WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and -WHEREAS, the Board of County Commissioners held a public hearing on the 8th day of January, 1986 , at the hour of 2 :00 p.m. in the Chambers of the Board for the purpose of hearing the application of Triangle Cross Ranch, Inc. , P.O. Box 5172 , Greeley, Colorado 80631 , for a Use by Special Review for an adult mentally retarded group ranch on the following described real estate, to-wit: Part of Section 31 , Township 7 North, Range 64 West of the 6th P.M. , Weld County, Colorado WHEREAS , Section 24 .4 .2 of the Weld County Zoning Ordinance provides standards for review of said Use by Special Review, and WHEREAS , the Board of County Commissioners heard all of the testimony and statements of those present, has studied the request of the applicant and the recommendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter and, having been fully informed, finds that this request shall be approved for the following reasons: 1 . The submitted materials are in compliance with the application requirements of Section 24. 7 of the Weld County Zoning Ordinance. 2 . It is the opinion of the Board of County Commissioners that the applicant has shown compliance with Section 24.4 .2 of the Weld County Zoning Ordinance as follows: a. The proposal is consistent with the Weld County Comprehensive Plan in that the proposed use would be adjacent to the unincorporated town of Galeton, and will not adversely impact the agricultural interests of the County. it6nG Page 2 RE: USR, TRIANGLE CROSS RANCH, INC. b. The proposal is allowed as a Use by Special Review. c. The proposal is consistent with the Agricultural Zone District. "The Agricultural District is intended to provide areas for the conduct of agricultural activities and activities related to agriculture and agricultural production without the interference of other, incompatible land uses. " The proposal is intended to provide a rural, agricultural setting for the mentally retarded. fl. No overlay districts affect the site. e. -Use by Special Review Development Standards will provide adequate protection of the health, safety and welfare of the neighborhood and County. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the application for a Use by Special Review for an adult mentally retarded group ranch on the hereinabove described parcel of land be, and hereby is, granted subject to the following conditions: 1 . the attached Development Standards for the Use by Special Review be adopted and placed on the Use by Special Review plat prior to recording the plat. 2 . The Use by Special Review activity shall not occur nor shall any building or electrical permits be issued on the property until the Use by Special Review plat has teen delivered to the Department of Planning Services Office and the plat is ready to be recorded in the office of the Weld County Clerk and Recorder. 3. The Use by Special Review activity shall not occur until the applicant secures all applicable licenses and approval from the Colorado Department of Health and the State of Colorado Division for Developmental Disabilities. USR-703 :85 :48 1 . The Use by Special Review permit is for an adult mentally retarded group ranch as submitted in the application materials on file in the Department of Planning Services and subject to the Development Standards stated herein. The number of "Ranchers" shall not exceed the amount allowed by the Colorado Department of Health and the St-ate of Colorado Division for Developmental Disabilities. 2 . Each septic system on the property shall be designed by a registered professional -engineer. 3 . All public food facilities on the property shall be licensed and operated according to the Colorado Food Services Regulations. 4 . All construction done on the property shall be in accordance with the requirements of the Weld County Building Code Ordinance. 5 . The applicant shall comply with the design standards for the Use by Special Review, Section 24 .5 of the Weld County Zoning Ordinance. 6 . The applicant shall comply with the Operation Standards for Uses by Special Review, Section 24 . 6 of the Weld County Zoning Ordinance. 7. Representatives or members of the Weld County Health Department and Weld County Department of Planning Services shall be granted access onto the property at any reasonable time in order to insure the operations carried out on the property comply with the Development Standards stated herein and all applicable Weld County Regulations. 8 . The Use by Special Review area shall be limited to the plans shown herein and governed by the foregoing St-andards and all applicable Weld County Regulations. Any material deviations from the plans and/or Standards as shown or stated shall require the approval of an amendment of the Permit by the Weld County Planning Commission and the Board of County Commissioners before such change-s from the plans and/or Standards are -permitted. Any other changes shall be filed in the office of the Department of Tlanni-ng Services. Page 2 RE: DEVELOPMENT STANDARDS 9. The property owner and/or operator of this operation shall be responsible for complying with all of the foregoing Standards. Noncompliance with any of the foregoing Standards may be reason for revocation of the Permit by the Board of County Commissioners. Morrison Planning Department representative, Debbie deBesche The following business was transacted: