Speckman, Executive Director, Human Resources ,r Memorandum of Agreement Between Human Resources' Nutrition Program Subject: and School District 6 Enclosed for Board approval is an agreement between the Senior Nutrition Program and School District 6. School District 6's Vocational Education Program will be providing a congregate meal site at the Heath Junior High School (Trademark) . A maximum of ninety (90) meals per day will be served on Tuesday and Thursday of each week for the Senior Nutrition Program. The cost of the complete meal will be $2.50, which includes milk. If you have any questions, please telephone me at 353-3816. 89:977 MEMORANDUM OF AGREEMENT THIS AGREEMENT is made and entered into this 28th day of August 1989, by and between the Board of County Commissioners of Weld County, Colorado, on behalf of the Weld County Division of Human Resources ' Senior Nutrition Project, hereinafter referred to as "Project," and Weld County School District 6, hereinafter referred to as the "School District." WITNESSETH: IN CONSIDERATION of the mutual promises and covenants contained herein, the School District and the Project agree as follows: 1 . The School District will provide a site, located at Heath Junior High School (Trademark) , and service a maximum of 90 meals per day, prepared by the Vocational Education students , to the persons eligible under Title III-C of the Older Americans Act. Meals will be served on Tuesday and Thursday of each week. 2. The School District shall provide such space and fixtures as may be necessary to serve the above described number of meals. 3. The cost of the complete meal will be $2.50, including milk. The Project will reimburse the School District on a monthly basis. The School District agrees to submit the necessary reimbursement vouchers oy the seventh working day of each month. 4. The Project further agrees not to interfere with the existing activities of the School District. 5. The School District agrees to maintain the nutritional standards set forth by the Project as specified under Title III-C of the Older Americans Act . Menus will be reviewed by the Nutrition Consultant. 890957 6. The School District service will be available only when the school is in session (October though mid-May) . 7. Modification of Agreement: All modifications to this Agreement shall be in writing ana signed by both parties. 8. Assurances: a. The School District agrees that it is an independent contractor and that its officers, employees, and clients do not become employees of Weld County, and therefore are not entitled to any employee benefits as Weld County' employees, as a result of the execution of this Agreement. b. The Project, the Weld County Board of Commissioners, its officers and employees, shall not be held liable for injuries or damages caused by any negligent acts or omissions of the School District, the School Board of District 6, its employees , volunteers, or agents while performing this Agreement. The School District, the School Board of District 6, its officers and employees , shall not be held liable for injuries or damages caused by any negligent acts or omissions of the Project, or its employees , volunteers , or agents while performing functions as described in this Agreement. The School District shall provide workers ' compensation insurance for all of its employees, volunteers and agents engaged in the performance of this Agreement, as required by the Colorado Workers ' Compensation Act. Likewise, the Project , by and through the Board of Weld County Commissioners, shall provide adequate liability and workers ' compensation insurance for all employees of the Project engaged in the performance of this Agreement. c. No officer, member, or employee of the School District and no member of their governing bodies shall have any pecuniary interest, direct or 890957 indirect, in the approved Agreement or the proceeds thereof. d. The School District understands that monitoring and evaluation of the performance of this Agreement shall be conducted by the Weld County Department of Human Resources and the results provided to the Weld County Commissioners. e. The School District and the Project assure compliance with Title VI of the Civil Rights Act of 1986, and that no person shall , on the grounds of race, creed, color, sex, handicap, or national origin be excluded from participation in, be denied the benefits of, or be otherwise subjected to discrimination under the approved Agreement. 9. Termination: This Agreement may be terminated at any time by either party giving thirty (30) day written notice. This agreement is subject to immediate termination upon the loss of funding to the Project. IN WITNESS WHEREOF, the parties hereto have duly executed the Agreement ds of the day, month, and year first above written.
