RESOLUTION RE: APPROVE SPECIAL REVIEW PERMIT FOR A LIVESTOCK CONFINEMENT OPERATION (2 ,500 HEAD DAIRY) IN THE A (AGRICULTURAL) ZONE DISTRICT - RON GORZEMAN WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners held a public hearing on the 30th day of March, 1988 , at the hour of 2 :00 p.m. in the Chambers of the Board for the purpose of hearing the application of Ron Gorzeman, 2056 South County Road 7 , Loveland, Colorado 80537, for a Special Review permit for a livestock confinement operation (2,500 head dairy) in the A (Agricultural) Zone District on the following described real estate, to-wit: Part of the SWI , Section 15 , Township 6 North, Range 64 West of the 6th P.M. , Weld County, Colorado, Lot B, RE-655 WHEREAS, said applicant was represented by Russ Anson, Attorney, and William Condon, Jr. , Attorney, represented certain opponents, and WHEREAS, Section 24 .4 .2 of the Weld County Zoning Ordinance provides standards for review of said Special Review permit, and WHEREAS, the Board of County Commissioners heard all of the testimony and statements of those present, has studied the request of the applicant and the recommendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter and, having been fully informed, finds that this request shall be approved for the following reasons: 1 . The submitted materials are in compliance with the application requirements of Section 24 .7 of the Weld County Zoning Ordinance. 2 . It is the opinion of the Board of County Commissioners that the applicant has shown compliance with Section 24 . 4 .2 of the Weld County Zoning Ordinance as follows: a. The proposal is consistent with the intent of the Weld County Comprehensive Plan. The Comprehensive Plan Agricultural Goals and Policies are intended to support and preserve agricultural industries and farming. �( � / . . / 880237 Page 2 RE: USR - GORZEMAN b. The proposed use is an agricultural service establishment and is provided for as a Use by Special Review in the Agricultural Zone District. c. The uses permitted will be compatible with the existing surrounding uses and with the future development of the surrounding area as permitted by the Agricultural Zone District. d. No overlay districts affect the site. e. Special Review permit Development Standards will provide adequate protection of the health, safety, and welfare of the neighborhood and County. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the application for a Special Review permit for a livestock confinement operation (2,500 head dairy) on the hereinabove described parcel of land be, and hereby is , granted subject to the following conditions: 1 . The Special Review activity shall not occur nor shall any building or electrical permits be issued on the property until the Special Review plat has been delivered to the Department of Planning Services Office and the plat is ready to be recorded in the office of the Weld County Clerk and Recorder. 2 . Prior to recording the Special Review plat: a. The Development Standards for the Special Review permit shall be adopted and placed on the Special Review plat. b. The plat shall be amended to show a 60-foot road right-of-way reservation from the centerline of State Highway 392 . 3 . Prior to construction of the dairy facility, evidence shall be submitted to the Department of Planning Services that the Colorado Department of Health, Water Quality Control Division, has approved an engineering report, prepared by a Colorado Registered Professional Engineer, demonstrating compliance with its Guidelines for Design of Feedlot Runoff Containment Facilities . 880237 Page 3 -RE: USR - GORZEMAN 4 . Prior to operation of the dairy facility, the applicant shall install a 4" fire hydrant on the east right-of-way boundary of Weld County Road 55 adjoining the property. The fire hydrant shall be served by an adequate, legal source of water. 5 . The Special Review permit plat shall be amended to show any proposed corral or fenced pasture areas on the site and to show the existing and proposed drainage ways. 6 . Prior to construction of the dairy facility, the applicant shall develop a plan that will address the diversion of storm water from the north and how that storm water will be directed to Weld County Road 55 . The plan shall address the quantity of runoff, structures involved, and potential erosion problems. The above and foregoing Resolution was, on motion duly made and seconded, adopted by the following vote on the 30th day of March, A.D. , 1988 . The Special Review permit is for a livestock confinement operation and dairy as submitted in the application materials on file in the Department of Planning Services and subject to the Development Standards stated herein. The maximum number of livestock shall not exceed 2 ,500 head. -2. The applicant shall be responsible for implementing and maintaining the runoff retention and containment facilities in accordance with the engineered report as approved by the Weld County Health Department and the Colorado Department of Health, Water Quality Control Division. The runoff containment shall be separate from the waste water disposal system, and the facilities shall be constructed and maintained in accordance with the State Health Department ' s Guidelines for Design of Feedlot Runoff Containment Facilities and standards stated herein. The applicant shall be responsible for any additional requirements issued by the Colorado Department of Health, Water Quality Control -Division. 