The submitted materials are in compliance with the application requirements of Section 24.7 of the Weld County Zoning Ordinance. 2. It is the opinion of the Board of County Commissioners that the applicant has shown compliance with Section 24.4.2 of the Weld County Zoning Ordinance as follows: a. The proposal is consistent with the Weld County Comprehensive Plan's Agricultural Goals and Policies. The facility is an existing operation which has not removed prime farmground from production. b. The proposal is consistent with the intent of the Agricultural Zone District and is provided for as a Use by Special Review. c. The uses which would be permitted will be compatible with the existing surrounding land uses which include agricultural production, oil and gas production, and an abandoned livestock confinement operation. The Site Specific Development Plan and Amended Special Review Permit is for expansion of a natural gas processing facility in the A (Agricultural) Zone District as submitted in the application materials on file in the Department of Planning Services and subject to the Development Standards stated herein. 2. Approval of this plan may create a vested property right pursuant to Section 90 of the Weld County Zoning Ordinance. 3. All liquid and solid wastes shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. The wastes shall be disposed of at an approved disposal site. 4. Any required air emissions permit shall be obtained from the Air Pollution Control Division, Colorado Department of Health, for fugitive dust and odors. 5. No permanent disposal of wastes shall be permitted at this site. 6. The maximum permissible noise level shall not exceed the industrial limit of 80 dB(A), as measured according to 25-12-102, Colorado Revised Statutes. 7. An I.S.D.S. evaluation on any existing septic systems will be necessary prior to issuing the required septic permits on the existing systems. 8. Adequate toilet facilities shall be provided for employees. 9. A spillage retention berm shall be provided around any tank battery. The volume retained by the spillage berm shall be greater than the volume of the largest tank inside the berm. 10. All pesticides, fertilizer, and other potentially hazardous chemicals shall be stored and handled in a safe manner. 11. All construction activities that disturb more than five (5) acres shall obtain a stormwater discharge permit from the Colorado Department of Health, Water Quality Control Division. 12. The property shall be maintained in compliance with the regulations of S.A.R.A. , Title III. 13. All construction on the property shall be in accordance with the requirements of the Weld County Building Code Ordinance. 14. We have in place a protocol with the Fire Department in the form of our Emergency Response Plan. In addition, we have on site Fire extinguishers of suitable size and classification to fight potential fires. Animals No animals on use site. Waste and Storage Storage capacities for pressurized natural gas liquids is approximately 9800 barrels. Storage for crude oil/ condensate is approximately 1200 barrels. Storm Water Retention facilities Water is impounded on the property by Berms and monitored for evidence of contamination before releasing for drainage offsite. Removal and Disposal of Debris and Wastes Production water from oil wells (approx. 60 Barrels per week) is removed by truck on a weekly basis and disposed of in water disposal Sites approved by the State of Colorado oil and Gas Commission. Junk and debris is removed on an annual basis and disposed of in an approved landfill. Erosion Control Measures Approximately 40% of the site is rock, gravel, road base or power plant bottom ash. Remainder is occasionally cultivated to prevent wind erosion. Reglamation Procedures If no other alternative uses for the facility we would disassemble buildings and equipment (including concrete foundations) and remove from site. Site would then be returned to its original conditions and grade. Construction and Start-up Timetable Construction will begin approximately 10-Q1-92 Start-up sometime between 11-01-92 and 1-01-93. Weld County September 15, 1992 Page 3 Weld County Comprehensive Plan The equipment addition to this gas processing facility will increase our ability to meet the high processing demands created by the large number of gas wells currently being completed and put on line in Weld County. This is consistent with Item 7 of the Agricultural Goals of the Weld County Comprehensive Plan: "develop policies and regulations to permit development of oil, gas, . . . .on agricultural lands". The special review area is located in an area dominated by irrigated farming, dry land farming and grazing. Because of the relatively small size of the site to the grazing capacity of the area, the impact of the proposed use on agricultural development would be insignificant. Further the SRA is a compatible