RESOLUTION RE: APPROVAL OF USE BY SPECIAL REVIEW FOR BOARDING KENNEL FACILITY - JANICE L. AND JOETTA L. MEYER WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners held a public hearing on the 7th day of August, 1985 , at the hour of 2 :00 p.m. in the Chambers of the Board for the purpose of hearing the application of Janice L. and Joetta L. Meyer, P.O. Box 575, Windsor, Colorado 80550 , for a Use by Special Review for a boarding kennel facility on the following described real estate, to-wit: Part of the SWIL, Section 16 , Township 6 North, Range 66 West of the 6th P.M. , Weld County, Colorado WHEREAS, Section 24 .4 .2 of the Weld County Zoning Ordinance provides standards for review of said Use by Special Review, and WHEREAS, the Board of County Commissioners heard all of the testimony and statements of those present, has studied the request of the applicant and the recommendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter and, having been fully informed, finds that this request shall be approved for the following reasons: 1 . The submitted materials are in compliance with the application requirements of Section 24 . 7 of the Weld County Zoning Ordinance. 2 . It is the opinion of the Board of County Commissioners that the applicant has shown compliance with Section 24 .4 . 2 of the Weld County Zoning Ordinance as follows: a. The proposal is consistent with the Comprehensive Plan policies in that the use does not infringe on continued agricultural use in the vicinity or County. The proposal does not appear to have any adverse impacts on the agricultural interests of the County or the environment. b. The proposal is consistent with the intent of the Agricultural Zone District and is provided for as a Use by Special Review. 85066) f xl$loS Page 2 RE: USR - MEYER c. The activities proposed will be compatible with existing agricultural uses, as well as with the future projected development in the immediate area. The intended proposal will not have any significant traffic or noise impacts. d. The proposal was reviewed by the City of Greeley Planning Commission and it recommended no objection to the proposal. e. No overlay districts affect the site. f. Use by Special Review Operation and Design Standards provide adequate protection of the health, safety and welfare of the neighborhood and County. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the application for a Use by Special Review for a boarding kennel facility on the hereinabove described parcel of land be, and hereby is, granted subject to the following conditions: 1 . The attached Standards for Use by Special Review be adopted and placed on the Use by Special Review plat prior to recording. 2 . The prescribed Use by Special Review activity shall not occur nor shall any building or electrical permits be issued on the subject property until the Use by Special Review plat has been delivered to the Department of Planning Services Office and the plat has been recorded in the office of the Weld County Clerk and Recorder. 3 . The Use by Special Review plat shall be amended to show a 75 foot right-of-way reservation on the north side from the centerline of State Highway 392. The plat shall be amended prior to recording the plat. 4 . Prior to the issuance of any building permits, the applicant shall provide evidence that the septic system for the proposed kennel has been approved by the Weld County Health Department. The permitted use shall be a boarding kennel facility designed to hold a maximum of eighty (80) dogs and twenty (20) cats as described in the application materials on file in the office of the Weld County Department of Planning Services and subject to the Operation Standards hereon. 2 . The boarding kennel facility shall be constructed and operated in compliance with the Colorado State Health Department ' s Kennel Regulations. 3 . Trees along the north side of the property shall be located a minimum of thirty-five feet (35 ' ) from the edge of the Greeley No. 2 Canal. 4 . An access permit to serve the boarding kennel facility shall be obtained from the Colorado Division of Highways prior to beginning operation of the kennel. 5 . Animals kept by the kennel shall be allowed in the outdoor runs between the hours of 8 :00 a.m. and 8 : 00 p.m. only. 6. The applicant shall comply with the design standards for the Use by Special Review, Section 24 .5 et seq. , of the Weld County Zoning Ordinance. 7. The applicant shall comply with the Operation Standards for Uses by Special Review, Section 24 . 6 et seq. , of the Weld County Zoning Ordinance. 8 . Representatives or members of the Weld County Health Department and Weld County Department of Planning Services shall be granted access onto the site at any reasonable time in order to insure the operations carried out on the site comply with the Operation Standards stated herein and all applicable Weld County Regulations. 9 . The Use by Special Review area shall be limited to the plans shown hereon and governed by the Standards as stated above and all applicable Weld County Regulations. Any material deviations from the plans and/or Standards as shown or stated above shall require the approval of an amendment of the Permit by the Weld County Planning Commission and the Board Page 2 OPERATION STANDARDS - MEYER of County Commissioners before such changes from the plans and/or Standards are permitted. Any other changes shall be filed in the office of the Department of Planning Services. 