I hereby certify that pursuant to a notice dated December 16, 1985, and duly published December 26, 1985, in the Johnstown Breeze, a public hearing was conducted -to consider the request of Triangle Cross Ranch, Inc. for a Use by Special Review for an adult mentally retarded group ranch. Lee Morrison, Assistant County Attorney, made this matter of record. Debbie deBesche, Planning Department representative, read the favorable recommendation of the Planning Commission into the record and stated that there are four conditions and nine Development Standards associated with this request. Ms. deBesche said that Condition #4 has been complied with. Keith Mahan, representing the applicant, came forward to answer questions of the Board. He commented that this ranch is being established with private funds. There was no public comment from members of the audience. After discussion, Commissioner Lacy moved to approve the -application of Triangle Cross Ranch, Inc. for a Use by Special Review for an adult mentally retarded group ranch, subject to the conditions and Development Standards recommended by the Planning Commission. The motion, seconded by Commissioner Yamaguchi, carried unanimously. This Certification was approved on the 13th day of January, 1986. REQUEST: A Use by Special Review permit for an adult mentally handicapped group ranch LEGAL DESCRIPTION: Part of Section 31, T7N, R64W of the 6th P.M. , Weld County, Colorado LOCATION: Just north and adjacent to First Street in the unincorporated town of Galeton; east of Weld County Road 51 APPEARANCE: Rick Blondell, represented Triangle Cross Ranch, Inc. He stated he is a member of the Board of the Triangle Cross Ranch, Inc. There is a chance to establish, in Weld County, what only, a few states now have---an establishment for the adult mentally retarded or people with developmental disabilities. All applicants will be carefully screened and no person will be accepted with an aggressive nature. Persons with these types of handicaps can be taught many tasks. This is a nonprofit group that is trying to fill a need in Weld County. The Chairman called for discussion from the members of the audience. Pauline Bonner, member of the Board, Triangle Cross Ranch, Inc. , explained House Bill 1205 and the need to make definite progress before January 1, 1986. CASE NUMBER: USR-707:85:52 APPLICANT: Natural Gas Associates, Inc. REQUEST: A Use by Special Review permit for a natural gas compression and liquid petroleum gas trucking facility LEGAL DESCRIPTION: Part of the SEA, Section 33, T2N, R67W of the 6th P.M. , Weld County, Colorado LOCATION: Approximately one mile east of Frederick; south of Weld County Road 16 and east of Weld County Road 19 APPEARANCE: Richard Powell, Natural Gas Associates, Inc. , represented the applicant. He asked that all references to Weld County Road 17 be changed to Weld County Road 19. They do not feel this request is a gas processing plant as referred to in the recommendations and the Development Standards. The gas processing plant is across the road. This site will be a compressor station and liquid petroleum gas trucking facility. They are pumping gas from tanks into the Amoco lines; raising the compression to send it through the pipeline. This gas will be delivered to the University of Northern Colorado. They have asked for a 2,000 horsepower compressor, but initially only a 700 horsepower compressor will be used. There will also be a liquid petroleum gas unloading plant and weigh station at this site. There will be two thirty thousand gallon tanks on the property and about five trucks of gas coming in per day. Eventually they plan to have five 30,000 gallon tanks and about ten truck loads coming in per day. The liquid petroleum gas is for delivery and transportation in the Amoco pipeline. They have done noise studies at the site and at midnight they are not reaching the fifty decibels that are considered acceptable. Even when the larger compressor is installed they will not reach this level. They will install hospital mufflers to control the noise. This will be an unmanned plant and he explained the safety and control features of the plant. The Chairman asked Mr. Powell if he had reviewed the recommendations, conditions, and Development Standards as outlined by the Department of Planning Services staff. He stated he had and asked that Development Standards #1 be changed to read Weld County Road 19, condition 1/ 3, and Development Standards #2 be changed to reflect that no drilling will take place on the property. Other than these three minor changes he had no problems with anything outlined by the Department of planning Services staff. While I am in favor of the creation of increased living alternatives for persons with developmental disabilities, I have concerns about the eventual number of persons that the ranch plansto_house. I support the development of a ranch for up to eight persons; but cannot do so at this time if more than that number are to be in residence. I am sure that the staffs of the Departments of Health and Institutions will point out in their comments that the ranch needs to be licensed and the relationship of the current proposal to the requirements thereof. For that reason, I will not deal with that issue at this time. I have, however, raised the issue with Dr. Bitter of the organization's Board of Directors who has assured me that they will meet all of the