AND MARYANNE PENNOCK WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners held a public hearing on the 26th day of June, 1991, at the hour of 10:00 a.m. in the Chambers of the Board for the purpose of hearing the application of Phil B. and Maryanne Pennock, 0329 Highway 56, Berthoud, Colorado 80513, for a Site Specific Development Plan and Special Review Permit for a livestock confinement operation (an 80,000 head turkey brooding facility and a 150 head dairy) in the A (Agricultural) Zone District on the following described real estate, to-wit: Ei SW! Section 18, Township 4 North, Range 68 West of the 6th P.M. , Weld County, Colorado WHEREAS, Phil B. Pennock, applicant, was present, and WHEREAS, Section 24.4.2 of the Weld County Zoning Ordinance provides standards for review of said Special Review Permit, and WHEREAS, the Board of County Commissioners heard all of the testimony and statements of those present, has studied the request of the applicant and the recommendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter and, having been fully informed, finds that this request shall be approved for the following reasons: 1. The submitted materials are in compliance with the application requirements of Section 24.7 of the Weld County Zoning Ordinance. 2. It is the opinion of the Board of County Commissioners that the applicant has shown compliance with Section 24.4.2 of the Weld County Zoning Ordinance as follows: a. The proposal is consistent with the Urban Growth Boundary Area Goals and Policies as set forth in the Weld County Comprehensive Plan. A representative of the Town of Berthoud stated, in the Town's May 29 referral response, that the Town's Planning Commission and Board of Trustees had recommended approval of this request. b. The proposal is consistent with the intent of the Agricultural Zone District and is provided for as a Use by Special Review. PL0840 910552 P1_O340 GC. The uses which would be permitted will be compatible with the existing surrounding land uses which include agricultural production, rural residences, and a large dairy. The uses which would be permitted will be compatible with the future development of the surrounding area as permitted by the Agricultural Zone District and with the future development of the surrounding area as permitted by the Town of Berthoud. d. The applicant has demonstrated a diligent effort to minimize the removal of productive agricultural land in the locational decision for the proposed use. e. No overlay districts affect the site. f. Special Review Permit Development Standards will provide adequate protection of the health, safety, and welfare of the neighborhood and County. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the application for a Site Specific Development Plan and Special Review Permit for a livestock confinement operation (an 80,000 head turkey brooding facility and a 150 head dairy) in the A (Agricultural) Zone District on the hereinabove described parcel of land be, and hereby is, granted subject to the following conditions: 1. The attached Development Standards for the Special Review Permit shall be adopted and placed on the Special Review plat prior to recording the plat. The plat shall be delivered to the Department of Planning Services and be ready for recording in the Weld County Clerk and Recorder's Office within 15 days of approval by the Board of County Commissioners. 2. The Special Review activity shall not occur nor shall any building or electrical permits be issued on the property until the Special Review plat is ready to be recorded in the office of the Weld County Clerk and Recorder. 3. Prior to recording, the Special Review Permit plat shall be amended to show the existing mobile home and the elimination of proposed access on the west property line. 4. Within 30 days of approval by the Board of County Commissioners, the applicant shall provide evidence to the Department of Planning Services' staff, that the Weld County Health Department has determined the existing dairy to be in compliance with the Colorado Guidelines for Feedlot Run-off Containment. 910552 Page 3 RE: USR - PENNOCK 5. Within 30 days of approval by the Board of County Commissioners, an I.S.D.S. Evaluation shall be performed by the Weld County Health Department on any existing septic systems, prior to issuing the required septic permits on the existing systems. 6. Prior to the public hearing with the Board of County Commissioners, the applicant shall submit evidence to the Department of Planning Services' staff that the plan for disposal of run-off pond effluent for the proposed facilities has been approved by the Weld County Health Department. The Site Specific Development Plan and Special Review Permit is for a livestock confinement operation (80,000 turkeys and a 150 head dairy) in the A (Agricultural) Zone District as submitted in the application materials on file in the Department of Planning Services and subject to the Development Standards stated herein. 2. Approval of this plan may create a vested property right pursuant to Section 90 of the Weld County Zoning Ordinance. 3. The applicant shall remove, handle, and stockpile manure from the livestock area in a manner that will prevent nuisance conditions. The manure piles shall not be allowed to exist or deteriorate to a condition that facilitates excessive odors, flies, insect pests, or pollutant runoff. The manure storage site shall have a water-tight surface which does not permit seepage or percolation of manure pollutants into the ground. 4. The facility shall be operated and maintained in compliance with the Colorado Guidelines for Feedlot Run-off Containment. The applicant shall comply with all State Health Department requirements for construction and operation of a dairy. Run-off retention and containment facilities shall be designed by a registered professional engineer, reviewed and approved by the Weld County Health Department, and constructed in compliance with State statutes. 5. All liquid and solid wastes shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 6. No permanent disposal of wastes shall be permitted at this site. 7. Wood shavings, sawdust, and waste materials shall be handled, stored, and disposed of in a manner that controls fugitive dust, blowing debris, and other potential nuisance conditions. 