HomeMy WebLinkAbout940993 RESOLUTION RE: APPROVE CONTRACT FOR PURCHASE OF SERVICES AND ADDENDUM BETWEEN FENWC AND SCHOOL DISTRICT 6 AND AUTHORIZE CHAIRMAN TO SIGN WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board has been presented with a Contract for Purchase of Services and Addendum between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of Family Educational Network of Weld County, and Weld County School District 6, commencing September 30, 1994, and ending June 10, 1995, with further terms and conditions being as stated in said contract, and WHEREAS, after review, the Board deems it advisable to approve said contract and addendum, copies of which are attached hereto and incorporated herein by reference. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the Contract for Purchase of Services and Addendum between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of Family Educational Network of Weld County, and Weld County School District 6 be, and hereby are, approved. BE IT FURTHER RESOLVED by the Board that the Chairman be, and hereby is, authorized to sign said contract and addendum. Kirkm er 940993 1.).- 006,- ed L : fi c(3 e2-z-0 CONTRACT FOR PURCHASE OF SERVICES THIS AGREEMENT, made and entered into this /D13 day of 44 12d , 1994, by and between Weld County School District Six, of 811 15th Street, Greeley, Colorado 80631, hereinafter referred to as "DISTRICT #6," Contractor, and Family Educational Network of Weld County, of P.O. 1805, Greeley, Colorado 80631, hereinafter referred to as "FENWC", Contractee. RECITAL DISTRICT #6 has been given the responsibility for providing certain preschool education services under P.L. 99-457 and the Colorado Preschool Program, Section 22-28-101, Colorado Revised Statute, hereinafter referred to as "CPP". DISTRICT#6 and FENWC wish to establish a written agreement for the provision of the services, and in consideration of the mutual benefits, responsibilities and considerations set forth herein, the parties covenant and agree as follows: SCOPE AND PURPOSE The purpose of this Contract for Purchase of Services between DISTRICT #6 and FENWC is to establish the terms, conditions and responsibilities of the parties, in connection with the providing of certain preschool education services under P.L. 99-457 and "CPP" by FENWC for DISTRICT#6. This collaboration is to provide a fully inclusive educational preschool program for three to five year old children identified as having developmental delays in one or more areas of development and who are eligible for said services under the guidelines of P.L. 99-457 and "CPP". DESCRIPTION OF THE PROGRAM This program, hereinafter referred to as The Community-Based Preschool Program was • conceptualized as a way to meet the needs of developmentally delayed children and their families within the community of Greeley/Evans. The program is an effort to serve children in a variety of natural environments including childcare and preschools. The total program provides each child with three or four half days of preschool education per week or equivalent and any Special Education support as designated on the child's Individual Education Program. For example, Speech-Language Therapy, Occupational Therapy, Early Childhood Special Education Support, etc. I . The DISTRICT #6 Special F&._.:ation Support Services Staff Mix 1.40 FTE Speech- • Language Pathologists , 5.10 FTE Early Childhood Special Education Support Teachers, .85 FTE Occupational Therapists, .59 FTE Nurse, .64 FTE Paraprofessional and 1.00 FTE Coordinator. Physical Therapy is contracted through North Colorado Medical Center. These staff members provide services at the child's preschool site, utilizing an integrated services approach. Each child has access to individual, small group and/or consultation (with teacher or parent) services as needed. The program presently serves up to 200 CPP children and 120 children with disabilities whose programs are provided by five community preschools and two District#6 preschools. Additional vendors may be identified in the future. The vendors used are appropriately licensed and endorsed under the guidelines of the Department of Social Services. I. SERVICES TO BE PROVIDED AT FENWC SITES 1. DISTRICT #6 will provide the following services: A. Supervision and evaluation of the Speech-Language Pathologists, Early Childhood Special Education Support Teachers, Occupational Therapists, Nurse, Paraprofessionals and Coordinator and provide a written evaluation of each; B. Coordination activities for the preschool programs; C. Assure Due Process Procedures under P.L. 94-142; D. The total number of students served will vary depending on the childcare needs and/or parent request; E. Services at the following sites will be addressed in a separate contract regarding site utilization and service agreement: East Memorial (4), Jefferson (2), Dos Rios (4), Centennial (4), Madison (4), Martinez (4) 2. FENWC will provide and meet the following services and parameters: A. At a minimum, provide three, one half days of preschool education for 99-457/Head Start eligible students (105 days) and four, one half days of preschool education for CPP eligible students (144 days) or equivalent; B. Provide a balanced, rich educational program which includes developmentally appropriate learning activities in the following areas: social/self-esteem, fine and gross motor,perceptual, cognitive, speech and language development; - ter ay p . • n C. Session composition will be determined by FENWC to 45-CFR 1304, • 1305, 1306 and 1308 Head Start Regulations and follow 'Best Practices' established by the National Association of the Education of Young Children (NAEYC) of no more than 15% children with disabilities per classroom. D. Teacher/adult ratio per section will be: - 1 teacher with a minimum Child Development Associate Certificate - 1 paraprofessional/teacher assistant; E. Students must be in program membership by October 1, 1994 per Colorado Department of Education's requirements; F. Obtain and maintain appropriate license from the Department of Social Services; G. Held accountable to the Colorado Department of Education's Quality Standards For Early Childhood