WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners has reviewed the request of Interstate Lands, Inc . for an exemption from the definitions of "subdivision" and "subdivided land" in Section 30-28-101 (10) (d) , CRS , as amended, and Section 2-1 A. (3) of the Weld County Subdivision Regulations, and WHEREAS, this Subdivision Exemption request from Interstate Land, Inc. , in conjuction with a request for Recorded Exemption No. 1094 , is to divide a 76 acre parcel into parcels of 3 acres, 45 acres, and 29 acres, more or less, and WHEREAS , said land is located in part of the SW* , Section 6 , Township 7 North, Range 67 West of the 6th P.M. , Weld County, Colorado, WHEREAS, after hearing the testimony presented and reviewing the recommendation of the Planning staff, a motion was made and seconded to approve said request for Subdivision Exemption No. 343 , and WHEREAS, on a roll call vote, the motion to approve said request resulted in a tie vote , with Commissioners Brantner and Kirby voting aye, and Commissioners Lacy and Yamaguchi voting nay, and WHEREAS, pursuant to the policy regarding land use matters, it was determined that Commissioner Johnson, who was excused from the meeting of July 13 , would review the record and listen to that portion of the tapes concerning this matter, then cast her vote a later Board meeting, and WHEREAS, at the Board meeting of July 20 , Commissioner Johnson, after reviewing the record and listening to said tapes, voted nay on the motion to approve the request; therefore, the motion fails resulting in a denial of Subdivision Exemption No. 343 . NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the request of " < � � 880746 Page 2 RE: SE #343 - INTERSTATE LANDS, LTD. The parcel of land on which this request is being made is described as part of the SW} of section 6, T7N, R67W of the 6th P.M. , Weld County, Colorado. The property is located north of Weld County Road 84 and east of Weld County Road 13. The parcel of land under consideration is not the total contiguous land holdings of the applicant. The request is to divide the 76 acre parcel into parcels of 3 acres, 45 acres, and 29 acres, more or less. Based upon the submitted information and policies of the County, the Department of Planning Services' staff recommends the request be denied for the following reasons: The applicant has not demonstrated that the proposal is consistent with efficient and orderly development. In 1987, Interstate Lands, Ltd. acquired 144 acres, more or less, in the southwest quarter of the section. The parcel was divided into two parcels of 76 acres, more or less, and 68 acres, more or less, by the Water Supply and Storage Irrigation Ditch right-of-way. The applicant is requesting to use the subdivision exemption in conjunction with the recorded exemption to split off existing dwellings and to further divide the 76 acres, more or less, into three parcels. Approval of these requests will create another residential building site on the 76 acres. 880746 880713 Interstate Lands, Ltd. June 24, 1988 Page 2 - The applicant has not demonstrated that the proposal is consistent with the intent of the Agricultural zone district nor how the applications comply with the minimum lot size requirements. The minimum lot size in the Agricultural zone district is 80 acres for irrigated land and 160 acres for dryland. In the immediate vicinity, the average lot size is 78 acres, more or less. - Agriculture in Weld County is considered a valuable resource which must be protected from adverse impacts resulting from uncontrolled and undirected residential land uses. Land uses surrounding this proposal are crop production, pasture, and a dairy operation. The Agricultural zone district was established to maintain and promote agriculture as an essential feature of Weld County and areas for the conduct of agricultural activities without the interference and encroachment of the more intensive land uses. - The applicant has failed to demonstrate that the proposal is consistent with the Weld County Comprehensive Plan as stated on page 1, of the Weld Comprehensive Plan, the purpose of the Comprehensive Plan is for. . . "general purpose of guiding the accomplishing the coordinated, adjusted, and harmonious development of Weld County." The plan also states in part that residential development shall be discouraged when the site is located outside of a municipality's comprehensive planning area and to promote conservation of agricultural land in a orderly manner that is in harmony with the phased growth plans of a municipality and the County. - The approval of this land split may encourage requests to subdivide neighboring properties in the vicinity. Scattered residential development in rural areas necessitates an increased demand for roads and bridges, police and fire protection, education facilities, utilities, and other services. The cost of providing services and the conflicts between rural and urban land uses can be reduced if development is encouraged within urban growth boundary areas or adjacent to existing municipalities. An overall understanding of the owners plan is necessary in evaluating each of the two exemption applications. LF/DS.NARR 880746 C Interstate Lands, Ltd. (a Colorado limited partnership) is the owner of a parcel of land located on the northeast corner of the intersection of County Road 13 and Vine Drive (County Road 84). Larimer County borders the property on the west and Highway 14, running between Fort Collins and Ault, lies one mile to the south. The property lies approximately 3/4 of a mile north of the urban growth boundary line in an area consisting primarily of irrigated farmland with some interspersed residences and residential acreages. It appears that the growth patterns of Fort Collins, as evidenced by the location of the Anheuser Busch Brewery, is increasing public demand for residential uses in the surrounding area. The attached photographs (Exhibit #1 ) depict the type of uses now existing within one mile of the subject property. The subject property contains approximately 6 acres of improvements, 27 acres of pasture (very seepy pastureland) and 44 acres of irrigated farmland. The irri- gated land is separated into two fields of 26 acres and 18 acres, respectively. The improved portion of the property contains two separate residences, various garages and outbuildings, and some cattle corrals and grain handling equipment which were once