use of the land within the vicinity since the area has a number of producing oil and gas wells with associated production equipment which requires daily attention. In the short term, the approved amended SRA would increase the assessed value of the property, thereby increasing revenue to the county. More importantly, it will contribute to the present and future development of Weld County's mineral resources. This will, in turn increase the future tax revenues to the county. As mentioned previously, the development of the county's mineral resources is consistent with Goal 7 of the plan. This property is not in an incorporated area and is zoned agricultural (mainly farming operations) . No farming operations on the use area. This approximately 20 acre parcel has been removed from livestock grazing. There is adequate protection of the inhabitants of the neighborhood and the county as we have an Emergency Response plan that complies with SARA Title III, Community's Right to Know. The permitted use will be compatible with adjacent land use of either farming or livestock grazing. The permitted use will be compatible with the future development of the surrounding area as oil and gas production is inherent and prevalent in this area of Weld County and this facility is in place to process gas from wells in Weld County. Geologic floodplain and airport overlay: the area subject to Special review is not located in a geological hazard, floodplain, or Weld County Airport Weld County September 15, 1992 Page 4 overlay district area. Noise The SRA is to have a noise level measured twenty-five (25) feet from the property line of less than 80 decibels which will comply with the industrial standard. All liquid and solid wastes shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination, and at an approved disposal site. 2. Any required Emissions Permit is obtained from the Air Pollution Control Division, Colorado Department of Health for fugitive dust and odors. 3. No permanent disposal of wastes shall be permitted at this site. 4. The maximum permissible noise level shall not exceed the industrial limit of 80 dB(A) , as measured according to 25-12-102, Colorado Revised Statutes. 5. An I.S.D.S. Evaluation on any existing septic systems will be necessary, prior to issuing the required septic permits on the existing systems. 6. Adequate toilet facilities shall be provided for the employees. 7. The existing septic system is required to be reviewed by a Colorado Registered Professional Engineer and a copy of that review submitted to this Division, before the required I.S.D.S. Evaluation can be performed. 8. A spillage retention berm shall be required around the tank battery. The volume retained by the spillage berm should be greater than the volume of the largest tank inside the berm. 9. All pesticides, fertilizer, and other potentially hazardous chemicals must be stored and handled in a safe manner. Reference 25-8-205.5 Colorado Water Quality Control Act and Rules and Regulations thereof. 10. After October 1, 1992, all construction activities that disturb more than five (5) acres will be required to obtain a stormwater discharge permit from the Colorado Department of Health, Water Quality Control Division. There is only one of three reports on file for the Roggen Gas Processing Plant. This is the Material Safety Data Sheet (MSDS) . The Tier II report was last filed for 1989 indicating that they have had no regulated chemicals since then. This amended USR-274 shows that they have infact had these chemicals since 1989. I would recommend that this amendment not be authorized until the Roggen Gas Processing Plant is in compliance with all parts of SARA Title III. No information was provider on projected water requirements or use. The application does indicate that there will be 13 employees , 2 shifts, and 24 hour operation. The applicant does have a well operating under permit number 78049, issued in 1975 for drinking and sanitary facilities to serve the processing facility. The permit allows a maximum diversion rate of 15 gallons per minute and a annual diversion of 3 acre feet. We have no objection to approval if the estimated water use at the facility is not greater than 3 acre feet. If you have any questions in this matter, please contact me. The submitted materials are in compliance with the application requirements of Section 24.7 of the Weld County Zoning Ordinance. 2. It is the opinion of the Planning Commission that the applicant has shown compliance with Section 24.3 of the Weld County Zoning Ordinance as follows: The proposal is consistent with the Weld County Comprehensive Plan's Agricultural goals and policies. The facility is an existing operation which has not removed prime farmground from production. The proposal is consistent with the intent of the Agricultural zone district and is provided for as a use by special review. The attached Development Standards for the Special Review permit shall be adopted and placed on the Special Review plat prior to recording the plat. The plat shall be delivered to the Department of Planning Services and be ready for recording in the Weld County Clerk and Recorder's office within 15 days of approval by the Board of County Commissioners. 