and flaggers.This is also required by section 42-4-501,C.R.S. as amended.The issuing authority, the Department and their duly appointed agents and employees shall be held harmless against any action for personal injury or property damage sustained by reason of the exercise of the permit. III Changes in use and violations • 1. If there are changes in the use of the access,the access permit-issuing authority must be notified of the change.A change in property use which makes the existing access design or use in non-conformance with the Access Code or the terms and conditions of the permit,may require the reconstruction or relocation of the access.Examples of changes in access use are; an increase in vehicular volume by 20 percent,or an increase by 20 percent of a directional characteristic such as a left turn. The issuing authority will review the original permit;it may decide it is adequate or request that you apply for a new permit. 2. All terms and conditions of the permit are binding upon all assigns, successors-in-interest and heirs. 3. When a permitted driveway is constructed or used in violation of the Access Code,the local government or Department may obtain a court order to halt the violation. Such access permits may be revoked by the issuing authority. IV Further information 1. When the permit holder wishes to make improvements to an existing legal access, he shall make his request by filing a completed permit application form with the issuing authority.The issuing authority may take action only on the request for improvement. Denial does not revoke the existing access. 2. The permittee,his heirs,successors-in-interest,and assigns,of the property serviced by the access shall be responsible for meeting the terms and conditions of the permit and the removal or clearance of snow or ice upon the access even though deposited on the access in the course of Department snow removal operations. The Department shall maintain in unincorporated areas the highway drainage system,including those culverts under the access which are part of that system within the right-of-way. 3. The issue date of the permit is the date the Department representative signs the permit which is after the permittee has returned the permit signed and paid any required fees. 4. The Department may,when necessary for the improved safety and operation of the roadway, rebuild, modify, remove,or redesign the highway including any auxiliary lane. 5. Any driveway, whether constructed before, on, or after June 30, 1979, may be required by the Department, with written concurrence of the appropriate local authority,to be reconstructed or relocated to conform to the Access Code,either at the property owner's expense if the reconstruction or relocation is necessitated by a change in the use of the property which results in a change in the type of driveway operation; or at the expense of the Department if the reconstruction or relocation is necessitated by changes in road or traffic conditions.The necessity for the relocation or reconstruction shall be determined by reference to the standards set forth in the Access Code. EXHIBIT A DESIGN 1.o Driveway shall be constructed 35 feet wide with 20 foot radii , as per Exhibit "B". 2. The access approach shall be surfaced immediately upon completion of earthwork construction and prior to being used. 3 Surfacing shall consist of 2 inches of ABC Class 6 and shall extend from the highway travelled way to the right of way line. Specifications for these materials are attached. 4. The first 20 feet beyond, the closest highway lane, including speed change lanes, shall slope down and away from the highway at a 2% grade to ensure proper drainage control . 5. The horizontal axis of the access shall be at a right angle to the centerline of the highway and extend a minimum of 40 feet beyond the outside edge of the nearest lane. 5. An access that has a gate across it shall be designed so that the longest vehicle using it can completely clear the travelled way when the gate is closed. 7. The side slopes of the access approach shall be 6:1 or flatter. 8. Drainage to the State Highway right of way shall not exceed the historical flow. 9. An adequate length of 18-inch corrugated metal pipe exists. 10. If frost is present in the sub-grade, no surfacing material shall be placed until all frost is gone or removed. 11. Owner is responsible for any utilities disrupted by the construction of this driveway and all expenses incurred for repair. 12. Survey markers present must be preserved in their original positions. Notify 350-2173 upon discovery of any such markers. 13. Accesses which require a beak in the right of way fence shall not allow livestock to enter the highway right of way. 4.
