RE: APPROVAL OF RECORDED EXEMPTION NO. 1577 - RICHARDSON
WHEREAS, the Board of County Commissioners of Weld County, Colorado,
pursuant to Colorado statute and the Weld County Home Rule Charter, is vested
with the authority of administering the affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners, pursuant to its authority under
Section 30-28-101(10) (d) , CRS, as amended, did determine at a public meeting held
in the Chambers of the Board, that a certain parcel of land, to be divided into
two parcels, as shown on the plat known as Recorded Exemption No. 1577, does not
come within the purview of the definition of the terms, "subdivision" and
"subdivided land", and
WHEREAS, :.he request for Recorded Exemption No. 1577 was submitted by
Howard V. Richardson, 21990 Weld County Road 62, Greeley, Colorado 80631, for
property which is located in part of the NE-`, of Section 16, Township 4 North,
Range 64 West of the 6th P.M. , Weld County, Colorado, being more particularly
described in the plat which shall be provided by the applicant and known as
Exhibit "A", said plat to be recorded, and
WHEREAS, this request is to divide the property into parcels estimated to
be approximately 10 acres and 145 acres.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the hereinabove described parcel of land be, and hereby
is, exempt from the definition of the terms, "subdivision" and "subdivided land".
BE IT FURTHER RESOLVED by the Board that this approval is conditional upon
the following:
1. A Weld County septic permit is required for the proposed home septic
system and shall be installed according to the Weld County
Individual. Sewage Disposal System (ISDS) Regulations.
2. An existing septic system which is not currently permitted through
the Weld County Health Department will require an ISDS evaluation
prior to the issuance of the required septic permit.
3. An ISDS shall be located at least 100 feet from any well .
4. The applicant shall submit a mylar plat to the Department of
Planning Services to be recorded in the office of the Weld County
Clerk and Recorder. The plat shall be prepared in accordance with
the requirements of Section 11. 7 of the Weld County Subdivision
Ordinance. The plat shall be submitted within sixty days from the
date of approval by the Board of County Commissioners. The
applicant shall be responsible for paying the recording fees.

Dear Commissioners:
The present recorded exemption request is submitted by Howard V. Richardson. The
parcel of land on which this request is being made is described as Lot B of RE-86,
which is part of the NE4 of Section 16, T4N, R64W, of the 6th P.M. , Weld County,
Colorado. The property is located southwest of the intersection of Weld County Road
55 and Weld County Road 46. The request is to divide an approximate 155 acre parcel
into 10 and 145 acre parcels. This is the second request for a recorded exemption
on this quarter section. Central Weld County Water District serves the proposed 10
acre site, and indicate they have no conflict with their interests to serve the other
lot. The proposed small lot is currently served by a septic system, and septic could
potentially serve the large lot.
The Department of Planning Services' staff recommends approval of this recorded
exemption application, since the proposal does not remove any additional prime
agricultural land from production, and conforms to the Weld County Comprehensive
Plan. In addition, the proposal is compatible with existing land uses. This
proposal, in this location, will have only a minor potential impact on the
surrounding properties and character of the area. The improvements which will be
exempted are already existing. If this proposal is approved, the potential for a
single-family dwelling on the 145 acre parcel would exist. However, this potential
addition to the area will create only a minor impact. This proposal is in harmony
with efficient and orderly development and is consistent with the Agricultural zone
district.
The application materials suggest the proposal is in compliance with the recorded
exemption standards which are listed in the Subdivision Ordinance. Additionally, the
proposal provides adequate provision for the protection of the health, safety, and
welfare of the inhabitants of the neighborhood and the County. Due to the stated
reasons, the Department of Planning Services' staff recommends approval for this
case.

CENTRAL WELD COUNTY WATER DISTRICT, on my/our property described as follows
situate in Weld County, Colorado, to wit:
Parcel "A" of Recorded Exemption NO. 1053-16-1RE86, recorded November 9,
1973 in Book 703 as Reception No. 1624507, Weld County Records, located
in the NE4 of Section 16, Township 4 North, Range 64 West of the 6th P.M. , in Weld
County, Colorado aka: 21509 Weld County Road 55, Kersey, CO 80644
It is understood that these taps were purchased for the above• described lands
and may not be transferred to other lands, without express, written consent,
in addition to the below consent, of the CENTRAL WELD COUNTY WATER DISTRICT.
I/we further authorize the Secretary of said District to do any and all things
necessary to effectuate this transfer on the books and records of said District.
I/we hereby state that all water rates and charges and other monies owed to
the District have been paid and if not, shall be held out at the closy of
the sale of my premises.
