The applicant has complied with all the application requirements listed in Section 21 . 7 et seq. , of the Weld County Zoning Ordinance. 2 . The request is in conformance with Section 21 . 6 of the Weld County Zoning Ordinance as follows: a . The existing zoning is faulty and the proposed rezoning of this property will correct it. The duplex located on this property was constructed in 1966 . The duplex is a nonconforming use . On August 25 , 1981 , the Weld County Commissioners adopted the official Weld County Zoning Ordinance and Map which repealed the existing zoning Resolution and established several new zoning 2Locc 880426 Page 2 o 0 RE: COZ - WELD COUNTY NO classifications in the County. Cherry Avenue provides access to the property. ko Cherry Avenue is classified as a County local o street and is adequate in size to meet the cua requirements of the proposed zone district. The property is not located within a Geologic or x Flood Hazard Overlay District, but is located a within the Airport Overlay District. Kirby, Pro-Tem Commissioner Jacqueline Johnson Commissioner Gordon E. Lacy Commissioner Frank Yamaguchi - Arrived later Also present: Acting Clerk to the Board, Mary Reiff Assistant County Attorney, Lee D. Morrison Planning Department representative, Rod Allison The following business was transacted: I hereby certify that pursuant to a notice dated April 27, 1988, and duly published April 28, 1988, in the Johnstown Breeze, a public hearing was conducted to consider the request of Weld County for a Change of Zone from R-1 (Low Density Residential) to R-2 (Duplex Residential) Zone District. Lee Morrison, Assistant County Attorney, made this matter of record. Rod Allison, Planning Department representative, entered the favorable recommendation of the Planning Commission into the record and said that, in compliance with a request from the Health Department, the Planning staff would like to recommend the addition of a Condition requiring an ISDS evaluation. (Let the record reflect that Commissioner Yamaguchi arrived during Mr. Allison's comments.) William Bohlender, Attorney representing Jerre Largent, the landowner, objected to the addition of this condition. Commissioner Kirby expressed the opinion that the recommended Condition is not appropriate in this situation. No public comment was offered concerning this request. Commissioner Lacy moved to approve this request for a Change of Zone, with the stipulation that, if an ISDS evaluation proves to be necessary, the charges are to be borne by Weld County and not the landowner. The motion was seconded by Commissioner Kirby and carried unanimously. This Certification was approved on the 6th day of June, 1988. Largent, owner of a duplex located at 1829 - 1831 Cherry Avenue, to initiate a rezoning from R-1 (Low Density Residential) to R-2 (Duplex Residential) zone district. It is the opinion of the Department of Planning Services' staff that the petitioner has shown the existing zoning to be perceived as faulty and that the proposed rezoning of this property would correct it. The Weld County Assessors records show that the construction of this duplex occurred in 1966. The parcel on which the construction occurred was zoned "Estate" which was approved by Weld County on September 26, 1962. In 1981, Weld County in a comprehensive redistricting of the county changed the "Estate" zone to R-1 (Low Density Residential) . An administrative remedy was provided for minor corrections with the redistricting procedure in Section 8.2.4 of the Weld County Zoning Ordinance. The property owner could have requested a meeting before the Board of County Commissioners for the purpose of making a minor correction to the zoning classification approved by the Board of County Commissioners.
