RE: Response to Letter Received on September 9, 1988
Dear Mr. Kressler:
The Board of County Commissioners of Weld County, Colorado, has considered
your letter received on September 9, 1988, concerning water in the Roth
Subdivision park.
The Board has decided that it will take no action with regard to the water
at this time. The park is located at the bottom of a basin. Water
naturally collects there. Furthermore, it appears that water has
historically gathered on the parcel. The County cannot channel this water
away from the property without placing it upon a lower, downstream owner in
a quantity and fashion which is not natural and in accordance with the
historical flow.
The Board of County Commissioners understands the problems you are facing
with water coming into your basement; however, the County cannot provide a
remedy for this situation.
