WILTS WHEREAS , the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners held a public hearing on the 16th day of September, 1987, at the hour of 2 :00 p.m. in the Chambers of the Board for the purpose of hearing the application of Wendell and Cheryl D. Wilts , 649 Highway 52 , Erie, Colorado 80516 , for a Use by Special Review for a home business, custom cabinet shop, on the following described real estate, to-wit: Part of the SW* SE} , Section 31 , Township 2 North, Range 68 West of the 6th P.M. , Weld County, Colorado WHEREAS, said applicant, Wendell Wilts, was present, and WHEREAS, Section 24 .4 . 2 of the Weld County Zoning Ordinance provides standards for review of said Use by Special Review, and WHEREAS , the Board of County Commissioners heard all of the testimony and statements of those present, has studied the request of the applicant and the recommendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter and, having been fully informed, finds that this request shall be approved for the following reasons: 1 . The submitted materials are in compliance with the application requirements of Section 24 . 7 of the Weld County Zoning Ordinance. 2 . It is the opinion of the Board of County Commissioners that the applicant has shown compliance with Section 24 . 4 . 2 of the Weld County Zoning Ordinance as follows : a. The proposed Use by Special Review site is located within the urban growth boundary area of the Town of Erie. The location of the Use by Special Review site and the attached Conditions and Development Standards make the proposed use consistent with the Weld County Comprehensive Plan' s urban growth boundary policies in that: P40248 871222 Page 2 RE: USR - WILTS 1) The proposed use is located within the urban growth boundary of an existing municipality. 2) The adjacent municipality does not consent to annex the property. Hank Epstein, Community Development Director, stated in a letter dated July 23 , 1987 , that the subject property is outside of the Town of Erie planning area and that they are not anticipating any change of uses or extension of the Town limits in this area for the next 15 years or more. 3) This proposal is compatible with the Comprehensive Plan' s transportation and public facility and service goals and policies because it will not significantly impact or require additional public facilities and services . b. The proposal is consistent with the intent of the Agricultural Zone District in which the use would be located. The proposed use is a home business and is provided for as a Use by Special Review in the Agricultural Zone District. c. The uses permitted will be compatible with the existing surrounding land uses and with the future development of the surrounding area as permitted by the Weld County Comprehensive Plan. Uses on surrounding properties include gravel mining, farming and ranching, a mobile home park, a beauty salon, a second hand store , and a tree farm, all within approximately 1 .5 miles of the property under consideration. d. No overlay districts affect the site. e. Use by Special Review Development Standards will provide adequate protection of the health, safety and welfare of the neighborhood and County. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the application for a Use by Special Review for a home business , custom cabinet shop, on the hereinabove described parcel of land be, and hereby is , granted subject to the following conditions : 871222 Page 3 RE: USR - WILTS 1 . The attached Development Standards for the Use by Special Review permit be adopted and placed on the Use by Special Review plat prior to recording the plat. 2 . The Use by Special Review plat shall be delivered to the Department of Planning Services Office and be ready to be recorded in the office of the Weld County Clerk and Recorder within 30 days after approval by the Board of County Commissioners. 3 . The septic system for the proposed use shall be designed by a Colorado Registered Professional Engineer according to the Weld County Individual Sewage Disposal Regulations . 4 . Prior to recording, the Use by Special Review plat shall be amended to show: a. A 75-foot right-of-way reservation from the center- line on the north side of State Highway 52 . 5 . The Use by Special Review activity shall not occur until the applicant/operator has met the requirements of the Weld County Building Code Ordinance. 6 . A fire hydrant shall be installed within 300 feet of the building to provide a water supply for fire fighting as requested by the Longmont Fire Protection District. 7 . Wilts USR-802 :87: 28 1 . The Special Review permit is for a home business , custom cabinet shop, as submitted in the application materials on file in the Department of Planning Services and subject to the Development Standards stated herein. 2 . Waste paints, stains, treatments, and other associated liquid and solid wastes shall be stored and removed for final disposal in a manner that protects against surface and ground water contamination. 3 . Within 180 days following approval by the Board of County Commissioners , an Air Emissions Permit shall be obtained from the Air Pollution Control Division, Colorado Department of Health. The applicant shall comply with all requirements of the permit to control fugitive dust and odors. 4 . Wood shavings , sawdust, and waste materials shall be handled , stored, and disposed of in a manner that controls fugitive dust, blowing debris , and other potential nuisance conditions. Debris such as sawdust, chips and shorts shall be removed daily and proper housekeeping shall be maintained at all times. 5 . Smoking shall be prohibited except in specified safe locations in the building. "No Smoking" signs shall be posted on two interior walls of the building and outside of the building at the personnel entrance. 6 . One portable fire extinguisher, rated 2A 40BC, shall be provided for each 1 , 000 square feet of floor area. A fire extinguisher shall be available within 75 feet travel distance from anywhere in the building. 7 . Cutting and welding or any other activity using open flame devices shall be prohibited within the building. 8 . Interior surfaces and ledges shall be designed to minimize dust accumulations. Surfaces not readily accessible for cleaning shall be inclined at an angle of not less than 45 degrees. 871222 Page 2 DEVELOPMENT STANDARDS : USR - WILTS 9 . Woodworking dust and chip collection systems shall be -provided on all woodworking machinery. The collection equipment ducts, hoods , etc. , shall be noncombustible construction except for filter bags. 10 . The Use by Special Review site and improvements shall conform to the requirements of the Uniform Fire Code , 1985 Edition. 11 . All construction on the property shall be in accordance with the requirements of the Weld County Building Code Ordinance. 12 . The property owner or operator shall be responsible for complying with the Design Standards of Section 24 .5 of the Weld County Zoning Ordinance. 13 . The property owner or operator shall be responsible for complying with the Operation Standards of Section 24 . 6 of the Weld County Zoning Ordinance . 14 . Personnel from the Weld County Health Department, the Longmont Fire Protection District, and Weld County Department of Planning Services shall be granted access onto the property at any reasonable time in order to insure the activities carried out on the property comply with the Development Standards stated herein and all applicable Weld County Regulations . 15 . The Use by Special Review area shall be limited to the plans shown herein and governed by the foregoing Standards and all applicable Weld County Regulations . Any material deviations from the plans or Standards as shown or stated shall require the approval of an amendment of the Permit by the Weld County Planning Commission and the Board of County Commissioners before such changes from the plans or Standards are permitted. Any other changes shall be filed in the office of the Department of Planning Services. 16 . The property owner or operator shall be responsible for complying with all of the foregoing Standards . The subject property is outside of the Town of Erie planning area designated by our Planning and Zoning Commission which stops at State -Highway X52. It may be within three(3) miles of our present Town limits, but it is in an area we are not anticipating any change of uses or extension of the Town limits for the next 15 years or more. In general , we have a definite -concern, and more specifically, a technical conflict about the allowance of industrial or commercial uses in agricultural zone -districts under the guise of "home business" -as a Use-by-Special Review.