8. Fugitive dust shall be controlled on this site. 9. In the event that an employee or employees are hired, who do not live on the site, an employee restroom with adequate toilet facilities serviced by an approved sewage disposal system, shall be provided for the proposed facility and the system shall be installed according to the Weld County Individual Sewage Disposal Regulations. The employee restroom septic system shall be designed by a Colorado Registered Professional Engineer according to the Weld County Individual Sewage Disposal Regulations. 910552 Page 2 RE: DEVELOPMENT STANDARDS - PENNOCK 10. The property shall be maintained in compliance with Sections 45. 1 and 47 of the Weld County Zoning Ordinance. 11. All construction on the property shall be in accordance with the requirements of the Weld County Building Code Ordinance. 12. The property owner or operator shall be responsible for complying with the Design Standards of Section 24.5 of the Weld County Zoning Ordinance. 13. The property owner or operator shall be responsible for complying with the Operation Standards of Section 24.6 of the Weld County Zoning Ordinance. 14. Personnel from the Weld County Health Department and Weld County Department of Planning Services shall be granted access onto the property at any reasonable time in order to ensure the activities carried out on the property comply with the Development Standards stated herein and all applicable Weld County Regulations. 15. The Special Review area shall be limited to the plans shown herein and governed by the foregoing Standards and all applicable Weld County Regulations. Major changes from the plans or Development Standards as shown or stated shall require the approval of an amendment of the Permit by the Weld County Planning Commission and the Board of County Commissioners before such changes from the plans or Development Standards are permitted. Any other changes shall be filed in the office of the Department of Planning Services. 16. The property owner or operator shall be responsible for complying with all of the foregoing Development Standards. Lacy, Chairman Commissioner George Kennedy, Pro-Tem Commissioner Constance L. Harbert Commissioner C. W. Kirby Commissioner W. H. Webster Also present: Acting Clerk to the Board, Shelly Miller Assistant County Attorney, Lee Morrison Planning Department representative, Lanell Swanson The following business was transacted: I hereby certify that pursuant to a notice dated May 13, 1991, and duly published June 13, 1991, in The New News, a public hearing was conducted to consider the request of Phil B. and Maryanne Pennock for a Site Specific Development Plan and Special Review Permit for a livestock confinement operation (an 80,000 head turkey brooding facility and a 150 head dairy) in the A (Agricultural) Zone District. Lee Morrison, Assistant County Attorney, made this matter of record. Lanell Swanson, Planning Department representative, recommended the Resolution of the Planning Commission and the Planning staff's recommendation be entered into the record as written. Phil B. Pennock, applicant, was present, and stated they were agreeable to this. Mr. Pennock said there has been an existing dairy on the property for approximately 30 years. He said he does not plan to increase the number of head of cattle, unless the turkey brooding facility does not work. Ms. Swanson said their decision was based on staff recommendation, and the 57 acres owned by the Pennocks is sufficient for 150 head. Mr. Pennock said he would like Development Standard #10, regarding the painting of the buildings to house the turkeys, changed. He said his reason for this is because he needs to have a galvanized roof for control of heat. Mr. Pennock submitted a picture, as Exhibit H, of the proposed building. Ms. Swanson said she feels said Development Standard can be removed with no problem. Commissioner Kirby asked if the whole acreage owned by the Pennocks would be used for the Permit. Ms. Swanson said it would. Arthur Roy, Attorney representing Mr. and Mrs. Enright whom are surrounding property owners, stated concerns regarding drainage, the large number of animals, odor, and loose debris and feathers. He also said even though the area is zoned agricultural, many parcels are subdivided, and the area is becoming more residential. Mr. Roy answered questions of the Board regarding Newell Lake and the Enrights' property. Anna May Hilton, surrounding property owner, spoke on behalf of herself and her mother in favor of said facility. Mr. Pennock said, in respect to the drainage, they will be building a holding pond for run-off containment; and the manure from the turkey brooding facility will be dry material and wood chips. He also said they have existing fly control for the dairy. In response to a question from Commissioner Harbert, Mr. Pennock said the turkeys will only be on site from the age of one day to five weeks; therefore, there will be very minimal feathers. The feathers that do fall off will be inside the building and mixed with the wood chips to be used for fertilizer. Mr. Pennock, in response to a question from Commissioner Webster, said Longmont Foods will be transporting the turkeys. Commissioner Lacy questioned the access road. Mr. Pennock explained there will only be one main access road, which is the original access. We cannot understand the Planning Commission ' s decision when an application calling for 80 , 000 turkeys and 150 head of dairy cows are placed on only 57 . 