3 . Land application of wastewater from the retention basins shall be onto farm land for irrigation and not discharged into State waters. 4 . All storm water and dairy operation runoff from the portion of the site which includes the house, barns, livestock pens, feed storage area, and labor housing shall be controlled and confined within the boundaries of the subject property. This Standard shall not apply to the portion of the site which will be used for pasture and crop land. 5 . The applicant shall comply with all State Health Department requirements for construction and operation of a dairy. 6 . The applicant shall remove, handle, and stockpile manure from the livestock confinement area in a manner that will prevent nuisance conditions. The manure piles shall not be allowed to exist or deteriorate to a condition that facilitates excessive odors, flies or insect pests, or pollutant runoff. The manure storage site shall have a water-tight surface which does not permit seepage or percolation of manure pollutants into the ground. 880237 Page 2 DEVELOPMENT STANDARDS - GORZEMAN 7 . The septic systems for the proposed milking barns shall be 'designed by a Colorado Registered Professional Engineer according to the Weld County Individual Sewage Disposal Regulations . I . Fugitive dust shall be confined on this site. -9 . The water source for the dairy operation shall be North Weld _County Water District or a well permitted by the Division of Water Resources or approved by Division 1 Water Court specifically for the dairy operation. In the absence of such approval, a well may only be used for domestic purposes only and not the dairy operation. 1 10 . The addition of residential dwellings, including mobile homes or manufactured homes on the property, not shown herein shall require an amendment to the Special Review permit. 11 . The fire hydrant adjoining the site shall be inspected annually by the Galeton Fire District and shall be maintained in working order at all times. 12. The septic systems for the proposed labor housing shall be designed by a Colorado Registered Professional Engineer according to the Weld County Individual Sewage Disposal Systems -Regulations . The applicant shall provide a preliminary study of soils and geologic conditions at the site to the Weld County Health Department. 13 . Waste oil, waste paints, stains, treatments, spent drug containers, empty livestock dip containers , antifreeze , and other associated liquid and solid wastes, shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 14 . Access to the Special Review facility shall be from the three accesses located on Weld County Road 55 as shown herein. No 'direct access shall be allowed onto State -Highway 392 . 15 . If erosion damage occurs to the east ditch of Weld County Road 55 as a result of storm water diversion, the applicant shall repair any such damage. 16 . All construction on the property shall be in accordance with the requirements of the Weld County Building Code Ordinance. 17 . The property owner or operator shall be responsible for complying with the Design Standards of Section 24 .5 of the Weld County Zoning Ordinance. 880237 Page 3 DEVELOPMENT STANDARDS - CORZEMAN 18 . the property owner or operator shall be responsible for complying with the Operation Standards of Section 24 .6 of the Weld County Toning Ordinance. 1S . The property owner or operator shall be responsible for complying with the Supplementary -Regulations of Section 43.1 of the Weld County Zoning Ordinance. 20 . Personnel from the Weld County Health Department, Oa1eton Area Fire Protection District, Colorado Department of Health, and Weld County Department of Planning Services shall be granted access onto the property at any reasonable time in order to ensure the activities carried out on the property comply with the Development Standards stated herein and all applicable Weld County Regulations. 21 . The Special Review area shall be limited to the plans shown herein and governed by the foregoing Standards and all applicable weld County Regulations. Any material deviations from the plans or Standards as shown or stated shall require the approval of an amendment of the permit by the Weld County Planning Commission and the Board of County Commissioners before such changes from the plans or Standards are permitted. Any other changes shall be filed in the office of the Department of Planning Services. 22 . The property owner or operator shall be responsible for complying with all of the foregoing Standards. Noncompliance with any of the foregoing Standards may be reason for revocation of the permit by the Board of County Commissioners. B80237 HEARING CERTIFICATION DOCKET NO. 88-10 RE: SPECIAL REVIEW PERMIT FOR LIVESTOCK CONFINEMENT OPERATION (2,500 HEAD DAIRY) IN THE A (AGRICULTURAL) ZONE DISTRICT - RON GORZ-EMAN A public -hearing was conducted on March 30, 1988, at 2:00 T.M. , with the following present: Commissioner Gene Brantner, Chairman Commissioner C.