RE: APPROVAL OF RECORDED EXEMPTION NO. 977 - LOWELL AND BETTY
ALDERFER
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners, pursuant to its
authority under Section 30-28-101 (10) (d) , CRS , as amended, did
determine at a public meeting held in the Chambers of the Board,
that a certain parcel of land, to be divided into two parcels , as
shown on the plat known as Recorded Exemption No. 977 , does not
come within the purview of the definition of the terms ,
"subdivision" and "subdivided land" , and
WHEREAS, the request for Recorded Exemption No. 977 was
submitted by Lowell and Betty Alderfer, for property which is
located in part of the SWa, Section 18 , Township 2 North, Range 67
West of the 6th P.M. , Weld County, Colorado, being more
particularly described in the plat which shall be provided by the
applicants and known as Exhibit "A" , said plat to be recorded, and
WHEREAS, this request is to divide the property into parcels
estimated to be approximately 12 acres and 10 acres, and
WHEREAS , the Board deems it advisable to approve Recorded
Exemption No. 977 for Lowell and Betty Alderfer, subject to the
following conditions:
1) The applicant shall submit a mylar plat to the
Department of Planning Services to be recorded in the
office of the Weld County Clerk and Recorder. The plat
shall be prepared in accordance with the requirements of
Section 9-2 C. 4 . of the Weld County Subdivision
Regulations . The plat shall be submitted within 60 days
from the date of approval by the Board of County
Commissioners.
2) A Weld County septic permit is required for the proposed
home and its septic system shall be installed according
to the Weld County Individual Sewage Disposal
Regulations.

3) The Recorded Exemption plat shall show a minimum
thirty-foot wide easement for ingress and egress to the
ten-acre parcel.
4) Prior to recording the plat, a copy of a deed shall be
submitted to the Department of Planning Services
describing the ten-acre parcel, including conveyances of
the right to use the 30 foot ingress and egress
easement.
5) The following note shall be placed on the Recorded
Exemption plat prior to recording the plat:
a) The property has not been previously subdivided or
exempted since 1972 . The Division of Water
Resources will not make additional permits
available for future splits of either tract.
b) The well permit, which will be available , will be
limited to use inside one single-family dwelling
only. Outside use for lawn and garden irrigation
or livestock is prohibited.
c) The applicant should provide proof that an
evaporative wastewater system will not be required.
The Division of Water Resources will not issue the
well permit if any evaporative system is required.
d) Prospective lot purchasers should be made aware of
the limitations on water use.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the hereinabove
described parcel of land be, and hereby is , exempt from the
definition of the terms, "subdivision" and "subdivided land" .
BE IT FURTHER RESOLVED by the Board that this approval is
subject to the hereinabove mentioned conditions.

Dear Commissioners:
This request for a recorded exemption is submitted by Lowell and Betty
Alderfer. The parcel of land on which this request is being made is
described as part of the SWI of Section 18, T2N, R67W of the 6th P.M. , Weld
County, Colorado. The property is located adjacent to the north side of
Firestone on the north side of Weld County Road 20. The parcel under
consideration is the total contiguous land holdings of the applicant. The
request is to divide the property into parcels of 11.768 acres and 10 acres,
more or less. The applicants wish to sell the 10 acre parcel to relatives.
The Tri-Area Planning Commission and the Weld County Health Department have
reviewed the application materials and have no objections to the request.
The Division of Water Resources has also reviewed the application materials
and has recommended approval if certain conditions are complied with.
The staff has concerns whether adequate water will be available for the
potential uses of this property if the Division of Water Resources'
conditions of approval are met. The Division of Water Resources' conditions
are identified in its letter of February 6, 1987.
The staff recommends that the Board of County Commissioners consider this
request and determine if the standards of Section 9-2 E. (1) (a) through (m)
of the Weld County Subdivision Regulations have been met.

Lowell and Betty Alderfer
1. The applicant shall submit a mylar plat to the Department of
Planning Services to be recorded in the office of the Weld County
Clerk and Recorder. The Plat shall be prepared in accordance with
the requirements of Section 9-2 C. (4) of the Weld County
Subdivision Regulations. The plat shall be submitted within sixty
(60) days from the date of approval.
2. A Weld County septic permit is required for the proposed home and
its septic system shall be installed according to the Weld County
Individual Sewage Disposal Regulations.

The purpose and reason for dividing our property
into two parcels is so we can sell ten acres to our
cousin , for a single house dwelling.
This proposal is consistent with the intent of the
zone district in which it is located , in that , the
property will continue to be used for agricultural
purposes . The use of this property will be residential ,
single house dwelling which is conpatiable with the
surrounding' farm area . It will continue to Le used fa-
pasture of the family farm animals . We ''believe this
will be acceptable and compatiable with the future dev—
elopment of the surrounding; area , since it will remain
like it is , residential and agricultural .

Per my telephone conversation with your office on February 4 , I

of the Tri-Area Planning Commission held on February 3 , 1987
application from Lowell and Betty Alderfer for a recorded exemption
was on the agenda. The parcel of land is a half a mile east of
Weld County Road 13 on Weld County Road 20 .
For the record Mr. Alderfer was present to answer questions . Mr.
Alderfer indicated they have approximately 22 acres of which they
would like to break-off 10 acres to sell to their cousins to build
• a home and will continue to raise horses and farm the land for
their own personal use . After great discussion this Commission
deemed this application acceptable and compatible with the area and
granted approval to this recorded exemption.

Dear Mr. Cunliffe:
We have reviewed the above referenced proposal to separate 21 .768 acres
into lots of 11 .768 and 10 acres. The proposed 11 .768-acre lot would be
served by a well (permit no. 64511 ) . The conditions of approval do not
prohibit the issuance of an additional permit.
We could issue an additional household use only well for the proposed
10-acre tract. Since a well permit would be available, we can recommend
approval. The availability of a well permit and our recommendation for
approval is subject to the following conditions:
1 . The property has not been previously subdivided or exempted since
1972. We consider this as a one-time exemption and will not make
additional permits available for future splits of either tract.
2. The well permit which will be available will be limited to use inside
one single-family dwelling only. Outside use for lawn and garden
irrigation or livestock is prohibited. Plat notes and covenants
should reflect this limitation.
3. The applicant should provide proof that an evaporative wastewater
system will not be required. We could not issue the well permit if
any evaporative system is required.
4. Prospective lot purchasers should be made aware of the limitations on
water use and other information contained in this letter. We

recommend that a copy of this letter be given to lot purchasers and
submitted with the well permit application.