regulations that may apply to their operation. He has also indicated that the group cannot apply for licensure until your review has been completed and positive action taken. It is my hope that whatever decisions are forthcoming are coordinated so that the group will not have to resubmit their Use by Special Review application if they have to change the scope of their operation in order to become licensed. Details for the following items, when applicable, are required. a) Explain proposed use. b) Explain need for use. This application of Triangle Cross Ranch, Inc. , a Colorado non-profit Corporation is for the purposes of establishing on the proposed site a permanent home (sometimes referred to as: "The Ranch") for a carefully selected group of mentally retarded adults able to cope with, and adjust to, the demands of that structured, rural, Christian living environment. Thus, the proposed use provides a unique opportunity for the betterment of such persons (referred to as "ranchers"), and a first of its kind alternative in Colorado to the traditional and extremely limited living environments otherwise available for them. Although untested in Colorado, the proposed use is based upon, and similar to, the immensely successful ranch home for mentally retarded adults in Arizona, known as "Rainbow Acres," and founded by the nationally known Reverend Ralph Showers in 1973. The extraordinary success of Rainbow Acres has led to the establishment in other states of similarly successful facilities based upon those principles and methodologies originated at Rainbow Acres by Reverend Showers. The success of all those facilities has, in turn, spawned a national grassroots movement by many persons of Christian backgrounds for the establishment of additional similar facilities for mentally retarded adults throughout the United States. Now, following more than two years of on-going work by Triangle Cross Ranch, its agents, and many supporters, a proposed site for such a home has been chosen, and agreements have been reached for the acquisition of the real property described herein. Hence, the only remaining obstacle for its establishment is the obtaining of a special use permit and recorded exemption from Weld County. Through the success of Rainbow Acres and its progeny, it has been established that certain mentally retarded adults are able to accomplish many tasks in such a rural setting that they would otherwise had been unable to perform in a more urban environment, and that, accordingly, such facilities provide not only an alternative form of placement for these individuals, but, indeed, in many cases, one which permits them to achieve their maximum potential for fulfillment in life. This has been due, in part, to the simpler form of life found in rural settings, but also to the ability to utilize animal therapy to assist each "rancher" in defining and achieving his individual responsibilities and goals. -1- Therefore, the proposed use envisions an environment in which the "ranchers" will assume general responsibility for the day to day care of the domestic livestock and vegetable garden on the proposed site. Furthermore, the proposal contemplates the ultimate establishment of a small coffee shop and laundromat on the premises for the primary use of the ranchers, to be generally operated by them under the direction and supervision of the vocational supervisor on the premises. However, because the Galeton Community presently lacks both a coffee shop and a laundromat, those facilities will be made available to the members of that community, as well as others, based upon the demand therefore, with the income generated therefrom to be used both by the Ranch and the "ranchers" to help achieve their economic self-sufficiency. In any case, the establishment, operation, and use of both the foregoing facilities, and of the proposed camper parking area described below, shall be consistent with all governing laws, ordinanaces, and regulations. There are presently four kinds of facilities available to mentally retarded adults: a. State run institutions b. Nursing homes c. Group homes d. Living with a relative or other guardian or responsible party Triangle Cross Ranch, Inc. , will provide an additional alternative to these existing facilities. There are presently over 200 adults with mental retardation in the State of Colorado whose needs are not being met, as evidenced by the attached letters from the surrounding area and by professionals in this work. Hence, there is a substantial need for this type of facility. c) Explain the types of existing uses on surrounding properties. To the south are small businesses such as a service station, grocery store and post office. To the west, are several single family residences. To the north and east is irrigated farm land. The proposed ranch will be consistent with these existing uses. A) The distance of the proposed use to residential structures in each direction. See attached sketch e) The maximum number of users, patrons, members and buyers. Initially, there will be four ranchers with a maximum number of ranchers of 24 ranchers by 1990. -2- f) The number of employees, number of shifts, and hours of operation. The close proximity of UNC to the7•proposed site was an important factor in its selection, since it is praj.e.c .ed. at least initially that the University will provide the source for prospective employees of the ranch. The