2. Within 30 days of approval by the Board of County Commissioners, the existing septic system shall be reviewed by a Colorado Registered Professional Engineer, and a copy of that review shall be submitted to the Weld County Environmental Protection Services Division before the required I.S.D.S. The Site Specific Development Plan and Special Review permit is for an expansion of a Natural Gas Processing Facility in the A (Agricultural) zone district as submitted in the application materials on file in the Department of Planning Services and subject to the Development Standards stated hereon. 2. Approval of this plan may create a vested property right pursuant to Section 90 of the Weld County Zoning Ordinance. 3. All liquid and solid wastes shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. The wastes shall be disposed of at an approved disposal site. 4. Any required Air Emissions Permit shall be obtained from the Air Pollution Control Division, Colorado Department of Health for fugitive dust and odors. 5. No permanent disposal of wastes shall be permitted at this site. 6. The maximum permissible noise level shall not exceed the industrial limit of 80 dB(A) , as measured according to 25-12-102, Colorado Revised Statutes. 7. An I.S.D.S. Evaluation on any existing septic systems will be necessary prior to issuing the required septic permits on the existing systems. 8. Adequate toilet facilities shall be provided for employees. 9. A spillage retention berm shall be provided around any tank battery. The volume retained by the spillage berm shall be greater than the volume of the largest tank inside the berm. 10. All pesticides, fertilizer, and other potentially hazardous chemicals shall be stored and handled in a safe manner. 11. All construction activities that disturb more than five (5) acres shall obtain a stormwater discharge permit from the Colorado Department of Health, Water Quality Control Division. 12. The property shall be maintained in compliance with the regulations of S.A.R.A. , Title III. 13. All construction on the property shall be in accordance with the requirements of the Weld County Building Code Ordinance. DEVELOPMENT STANDARDS Snyder Oil Corporation Amended USR-274 Page 2 14. The property owner or operator shall be responsible for complying with the Design Standards of Section 24.5 of the Weld County Zoning Ordinance. 15. The property owner or operator shall be responsible for complying with the Operation Standards of Section 24.6 of the Weld County Zoning Ordinance. 16. Personnel from the Weld County Health Department and Weld County Department of Planning Services shall be granted access onto the property at any reasonable time in order to ensure the activities carried out on the property comply with the Development Standards stated hereon and all applicable Weld County Regulations. 17. The Special Review area shall be limited to the plans shown hereon and governed by the foregoing Standards and all applicable Weld County Regulations. Major changes from the plans or Development Standards as shown or stated shall require the approval of an amendment of the Permit by the Weld County Planning Commission and the Board of County Commissioners before such changes from the plans or Development Standards are permitted. Doug Swanson, representative, Snyder Oil Corporation, introduced Al Kuykendal, also a representative of Snyder Oil Corporation. Doug Swanson explained the application is a request to be allowed to increase gas processing at the facility near Roggen. This facility was built in 1975 and Snyder Oil Corporation feels it's time to upgrade. Bud Clemons asked if this application would expand beyond the 20 acres Snyder Oil now operates. Doug Swanson said no, this increase will stay within the 20 acre boundary. Bud Clemons also asked if Snyder Oil leased or owned this property. Doug Swanson said Snyder Oil owns this land. The Chairperson asked if there was anyone in the audience who wished to speak for or against this application. No one wished to speak. This particular set of amendments were reviewed by the Weld County Building Trades Advisory Committee and approved earlier this year. There has been one work session with the County Commissioners and some of the homebuilders and they were also receptive to the changes. Chuck Cunliffe introduced Ed Stoner with the Weld County Building Inspection Department who was available to answer technical questions about the code. Judy Yamaguchi asked if this change would affect smoke detectors already in existence. Chuck Cunliffe said no.