-W. Eirby, Tro-Tem Commissioner Jacqueline Johnson Commissioner Gordon E. Lacy Commissioner -Frank Yamaguchi Also present: Acting Clerk to the Board, -Tommie Antuna Assist-ant County Attorney, Lee D. Morrison Planning -Department representative, Lanell Swanson Certified Court Reporter, Jacque Wilson During this hearing, several exhibits were submitted by the proponents and opponents of this matter. The exhibits were marked for the -record by Mr. Morrison. The following business was transacted: I hereby certify that pursuant to a notice slated February 29, 1988, and duly -published Starch 17, 1988, in the Johnstown Breeze, a public hearing was conducted to consider the request of -Ron Gorzeman for a Special Review permit for a livestock confinement -operation for 2,500 head of dairy in the A (Agricultural) Zone District. Lee Morrison, Assistant County Attorney, -made This -matter -of -record. Lanell Swanson, representing the Department of Planning Services, said a motion was made at the Planning Commission meeting to recommend this request favorably to the Board, with said motion being subject to five Conditions and 21 -Development Standards. Ms. Swanson said there was a tie vote on this motion; therefore, there was no recommendati-on from the Planning Commission concerning this request. Bob -Ehrlich, en adjoining property owner, came forward at this time and stated that he is in favor of this proposed -operation. Russ Anson, attorney representing the -applicant, gave his presentation. He said the applicant has agreed to comply with the Conditions and Development Standards. Mr. Anson addressed concerns which have been stated in letters to the Board. Pat McNear, realtor, and Don Carlson, engineer, also made presentations for the applicant. Ton Gorzeman, the applicant, made -comments concerning his proposed -operation. (Tape Change #88-14) Drew Scheltinga, County Engineer, answered questions of the Board concerning the roads, the borrow pits, and the topography of the land at the site of the proposed operation. Scott Perkins, of the Health Department, answered questions concerning the storm -water and dairy operation runoff. Ma. Swanson suggested that Development Standard #4 be amended to read as follows: "All storm water and dairy operation runoff from the portion of the site which includes the house, barns, livestock pens, feed storage area, and labor housing shall be controlled and confined within the boundaries of the subject property. This standard shall not apply to the portion of the site which will be used for pasture and crop land." After a short recess, Steve Wells, neighbor, spoke in favor of the proposed dairy. Bill Condon, attorney representing -opponents of this request, made his presentation. Others speaking in opposition were Myron Phinney, Ed Tergeson, Dan Tietmeyer, Alex Heidenreich, Alvin -Heidenreich, Walter Henderson, Mrs. Junior Anderson, Maureen Tietmeyer, Laurel Bojanowski, Don McLain, Teresa Jones, Susan Rettele, and Gary Uhrich. (Tape Change 1188-13 during comments by Mr. McLain.) Mr. Condon -made his closing statements, and 880237 -1` ;� y Page 2 RE: CERTIFICATION - GORZEMAN Mr. Anson presented his rebuttal. Mr. Anson called Mr. Perkins and Mr. Carlson forward to answer further questions. In response to -questions posed by Commissioner Kirby, Ms. Swanson recommended that Condition #6 be added, said condition to read as follows: "Prior to construction of the dairy facility, the applicant shall develop a plan that will address the diversion of storm water from the north -and how that storm water -will be directed to Weld County Road 35. The Tian shall address the quantity of runoff, structures involved and potential erosion problems. The plan shall be approved ty the Weld County Engineering Department." Ms. Swanson further recommended that the Development Standards, from #15 be moved forward and a new #15 be added, which would read: "If erosion damage occurs to the east ditch of Weld County Road 3-5 as a result of storm mater diversion, the applicant shall repair any such damage." After further comments -by Mr. Scheltinga and Mr. McNear, Mr. Anson made his summary statements. Mr. Morrison commented on the use of borrow pits, and Mr. Scheltinga answered questions of the Board 'concerning same. Mr. Perkins answered questions 'concerning water and/or soil pollution and odor violations. Following -discussion, Commissioner Johnson moved to approve the Special Review permit for Ron Dorzeman, subject to the Conditions and Development Standards as amended. Commissioner lacy seconded the motion. On a roll mall vote, the motion carried 4-1 with _Chairman Brantner voting nay. This Certification was approved on the 14th day of April, 1388. Five (5) -profile pits were excavated in the approximate locations of the proposed retention _ponds, the labor housing and residence; to a depth of eight (8) feet. The United States Soil Conservation Survey identifies three (3) types at this site (Section 15, Township 6N, Range £4W) : The Otero sandy loam, Nelson fine sandy loam, and the T₹tedalund loam. The soils are moderately deep to deep, well drained soils with rapid to moderately rapid permeabili- ties. Surface runoffs and erosion hazards for these soil types are low. Visual observation of the profile pits confirmed USSC surveys of the site. The soils observed were predominately light brown, firm-fri-able silty -sands and sand loams from surface to a depth of -40-90 inches. Clayey silts and sands were observed at depths from 70-9?) inches. Silty clays were observed at the -proposed retention pond locations at a depth of 90-108 inches. There are precautions that may be taken, however, nothing is absolute--there are no patentees! Prior generations were unaware of the long range outcome of environmental deterioration. This dairy will be equiped with twelve trailer houses for-employees and a massive lagoon system so handle the waste products. The contention is that the positive effects out weigh the bad—and when considered in that aspect alone, it's correct. The other side of this is that there is a group of families surrounding the area that would be directly and adversly affected. Their property values would decline and their quality of life would greatly deteriorate. Is it right to say that some should be forced to sacrifice so others could be allowed to profit? I certainly do not possess the wisdom to determine this! Another very important consideration is the effect on our environment. By Weld County's own soil analysis, the ground in this particular area is sandy loam. The rapid hazard of ground water contamination from sewage permeability causes a g lagoons. There are precautions ma y may be taken, however, nothing is absolute--there are no guarentees! At this point in time when our environment is so vulnerable, a remote possibility of further contamination has the potential of a hazzardous, wide-spread and long-term outcome. Water contamination begins as a seep, accesses to ditch water, further accessing to river water, thus spreading quickly and uncontrolably to far reaching areas. Prior generations were unaware of the long range outcome of environmental deterioration. We are now knowledgeable and concerned and now is the time to clean up past contamination, whenever possible, and prevent further abuse of our land. Construction and reconstruction of housing, businesses, industral parks, road-ways, etc. will con- tinue. Our land, the basis of our existance, cannot be reconstructed after it has been destroyed. We owe it to our children, county, state and country to use the land cautiously and carefully, thusly turning it to the next generation in a manner in which they can live and raise their families without fear. Indeed, there are pros and cons to this particular venture. The things to be considered are: !). Do the short term advantages out weigh the long term disadvantages? 2). Will the revenues generated sufficiently off set the costs suffered by some individuals in the onset of this as well as cover the potential damage to our land? 3). Could the county's best interest be served by recommending relocation to an area where sewage lagoons could be safely implemented? 4). Is this a morally and ecologically sound proposal? Our commissioners have a grave responsibility in their decision. We hope this matter will be given the utmost consideration and caution. As far as I am concerned this dairy operation would definetly be a violation of the rights of the surrounding residents. A number of us have aspirations of living out away from the hassle and hustle of city life. The people in this area have either farmed the area for a number of years or have chosen to build and secure a future in this neighborhood because of the sense of serenity the area offers. Allowing this dairy to come into the area would disrupt the neighborhood in many different ways. I understand that this operation plans to put twelve trailer houses on the property for hired help. The family living next to the site might as well move into town because they are going to overrun by "NEIGHBORS". The lagoon system is cause for alarm due to the ecological problems that may arise. There are many water sources-irrigation ditches, wells, creeks, tiles,etc. that stand a great chance of being contaminated due to the type of soil the dairy is to be built on. I realize the plans are being closely watched and there are quite a few concerns noted by different agencies. Most of the problems can be rectified by changing the original plans. My question is who is going to be responsible for making sure the problems are corrected not only on paper but in the physical building of this dairy? The land purchaser has already indicated a lack of concern for the environment by exercising the intention to con- tinue with this operation knowing of the conamination factor. It is my understanding a 2500 head dairy has been proposed for the northeast corner of WCR 55 and Hwy. 392. My Family has had a cow/calf operation for many years and we are very familiar with how many head of cattle can be confined to an area without damage to property. Our cattle are confined to corrals for a short period of time in between taking them off of the winter feed and sending them to simmer pasture. We have problems with insects for the short amount of time our cattle are penned up and are very worried about pest and insect problems that will arise fran having so many cattle constantly confined to a relatively small area. We are already faced with a 1200 head dairy directly across the road fran the proposed site of the 2500 head dairy. How can the area support nearly 4000 head of cattle without damage to the surrounding properties? Many of us in the area also