used in a small feedlot operation. Due to various obsolesence factors, the feedlot is no longer operational. The functional utility of the property is impaired due to the combination of uses now existing on the property and the relative size of each. The large amount of improved area and unproductive pastureland in relation to the small area of pro- ducing farmland make it very infeasable to function as a farming operation. Similarly, the fact that the improvements contain two separate residences and relatively large acreage as residential units are concerned, make the property unattractive for residential use. The owners believe that by strategically dividing the property, the functional utilization of both the residential and agricultural components of the property can be maximized, while at the same time, the existing agricultural uses can be preserved. As previously discussed, the ratio of productive land to improvements and the ratio of productive land to unproductive land make the property unattractive to farmers for economic reasons. However, due to the physical separation of the improve- ments and the unproductive land, it is impossible to separate the producing acres from the unproductive acres. Therefore, the owners have determined that a two-phased division of the property utilizing a Subdivision Exemption in con- junction with a Recorded Exemption could be used to divide the property in an orderly manner. The first phase would involve the division of the small house on approximately 3.1 acres (Parcel #1) from the main Parcel by an approved Subdivision Exemption. The second phase would involve the division of the remaining parcel in a manner which combines one of the irrigated fields (26 acres) with one the the houses and the other field (18 acres) with the unproductive pastureland by an approved Recorded Exemption. This proposed plan of division creates a better "balance" and improves the overall utility of the property. The irrigated parcels are large enough that the income produced by farming, custom farming or renting is significant in an overall economic analysis. Any termination of use as irrigated farmland would cause a material enough loss in overall property value to prohi- bit future owners from simply allowing the property to sit idle. The separation LF/DS.NARR1 880746 Page 2 — continued of the houses and the combination of 26 acres with the larger of the houses add greatly to the attractiveness of these parcels for residential use. The owner currently has contracted, contingent upon the outcome of this application, for sale of the 18 acre field and the pasture to a young neighboring farmer, further indicating that the proposed division adds to the attractiveness of the property to farmers and residential users alike. The proposed division has been carefully considered by the owners and is believed to be in compliance with the Weld County Comprehensive Plan and with the overall goals and objectives of Weld County. The plan is also believed to be consistent and compatible with the surrounding area and provides an orderly and efficient means of improving the use of the property. Factors considered in this regard are as follows: 1 ) The proposal has been prepared in a manner which will preserve the agricultural land for agricultural usage, consistant with current existing use of the property. In fact, none of the farmland would be converted to alternate uses. 2) The residential uses discussed above are already existing and do not interfere with the agricultural use of the adjacent parcels. No new residential uses are being proposed at this time. 3) The proposed divisions are such that additional future subdivision of the parcels is not encouraged. Division boundaries have been located on natural break lines, such as irrigation ditches, fences, and other natural separation points. Further subdivision would be difficult without dividing existing fields or otherwise interfering with the primary agricultural use of the land. 4) Any future residential development and new construction on the unimproved parcel could be located on unproductive land which would not have an adverse impact on the agricultural use of the adjacent land. 5) The owner agrees to grant and record necessary irrigation easements to provide access to irrigation water for the irrigated parcels. 6) Adequate water (North Weld Water District), electricity (Poudre Valley REA) , and gas (Public Service) are available to the property. The owners will be responsible for an additional water tap for one of the houses and installation of electrical metering and separation equipment. Discussions with Lyle Nelson of the North Weld Water District indicate that the water tap is readily available. 7) Since the plan as currently proposed will not change any of the existing land uses, the plan is compatible with existing and surrounding land uses. Given the strategic location of boundary lines, it appears that any permitted new developemnt would be compatible with development now occurring in the surrounding area. LF/NARR2 880746 746 Page 3 — continued 8) The subject property is not located in a flood plain, geologic hazard, or Weld County Airport overlay district. 9) All parcels created by the plan are larger than one acre. 10) All parcels created by the plan have immediate access from existing public roads. 11) Existing residences use septic systems for sewage disposal. All parcels have sufficient access and area for this method of sewage disposal. 12) The proposed parcels are not part of a Recorded Exemption, are not part of a Subdivision and are not part of a Minor Subdivision. 13) It is not the intention of the owners to in anyway evade the requirements and Statement of Purposes of the Weld County Subdivision Regulations through the use of this Recorded Exemption. 14) The owners believe the current existing provisions for the protection of the health, safety and welfare of the inhabitants of the area are adequate. Since the proposed changes will have a negligible impact on the use of the property, it is believed that the existing provisions will remain adequate. However, due to the growth of Fort Collins, the area is under increasing pressure for residential uses. The farm immediately west of the subject property currently has three houses built on it as can be seen in the following photos. Those photos were taken from County Road 13 (from the eastern property boundary) and County Road 84 .