10 . The property owner and/or operator of this operation shall be responsible for complying with all of the above stated Standards. Noncompliance with any of the above stated Standards may be reason for revocation of the Permit by the Board of County Commissioners. Meyer for a Use by Special Review for a boarding kennel facility. Bruce Barker, Assistant County Attorney, made this matter of record. Gloria Dunn, Planning Department representative, read the favorable recommendation of the Planning Commission, subject to four conditions, into the record and stated that there are ten Operation Standards associated with this Use by Special Review. Tom Hellerich, Attorney, came forward to represent the applicants. He submitted a letter from Pat Martin of the Humane Society in favor of this application and also stated that the applicants have no objections to the recommendation by the Planning Commission. Joetta Meyer came forward to answer questions of the Board and explained the procedures for her proposed operation. Dave Schumaker, Veterinarian, came forward. Mr. Schumaker would be on call to assist if anything would happen to the animals. Commissioner Lacy moved to approve the request of Janice and Joetta Meyer for a Use by Special Review for a boarding kennel facility, subject to the conditions and Operation Standards as recommended by the Planning Commission. Commissioner Kirby seconded the motion and it carried by unanimous vote. However, I would like to comment in favor of Ms. Jody Meyer's kennel application and urge your approval of it. There definitely is a need for an animal boarding facility in Weld County. We get numerous calls at the shelter asking about this very situation. We also have experienced many situations wherein dogs are left at home, often unattended, while the owners are on vacation, simply due to the fact that they had no place to board their pets. I personally, and many others, currently drive to Loveland in Larimer County to board our pets. My personal knowledge of Ms. Meyer shows that she cares a great deal for animals. Through my discussions with her and observation of the blueprints, I have no doubt that she will operate a quality facility. I strongly urge you to approve her application. If you should have any further questions of me, please do not hesitate to call. LEGAL DESCRIPTION: Part of the SW'- Section 16, T6N, R66W of the 6th P.M. , Weld County, Colorado. LOCATION: Approximately 1 mile west of the City of Greeley on the north side of State Highway 392. APPEARANCE: Thomas E. Hellerich, Attorney, Dinner, Hellerich, and Lazar, represented the applicants. He stated they have received the staff comments, conditions, and operation standards and have no objections to anything outlined. They have submitted written materials of what they would like to do with this property. The property is only three miles from the city of Greeley. 'They have a petition with four hundred and forty-four signatures from residents in Greeley and the surrounding area stating that there is a need for this type of facility in the area. Tape 209 - Side 2 Joyetta Meyer explained the type of operation they are planning for this area. Presently veterinarians are the only place a person may leave their dog of cat if it needs to be boarded and their services are limited. The cages are small and there is seldom an exercise area. She explained the physical layout of the kennel area which would make it virtually impossible for any pet to escape unless it was still with the owner being brought to or taken from the kennel. There will be concrete walls between the runs so �XN/8i I l.. Summary of the Weld County Planning Commission Meeting July 2, 1985 Page 7 the dogs being boarded do not see each other and bark. Runs will also be fenced on the top as well as the sides so the animals cannot climb over the runs. There will be a small area for problem animals so they will not disturb the other animals or the neighbors. There will be room for eighty dogs and twenty cats. She also explained the landscaping plans and future plans for play and swimming areas for the dogs. All waste will be put into a septic system which will be designed by an engineer. She will live on-site and there should not be any time when the animals are left alone. The Chairman called for discussion from the members of the audience. Alice Leffler, adjacent property owner, stated they are against this proposal because they are afraid the kennel would cause a devaluation of their property, there would be a lot of noise, if one of the dogs were to escape, their livestock could be killed or maimed, and the deciduous trees planned for landscaping would cause a problem with the flow of water in the Number Two Ditch. Ira Sanders reported he has pets and has a problem trying to find a place to leave them when they go out of town. It was his feeling a facility such as this is needed in this area. The Chairman asked Gloria Dunn to read the recommendations, conditions, and operation standards as outlined by the Department of Planning Services staff into the record. Gloria Dunn amended Operation Standard Number 5 to read as follows: 5. LEGAL DESCRIPTION: Part of Lot 11, Buffalo Acres, A subdivision located in part of the NF.1 of Section 13, T2N, R68W of the 6th P.M. , Weld County, Colorado. LOCATION: Approximately 3/4 mile north of Firestone; east of Weld County Road 11 and south of Weld County Road 22. APPEARANCE: Pat Simpson, property owner and applicant, reported he owns several pieces of large equipment used for oil and gas pipeline construction. Things have been slow lately and he needed a place to store of the the equipment and trucks so he parked them on his land. This is a 3.2 acre parcel of land and he has stored eight to ten pieces of equipment on it at various times. Storage of the equipment on the property will not be a permanent base of operations. The Chairman asked Mr. Simpson if he had