winter cattle and sheep on the surrounding farms which will increase the livestock population even more. I an also concerned with the twelve trailer houses that are to be installed for the employees of this dairy. I am afraid of being overrun by people's pets-mainly dogs. Are there any measures being taken to restrict pets? My neighbors are vey considerate of my cow/calf operation and strive to keep thier dogs from running or killing my cattle. The soil in our area is classified as sandy loam and I know from experience that the potential for water contamination, due to a fluctuating water table and the type of soil is of great concern to me. We have a tail water pond with a lift pump that we use for irrigation. The water in this pond would be adversely affected by any sewage and chemical run off fran the dairy. Farming for a living is difficult enough without being subjected to the additional worry over possible crop and water contamination fran sewage and chemicals destroying my very livelihood. I am asking that you please take a long, hard look at the problems and concerns of those of us who stand to lose the very things we have worked so hard for because an operation such as the 2500 head dairy can care in and make a profit at my expense and at the expense of all the people in the area. We, as home owners in the area are not opposed to dairy operations. We have several, smaller existing dairies in the area. These dairymen are friends as well as neighbors. We are not opposed to industry being generated in our county. We do, however, question the choice of location. This area has established both large farms (by todays standards) as well as smaller parcials. Some have been here all their lives while some have bought and built fairly recently. We question the intense saturation of one area. The potential of an excess of four thousand cattle in a one-half mile area is a little much. We have been told that when one chooses to live in the country, one must be prepared to smell country smells. We whole-heartedly agree. We all raise livestock of one kind or another. Country smells are part of the environment that intices one to go outside the city limits. What we do not expect, is to be subjected to the "mad-made septic" odors associated with lagoon systems. We have been told that we must expect the land to be used in the capacity for which it was originally zoned. Again, we whole-heartedly agree. The special use of the land requested falls outside the capacity for which the land was originally zoned or a special use permit would not be required. We chose to give up the conveniences of finger-tip shopping centers, paved streets and sidewalks, close-in fire and police protection, shorter commut- ing distance to and from our work places and we also chose against the congestion and pollution factors associated with city living. We are trying to protect our environment as it was when we chose the area. Had we wanted to live near an operation such as this we would have chosen to--probably at a much reduced monetary cost to us. However, we chose not to. The investment one makes in his home is probably the largest in his life. Careful and painstaking considerations are made and hard earned money invested. We are trying to protect our lifestyles and values that we chose for our family. There is, however, an economical theory (pointed out by the planning commission) called the "Fallacy of Composition" which is when the sum of the parts is not equal to the whole. We feel that an area better suited to the operation and less populated would be in everyones best interest. We are not anti-dairy but we are pro-home! This accumulation comes to the southwest corner (our corner) and to the east portions of the farm. We are very moncerned about the dama e -a flooded out lagoon or corrals can do to our property and others. This farm has a lot of seep. We're concerned about all the leach- fields and lagoons causing the water table to rise, thus causing water in our basement. We can -see no guarantee that a dairy of this size will -not cause damage to our property or its value. We hone you will take into consideration that you have already approved a 1200-head dairy right across the road crest of our home. We feel that the combined 3700-head, and from om he information fmat n life have and gathered, 4 lagoons, so near to our home affect our way of the saleability of our property. '7e have family operated dairies in our area, and more possible ones, which are assets to our community. The size of this operation will cause the following problems: -1. The smell from the lagoons. There is a tremendous difference it smell between corrals and lagoons. 2. -If we have a flood, this will be raw sewage coming down on us from the lagoons. 