N O RE: APPROVE RELEASE OF COMPLIANCE SECURITY - SUNSHINE VALLEY

WHEREAS, the Board of County Commissioners of Weld County,
A Colorado, pursuant to Colorado statute and the Weld County Home
o 3 Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and

o WHEREAS , Development Standard #11 of an Amended Use by
M Special Review for Sunshine Valley Petroleum Corporation, approved
w x March 4 , 1987 , on property described as the NEB, Eh NW4, W1 SE4 of
•• w Section 33 , Township 6 North , Range 65 West and the N' NW4 of
w Section 4 , Township 5 North, Range 65 West of the 6th P.M. , Weld
x County, Colorado, provides that security in the amount of $5 , 000
Ni-1 per well is to be retained until each well is capable of
u production, after which a single $5, 000 bond or security shall be
o z held on the entire area, and
WHEREAS, the Department of Planning Services has recommended
m that the Board release the $30,000 security on the six wells
crow currently on this parcel of ground and require that the applicant
rn place $5 , 000 into a bond or security to be held on the entire area
M z until all wells on the Use by Special Review site are capped in

WHEREAS , after review, the Board deems it appropriate to

NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the $30, 000 security
on the wells located on the hereinabove mentioned property be, and
hereby is , released , conditional upon the applicant placing $5 ,000
into a bond or security to be held on the entire area until all
wells on the Use by Special Review site are capped in accordance
with the State regulations.

Re: Release of compliance security for Sunshine Valley Petroleum
Corporation.
Dear Commissioners:
Attached is a -copy of a letter from Mr. William C. Crews, requesting that
$25,000 of the $30,000 security being held to ensure compliance with the
requirements of Amended USR-717:83:64 be released. This security is to be
retained only until the oil wells are capable of production, and then a
single $3,000 bond or security shall be held on the entire area of the Use
by Special Review area until all wells are capped.
The property has been inspected by the Planning -Department and the Building
Inspection Department. The Planning Department has determined that the
applicant is complying with the approved Development Standards for the Use
by Special Review permit. The Building Inspection Department has approved
final inspections for the building permits on the following six wells:
1) Hoshiko #1-33 (NE} NE} of Section 33, T6N, R63W of the 6th -P.M. , Weld
County, Colorado.)
2) Hoshiko 112-33 (NW} NE} of Section 33, T6N, R65W of the 6th P.M., Weld
County, Colorado.)
3) Hoshiko 113-33 (NE} NW} of Section 33, T6N, R65W of the 6th P.M., Weld
County, Colorado.)
4) Hungenberg #7-33 (SWI NEl of Section 33, T6N, R65W of the 6th P.M. ,
Weld County, Colorado.)
5) Bliss 1115-33 (SW} SE} of Section 33, T6N, R65W of the 6th P.M., Weld
County, Colorado.)
6) Noffsinger 112-4 (NW} NEI of Section 4, T5N, R65W of the 6th P.M., held
County, Colorado.)

The _Department of Planning Services recommends that the Board of County
Commissioners release the $30,000 security on the foregoing wells and
require that the applicant place $5,000 into a bond or security to be -held
on the entire area until all wells on the Use by -Special Review Site are
capped in accordance with the State Regulations.

Per our conversation, I enclose a letter which, when executed by the Chairman
of the Board of County Commissioners with an attached Resolution, will release
$25,000 of the $30,000 Sunshine Valley Petroleum Corporation has on deposit at
Union Colony Bank in connection with Amended U.S.R.-717:85:64. The Hoshiko
#1-33 account will be kept open and the $5,000 in that account will cover all
of the wells drilled under the U.S.R.
Your prompt submission of this matter to the Board of County Commissioners
will be sincerely appreciated. When the Board has executed the enclosed
letter, please call Cynthia Zeren at my office to notify her it is ready to be
picked up and taken to Union Colony Bank.
