"d .o'-+;f'ryf # +ZY `Js ..x ^4' RESOLUTION RE: APPROVE SITE SPECIFIC DEVELOPMENT PLAN AND AMENDED SPECIAL REVIEW PERMIT FOR AN OVERNIGHT SHELTER FOR HOMELESS PEOPLE IN THE A (AGRICULTURAL) ZONE DISTRICT - CATHOLIC COMMUNITY SERVICES WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners held a public hearing on the 4th day of August, 1993, at the hour of 10:00 a.m. in the Chambers of the Board for the purpose of hearing the application of Catholic Community Services, 1311 11th Street, Greeley, Colorado 80631, for a Site Specific Development Plan and Amended Special Review Permit for an overnight shelter for homeless people in the A (Agricultural) Zone District on the following described real estate, to-wit: Lot 9 and portions of Lots 1 and 10, Espanola Subdivision, Weld County, Colorado WHEREAS, at said hearing on August 4, 1993, said matter was continued to August 11, 1993, at 10:00 a.m. , and WHEREAS, at said hearing on August 11, 1993, said applicant was represented by Jerry Kiefer, President of the Board of Catholic Community Services Northern, and WHEREAS, Section 24.4.2 of the Weld County Zoning Ordinance provides standards for review of said Amended Special Review Permit, and WHEREAS, the Board of County Commissioners heard all of the testimony and statements of those present, has studied the request of the applicant and the recommendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter and, having been fully informed, finds that this request shall be approved for the following reasons: 1. The submitted materials are in compliance with the application requirements of Section 24.7 of the Weld County Zoning Ordinance. 2. It is the opinion of the Board of County Commissioners that the applicant has shown compliance with Section 24.4.2 of the Weld County Zoning Ordinance as follows: a. The proposal is consistent with the Weld County Comprehensive Plan because the proposed amended use is located in an urban growth boundary area and consistent with the intent of the original Special Review Permit. Land-use development proposals within an urban growth boundary area are encouraged so long as they conform to the desires of the municipality as expressed in its comprehensive plan or its land-use decision- making body and if the municipality has agreed to provide services. The Greeley Planning Commission has recommended no objections to the proposal. The City of Greeley provides water and sewer services to the property. 930782 pi..bl03 ( � SPECIAL REVIEW PERMIT - CATHOLIC COMMUNITY SERVICES PAGE 2 b. The proposed use is consistent with the intent of the A (Agricultural) Zone District and is provided for as a Use by Special Review Permit. c. The proposed amendment will be compatible with the existing surrounding land uses and the future development of the surrounding area. The existing surrounding land uses include rural residences, a church and a small grocery store in Espanola Subdivision, oil and gas production, irrigated crops, pasture, and a gravel mine and batch plant. d. The property does not contain productive agricultural land. Espanola Subdivision existed prior to the adoption of the County's land-use regulations. Weld County and the City of Greeley recognize the subdivision as a non-conforming subdivision. e. The property is located in the A-P (Airport) Overlay District. Structures associated with the Special Review Permit will have to conform to the regulations of this district. No other overlay districts affect the site. f. Special Review Permit Development Standards will provide adequate protection of the health, safety, and welfare of the neighborhood and County. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the application for a Site Specific Development Plan and Amended Special Review Permit for an overnight shelter for homeless people in the A (Agricultural) Zone District on the hereinabove described parcel of land be, and hereby is, granted subject to the following conditions: 1. The attached Development Standards for the Amended Special Review Permit shall be adopted and placed on the Special Review plat prior to recording the plat. The plat shall be delivered to the Department of Planning Services and be ready for recording in the Weld County Clerk and Recorder's Office within 15 days of approval by the Board of County Commissioners. 2. The Site Specific Development Plan and Amended Special -Review -Permit is for a Site Specific Development Plan and an Amended Special Review Permit for an overnight shelter for the homeless with a maximum number of 4D occupants in the A (Agricultural) Zone District as submitted in the application -materials on Tile in the Department of Planning Services and subject to the Development Standards stated herein. 2. Approval of this plan may create a vested property right pursuant to Section -90 of the Weld County Zoning Ordinance. 3. a minimum of tight off-street parking spaces shall be provided on the property. The spaces shall be constructed in accordance with Section 41. 1.2 of the Weld County Zoning Ordinance. No parking shall occur within -25 feet _from the front property line (North 25th Avenue) , 20 feet from the back property line (North 25th Avenue Court) , and five feet from the north and south property lines. 4. Ingress and egress to the property shall be restricted to North 25th Avenue. 5. No parking shall be permitted on North 25th Avenue Court or North 25th Avenue by persons employed at or using the shelter :facility. 6. A minimum oT 25 percent gross lot area shall be maintained as open space on the property. 7. All construction on the -property shall be in accordance with the requirements of the Weld County Building Code Ordinance. 8. The property owner or operator shall be responsible for complying with the Design Standards of Section 24.5 of the Weld County Zoning Ordinance. 