3. He felt rerouting wastewater on this farm is not feasible. Dan Tietmeyer, area resident, stated he is concerned with the impact the dairy will have on the area's quality of life. Teresa Jones, property owner 1.5 miles from this area, stated they had not been contacted by Mr. McNear regarding this dairy. Dean McElroy, area property owner, stated he was not contacted regarding the dairy going into this area either. He, also, is concerned about the impact the dairy will have on the quality of life in the area and the possibility of declining land values. Derald Peterson, surrounding property owner, spoke against this request because of the possible adverse affects the dairy could have on the quality of life in the area and the offensive odors that are sure to arise from the lagoons. Louis Rademacher — Yes; Leann Reid — Yes; Ivan Gosnell - Yes, he lives closer than one-half mile from a dairy, but it is not quite this size. When he bought the property he knew that there was the possibility of having some of the conflicts a dairy presents. Therefore, he puts up with the smell like everyone else in the area does . There are times when he does not necessarily like it, but it is part of living in a farming community. Ernie Ross - No; Paulette Weaver -- No, clearly Weld County is an agricultural county and we do need agricultural enterprises in the county, but as with any other development it needs to be located appropriately and sized appropriately. It seems there is already a considerable density of dairies in this area. This proposed dairy is twice as large as any of the others in the area so it is probably doubling the amount of cattle in the area. It seems people have little trouble with the smaller dairies, but when they become this large, there seems to be understandable opposition. Not everyone thinks that "big" is something they appreciate. This is called a family operation, but if it requires 12 or 14 employees she would not define this as a family operation. There seems to be overwhelming opposition from the people in the immediate area. While we do need agricultural operations in this county, just because something is agricultural does not mean that she, at least, has to approve the operation. She feels there are other things that need to be looked at . In this case, she is inclined to say that although the dairy may be perfectly run in terms of technical operation and other aspects that are important, it seems that it is not appropriate in this particular location. Ann Garrison - No, her decision is based mostly on economics. In making decisions you look at additional benefits and additional costs. She feels that the additional costs to the people in the area and to the environment outweigh the 1 , additional benefits. In economics there is something called the fallacy of composition. When the fallacy of composition deals with the sum of the parts not being equal to the whole, then she feels that the fallacy of composition rules in this particular case. There may be development standards for every dairy in the area which would protect the residents from that dairy, but if you look at the whole, the development standards that would protect the environment and the residents from each individual dairy would not necessarily protect the environment and the individuals from the whole. Motion is a tie vote with three voting for the motion and three voting against the motion. Lee Morrison explained in this instance the motion fails. The Planning Commission on occasion has considered a following motion to explain to the Board of County Commissioners what they wanted the vote to mean. Basically, -what has been done before is that a tie vote is considered no opinion. Bobbie Good Secretary 880237 AGREEMENT THIS AGREEMENT is made this /off` day of � 4/,7 , 1988, by and between UNION PACIFIC RESOURCES COMPANY ( "UPRC" ) and RONALD GORZEMAN ( "Gorzeman" ) and is based on the following premises: WHEREAS, Gorzeman owns the surface rights to certain property located in Weld County, Colorado, and which is described more specifically as the SW/4 of Section 15, Township 6 North, Range 64 West ( "Property" ) ; and WHEREAS, Gorzeman intends to develop the Property for dairy operations and in furtherance of such intention has applied to the Weld County Board of County Commissioners for a use by Special Review ( "Application" ) ; and WHEREAS, UPRC owns the oil and gas which underlies the Property; and WHEREAS, the parties desire to protect the rights of UPRC to develop the oil and gas underlying the Property consistent with Gorzeman ' s plans to develop the surface of the Property; NOW, THEREFORE, in consideration of the premises, the mutual covenants herein contained and other good and valuable considera- tion, the parties agree as follows: 1. Drilling and Drillsite: UPRC shall have the right to enter upon the Property for the purpose of drilling one well on each forty acre drillsite location ( "Drillsite Location" ) as follows: a-i,• geF 880237 --�_ Drillsite #1 NE/4SW/4 Drillsite #2 NW/4SW/4 Drillsite #3 SW/4SW/4 Drillsite #4 SE/4SW/4 UPRC shall have the right to drill each of the wells which are located on Drillsites #2, 3, and 4 in the center of the forty acre Drillsite Location. The well which is drilled on Drillsite #1 shall be located no more than 200 feet to the east of the center of the forty acre Drillsite Location. 2. Access: For each Drillsite Location and commencing with preparation for the drilling of a well and continuing until the well is plugged and abandoned, UPRC shall have full rights of ingress and egress to the location along mutually acceptable routes at any time and for any purpose it desires related to oil and gas operations. 