RE: APPROVAL OF RECORDED EXEMPTION NO. 1110 - JAMES E. AND NELLIE
L. CLINKENBEARD
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners, pursuant to its
authority under Section 30-28-101 (10) (d) , CRS, as amended, did
determine at a public meeting held in the Chambers of the Board,
that a certain parcel of land, to be divided into two parcels , as
shown on the plat known as Recorded Exemption No. 1110, does not
come within the purview of the definition of the terms,
"subdivision" and "subdivided land" , and
WHEREAS, the request for Recorded Exemption No. 1110 was
submitted by James E. and Nellie L. Clinkenbeard for property
which is located in the W}NEI and E}E}NW} of Section 16 , Township
2 North, Range 66 West of the 6th P.M. , Weld County, Colorado,
being more particularly described in the plat which shall be
provided by the applicant and known as Exhibit "A" , said plat to
be recorded, and
WHEREAS, this request is to divide the property into parcels
estimated to be approximately 117 acres and 3 acres.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the hereinabove
described parcel of land be, and hereby is, exempt from the
definition of the terms , "subdivision" and "subdivided land" .
BE IT FURTHER RESOLVED by the Board that this approval is
subject to the following conditions: 1) The applicant shall
submit a mylar plat to the Department of Planning Services to be
recorded in the office of the Weld County Clerk and Recorder. The
plat shall be prepared in accordance with the requirements of
Section 9-2C. (4) of the Weld County Subdivision Regulations . The
plat shall be submitted within sixty days from the date of
approval by the Department of Planning Services. The applicant
shall be responsible for paying the recording fees; 2) A Weld
County Septic Permit is required for the proposed home and its
septic system shall be installed according to the Weld County
Individual Sewage Disposal System Regulations; and 3) The
applicant shall obtain a well permit form the State Engineers
Office, Division of Water Resources , for a non-tributary well from
the Laramie-Fox Hills formation.

Dear Mrs. Curry:
We have received additional information concerning the above referenced
proposal . It appears that the applicant wishes to construct a well into the
Laramie-Fox Hills formation on the proposed 3+ acre tract. A preliminary
analysis indicates that there is non-tributary water available for
appropriation by the applicant. Our analysis indicates that there is
sufficient water available under the proposed 3+ acre tract to allow for some
outside uses.
Since it appears that water for the proposed uses will be available, we
recommend that the county conditionally approve this proposal upon the
applicant obtaining a well permit from our office for this non-tributary
water. Once the county conditionally approves this exemption, a well permit
will be made available to the applicant which will allow for some outside uses
from the Laramie-Fox hills formation. Until we can obtain a survey of the
exact location and size of the proposed tract, the amount of water available
for outside uses cannot be determined.

Dear Commissioners:
This request for a recorded exemption is submitted by James E. and Nellie L.
Clinkenbeard. The parcel of land on which this request is being made i.s
described as the Wk of the NE' and the Ek of the E> of the NWT of Section
16, T2N, R66W of the 6th P.M. , Weld County, Colorado. The property is
located approximately 3.5 miles north of the City of Fort Lupton, on Weld
County Road 22. The property under consideration is the total contiguous
land holdings of the applicants. The request is to divide a 120 acre
parcel, more or less, into two parcels of 117 acres and 3 acres, more or
less. There is an existing residence and other improvements on the 117 acre
parcel.
The Weld County Health Department and the Fulton Irrigating Ditch Company
have reviewed the application materials and have no objections to the
request. The Division of Water Resources has also reviewed the application
and has recommended approval if certain conditions are complied with.
The staff has concerns whether adequate water will be available for the
potential uses of this property if the Division of Water Resources'
conditions of approval are met. The Division of Water Resources' conditions
are identified in its letter of August 16, 1988.
The staff recommends that the Board of County Commissioners consider this
request and determine if the standards of Section 9-2 E. (1) (a) through (m)
of the Weld County Subdivision Regulations have been met.

The applicant shall submit a mylar plat to the Department of Planning
Services to be recorded in the office of the Weld County Clerk and Recorder.
The plat shall be prepared in accordance with the requirements of Section
9-2 C. (4) of the Weld County Subdivision Regulations. The plat shall be
submitted within sixty (60) days from the date of approval by the Department
of Planning Services. The applicant shall be responsible for paying the
recording fees.
A Weld County Septic Permit is required for the proposed home and its septic
system shall be installed according to the Weld County Individual Sewage
Disposal System Regulations.
The following note shall be placed on the recorded exemption plat prior to
recording:
At the request of the Division of Water Resources, the following conditions
and/or restrictions shall be complied with:
1. The property has not been previously subdivided or exempted
since 1972. The Division of Water Resources considers this a
one-time exemption and will not make additional permits
available for future splits of either tract.
2. The well permit which will be available will be limited to
use inside one single-family dwelling only. Outside use for
lawn and garden irrigation or livestock is prohibited.
3. The applicant should provide proof that an evaporative
wastewater system will not be required.
4. Prospective lot purchasers should be made aware of the
limitations on water use.
The foregoing conditions and/or restrictions are contained in the Division
of Water Resources' letter dated August 16, 1988.