9. The-property owner or operator shall be -responsible for complying with the Operation Standards of Section 24.6 of the Weld County Zoning Ordinance. 10. Tersonnel from the Weld County Health -Department, -Western Hills Fire Protecti-on District and Weld I;ounty Department of -Planning Services shall be granted access onto the property at any reasonable time in order to ensure the activities carried out on the property comply with the Development Standards stated herein and all applicable Weld County Regulations. 930782 DEVELOPMENT STANDARDS - CATHOLIC COMMUNITY SERVICES PAGE 2 11. Harbert, Chairman Commissioner W. H. -Webster, Pro-Tem Commissioner George E. Baxter Commissioner Dale K. Hall Commissioner Barbara J. Kirkmeyer - Excused Also present: Acting Clerk to the -Board, Shelly Miller Assistant County Attorney, Lee Morrison Planning Department representative, Greg Thompson The following business was transacted: I hereby certify -that pursuant to a notice dated July 14, 1993, and duly published July 22, 1993, in the Windsor Beacon, a public hearing was conducted to consider the request of Catholic Community Services for a Site Specific Development Plan and Amended Special Review Permit for an overnight shelter for homeless people in the A (Agricultural) Zone District. Lee Morrison, Assistant County Attorney, mate this a matter of record and indicated this hearing had been continued from August 4, 1993, to allow the applicant to post the necessary sign. Greg Thompson, Planning Department representative, entered the favorable recommendation of the Planning Commission into the record as written. Jerry Kiefer, President of the Board of Catholic Community Services Northern, stated this Permit is needed for expansion and remodeling of the facility. In response to a question from Commissioner Hall, Mr. Kiefer said he had no problems with the _Conditions of Approval and Development Standards. Chairman Harbert stated she feels this is a very good project and is working out very well. Mr. Kiefer said he appreciates the cooperation of staff and indicated this is -a necessary facility. Commissioner -Hall moved to approve the -request of Catholic Community Services for a Site Specific Development Plan and Amended Special Review Permit for an overnight shelter for homeless people in the A (Agricultural) Zone District, based on the recommendations of the Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards as entered into the -record. The motion was seconded by Commissioner Baxter. There was-no public testimony offered concerning this matter. After Chairman Harbert explained that, in the case of a tie vote, Commissioner Kirkmeyer would cast the deciding vote after reviewing the record, the motion carried unanimously. Bill O'Hare _asked if the shelter is open 365 days per year. Jerry Keifer stated yes, but it Is not always full. Gill -Ramirez stated that the shelter is usually 902 full, they are closed from 7:00 a.m. to 7:00 p.m. Jerry Keifer stated that there will to little impact on 25th -Avenue because most People walk or are brought 'be county bus. The hours they are open no not conflict with heavy traffic times. Bill D'-Hare asked if there was any problems with the Department of Planning Services' staff recommendation. Jerry -Keifer -stated they had no problems. Morrison and Thompson: I am writing this letter to express my concern to you about the way the zoning approval was handled recently for Catholic Community Services-Northern and the Guadalupe Center Homeless Shelter. As a neighbor to the Guadalupe Center,I have directed some concerns about the center to the director, Gil Ramirez,but to date those concerns have gone un-addressed. When I became aware of plans to expand the shelter, I appreciated the fact that there would be a public hearing where I could air my concerns before the County Commissioners and the Planning Boards. I have been very disappointed-about how these meetings were held. The original meeting occurred while I was out-of-town on a long planned vacation. The second and as I understand it,final public hearing on the issue was held on August 11, 1993 at 10:00 a.m. The second meeting was originally scheduled for August 4, 1993,but was postponed until August 11, 1993 because the posting requirements(time)had not been met by Catholic Community Services. The posted sign stated that the meeting was to be held on August 11, 1993 at 10:00 p.m. rather than at 10:00 a.m. Because I went to the meeting place at 10:00 p.m. only to find out that the meeting had been held earlier, I retrieved the sign and took it to the Planning Offices to prove that there had indeed been an error in the posting. It is ironic that the reason this hearing was not held on August 4, 1993 was because this sign had not been posted in enough time. I appreciated the response and explanations I received from you,Mr. Thompson. I do not,however, appreciate the stance that the County is taking in that you would not order a-re-hearing unless I filed a motion for re-hearing. The purpose for the regulations in changing planning and zoning, i.e.posting requirements,public hearings,etc. are so that the party requesting a change can do so within the proper limits of the law and with proper notice to their neighbors. For the County to require a postponement of the August 4th hearing because the posting requirements had not been met,and then-to allow the results of the August 11th meeting to stand even though those posting requirements had still not been met(wrong time on sign)showsan inconsistency in following it's own procedure that,frankly, I find appalling. When we last spoke,you indicated thaLdue to funding shortages,you could not afford to leave the center open for people to use the-facilities around the clock. You also stated that you could not even afford renting a portable toilet for use in the center parking lot. Since that time,it has come to light that there are