reviewed the recommendations, conditions, and operation standards as outlined by the Department of Planning Services staff. He stated he had and has no ojections to them. The Chairman called for discussion from the members of the audience. There was none. The Chairman asked that reading of the recommendation, conditions, and operation standards as outlined by the Department of Planning Services staff be dispensed with and that they be filed with the summary as a permanent record of these proceedings. The Planning Commission felt Operation Standard #2 should be changed to go with the applicant and not with the land. Gloria Dunn amended Operation Standard #2 to read as follows: "The Use by Special Review permit shall automatically expire upon lease or conveyance by the applicant of the subject parcel." Meyer and Joetta L. Meyer for Use by Special Review Dear Members of the Planning Commission and of the Board of County Commissioners: Our office represents Janice L. Meyers and Joetta L. Meyers, the applicants for a Use by Special Review in an agricultural district for a kennel facility. This facility would be located approximately five miles west of Lucerne on State Highway 392. The parcel of ground selected by the applicants consists of approximately 10.298 acres of agriculturally zoned ground lying south of Greeley No. 2 Canal between the canal and Colorado Highway 392. The facility proposed by the applicants is for boarding of small animals such as dogs and cats. The only new structure would be the construction of a building to house the animals, which will be constructed of concrete blocks. All animals boarding at the facility would be either in the kennel itself or in fenced run areas totally enclosed. In addition, exterior chain link fencing is anticipated to be constructed by the applicants encompassing the majority of the property. In addition to the kennel building, offices will be located in one of the two residences now existing on the property. Remodeling of the one residence closest to the construction of the proposed kennel would be done to fit the specific needs of an office. The other residence, lying to the west, would continue as a residence for one of the owner-managers of the operation of the kennel. A sketch of the improvements on the proposed facility is provided herewith and attached as Exhibit "A". Greeley, Weld County and surrounding municipalities within Weld County are in great need of such a facility, specifically for the purpose of boarding small animals. Veterinary offices now existing have limited numbers of cages for animals, but few have outside runs or adequate space for housing animals for longer periods of time. Existing veterinary offices have boarding facilities primarily to be used for housing of animals during veterinary treatment for surgeries, etc. Other large municipalities such as Loveland, Longmont and Fort Collins Board of County Commissioners County Planning Commission May 9, 1985 Page 2 have facilities similar to the one proposed by the applicants specifically for boarding animals for times other than for veterinary treatment. However, Weld County does not have such a facility to meet this growing need. The neighboring properties are currently used for agricultural purposes, for production of crops, for pasturing of animals and for a dairy facility. The nearest residential structure to the west of the proposed kennel facility is approximately 1,525 feet, and it is approximately 1,175 feet to the nearest residence to the east. The closest residential structures to the north and south are approximately one mile away. The applicants anticipate that upon completion, the facility will have the capability of housing approximately 80 dogs and 20 cats at maximum capacity. The number of employees to operate and accommodate the facilities initially calls for the two owner-managers in the operation of the kennel. Extensive research has been done by the applicants as to the job requirements for the operation of a boarding facility; it is not anticipated to increase employee requirements substantially. If a need for an additional employee arises, it is anticipated such an employee would be part-time, and employees would operate the facility during the approximate hours of 7:30 A.M. to 5:30 Y.M. At least one of the owner-managers will be living on the premises and will be available at all times. However, normal operating hours are anticipated to be as set forth above. Utilities are already existing to the premises and to the existing residences. The current water source is North Weld County Water District. Adequate water is available as set forth in copy of the letter from the Water District attached hereto, marked Exhibit "B". All other utilities are currently available to the property. As previously indicated, the property is located five miles west of Lucerne on Colorado State Highway 392. Customers of the boarding facility will be able to use the existing driveway, which accommodates the residents to the east portion of the property. The new building to be constructed for the kennel will be located and situated so no additional or new driveways or accesses will be required. The second residence located to the west has a separate driveway and will continue to be a private residence with separate access. Adequate area is presently available to accommodate all anticipated customers for parking on the subject property. It is anticipated only standard sized vehicles will be used by customers of the facility and will not cause additional congestion or traffic flow on Highway 392. No parking will be allowed on the State Highway. Board of County Commissioners County Planning Commission May 9, 