NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the hereinabove described parcel of land be, and hereby is, exempt from the definition of the terms, "subdivision" and "subdivided land". The parcel of land on which this request is being made is described as the NE/4, NW/4 of Section 26, TIN, R67W of the 6th P.M., Weld County, Colorado. The property is located south of and adjacent to Weld County Road 6 and approximately 1/4 mile west of Weld County Road 23 right-of-way. This request is to divide a 40 acre parcel into two parcels of 20 acres each, more or less. The applicants have indicated through the application materials that they plan on building a residence on each proposed lot and continue to use the remaining property for agricultural production. Access to both proposed lots is proposed from Weld County Road 6. The proposed water supply is to be from a shared well and septic is proposed for sewage disposal on each lot . The Weld County Health Department and Public Works Department have reviewed this request and offer conditions of approval. The Division of Water Resources has reviewed this request and offers conditions of approval. The Town of Brighton has reviewed this request and has no concerns. The Department of Planning Service's staff recommends denial of this request based on the lack of efficient and orderly development, noncompliance with the transportation goals and policies, and noncompliance with the agricultural goals and policies as stated in the Weld County Comprehensive Plan. Access to both lots would be from Weld County Road 6, via a bridge across the Brantner ditch that runs along the north edge of the property. Weld County Road 6 is designated as a County arterial that connects State Highway 85 to Interstate Highway 25. The Weld County Comprehensive Plan states that the number of access points on an arterial should be kept to a 941184 minimum in order to maximize traffic flow and promote safety. The parcel under consideration has been designated as Prime Farm ground if irrigated by the Department of Agriculture Soil Conservation Service and the Colorado State University Test Station. This request, if approved, would allow for the addition of two residences thus greatly increasing the residential density and reducing the area of prime farm ground. The Weld County Comprehensive Plan promotes the preservation of Prime Farm Ground. The staff is concerned with the level of development that has occurred in this area and the potential for continued divisions. There have been fifteen (15) recorded exemptions approved within a two (2) mile radius of this proposal. Barker, Weld County Attorney Suggestions for Agreements for RE No. 1672-Rotherham Subject: I have reviewed the agreements which you sent over to me regarding RE No. 1672-Rotherham. I have a number of concerns regarding these agreements. They are as follows: 1. Each of the agreements should state that all of the people who signed the agreements are the current owners of the property. It is my understanding that after the plat is recorded, two of the owners will own Lot A and the other owners will own Lot B. It should be delineated in the agreements which two will own Lot A and which two will own Lot B. 2. In those agreements which deal with joint maintenance,the term "maintenance" should be defined. It should be agreed upon what maintenance is to be performed and when. 3. The following are specific recommendations as to each agreement: A. WATER WELL AGREEMENT: 1) The agreement should include some provision that when the plat is recorded, the owners of Lot A will then grant some form of ownership in the well to the owners of Lot B . The grant of ownership should be in the form of some document which details approximately where the well is located, the nature of the proposed use(domestic), and how the water is to be transported to the dwellings on the property. If there are any rules which the Rotherhams wish to have relative to the use of the water well, the rules should be explained in the agreement. 2) Although we understand what the term "shall run with the land" means, I prefer to have it stated such that the terms of the agreement bind the signers and their successors in ownership in the property. This leaves no ambiguity that the agreement is to continue after the present owners sell the property. At, 1 ' 1995 -Ft ntannine Todd Hodges, Planning January 12, 1995 Page 2. 3) The current agreement states that if the owners of Lot B decide to obtain their own well, "this agreement becomes null and void." This condition should be more specific. Does the term "obtain their own well" mean when they drill the well? Is the time when the agreement becomes null and void when the owners of Lot B are actually connected to the well? These specifics should be addressed. B. AGREEMENT FOR THE CONSTRUCTION AND MAINTENANCE OF NEW BRIDGE: 1) The agreement should state where the new bridge is to be located. What type of new bridge is to be constructed? Who will be responsible for obtaining the labor to construct the bridge? 2) When the agreement states "shared responsibilities", what does this mean? 3) There should be more information about where the "common access easement" is to be located on the plat. 4) Again, the term "shall run with the land" should be explained in more detail. C. The site is located south of WCR 6 separated by irrigation ditch from the road. Lot B has an existing bridge used to access the property. This bridge would need to be repaired to the legal loading status prior in order to grant an access point. Many planks on the decking are missing or broken creating a dangerous situation. Lot A has no access from WCR 6 across the ditch to the property. There is an oil battery access road from WCR 21 to the west that appears to be serving both lots A and B crossing a third parcel. Does the applicant have an easement in place to utilize that this is as permanent easement? The proposed water supply is to be from a shared well, permit No. 181185, issued in 1994 for domestic use and allows serving up to three single family dwellings. In order to assure that a permanent water supply will be available on an equitable basis to either lot, we recommend the following: 1. The well should be located on an outlot owned in common by all property owners using the well. Access to the well and the right to establish and maintain a pipeline shall be provided by easements where necessary. 2. The well should be jointly owned by the lot owners. 3. Covenants and/or other mechanisms should establish a lot owners association with powers to make decisions concerning management and operation of the well.