3 . Oil and Gas Facilities : UPRC shall have the right to locate permanent pumping units and tank batteries on each Drillsite Location, or, with respect to tank batteries, it shall have the right to locate them at a separate 1 1/2 acre location along Route 392 which is mutually acceptable to the parties and in such a manner as to not interfere with surface operations and UPRC shall have full rights of ingress and egress to such location. 4 . Activities on Property: UPRC shall have the right, but not the obligation, to drill the wells at the Drillsite Locations specified in paragraph numbered 1 ; however, UPRC is not obligated to commence any activity within any specified period of time. - 2 - 880237 5. Cooperation: Gorzeman shall, without expense to Gorzeman, cooperate with UPRC throughout UPRC ' s operations on the Property. Gorzeman shall not construct any facilities on the Drillsite Locations or take any action that would interfere with or diminish IIPRC' s interests in the Drillsite Locations and such mutually agreed upon access routes to such Drillsite Locations without prior written approval from UPRC. 6. Term: This Agreement shall be effective on the date of the Agreement and shall continue at all times and from time to time until and thereafter for so long as UPRC conducts operations on the Property. 7. Application: Gorzeman shall provide the Weld County Planning Commission and the Board of County Commissioners of Weld County with a copy of this Agreement as a part of the Application. Subject to Gorzeman' s compliance with this Agreement, UPRC has no objections to Gorzeman' s application for a use by Special Review Permit . 8 . Successors: This Agreement shall be binding upon, and shall inure to the benefit of the successors, assigns, agents, represen- tatives, lessees, and farmoutees of each of the parties. 9 . Final Agreement; Amendment : This Agreement represents the entire agreement between the parties with respect to the Applica- tion. The parties do not intend that this Agreement in any manner constitutes a waiver of any surface damages to which Gorzeman may become entitled. We purchased our home and 9 acres and an additional 200 acres in Weld County (within 500 feet of the proposed dairy operation) in October 1986. We left a long-time family farming and ranching operation in Douglas County because it had became one of the fastest growing counties in the country. To get away from dense population areas we moved our family to Gill and made a considerable investment to acquire this place. We chose this place because we felt it afforded our family with a life again in an atmosphere that was quieter, cleaner, more healthful and more rural. Recently (in the last few months) another 2,500 head dairy operation was approved within 500 feet of us. We did not officially protest this. While we were not pleased we felt we were new and didn't particularly want to create problems. However, with this new request that you-have under consideration we must tell you that we are adamantly opposed to your approving the same. 5,000 head of dairy cattle within such a short distance (all within 500 feet of us) is entirely too much. Under current mill levy rates, our house and 9 acres is appraised at $250,000. We feel that 2 dairy operations of this size within 500 feet of our property is entirely too much and would greatly de- `a lue our property and potentially affect what has been a considerable investment on our part. Further, we feel that it would also affect any future resale and marketability of our property. Historically the tail water from a portion of the land located north of this property had three options; it could be utili2ed for irrigation on approximately 40 acres in the northwest portion of this parcel. ; it could be allowed to flow directly off of this parcel through an existing irrigation ditch running along the north boundary of this parcel and then along County Road 55 to where it drained into Owl Creek; or- a ditch running north and south allowed the water to flow approximately 1200 feet_ south and then along an existing roadway westerly to County Road 55 where it would then again drain into Owl Creek. At which time Mr. t3c]reman begins construction of the dairy, he will eliminate one of these opti ons, and that being the latter of the ditch which runs north and south through the north end of the property. This will provide a much better situation for the drainac a of said water than what has existed in the past by the elimination of the some of the soil erosion and should allow less silt to accumulate in the County barrow pit. Soon another comes and another and another. Suddenly this group of -hare owners determines that the cattle feeder mist cease his operation due to environment, sanitation, visual desecration of the area or whatever—and he is out of business. The land is sold, re-worked and more homes are built with the original hare owners' property values increased. This is sad, in the fact, that each of us are guaranteed our right to choice. We can choose to live on the east coast or west coast, in a large city, a small town or in a rural, outlying area. We also can choose the environment we wish to be surrounded by. In the instance above the home owners chose the area with the cattle feeder already in existance. What we see happening now is a similar situation in reverse. We have people in this area that chose to live in a