number of employees at full operating capacity would be 15. All employees would be expected to live on the ranch. There would be some part time volunteer help from community churches and UNC. The staff will be working shifts 24 hours a day. g) The type of water source for the proposed use. Domestic water is supplied by North Weld County Water District, see attached letter. h) Explain the access route(s) to be utilized for the proposed use. Existing access road exits onto WCR 74 (First Street). The proposed access road would tie into the existing access road on the ranch and exit onto WCR 51. i) Explain type, size, weight, and the frequency of vehicular traffic associated with the proposed use. Vehicular traffic wuold consist of automobiles and pickup trucks consistent with 6 number of households. The maximum of residents could be 24 by 1990. It is not anticipated that the proposed site would place any abnormal or undue demands on adjacent roads or highways. j) The type of sewage facilties for the proposed use. The two existing houses are connected to the Galeton sewer system. All proposed construction would require a new septic system consistent with health requirements. k) A description of the proposed fire protection measures associated with the proposed use. The Galeton Volunteer Fire Department is located across the street from the proposed ranch. The facilities shall meet or exceed all governmental fire protection regulations. 1) The types and maximum number of animals to be concentrated on the use by Special Review area at any one time. The maximum number of animals on the ranch are as follows: 6 horses 12 cows and calves 30 sows and pigs 10 goats —3— The maximum number of animals will not exceed any applicable governmental regulations, particularly those as to the number of animal units per acre. m) The type and size of any waste,Tayatockpile or storage areas associated with the proposed use. Such a need is not anticipated at this time. n) Type of storm water retention facilities associated with the _proposed use. Such a need is not anticipated at this time. o) The time schedule and method of removal and disposal of debris, junk and other wates associated with the proposed use. Commercial trash pickup is available on a regular and on-going basis, and it will be so utilized. p) Explain proposed landscaping plans and erosion control measures associated with the proposed use. Landscaping of the homes would be consistent with existing homes in the area. The majority of the land will be in grass and pasture. Any tilled ground would be controlled through proper farming methods. q) Reclamation procedures to be employed upon cessation of the use by Special Review activity. The following written materials and supporting documents shall be submitted as part of the application. a) A statement concerning the trailer hookups and laundry. Within two years, the ranch plans to install 6 camper hookups complete with water, sewer and electricity. The purpose of the hookups is for the use of a volunteer organization called RIVICS (Retired Volunteers in Christian Service) which is based in Florida. RIVICS is a group of retired tradespeople who travel around the county helping nonprofit organizations. They have offered to donate 3500 man hours of labor to the ranch for such things as remodeling homes, constructing homes and outbuildings. Their only requirements are proper trailer hookups for their mobile homes. The camper hookups would also be made available to the rancher's parents. b) A statement explaining how the proposal is consistent with the c) Weld County Comprehensive Plan and intent of the district in which the use is located. The ranch will be develop on 20 acres of land north of Galeton. Along the eastern edge of the property is 3.8 acres of former railroad right— of—way classified as non—productive. The remaining 16.2 acres are irrigated farm land. The ranch plans to build on the higher land on the western edge of the 20 acres. The former railroad property will be leveled and returned to production. This will result in no loss of productive farm land. e) A statement explaining there is adequate provision for the protection of the health, safety and welfare of the inhabitants of the neighborhood and the county. The facility shall meet all health and safety regulations. f) A statement explaining the uses permitted will be compatible with the existing surrounding land uses (include a description of existing land uses of all properties adjacent to the property). South of the proposed ranch is Dillards Grocery Store and post office and Hill's Service Station and Garage. The proposed laundry, coffee shop and camper park are adjacent to the store and service station. West of the proposed ranch are single family residences. Homes on the ranch will be built on the southwest corner of the ranch adjacent to esixting homes. The land surrounding the ranch on the west, north and east is irrigated farmland. Most of the ranch will be in pasture. East of the ranch is a confine swine operation. g) A statement explaining the proposed use will be compatible with the future development of the surrounding areas as permitted by the existing zone and with future development as projected by the comprehensive plan of the county or the adopted master plans of affected municipalities. The development on the ranch will be adjacent to the unincorporated community of Galeton.