Statements
(f//4) The reason for this application to split this parcel is to create
a home site on which a friend of Mr. & Mrs. Clinkenbeard wants to
build a home.
(//5) The smaller parcel is separated from the rest of the farm by the
Fulton Irrigation Ditch. It is hard to farm with the rest of the
farm and non irrigated ground. Usually this type of property is
allowed to be split by the policies of the comprehensive plan.
(ff6) The zoning is currently agriculture and will remain agriculture
after the split.
(#7) The use intended Is for a rural home site on a small acreage and
will be compatible with existing surrounding land uses.
(#8) The location of the property is well outside of any future develop—
ment patterns and shall remain isolated rural agricultural use.
It is outside of any of the communities master plan areas.
(/f9) No development is expected in the area but the division of this
property will not be inconsistent with efficient and orderly
development if it should occur.
(#10) A well permit has been applied for and the state engineers office is
awaiting action from the county before approving the permit. Copy
of application and letter from John Bilisoly attached.
The water will be from a Laramie-Foxhill aquifer, will probably
be 750' to 850' deep.
The sewage disposal will be a county approved septic and leach •
field.
($11) The property is located approximately 21/2 miles east of the Platte
River and is high and dry and is not located in a flood plain, nor
a geological hazard, nor a Weld County Airport overlay District and
is believed to comply with section 50 overlay district regulations.
(f/12) Other information: The property lies on a hill about 21/2 miles east
of the river valley. It has a nice view of the river valley and the
mountains and will be an excellent home site.

The subject application for a permit to construct a well is being returned for
additional information concerning the parcel of land on which the proposed well will
be located. In order to properly evaluate the application, this office must have
evidence indicating when the subdivision or this particular parcel of land was
created. Please provide one of the following :
-1)' If the subdivision or particular parcel was in existence prior to June 1 , 1972 ;
please provide a copy of a deed , subdivision plat, or other document to verify
that fact. This document must be dated prior to June 1 , 1972,, and must describe
the subject property in question .
2), If the subdivision or particular parcel was exempted from the county
subdivision regulations, please provide all of the following:
a) A copy of the county commissioners resolution.
b) A copy of a survey plat showing the original tract and all exempted tracts .
c) Information concerning the existence of any wells and their uses on the
original tract and on the exempted tracts .
d) Copies of documents showing when the original tract was created (this is
required only if the original tract was less than 35 acres in size, or
if it was involved in a previous exemption) .
e) Copies of any other agreements concerning this tract executed with the
county.
33) If the subdivision or particular parcel was created after June 1, 1972 by
action other than resolution of the county commissioners, please provide
copies of documents to show how it was created.

Reference is hereby made to the application for recorded
exemption of James E. and Nellie L. Clinkenbeard.
Fulton Irrigating Ditch Company has no objection to the
granting of this request. It is noted that the attachment
showing the location of the subject property contains a drawing
showing the Fulton Ditch being adjacent to such property. This
is to advise that the ditch lateral shown on the attachment is
not under the supervision of the Fulton Ditch. The ditch does
deliver water to the headgate for such lateral; however, the
maintenance and upkeep of such lateral is performed by those
users of the lateral, not the Fulton Ditch Company.

Dear Ms. Swanson:
We have reviewed the above referenced proposal to separate approximately
120 acres into lots of 117 and three acres. The proposed 117 acre lot would
be served by an existing well (Permit No. 28967) . The conditions of approval
do not prohibit the issuance of an additional permit.
We could issue an additional household use only well for the proposed
three acre tract. Since a well permit would be available, we can recommmend
approval . The availability of a well permit and our recommendation for
approval is subject to the following conditions:
1. The property has not been previously subdivided or exempted since
1972. We consider this as a one-time exemption and will not make
additional permits available for future splits of less than 35 acres
of either tract.
2. The well permit which will be available will be limited to use inside
one single-family dwelling only. Outside use for lawn and garden
irrigation or livestock is prohibited. Plat notes and covenants
should reflect this limitation.
3. The applicant should provide proof that an evaporative wastewater
system will not be required. We could not issue the well permit if
any evaporative system is required.

4. Prospective lot purchasers should be made aware of the limitations on
water use and other information contained in this letter. We
recommend that a copy of this letter be given to lot purchasers and
submitted with the well permit application.
