HomeMy WebLinkAbout850387.tiff RESOLUTION RE: APPROVAL OF AMENDMENT TO USE BY SPECIAL REVIEW TO ALLOW FOR EXPANSION OF A NATURAL GAS PROCESSING PLANT - NATURAL GAS ASSOCIATES, INC. WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners held a public hearing on the 13th day of November, 1985 , at the hour of 2 :00 p.m. in the Chambers of the Board for the purpose of hearing the application of Natural Gas Associates, Inc. , 1401 17th Street, Suite 600 , Denver, Colorado 80202 , to amend a Use by Special Review to allow for expansion of a natural gas processing plant on the following described real estate, to-wit: The SE4 SW1, Section 25 , Township 5 North, Range 66 West of the 6th P.M. , Weld County, Colorado WHEREAS, Section 24 .4 .2 of the Weld County Zoning Ordinance provides standards for review of said Use by Special Review, and WHEREAS, the Board of County Commissioners heard all of the testimony and statements of those present, has studied the request of the applicant and the recommendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter and, having been fully informed, finds that this request shall be approved for the following reasons: 1 . The submitted materials are in compliance with the application requirements of Section 24 . 7 of the Weld County Zoning Ordinance. 2 . It is the opinion of the Board of County Commissioners that the applicant has shown compliance with Section 24 . 4 . 2 of the Weld County Zoning Ordinance as follows: a. The proposal is consistent with the Comprehensive Plan policies in that the use does not infringe on continued agricultural use in the vicinity or County. b. The proposal is consistent with the intent of the Agricultural Zone District and is provided for as a Use by Special Review. 850387 Page 2 RE: AMEND USR - NATURAL GAS ASSOCIATES , INC. c. The Greeley Planning Commission has recommended no objection to this proposal. Its concerns are addressed in the Development Standards. d. The City of Evans has recommended no objection to this proposal. Its concerns are addressed in the Development Standards. e. No overlay districts affect the site. f. Use by Special Review Development Standards will provide adequate protection of the health, safety and welfare of the neighborhood and County. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the application to amend a Use by Special Review to allow for expansion of a natural gas processing plant on the hereinabove described parcel of land be, and hereby is , granted subject to the following conditions: 1 . The attached Development Standards for the Use by Special Review permit be adopted and placed on the Use by Special Review plat prior to recording the plat. 2 . No expansion of the Use by Special Review activity shall occur nor shall any building or electrical permits be issued on the property until the Use by Special Review plat has been delivered to the Department of Planning Services Office and the plat is ready to be recorded in the office of the Weld County Clerk and Recorder. 3 . Prior to expansion , the applicant shall submit evidence to the Department of Planning Services that they have amended their Air Emission Permit for the site. 4 . Prior to recording the Use by Special Review plat, the facility shall be inspected by a fire safety expert to determine whether there is compliance with Article 2 , Section 2 .301 of the Uniform Fire Code . Evidence showing compliance with the Uniform Fire Code shall be delivered to the La Salle Fire Protection District and the Department of Planning Services. 5 . Prior to recording, the plat shall be amended to show the ten foot perimeter landscaping strip required by Development Standard #9 . Page 3 TT: AMEND USR - NATURAL GAS ASSOCIATES, INC. The Use by Special Review permit is for amending USR-597 :85 :45 to allow for expansion of the existing gas processing facility as submitted in the application materials on file in the Department of Planning Services and subject to the Development Standards stated hereon. 2 . A six-foot chain link fence, topped with three strands of barbed wire, shall enclose the Use by Special Review area. 3 . The appearance of the facility shall be maintained in a neat and orderly condition through periodic painting and maintenance. 4 . The site is situated on soils that are susceptible to wind erosion when the soil surface is not adequately protected. The entire subject site shall be covered by either gravel or vegetative cover, as recommended by the Soil Conservation Service, to prevent wind erosion. Said subject site shall be restored to its original condition by the operator and/or owner upon cessation of the prescribed natural gas processing facility. 3 . The Use by Special Review area shall be limited to two access points on Weld County Road 52 . 6 . Construction of a flare pit shall be prohibited in the Use by Special Review area. 7 . Liquified petroleum gases (LPG) is considered a hazardous substance per C.R.S. 29-22-107 (2) (a) . Prior to the issuance of additional building permits, the applicant shall list the maximum quantity of LPG expected at the site with the State Health Department - Division of Waste Management and with the Weld County Emergency Response Coordinator. Evidence of this listing shall be provided to the Department of Planning Services prior to the issuance of building permits. 