plans in action to expand the center. Let me ask you then, if you could-not even afford to-accommodate the people you currently can have at the center(20 maximum allowable)how is it you can now afford to expand the building you are currently in to serve twice as many people? There are also the problems of litter from the center, residents at the center giving the children a hard time,and the disruption of emergency calls on occasion. it is my position that youshould first do something to address the concerns of the residents of the Colony before you seek to enhance the problem by inviting more people into the area. The Center, it seems, is here to stay. We're neighbors,why.don't we act like neighbors and work together to live in harmony within the same community. Since the error in the posted sign regarding the final public hearing on expansion of the Center, it has come to my attention that the Guadalupe Center is violating a number of county regulations. The maximum number of allowable people_on the property is twenty. A recent article in the Greeley Tribune statedlhat you have been allowing 23 people to stay at the center,not to mention the other 20+that sleep in and on their cars in the-parking lot. Those that are staying in the parking lot have-been using the rest of the Colony as their restroom. The county has chosen to ignore these violations unless someone such as myself files a written complaint. I do not wish to file a complaint because these homeless people-need a place to stay. It is fine with me if they stay in their cars or in the parking lot,just make arrangements for them so they do not have to continue to use our fence as a restroom and trash can. If making a complaint to the county is the way to get yourattention that we want something done to address this problem,then we can do that but it would only seek to divide us more as a community. I found it difficult to assess the site plan without further development plans for the structure. Items of concern regarding this proposed improvement which is a admirable undertaking of a needed project; 1 . Fire department access is not provided to the structure from the North 25th Avenue proposed access. Parking is proposed directly in front of what appears to be the main entrance. 2 . The proposed addition is within 5' of the property line. This is of great concern in correlation with the proposed use of the structure. Many of the people utilizing the structure will he unfamiliar with the building layout, and egress ways even with an escape plan posted. 3 . The water supply problem in the area creates serious concern with the occupancy type, occupancy load, and close proximity to other unprotected structures. There is a fire hydrant located at N. 25th Avenue and "M" Street which is unacceptable for fire protection use. 4 . If approved the building would most likely require a fire alarm system be installed. 5. The owners should be aware that with the proposed addition the current structure will be required to meet current code. Until construction plans are submitted it is difficult to determine code requirements. We would like to see this project completed provided these items of concern can be addressed. WELD COUNTY REFERRAL FOR AN AMENDED SPECIAL REVIEW PERMIT TO ALLOW AN OVERNIGHT SHELTER FOR HOMELESS PEOPLE Greg Flebbe, Planner II, advised that this request would allow Catholic Community Services to amend its special review permit with Weld County to remodel and expand the Guadalupe Center. The center currently provides shelter to 20 homeless individuals. Approval of this proposal would increase the operation to be able to serve 40. The center is located at O Street and 25th Avenue. Mr. Flebbe asked the Commission to consider three Comprehensive Plan polices relative to this request: (1) Housing is to be provided for be all incomes levels; (2) Development along major thoroughfares should enhance the visual appeal of the city; and (3) Access is to be limited to collector and arterial roadways. Mr. Flebbe advised that staff has found that this request presents no major conflicts with any of these policies. Mr. Flebbe advised that a spokesman from the Rodarte Center said that an expansion of the Guadalupe Center would probably lessen the number of people sleeping in the park. Mr. Flebbe advised that staff would request that a 10-foot landscaped strip would be added along 25th Avenue. Mr. Flebbe advised that since 25th Avenue is not classified as either a collector or an arterial roadway, the Public Works Department has no comment with regard to this request. Mr. Flebbe concluded by recommending that Planning Commission approve the proposal with a 10-foot landscaped strip adjacent to 25th Avenue. Henry Epstein, Planning Administrator, noted that because this is a remote site, there are no transportation or other support services in the area. Commissioner de Besche asked if the City has a homeless shelter. Mr. Flebbe advised that it does not and that the Guadalupe Center currently provides shelter for 30 percent of the area 's homeless. The applicant was represented by Ernest Giron and Jerry Kiefer. Mr. Giron advised that he would prefer to locate the facility within the city, if that were possible. Mr. Kiefer, board member of Catholic Community Services/Northern, echoed Mr. Giron's comment. He said that the expansion is needed as the center currently turns away as many clients as it serves. WELD COUNTY REFERRAL FOR A REZONE FROM C-1 (COMMERCIAL) TO I-3 (INDUSTRIAL) Greg Flebbe, Planner II, advised that the area of the proposed rezone is east of 8th Street and south of 4th Street. The applicant proposes to change the zone from County C-1 to 1-3 in order to allow him to store oilfield equipment. Mr. Flebbe advised that the applicant and City staff had discussed zoning the site I-2 as I-2 zoning would allow much of the same uses as the I-3 zone but