HomeMy WebLinkAbout920895.tiff RESOLUTION RE: APPROVE PURCHASE OF SERVICE AGREEMENT BETWEEN FAMILY EDUCATIONAL NETWORK OF WELD COUNTY AND SCHOOL DISTRICT RE-5J AND AUTHORIZE CHAIRMAN TO SIGN WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board has been presented with a Purchase of Service Agreement between the Family Educational Network of Weld County (FENWC) and Weld County school District RE-5J, commencing September 8, 1992, and ending May 31, 1993, with the further terms and conditions being as stated in said agreement, and WHEREAS, after review, the Board deems it advisable to approve said agreement, a copy of which is attached hereto and incorporated herein by reference. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the Purchase of Service Agreement between the Family Educational Network of Weld County and Weld County School District RE-5J be, and hereby is, approved. BE IT FURTHER RESOLVED by the Board that the Chairman be, and hereby is, authorized to sign said agreement. Kirb County Attorney G c / , W. ebster 920895 PR Cu :1 ac,: NPR, Rg-S3 PURCHASE OF SERVICES THIS AGREEMENT, made and entered into this 1st day of September 1992, by and between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Weld County Division of Human Resources ' Family Educational Network of Weld County, hereinafter referred to as "FENWC", and the Weld School district RE-5J, hereinafter referred to as "School District". WITNESSETH THAT FOR AND IN CONSIDERATION OF the covenants herein agreed to be kept and performed, the School District hereby leases and agrees to provide unto Head Start the following described premises and services based upon the following terms and conditions: 1. The School district agrees to provide classroom space at the Milliken Elementary School, Milliken, Colorado, for the rental amount of Two Hundred Dollars ($200) per month. The classroom space will be made available for one (1) daily Head Start session, beginning September 1, 1992, and ending May 31, 1992, contingent upon the School District's state requirements. Billing for rent shall be made monthly and may be made with the school lunch billing referenced in item 3 below. 2. The School District agrees to provide bus transportation for the Head Start children who live on the regular bus routes within the School District's boundaries, and the Head Start children who do not live on the regular bus route. There will be no transportation charge for those children on the regular bus routes. The charges for those children not on the regular bus routes will be $8.00 per child per month, not to exceed the total charge of $450.00 during the time frame referenced in item 1 above. Billing for transportation shall be made monthly and may be made with the school lunch billing referenced in item 3 below. 3. The School District agrees to provide hot lunches to the Head Start class- room at the price of $1.60 per meal. The School District will submit a bill by the 10th of the month for all services provided (space/transport- ation/meals) during the preceding month, to Weld County Division of Human Resources, P.O. Box 1805, Greeley, Colorado 80632. The term of this Agreement shall be from September 8, 1992 through May 31, 1993. 4. The School district agrees to provide meals in accordance with the regulations of the United Stated department of Agriculture's Child Care Food Program as shown in Attachment A of this Agreement. 5. Head Start agrees to notify the School District within the first hour of the beginning of the school day if there is a variance in the number of meals needed for that day. Head Start shall notify the School District the day before holidays and vacations that meals will not be needed for that specified day(s) . 920395 6. Thorough and complete custodial care shall be provided by the School District daily. This service is provided as part of the rental agreement stipulated in item 1. 7. FENWC agrees to provide telephone service for the FENWC staff for any telephone service installed in the Milliken Elementary School. 8. FENWC agrees to pay the above mentioned and agreed upon price for all classroom space, transportation, and meals served to the Head Start children, staff, and volunteers. The reimbursement for all such services will be made within three (3) weeks of receipt of a statement of charges from the School District. 9. FENWC agrees that it will throughout the term of this Agreement comply with the rules and regulations of the School District in effect from time to time as they may affect the Head Start children. 10. The School District and FENWC mutually agree that this Agreement may be modified, provided thirty (30) day written notice is provided to the other party. Any modifications made to this Agreement must be agreed upon in writing and signed by appropriate officials. 11. The School District and FENWC mutually agree to accept that this agreement may be terminated by either party upon a thirty (30) day written notice being provided to the other party. This Agreement will terminate immed- iately in the event of a loss of funding to the FENWC Program. 12. Assurances: a. The School District agrees that it is an independent contractor and that its officers, employees, and clients do not become employees of Weld County, and therefore are not entitled to any employee benefits as Weld County employees, as a result of the execution of this Agreement. b. FENWC, the Weld County Board of Commissioners, its officers and employees, shall not be held liable for injuries or damages caused by any negligent acts or omissions of the School District, the School Board of District RE-5J, its employees, volunteers, or agents while performing this Agreement. The School District, the School Board of District RE-5J, its officers and employees, shall not be held liable for injuries or damages caused by any negligent acts or omissions of FENWC, or its employees, volunteers, or agents while performing functions as described in this Agreement. The School District shall provide adequate liability and workers' compensation insurance for all of its employees, volunteers and agents engaged in the performance of this Agreement, as required by the Colorado Workers' Compensation Act. Likewise, FENWC, by and through the Board of Weld County Commissioners, shall provide adequate liability and workers' compensation insurance for all employees of FENWC engaged in the performance of this Agreement. 9AS x'95 c. No officer, member, or employee of the Weld County and no member of their governing bodies shall have any pecuniary interest, direct or indirect, in the approved Agreement or the proceeds thereof. d. The School District understands that monitoring and evaluation of the performance of this Agreement shall be conducted by the Weld County Division of Human Resources and the results provided to the Weld County Board of Commissioners. e. The School District and FENWC assure compliance with Title VI of the Civil Rights Act of 1986, and that no person shall, on the grounds of race, creed, color, sex, handicap, or national origin be excluded from participation in, be denied the benefits of, or be otherwise subjected to discrimination under the approved Agreement. IN WITNESS WHEREOF, the parties hereunto have caused this Agreement to be duly executed as of the day and year first hereinabove set forth. Speckman, Executive Director 920395 ATTACHMENT A Lunch or Supper The minimum amounts of food components to be served as lunch or supper as set forth are as follows: Food Components Age 3 up to 6 MILK 1 Milk, fluid 3/4 cup VEGETABLES AND FRUITS Vegetable(s) and/or fruit(s)-2 1/2 cup total BREAD AND BREAD ALTERNATIVES-3 Bread 1/2 slice or Cornbread, biscuits, rolls, muffins, etc.-4 1/2 serving or Cooked pasta or noodle products 1/4 cup Cooked cereal grains or an equivalent quantity of any combination of bread/bread alternative 1/4 cup MEAT AND MEAT ALTERNATIVES Lean meat/poultry or fish -5 1 1/2 oz. or Cheese 1 1/2 OZ. or Eggs 1 egg or Cooked dry beans or peas 3/8 cup or Peanut butter or an equivalent of any combination of meat/meat alternative 3 tbsp. 1-For purposes of the requirements outlined in this subsection, a cup means a standard measuring cup. 2-Serve two or more kinds of vegetable(s) and/or fruit(s) .