8 . The proposal shall comply with all City of Evans Ordinances pertaining to truck traffic. Traffic shall exit onto Weld County Road 52 , and either continue west or north on Weld County Road 35 . Page 2 ]DEVELOPMENT STANDARDS - NATURAL GAS ASSOCIATES, INC. '9. The applicant shall install and maintain a ten foot landscaping strip along the perimeter of this site. 10 . Within thirty days of final approval of the Board of County Commissioners, the applicant shall provide the La Salle Fire Protection District with a map showing locations of all ga-s valves which would need to be closed in the event of a fire. 11 . The plat shall show a right-of-way reservation of fifty feet north of the center line of Weld County Road 52 . 12 . All construction done on the property shall be in accordance with the requirements of the Weld County Building Code Ordinance. 13 . The applicant shall comply with the design standards for the Use by Special Review, Section 24 . 5 of the Weld County Zoning Ordinance. 14 . The applicant shall comply with the Operation Standards for Uses by Special Review, Section 24 . 6 of the Weld County Zoning Ordinance. 15 . Representatives or members of the Weld County Health Department and Weld County Department of Planning Services shall be granted access onto the property at any reasonable time in order to insure the operations carried out on the property comply with the Development Standards stated hereon and all applicable Weld County Regulations. 16 . The Use by Special Review area shall be limited to the plans shown herein and governed by the Standards as stated above and all applicable Weld County Regulations. Any material deviations from the plans and/or Standards as shown or stated above shall require the approval of an amendment of the -Permit by the Weld County Planning Commission and the Board of County Commissioners before such changes from the plans and/or Standards are permitted. Any other changes shall be filed in the office of the Department of Planning Services. 17 . The property owner and/or operator of this operation shall be responsible for complying with all of the foregoing Standards. Noncompliance with any of the foregoing Standards may be reason for revocation of the Permit by the Board of County Commissioners. HEARING CERTIFICATION DOCKET NO. 85-86 RE: -AMEND USE 13Y SPECIAL REVIEW TO ALLOW FOR EXPANSION OF A NATURAL GAS PROCESSING PLANT - NATURAL GAS ASSOCIATES, INC. A public hearing was conducted on November 13, 1985, at 2:00 P.M. , with the following present: Commissioner Jacqueline Johnson, Chairman Commissioner Gene Brantner, Pro-Tem Commissioner C.W. Kirby Commissioner Gordon E. Lacy Commissioner Frank Yamaguchi Also present: Acting Clerk to the Board, Mary Reiff Assistant County Attorney, Lee D. Morrison Planning Department representative, Gloria V. Dunn The following business was transacted: I hereby certify that pursuant to a notice dated October 28, 1985, and duly published October 31, 1985, in the Johnstown Breeze, a public hearing was conducted to consider the request of Natural Gas Associates, Inc. , to amend a Use by Special Review to allow for -expansion of a natural gas processing plant. Lee Morrison, Assistant County Attorney, made this matter of record. Gloria Dunn, Planning -Department representative, read the favorable recommendation of the Planning Commission into the record. Ms. Dunn stated that 17 Development Standards are recommended for this proposal. Richard Powell came forward to represent the applicant and answer questions of the -Board. He stated that producers expect to complete twenty more wells in the area. Following Mr. Powell's presentation, Gary Sandau, _fire marshall for the La Salle Fire Department, came forward. He stated that the Uniform Fire Code gives the right to have an inspection made by a technical inspector, and stated that he would like to request en inspection by an independent consultant. Following discussion, Commissioner Brantner moved to approve the amendment of the Use by _Special Review to allow for expansion of a natural gas processing plant, with Condition #4 amended to state that the facility shall be inspected by a fire safety expert prior to recording the Use by Special Review plat, and Development Standard #8 amended to provide that traffic shall exit onto Weld County Road 52 and either continue west, t r north on Weld County Road 35. Seconded by Commissioner Lacy, the motion carried unanimously. This Certification was approved on the 18th day of November, 1985. They purchased this plant from Universal Gas and Oil earlier this year and want to expand it to fifteen million cubic feet of gas per day, if the gas production in the area warrants it. The gas from the plant -is sold primarily to Greeley Ras -Company and any gas they do not use is sold to Western Ras. At the present time approximately one load of liquid gas is taken from the property per day. If the plant is enlarged, this could increase to four or five truck loads per day when run at full capacity. The plant is designed to work unattended. -Re explained the -built in safety control features for _automatic shutdown if there is a problem. They have been working with the La Salle Tire Department so they are familiar with the plant procedures. They have tested all areas of the plant for noise at night. They have reviewed the recommendations, conditions, and development standards as outlined by the Department of Planning Services and they agree to follow them and have no problem with them. The trucks make a lot of dust now, so if the truck traffic in increased there will be a lot more dust. Merel Meyer, surrounding property owner, asked if the plant were enlarged there would be a need to lay more underground pipeline. Mr. Powell stated, yes, if the plant were enlarged more underground pipeline would need to be laid. The Chairman asked that reading of the Department of Planning Services staff recommendations, comments, and development standards be