3 acres ; where the Weld County standards of animal units only allow a maximum of 200 birds /acre (total-11 , 460 birds ) or four cows / acre (total-229 cows ) in agricultural zoning . The approval of this application would grant 7 times the allowable animal units for turkeys and cows . Why are the health and enviromental factors suddenly allowed to be 7 times less stringent than the original animal unit /acre standards ? We do not understand how Weld County health and enviromental standards can fit such a wide variance in number of animal units /acre . What are now the health and enviromental standards in Weld County? When does a family farm become an agricultural industry? This application far exceeds the agricultural zoning standards . Why is it so easy for an applicant for a Special Review Permit to set the numerical limits for animal units /acre ? Weld County has set the agricultural and health standards hopefully with careful study and consideration before making the animal unit/acre guidelines . What are the limits ? We no longer know . Who sets the standards , the applicant or the county? We no longer know . In section 18 , there are 29 residences and another 15 residences facing section 18 from across the four perimeter roads . This density should also be considered . LEGAL DESCRIPTION: Part of the E2 SW4 of Section 18, T4N, R68W of the 6th P.M. , Weld County, Colorado. LOCATION: North of Colorado Highway 56, approximately .25 miles east of Weld - County Road 1. Phil and Doug Pennock, applicants, explained this would be a turkey brooding facility. The young turkeys would range from 1 day to 5 weeks old and then be removed. They want to stay agricultural and the turkeys would be in addition to the dairy they already own and operate. Ann Garrison asked if they had contacted people in the vicinity. Phil Pennock said they spoke with all of the surrounding property owners who had sent letters and explained they were not increasing the dairy, just adding the turkeys. Shirley Camenisch asked how the turkeys would be housed. Phil Pennock said they would be totally confined in a low nice looking building so there would be no noise and the flies would be controlled. Bud Clemons asked Lanell Swanson to explain how animals per acre was figured. Lanell Swanson said a cow was considered 1 animal unit, whereas turkeys are considered .02 of an animal unit. 200 turkeys per acre is allowed if no other livestock is on the property. Jean Hoffman asked what preparations the Pennocks were making for the handling of the turkeys. Phil Pennock said they had been raising animals all their lives. They have been working closely with Longmont Foods and have hands on experience and have the approval from the Weld County Health Department and Highway Department. Bud Clemons asked if they had contracted with Longmont Foods. Phil Pennock said yes. Doug Pennock explained the turkeys would produce 1/4 of the manure the cows do. Farmers in the area would take alot of it but they would have to stockpile it at certain times of the year. They have worked with the Health Department on this issue. The Pennock application for 80 , 000 birds on 57 . 3 acres exceeds the present regulations by 68 , 540 animals : On top of that , Pennocks want 150 cows . It is our understanding that the present regulations allow four cows per acre OR 200 birds per acre , or a combination of birds and cows that does not include the maximum number of BOTH . Section 18 , T4N, R68W of the 6th PM Weld County happens to be one of the most heavily populated agriculturally zoned sections in the county . We have counted 29 residences in section 18 and 15 additi- onal residences facing section 18 across the four perimeter roads . Our concern about the hugely excessive number of animals the Pennocks are proposing for their property are the same as the eleven points addressed by Mr . Since the existing width along this property is less than the desired 75 feet north of the centerline, additional width to meet the projected need should be protected by reservation, or, preferably, dedication, as permitted by County regulations. A site review of the property was conducted and it was found that there are at least three existing accesses to the property. Due to the anticipated increase in truck traffic, as a result of the turkey poult operation, it will be necessary for the owners to obtain an Access Permit for the property. That permit will require that the number of accesses to the property be in compliance with the State Highway Access Code. To comply with the Code, no more than one access will be allowed to the property from State Highway 56, with the single family dwellings and the agricultural businesses using an internal road system to be located at the site of one of the existing accesses or it may be at a new location, with the other accesses obliterated, but the owners will only be allowed one access to the state highway from the property. If there are any new utility lines or connections within the right of way, Mr. Henry Rangle of this office should be contacted at 350-2111 prior to any work to determine the need for a Utility Permit. The applicant shall remove, handle, and stockpile manure from the livestock area in a manner that will prevent nuisance conditions. The manure piles shall not be allowed to exist or deteriorate to a condition that facilitates excessive odors, flies, insect pests, or pollutant runoff. The manure storage site shall have a water-tight surface which does not permit seepage or percolation of manure pollutants into the ground. 2. The facility shall be in compliance with the Colorado Guidelines for Feedlot Runoff Containment, prior to final approval of the proposed use. 3. The applicant is required to submit a plan for disposal of run off pond effluent. This plan shall be reviewed and approved by the health department prior to the hearing before the Planning Commission. 4. All liquid and solid wastes shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 5. No permanent disposal of wastes shall be permitted at this site. 6. Wood shavings, saw dust, and waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, blowing debris, and other potential nuisance conditions. 7. Fugitive dust shall be controlled on this site. 8. An I.S.D.S. Evaluation on any existing septic systems will be necessary, prior to issuing the required septic permits on the existing systems. 9. An employee bathroom with adequate toilet facilities serviced by an approved sewage disposal system, are required for the proposed facility and shall be installed according to the Weld County Individual Sewage Disposal Regulations. 10. The employee restroom septic system is required to be designed by a Colorado Registered Professional Engineer according to the Weld County Individual Sewage Disposal Regulations. 11.