1985 Page 3 The two residences on the premises are presently serviced by septic tanks which have been approved by the Weld County Health Department. The applicants will be installing an additional septic tank according to state and county health regulations. They will be of adequate size to accommodate the kennel. Thus, all normal waste will be disposed of through septic systems, and there will be no waste stockpile or storage areas associated with the proposed use. The property in the application is located in the Eaton Fire District, and adequate fire protection is provided by the District. The kennel building will be a concrete block structure and will have very high fire resistance. No additional storm water retention facilities are anticipated or are required on the property. The existing storm water retention facilities and disposal will not be interfered with or altered by the operation of the facility or by the construction of the new building. The kennel facilities will be sanitized regularly in accordance with Colorado Health Department regulations and any regulations of the County Health Department. The facilities and runs will be cleaned several times daily according to individual pet requirements in addition to Health Department regulations. The applicants anticipate that the facility will require approximately 60 days of construction time from start to finish. This time schedule includes the installation of the septic tank per county regulations and all other extension of utilities. The applicants anticipate the planting of additional trees for windbreaks, erosion control, decoration and possible noise control. Additional landscaping measures include planting of shrubbery, grass, flowers, etc. to complement existing landscaping. No reclamation procedures will be required upon cessation of the Use by Special Review. The applicants' proposal for a boarding facility in an agriculturally zoned area is consistent with the Comprehensive Plan. As all members of the Planning Commission and Board of County Commissioners are aware, the intent of the agricultural district anticipates such activities as those proposed by the applicants. At present the neighboring lands are used for agricultural purposes including the production of crops, the pasturing of animals and livestock, and a dairy facility nearby. The Weld County zoning ordinances provide that the Use by Special Review in an "A" District contemplates uses such as a veterinary clinic or hospital, animal training and boarding facilities, and the keeping, raising and boarding of exotic animals. These specific uses, with other uses by right in the agriculturally zoned lands, are consistent with the intent and current uses of the property and are consistent with the Weld County Comprehensive Plan. At present the property described in the Board of County Commissioners County Planning Commission May 9, 1985 Page 4 application is barren and unsightly and has not been used for a substantial time for active agricultural purposes. The proposed use by the applicants will, in fact, enhance the aesthetic appearance of the property and will result in fencing and landscaping consistent with the existing use and surrounding uses. Adequate provisions have been made in the construction of the facility for protection of the health, safety and welfare of the inhabitants of the neighborhood and the county. Rigid sanitation methods will be applied according to the Colorado Health Department regulations and guidelines and will be implemented by the applicants. The kennel facility itself will be indoors with totally fenced in exercise areas for outdoor exercising attached to the building. A sketch of the facility is attached hereto, marked Exhibit "C". As indicated in the exhibits, indoor and outdoor runs will be totally enclosed to prevent the escape or straying of any animals at the facility. In addition, the office area and kennel will have exterior fencing around their perimeter made of chain link fencing of adequate height to protect neighboring properties as well as the animals. Animals will be confined to fenced areas and the kennel at all times except when being transported to and from a vehicle. At such time of transporting of any animals, all animals must be leashed. Internal health and safety protections include solid dividing walls between kennels and runs to protect animals from each other and to eliminate any potential noise created by the animals. In the event of excessive barking by any dog, confinement rooms containing several kennels are included in the facility to ensure that the facility will conform to all required noise levels. Thus, the proposed use, although it will be in the county, will be in compliance with any of the future development plans of the surrounding area including any Master Plans of nearby municipalities. As a further protection against noise and to protect the health, safety and welfare of the neighboring property owners, all animals will be kept indoors during nighttime hours. The soil report prepared by the Soil Conservation Service indicates the soil is Type 32 (Kin Loam, 12T0 3% slope) and has moderate strength. The Service has indicated there will be no problem with the proposed building, and many larger buildings are built on soil of this strength. Please see Exhibit "D" attached hereto from the Soil Conservation Service. The applicants have examined and have found that the property proposed in the application is not located in any flood plain, geologic hazard area or the Weld County Airport Overlay District area. Further, the applicants comply with Section 50 Overlay District Regulations as outlined in the Weld County Zoning Ordinances.