would allow less visual impact than the I-3 zone. Mr. Flebbe advised that the key issue for the Commission to consider is whether the proposal complies with the City's Comprehensive Plan. He asked the Commission to keep in mind the issues of compatibility and visual impact. In conclusion, Mr. Flebbe recommended that the Commission find that the proposed rezone to I-3 does not comply with the City's Comprehensive Plan and to recommend that the site be rezoned to County I-2 . This is a request to remodel and expand the existing Guadalupe Center which is being used as an overnight homeless shelter. For the past six years the Guadalupe Center has been used to shelter up to 20 people a night. The center currently provides shelter for 43 percent of all people seeking housing for the homeless in the Greeley area. Men and women would be segregated in separate dormitories with accommodations for a family in one room. A dining and living room is jointly used. The shelter is open 365 nights per year from 7 : 00 p.m. to 7: 00 a.m. The shelter is not open during daytime hours. Policy 4.8 All development is encouraged to have limited access onto collector and arterial roadways with access limited to the safest locations. Staff Response: As a general principal, limited access is recommended for collector and arterial roadways. This -would include renovation of two existing bathrooms to include an additional shower in each; addition of a family sleeping room (6-8 beds) and additional adjoining bath; two female rooms (6 beds each); storage area for supplies; and expansion of living/dining room area. The property is located at 1516 -North 25th Avenue Court. It is currently being used as an overnight homeless shelter for people with no housing available and will continue to be used as same. Due to addition, the only available access to the property is North 25th Avenue. Currently there is access to a small portion of the property from North 25th Avenue Court. Currently the only access to the major portion of the to the east of the structure is North 25th Avenue. For the past 6 years the property has been used as a homeless shelter providing accommodations Tor 20 people. There is a critical need for additional space for accommodating the homeless. In 1992, 5,315 nights of shelter and 12,073 meals were provided for 765 homeless people. In addition 802 people -were turned away because of lack of space. Weld Information A. Referral Service (WIRS) statistics show that in 1992, 1,797 homeless individuals were provided 17,834 nights of shelter by facilities in Weld County. Catholic Community Services Northern (Guadalupe Center) provided 30% of the total nights for 43% of the total homeless housed. The existing use of properties to the west are a church and single family residential. Use of properties to the south are single family residential with a neighborhood grocery store being directly to the south. Use of property to the north and east is agricultural. There are residential structures - within 100 feet to the south and west. This shelter is operated by Catholic Community Services Northern and with the addition would provide sleeping quarters for 40 people. Ken and women would be segregated in separate dormitories -with accommodations for a family in one room. A Jointly used dining/living room is available. A full time shelter coordinator oversees the operation. Three night staff rotate 12 hour shifts throughout the week with on-call back-up staff -available when necessary. The shelter is open 365 nights per year from 7:00 p.m. to 7:00 a.m. It is not open during daytime hours. 330'78+Z The City of Greeley Water and Sewer Department provides water and sewer services to the property known as Lot 9 and 10, and part of Lot 1, water account located at 1516 N. 25th Avenue Court. The address has a 5/S" water and 4" sewer service and is billed on a quarterly basis. It is proposed that the access be from North 25th Avenue. Current access to the property from the west from North 25th Avenue Court allows access to only part of the property. There is a barrier (a large tree) barring access to the east portion of the property by this route. The property immediately north of the existing building is owned by the Assembly of God Church and is not available for purchase by Catholic Community Services Northern. The proposed addition to the existing structure would be on the current access from North 25th Avenue Court. Currently the only access to the eastern portion of the property is from North 25th Avenue. -Access from North 25th Avenue Court, in addition to the fact that it accesses only part of the property, is a grave safety hazard to the residents in the area. The road is very narrow and not lighted. There are many small children in the area and during the summer months especially, they are out in the road area at night. Traffic on this route poses a danger to them. During the hours which the shelter is open (7:00 p.m. to 7:00 a.m.) there is light traffic on North 25th Avenue. The truck traffic which is there during business hours is not present during these hours. Primary traffic is local residents. Automobiles would be the type of traffic entering the property. The City of Greeley Water and Sewer Department provides water and sewer services to the property. The pr-operty has a 5/8" water and 4" sewer service. Fire protection is provided by Western Hills Fire Protection district. Smoke detectors and fire extinguishers are currently installed in the facility and would be installed in the proposed addition. A map of the building showing fire exits is displayed prominently for occupant's use. There will be no animals kept on the property. There would be no storage of wast-e, trash, debris, or Junk on the property. Commercial trash hauling service would be used for removal of same. There is natural water drainage on the property.