dispensed with and that they be filed with the summary as a permanent record of these proceedings. GENERAL INFORMATION FOR SPECIAL REVIEW PERMIT APPLICATION ASSOCIATED NATURAL GAS, INC. - GREELEY PLANT AUGUST 23, 1985 Associated Natural Gas, Inc. , is proposing to _permit and expand their gas processing plant one and one-half (1 1/2) miles west of Evans, Colorado. The plant being permitted was purchased on May 25, 1985, from Universal Oil and Gas by Associated Natural Gas, Inc. This plant was originally permitted by Valley Energy, late in 1983; U.S.R. — 597:83:60. The -plant is currently processing about 3MM SCF/D and mill be expanded at some point in the future (as market conditions dictate) to process a maximum ultimate volume of 15MM SCF/D. A drawing is enclosed with the permit application to show both conditions. The plant is operated as a business with no residential units at the plant site. The plant operates 24 -hours -per day -with one to two -people at the plant during normal daytime working hours. It is maintained by a crew working in and around the plant to operate and maintain the plant and the gas gathering system -which brings raw natural gas to the plant. The domestic sewage system at the site is a septic system, sized to accommodate the equivalent of a single-family residence. No additional sanitary facilities will be required at the plant site. The vehicular traffic consists of pipeline service vehicles which will be one or two pickups in and out of the site two to three times per day, plus semi- trailer truck-s which will be hauling plant products. The number of semi- trucks hauling products is presently one or two trucks per day and may be up to five when the plant is expanded. It is not the intent of Associated Natural Gas to store or stockpile any quantity of materials or waste at the site. There is no -taste associated with the processing plant, and the only materials that would be stored will be valves and piping materials Tor maintenance and repair of the pipeline system and plant. The fire protection measures necessary for a processing plant of this type, consist primarily cf continual attention to safety procedures by the employees. Fire extinguishers are available at the plant and in all vehicles. A fire hylrant on Central Weld Water is located inside the plant fence. Sound level tests will be done at the plant to assure that existing sound levels, as well as expanded sound levels, will be well within the limits of the State of Colorado's maximum permissible noise levels. Based on current operations at Associated Natural Gas, Inc. 's Kersey, and Eaton plants, the sound levels even at the ultimate condition will to well below the maximum permissible levels. Associated Natural Gas is requesting approval to operate as well as expand the existing gas processing plant on the subject property which is presently zoned agricultural, under the county regulations for the use by Special Review. This is consistent with the Weld County Comprehensive Plan _and similar plants are in agricultural zones as well as nearby the existing plant. Future development in the area is anticipated to be additional agricultural uses with continue-d development of the oil and gas available in Weld County. This future development is compatible with the use intended and in fact is necessary in the case of oil and gas development. I have received several facility design recommendations from the industry and Industrial Risk Insurers. I have also visited with Mr. Steve Berge, representing Associated Natural Gas, Inc. , and he assured me that all fire protection requirements would be followed. Mr. Berge further stated that a current plot plan of the site would be furnished to the La Salle Fire Department, showing the location of all emergency shut off valves. After reviewing the Uniform Fire Code and the suggested spacing and fire protection recommendations which I have received in the mail, I find that the facility, with the diking of the condensate tank and the location of the related equipment and product tanks, is in compliance with the Uniform Fire Code. However if the facility is enlarged there may be additional fire protection requirements such as, but not limited to, the placement of the larger compressor and the placement of water spray systems when the containers reach an aggregate water capacity of 120,000 gallons . In reference to my previous letter requesting a study of the _facility, Mr. Berge stated that Associated Natural Gas, Inc. probably had a facility design manual which covered fire protection, however I have not received this publication at this time. I have enclosed a copy of one page of the Uniform Fire Code which will give the company several guidelines to follow and questions to answer, which would be very beneficial to the La Salle Fire Department. If the company agrees to follow the guidelines and answer the Uniform Fire Code questions I don' t feeltthat a study is necessary. Mr. Powell further offered to invite the fire departments for a tour of the gas plant to explain the plant operation -and show them the valve locations. Due to the fact that we have no facilities of this type or size in our Fire Protection District we will need to have a professional opinion as to the fire protection requirements for a facility of this type. We were able to do a water flow test on the fire hydrant located at the site (see attached copy) and at a flow rate of 500 gallons per minute we do not feel this is adequate protection. Therefore we would ask that a professional study be done pursuant to the Uniform Fire Code, Article 2, Division III, Section 2.301 (d) (see attached copy) .
