It was the re- sult of my challenge of taxation . A January , 1987 , response is at- tached for your consideration . I spoke to courteous and helpful personnel . In order to establish comparative justice , several properties in the immediate area were pulled from the files . I proceeded to re- search the taxes attached to those properties . I verified with the office that assessors DO NOT tax concepts ; they tax realities . This is what I found : . There is a clear picture of our simple home in the file . There are clear pictures of various surrounding properties . In ALL cases , our taxes are the highest . . With the representative in the office I discussed numbers of bathrooms , square footage , ease of struc- ture based on elimination of angles , etc . It was determined that low-maintenance yards negate the need for a SPRINKLING SYSTEM, non-existent on this property . . It seems that the tax was based on simple concept-- spatial illusion . If this is the case , it is JUST to apply the same reasoning to all properties in and around Weld County . The following properties were considered : o ' ,s 445 Barry St . , owners Robert and Hannah Dreiling , no 1,- 1987 entry found . 470 Barry St . , owner now Paul Dalton & , formerly occupied by Jerry Sander ' s daughter ; 2nd unit by Paul 0' Dalton ' s son . 895 McKinley Ave . , luxury duplex owned by Paul Dalton . 1 ' ,r ,. 890 South Hoover , private home with unique exterior . e-< q J 870 South Hoover , owned by Mark Davis . / 1> - 857-855 McKinley , duplex owned by Robert Lee Based on the above , we have asked for consideration in readjusting our taxes for 1987 . Stone on 1 -25-88 . I have taken the time and effort to ( again ) copy the documents to assure that you have received the mailing . We wish to reiterate as attached . Compare to similar property in the same area -- around the block : . Paul Dalton ' s Duplex on the corner of McKinley and Elizabeth . . Bob Dreiling ' s house across the street . 2 . Consider the drop in value since an ERROR was made and the Planning Commission approved the duplexes FACING BARRY ST. Originally , the duplexes were planned to face McKinley . In addition , a duplex was built right behind our property with the excuse that the owner would be living there . 3 . Consider that we PAID FOR errors made while building and this did not enhance the value--merely added cost to the basic construction . . Ex . Storage doors do NOT open because frame was not planned properly . . The second kitchen was NEVER installed . . ONLY TWO BATHROOMS are finished in the house . No others have even been planned . 4 . The basic design was planned for ease in construction and maintenance . THis SIMPLIFIES . Look at the pictures of all houses on file in the Assessor ' s Office . 5 . We do not have desirable living space on main floor . All secondary bedrooms are below ground-- in finished basement space . ONE BEDROOM is finished on the main floor . 6 . There is NO formal living room at all . 7 . This property CANNOT be compared to South Fulton Avenue ! ! ! ! But yet , we are taxed at a higher value . 8 . We have ONE garage -- not two spaces . 880211 9 . Next door is an ABANDONED house . As property was built up around the former owner , drainage was into his yard . Nothing was done by the officials to protect his property . We adjoin that property and were forced to use plastic/bark to develop any kind of acceptable yard . March 16 , 1988 TO THE HONORABLE BOARD OF COUNTY COMMISSIONERS OF WELD COUNTY : Eugene J . and Marvel G. Ebner are asking for TAX ABATEMENT on the home located at 450 Barry Street , Fort Lupton , CO 80621 , based on the follow- ing facts . 1 . It is taxed above the values of similar property in the same area . 2 . The area is not strictly residential due to Planning Commission oversight . 3 . COMMUNICATION ERRORS BETWEEN THE BUILDERS AND US caused increased costs which did not result in increased value . . The patio doors were bricked from the outside to coincide with the draftman ' s error and had to be moved . . The front windows were erroneously listed with transposed measurements and had to be reframed . . Misunderstandings occurred when the house was bid with two bathrooms on the main floor and one bathroom was moved to the lower area because of limited space . . A BEAM was installed in error across the front hall and through the kitchen which completely interfered with cabinet placement and led to redesigning the kitchen . 4 . Our lease expired on the townhouse where we lived BEFORE our home could be completed and we could "close" on the purchase . WE , there- fore , moved into the dwelling and were charged the additional costs of money-management . Our request is based on . Real value . . Comparative homes in the area . . The fact that we have a smaller lot , are located next door to multiple-units (duplexes ) , have abandoned property on another side with drainage problems , and have low-maintenance yard . We take full responsibility for the errors which led to increased "closing costs " , but we DO NOT consent to increased taxes based on error . Furthermore , the NEED TO BUILD THIS TYPE OF DWELLING WAS BASED ON A RESIDUAL HANDICAP FROM POLIO. No such barrier-free dwelling existed in Fort LUpton at the time .