Care and Education Services, and to complete a preliminary assessment using the Standards by December 1, 1994; H. If school based, conform to the individual rules/procedures of the school (school calendar, conference schedule, playground schedules, staff meetings, and attendance routines). and to maintain appropriate communication with school leadership; I. Offer two parent/teacher conferences per year, with dates similar to school calendars; J. Offer at least one home visit per student per year; K. Maintain appropriate portfolios or documentation as defined by school district personnel (daily attendance, anecdotal records, records of progress with IEP goals and objectives); L. Provide for the transition of new students into programming and exiting students out of programming; M. Provide one staff member to participate in Special Education staffings; N. Provide one staff member to participate in one collaborative screening per month (DISTRICT #6 will provide training in the screening procedures); and • O. Classroom teachers will participate in one collaborative team planning/training session per month. k y 4 3 s,. t � , Q. CONSIDERATION A. The maximum number of slots/students awarded to FENWC for the 1994-95 school year will be as follows: - 72 Colorado Preschool, awarded by DISTRICT #6 - 30 Special Education/Head Start eligible children referred by DISTRICT#6; B. FENWC shall bill DISTRICT #6 for the student contact services referred to above on a monthly basis. The billing shall be made by the 5th of each month, with the payment due from DISTRICT #6 to FENWC by the 15th of each month. The payment by DISTRICT #6 is contingent upon FENWC satisfactorily providing all services set forth in this agreement. The consideration is established at$11.82 per day 3 1/2 hrs. per day for 128 school days for Colorado Preschool Project Children (not to exceed $1,512.00 per slot) and at $10.50 per day 2 1/2 hrs per day for 105 days for Special Education children (not to exceed $1,102.50 per slot). The last bill must be submitted by June 10, 1995 with the payment due from DISTRICT #6 to FENWC by the end of June; C. FENWC shall bill DISTRICT #6 for $55.00 per student membership for educational supplies and materials, not to exceed total amount of slots/students awarded; and D. FENWC will be eligible to requisition through DISTRICT #6 Capital Reserve budget no more than $101.00 per student membership, not to exceed the total amount of slots/students awarded. The final approval of the Capital Reserve expenditures will be solely that of DISTRICT #6. III. FUNDING SOURCES The funding sources for the payment of these services will be funds generated by Colorado Preschool Project, Per Pupil Operating Revenue (PPOR), P.L. 99-457 and/or local funds. IV. STAFF FENWC shall furnish all staff members with the following exceptions: A. Direct/indirect service providers as outlined in SECTION I. r.1 ' B. Related therapeutic services provided per Contract for Purchase of Services with North Colorado Medical Center. V. SUPERVISION AND RESPONSIBLE PARTIES 1. FENWC shall be responsible for the supervision, staffing and implementation of all of the services to be performed by FENWC under the terms of this Contract. DISTRICT #6 shall be responsible for the supervision, staffing and implementation of the provisions required by DISTRICT #6 under the terms of this Contract. 2. FENWC and DISTRICT #6 shall jointly be responsible for the supervision of the total program for providing the preschool education services under P.L. 99457 and "CPP" as contemplated under this Contract. 3. The contact persons for monitoring compliance with this Contract shall be Jolene Reichert for DISTRICT #6 and Tere Keller-Amaya for FENWC. 4. DISTRICT #6 shall be responsible for the referral of all of said students to the program contemplated by this Contract. 5. The assessment of all of said students shall be the joint responsibility of FENWC and DISTRICT #6. VI. INDEMNIFICATION 1. FENWC shall indemnify, defend and hold harmless DISTRICT #6 from any claims, losses, damages, liabilities, costs, expenses or obligations, including but not limited to attorneys' fees, court costs, and punitive or similar damages, arising out of or resulting from any act or omission by FENWC or any of its employees, agents or representatives in the furnishing of services, equipment or supplies, or arising out of or resulting from the negligent, fraudulent, dishonest or other acts or omissions of FENWC or its employees, agents or representatives in its performance under the terms of this Agreement. FENWC agrees to provide proof of liability insurance coverage with One Million Dollar aggregate coverage. 2. Likewise, DISTRICT #6 shall indemnify, defend and hold harmless FENWC from any claims, losses, damages, liabilities, costs, expenses or obligations, including but not limited to attorneys' fees and court costs, arising out of or resulting from any negligent act or omission by DISTRICT #6 or any of its employees, agents or representatives in the furnishing of services, equipment or supplies under the terms of this Agreement. ♦11. TERM 1. The term of this Agreement shall be for the 1994-95 school year, commencing on September 30, 1994 and terminating June 10, 1995. All education services provided will follow the DISTRICT #6 school calendar or unless previously negotiated. 2. This Agreement shall be construed in accordance with the laws of the State of Colorado. 3. This document and all documents incorporated herein by reference, contain the entire agreements between the parties and supersedes all other prior written or oral agreements or representations. 4. Both parties agree that they shall conduct their activities under this Agreement in accordance with state and federal non-discrimination laws. 5. Any waiver by either party of any provision of this Agreement at any one time shall not constitute a waiver of any other or all provisions. Any waiver by any party of provisions of this Agreement at any one time shall not constitute a waiver of said provisions on any subsequent occasion. Any and all waivers or modifications of the Contract must be executed in writing and signed by both parties.
