RE: APPROVE QUIT CLAIM DEED WITH TOWN OF EATON AND AUTHORIZE CHAIRMAN TO SIGN

WHEREAS, the Board of County Commissioners of Weld County, Colorado,
pursuant to Colorado statute and the Weld County Home Rule Charter, is vested
with the authority of administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with a Quit Claim Deed from the
County of Weld, State of Colorado, by and through the Board of County
Commissioners of Weld County, to the Town of Eaton, with terms and conditions
being as stated in said deed, and
WHEREAS, after review, the Board deems it advisable to approve said deed
for a strip or parcel of ground within the boundaries of the NW,' of Section 6,
Township 6 North, Range 65 West of the 6th P.M. , Weld County, Colorado, being
more particularly described in said deed, a copy of which is attached hereto and
incorporated herein by reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the Quit Claim Deed from the County of Weld, State of
Colorado, by and through the Board of County Commissioners of Weld County, to the
Town of Eaton for the above described parcel be, and hereby is, approved.
BE IT FURTHER RESOLVED by the Board that the Chairman be, and hereby is,
authorized to sign said deed.
The above and foregoing Resolution was, on motion duly made and seconded,
adopted by the following vote on the 13th day of June, A.D. , 1994.

QIJIT CLIIAIM DEED
THIS DEED, Made this /J day of JIL1 /2PJ , 19 94 ,
between the County of Weld, State of Colorado, -by and through the
Board of County Commissioners of the County of Weld and State of
Colorado, of the first part, and the Town of Eaton, a municipal
corporation, of the second part.
WITNESSETH, That the said party of the first part, for and in
consideration of the sum of good and valuable consideration, to the
said party of the first part in hand paid by the said party of the
second part, the receipt whereof is hereby confessed and
acknowledged, has remised, released, sold, conveyed and QUIT
CLAIMED, and by these presents does remise, release, sell,convey
and QUIT CLAIM unto the said party of the second part, its heirs,
successors and assigns, forever, all the right, title, interest,
claim and demand which the said party of the first part has in and
to the following described lots or parcels of land situate, lying
and being in the County of Weld and State of Colorado, to wit:
A strip or parcel of ground within the boundaries of the
Northwest Quarter of Section 6 , Township 6 North,
Range 65 West of the 6th P.M. , more particularly
described as follows :
Beginning at a point on the Union Pacific
Westerly line, said point being South 16° 09 '
East 702 . 5 feet; from the North boundary of
said Section 6, thence bearing North 49° 39 '
West 720 feet; thence on a 20° 30 ' curve right
239 . 6 feet, more or less; thence Westerly 10 . 0
feet; thence on a 19° 21 ' curve left 555 . 0
feet, more or less; thence South 57° 11 ' East
164 .4 feet more or less; thence on a 5° 11 '
curve right 369 . 6 feet, more or less , to a
point on the U.P.R.R. Westerly R.O.W. line;
thence North 16° 09 ' West along U.P.R.R.
Westerly R.O.W. line 122 . 4 feet, more or less
to point of beginning.
Containing in all, 1 . 18 acres, more or less .
A tract of land 60 feet wide, the center line of which is
described as follows, to wit:
Beginning at a point on the West line of
the right-of-way of the Union Pacific Railroad
Company, whence the intersection of the West
line of said right-of-way and the North line
of said Section 6, Township 6 North, Range 65
West of the 6th P.M. bears North 16° 09 ' West,
648 .2 feet; thence North 50° 39 ' West 656 . 7
feet to point of curve; thence on a 23° curve
to the right, 213 . 6 feet to a point on the

North one-quarter corner of said Section 6 and
containing 1 . 23 acres , more or less .
EXCEPT any of the above-described property which may be
located in the highway right-of-way known as U.S . Highway 85 .
ALSO EXCEPT the following parcel :
Commencing at the intersection of the
North line of Section 6 , Township 6 North, of
Range 65 West of the 6th, Weld County,
Colorado, with the West right-of-way line of
the Union Pacific Railroad, thence South 16°
09 ' East 595 .2 feet along said West right-of-
way line, thence North 50° 39 ' West 35 . 3 feet
to the place of beginning, running thence
North 30° 39 ' West 421 . 9 feet, more or less,
to the East line of a 20-foot alley, as
platted and filed in the Minnie Lee
Subdivision; thence South 70 feet, more or
less, along the East line of said 20-foot
alley, extended to the South, to a point on
the Easterly right-of-way line of the State
Highway, said point being 40 feet in a
Northeasterly direction at right angles to the
center line of said State Highway as now laid
out and constructed, thence in a Southeasterly
direction along the Easterly right-of-way line
of said State Highway 425 feet, more or less,
to a point 20 feet westerly, and at right
angles from the West right-of-way of the Union
Pacific Railroad, thence North 16° 09 ' West 50
feet, more or less, parallel with said West
right-of-way line of the Union Pacific
Railroad, to the place of beginning.

That part of a parcel of land in the

of Weld, state of Colorado, as described in
deed recorded in Book 985, Page 249 Weld
County Records, being more particularly
described as follows :
Commencing at the Northwest corner of
said Section 6; thence South 88°35 ' 03" East, a
distance of 1465 . 81 feet; on the North line of
the Northwest Quarter of said Section 6, said
bearing being an assumed bearing and all

thence leaving said North line, South
00°55 ' 55" East on the extended westerly right-
of-way line of a 20 feet wide alley (public
road) as plated in the Minnie Lee Eaton
subdivision, a distance of 273 . 64 feet to the
intersection of said westerly line with the
north right-of-way line of the abandoned state
highway (known as Lincoln Highway) as
described in deed recorded in Book 690, Page
621, Weld County Records , said point also
being the Point of Beginning; thence
continuing on said westerly line, South
0°55 ' 55" East, a distance of 71 . 19 feet to the
intersection of said westerly line with the
easterly right-of-way line of State Highway
No. 85 as shown in the state highway plans for
Federal Aid Project No. F 006-I (29 ) ; thence
northerly on said easterly right-of-way, said
line being a non-tangent curve, concave to the
northeast, a distance of 205 . 44 feet, whose
delta is 22°05 ' 05" , radius is 533 . 00 feet,
chord bears North 35°27 ' 24" West and chord
length is 204 . 18 feet to the intersection of
said easterly right-of-way line with the
northerly right-of-way line of the said
abandoned state highway (known as Lincoln
Highway) ; thence southeasterly on said
northerly right-of-way line, said line being a
non-tangent curve, concave to the northeast, a
distance of 18 . 94 feet, whose delta is
4°57 ' 07" , radius is 219 . 10 feet, chord bears
South 48°47 ' 14" East and chord length is 18 . 93
feet; thence continuing on said northerly
right-of-way line, South 51°15 ' 48" East, a
distance of 132 . 10 feet back to the point of
beginning.
Said described parcel of land contains
0. 124 acres of land +/- and is subject to any
rights-of-way or other easements as granted or
reserved by instruments of record or as now
exist on said described parcel .
TO HAVE AND TO HOLD the same, together with all and singular
the appurtenances and privileges thereunto belonging or in anywise
thereunto appertaining, and all the estate, right, title, interest
and claim whatsoever, of the said party of the first part, either
in law or equity, to the only proper use, benefit and behoof of the
said party of the second part, heirs and assigns forever.