rural area and give of themselves to their land and their homes. Some families have been on their land for generations, some have not. But, all of us have put a lifetime of work or our life savings into the lifestyle that we chose. Now, we are asked to make a major and unwanted change in what we value and have worked so hard for. We have family owned and operated dairys in the area. We were knowledgeable of them when the decision to buy was made. They are extremely dedicated and hard working—but, for their families, not big business! Better neighbors and dearer individuals could not be found. We all are concerned for our neighbors and are extremely careful not to disturb or disrupt each others "right to peaceful existance" which we all chose. Although we may not be able to cite legalities as to why a 2500 head dairy operation should not be established, we are trying to show that there are humanities involved. As surrounding neigh- bors, we cannot show that the effect of this proposed operation is direct and devasting. We can, however, show that there is concern and compassion for each other in our "little community" and a large business oriented operation would indeed, directly and drastically alter the entire neigh- boring community. We DO NOT want that very important aspect of our enviroiarent altered or des- troyed! Lie Phinneys are the most directly affected and must show that. All we, as neighbors, can do is support them. We feel the intensity with which one can love his land and resist such a drastic and personally devasting change. It is sad that an individual's right to privacy and choice can be challenged, but it can be and all to often is. It doesn't lessen the heart-felt loss. All one can do when your have and values are altered is up-root and try to find privacy, cleanli- ness and the openness sought in another area. Aside fran the monitary loss in up-rooting is the fact that one is forced to "leave behind" a part of their life and labor that cannot be recaptured anywhere at anytime. We would ask that our right to a peaceful existance and freedom of choice not be overlooked in this matter. WE DO NOT FAVOR THE DAIRY OPERATION PROPOSED IN THIS AREA! Swanson: Subsequent to our phone conversation January 18 , 1988 , the following information is provided to clarify the storm water management plan: 1. You will note that the sketch plan provided in the -preliminary engineering report identifies the loca- tion of the combination feedlot runoff collection/ "clean water" diversion facilities along the eastern and western sides of the pen area . Detail No. 1 on the following page describes the structures. They are designed to collect contaminated runoff from the pens and transport the liquids to the containment facilities . Straw bales will be placed every 100 feet perpendicular to the direction of flow to trap the solids and allow only the liquid portion of the waste stream to be carried to the containment facilities. The outside edge (the edge farthest from the fence line) will actually be a raised berm. It will ensure that the feedlot runoff remains in the collection/sedimentation ditch and also divert uncontaminated runoff away from the feedlot and containment facilities . Detail No. 7 shows the slopes of the pens toward the ditch and the relative locations of the collection/ sediment ditch and diversion berm. 886237 January 19, iJ88 Page 2 2. Both phases of the project are identical in size and will follow the same design concepts for runoff containment and "clean" water control and diversion. 3 . There will be a net decrease in total runoff from the entire approximately 160 acres due to the construction of the containment structures. All runoff from the pen area for a storm up to a 25-year 24-hour event will be retained and used for irrigation. Although the Weld County Subdivision Regulations only specify the design storm- frequency (i.e. 100-year storm) and not the duration, it is typical to use a 1-hour to 2-hour event. These events represent the common high-intensity, short-duration summer thunderstorm. The storm water control plan for the uncontaminated runoff is designed accordingly. 4 . It has also been brought to my attention the existence of field drain tiles on the property. As the northern half of the property is taken out of irrigated crop production, the drain lines will collect and carry little if any water. In any event, the lines will be located and appropriately considered during the final designs and construction. 5. Sanitary wastewaters from the bathroom facilities from both dairy barns and from the dwelling units will be collected and disposed in accordance with Weld County Health Department regulations utilizing properly designed septic tank and leach field systems . Summary In order to minimize the applicants ' initial planning and design expense, a preliminary plan has been developed. Mr. Gorzman fully intends to meet all County and State guidelines and regulations. Once the County approves the Special Use along with appropriate conditions of approval , 880237 January 19, ] 8 Page 3 final designs will be completed. The Gorzman family success- fully operates sizeable dairy operations in Larimer County and in New Mexico . This will be a valuable addition to the agricultural economy of Weld County.
