HomeMy WebLinkAbout880760.tiff RESOLUTION RE: COMPENSATION TO INDIVIDUALS FOR LOSSES ASSOCIATED WITH ANIMALS AND EQUIPMENT WHILE IN VOLUNTEER CAPACITY WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, Weld County has volunteers that utilize horses or dogs in performing volunteer work for the Weld County Sheriff, and WHEREAS, in the course of performing volunteer service with the horse or dog, a volunteer may experience financial loss in the form of the animal being injured or killed, and/or loss or damage to associated equipment, and WHEREAS, the benefit received from such volunteers to Weld County is substantial, and WHEREAS, normal insurance coverage does not cover losses of the type described above, and WHEREAS, the Board of County Commissioners and Sheriff of Weld County wish to provide limited coverage on a self-insured basis, and WHEREAS, the self-insured coverage shall be limited to TWO THOUSAND DOLLARS ($2 ,000) for loss or injury to an animal , and FIVE HUNDRED DOLLARS ($500) for loss or damage to associated equipment, based upon fair market value determined by the Weld County Sheriff. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado that within the self-insurance fund of Weld County, funds shall be provided to insure volunteers ' dogs and horses and associated equipment from losses or damages incurred while performing in a volunteer capacity for the Sheriff in amounts not to exceed $2 ,000 for loss or injury to the animal and $500 for loss or damage to associated equipment for any single occurrence with the claim to be determined by the Sheriff based upon fair market value of the loss incurred, said decision by the Sheriff shall be the final administrative decision. �'� 880760 Page 2 RE: COMPENSATION FOR LOSSES - SHERIFF'S OFFICE VOLUNTEERS BE IT FURTHER RESOLVED by the Board of County Commissioners that this action is not intended as a waiver of sovereign immunity pursuant to CRS §24-10-104 (1987 Cum. Supp. ) but is intended as reimbursement for volunteer' s expenses.
