APPROVED WITH CONDITIONS The Department of Planning Services has determined through the review that the standards of Section 9-2 E. (1) (a) through (m) of the Weld County Subdivision Regulations have been met. This Recorded Exemption is approved with the following conditions in accordance with information submitted in the application and the policies of the County. A Weld County septic permit is required for the proposed home and its septic system shall be installed according to the Weld County Individual Sewage Disposal System (ISDS) regulations. An ISDS evaluation by the Weld County Health Department on all existing septic systems will be necessary prior to issuing the required septic permits on the existing systems. The applicant shall submit a mylar plat to the Department of Planning Services to be recorded in the office of the Weld County Clerk and Recorder. The plat shall be prepared in accordance with the requirements of Section 9-2 C. (4) of the Weld County Subdivision Regulations. The plat shall be submitted within sixty (60) days from the date of approval by the Department of Planning Services. The applicant shall be responsible for paying the recording fees. The Recorded Exemption plat shall show a 50 foot right-of-way reservation west from the centerline of 95th Avenue (Weld County Road 25) and a 75 foot right-of-way reservation south from the centerline of Highway 34. The purpose and reason for this proposal is to enable Mrs. Rogakis to separate the existing improvements from the family farm and continue living there after the death of her husband Alex Rogakis . This had been their home since they purchased the farm in 1974 and Mr. Rogakis operated the farm until the time of his death. Mrs . Rogakis is not in a position to continue to operate the farm and has decided to sell the farmland but wishes to retain her home and surrounding improvement area which includes a garage, barn, machine shed, and a small corral area along with other misc. supporting outbuildings . We have received an offer from a local individual to purchase the farm and they would like to continue operating the farm. Mrs . Rogakis assumed responsibility of the existing mortgage on the property and this proposal would provide needed assistance to her financially. 5 . The integrity of the policies of the Weld County Comprehensive Plan would not be jeopardized by this proposal as an additional lot will not appreciably alter the nature, use or make-up of this agricultural land. New construction would only be single family dwelling and other agriculturally related structures . Furthermore, the proposed split would be in compliance with applicable state and county regulations. 6 . The lots created by this proposal will remain agricultural in use as well as agriculturally zoned, and this proposal is consistent with the intent of the zone district in which they are located. 7 . To remain compatible with the existing land uses, only those uses presently permitted on the surrounding properties will be permitted on the proposed parcels . 8 . In applying for the Recorded Exemption we are not seeking a land use variance or any change in zoning so the proposed split would not hinder future development as projected by either the County or nearby municipalities .
