POST WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners held a public hearing on the 13th day of November, 1985 , at the hour of 2 :00 p.m. in the Chambers of the Board for the purpose of hearing the application of William and Marjorie Post, 2887 Weld County Road 39 , Brighton, Colorado 80601 , for a Use by Special Review for a horse training facility and accessory structure larger than 1 , 500 square feet in a platted subdivision on the following described real estate, to-wit: Lot 5 , Second Replat of Apollo Subdivision, located in Section 19 , Township 1 North, Range 65 West of the 6th P.M. , Weld County, Colorado WHEREAS , Section 24 . 4 .2 of the Weld County Zoning Ordinance provides standards for review of said Use by Special Review, and WHEREAS , the Board of County Commissioners heard all of the testimony and statements of those present, has studied the request of the applicant and the recommendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter and, having been fully informed, finds that this request shall be approved for the following reasons: 1 . The submitted materials are in compliance with the application requirements of Section 24 .7 of the Weld County Zoning Ordinance. 2 . It is the opinion of the Board of County Commissioners that the applicant has shown compliance with Section 24 . 4 . 2 of the Weld County Zoning Ordinance as follows: 850650 i` rums Page 2 RE: USR - POST a. The proposal is consistent with the Comprehensive Plan policies in that the use does not infringe on continued agricultural use in the vicinity or County. b. The proposal is consistent with the intent of the Agricultural Zone District and is provided for as a Use by Special Review. c. The activities proposed will be compatible with existing residential and agricultural uses, as well as with the projected development in the immediate area. d. No overlay districts affect the site. e. Use by Special Review Development Standards will provide adequate protection of the health, safety and welfare of the neighborhood and County. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the application for a Use by Special. Review for a horse training facility and accessory structure larger than 1 ,500 square feet in a platted subdivision on the hereinabove described parcel of land be, and hereby is, granted subject to the following conditions: 1 . The attached Development Standards for the Use by Special Review permit be adopted and placed on the Use by Special Review plat prior to recording the plat. 2 . The Use by Special Review activity shall not occur nor shall any building or electrical permits be issued on the property until the Use by Special Review plat has been delivered to the Department of Planning Services Office and the plat is ready to be recorded in the office of the Weld County Clerk and Recorder. The Use by Special Review permit is for a horse training facility and a 4 ,800 square foot accessory structure as submitted in the application materials on file in the Department of Planning Services and subject to the Development Standards stated hereon. 2 . Any disturbed area during the construction process shall be reseeded to adapted grasses by the applicant according to the West Adams Soil Conservation District recommendations. 3 . All construction done on the property shall be in accordance with the requirements of the Weld County Building Code Ordinance. 4 . The applicant shall comply with the design standards for the Use by Special Review, Section 24 . 5 of the Weld County Zoning Ordinance. 5 . The applicant shall comply with the Operation Standards for Uses by Special Review, Section 24 .6 of the Weld County Zoning Ordinance. 6 . Representatives or members of the Weld County Health Department and Weld County Department of Planning Services shall be granted access onto the property at any reasonable time in order to insure the operations carried out on the property comply with the Development Standards stated herein and all applicable Weld County Regulations. 7 . The Use by Special Review area shall be limited to the plans shown herein and governed by the Standards as stated above and all applicable Weld County Regulations. Any material deviations from the plans and/or Standards as shown or stated above shall require the approval of an amendment of the Permit by the Weld County Planning Commission and the Board of County Commissioners before such changes from the plans and/or Standards are permitted. Any other changes shall be filed in the office of the Department of Planning Services. 8 . The property owner and/or operator of this operation shall be responsible for complying with all of the foregoing Standards. Noncompliance with any of the foregoing Standards may be reason for revocation of the Permit by the Board of County Commissioners. Kirby Commissioner Gordon E. Lacy Commissioner Frank Yamaguchi Also present: Acting Clerk to the Board, Tommie Antuna Assistant County Attorney, Lee D. Morrison Planning Department representative, Gloria Dunn The following business was transacted: I hereby certify that pursuant to a notice dated October 28, 1985, and duly published October 31, 1985, in the Johnstown Breeze, a public hearing was conducted to consider the request of William and Marjorie Post for a Use by Special Review for a horse training facility and accessory structure larger than 1,500 square feet in a platted subdivision. Lee Morrison, Assistant County Attorney, made this matter of record. Gloria Dunn, representing the Planning Department, read the favorable recommendation of the Planning Commission into the record, and said that there are two conditions and eight Development Standards associated with this request. William Post, the applicant, came forward to answer questions of the Board. There were no comments offered by members of the audience. Commissioner Kirby moved to approve the Use by Special Review for William and Marjorie Post, subject to the recommended conditions and Development Standards. Commissioner Brantner seconded the motion which carried unanimously. This Certification was approved on the 18th day of November, 1985. APPEARANCE: William Post, property owner and applicant, stated this request is for a building larger than 1,500 square feet in a platted subdivision and a horse training facility. They train, condition, and board horses. Usually, the horses are young and an investment for the people who are boarding them. The inside arena will not be used for training unless the weather is inclement, and will also be used for the storage of tack, hay, and feed. At no time will they exceed the number of horses allowed by right in the Agricultural Zone district. At the present time, only two of their horses are being boarded. The Chairman called for discussion from the :members of the audience. Elbert Carver, surrounding property owner, reported he had been down to review the site after he received his surrounding property owner letter. This is a nice horse training facility and he can see no reason Mr. Post should not be able to continue training horses here. Stanley Rank, adjacent property owner, felt there may be a problem with increased dust, etc. The Chairman asked Debbie deBesche to read the development standards as outlined by the Department of Planning Services staff into the record. The Chairman asked Mr. Post if he had any problem with the recommendations of the Department of Planning Services staff. He stated he had no problem with anything as outlined. SW1, Section 25, T5N, R66W of the 6th P.M. , Weld County, Colorado LOCATION: Approximately one mile south of Greeley; east of .Weld County Road 35 and north of Weld County Road 52 APPEARANCE: Richard Powell, Natural Gas Associates, represented the applicant. They purchased this plant from Universal Gas and Oil earlier this year and want to expand it to fifteen million cubic feet of gas per day, if the gas production in the area warrants it. The gas from the plant is sold primarily to Greeley Gas Company and any gas they do not use is sold to Western Gas. At the present time approximately one load of liquid gas is taken from the property per day. If the plant is enlarged, this could increase to four or five truck loads per day when run at full capacity. The plant is designed to work unattended. Fe explained the built in safety control features for automatic shutdown if there is a problem. They have been working with the La Salle Fire Department so they are familiar with the plant procedures. They have tested all areas of the plant for noise at night. We would also seek approval to care for horses owned by persons other than ourselves. Our intent is NOT to run a boarding stable where people would be coming and going daily. Our intent is to train and condition quality horses on an individual basis. Each animal has a program of feed, exericse and grooming that is specifically designed for that individual . In most cases, each• horse will have it's own daily turn- out area and at night or during bad weather will be put inside. Each stall and pen is cleaned at least once a day, with lime put on the wet spots, and bedded with wood shavings. Our fly control program consists of using predator flys that seek out and destroy pest-fly larva, fly bait that kills adult flys, fly spray that discourage additional fly infiltration and most important maintaining an extremely clean facility. We would also seek approval to install a small mobile home for help to live in. This would be located in an non conspicuous area and compatible with the existing buildings. We believe this request to be consistant with the area, since there are properties bordering ours with additional mobile homes. These requests are part of Phase One as mentioned in the DETAILED DESCRIPTION OF OPERATION. Phase Two of our request would be approval to install a twenty stall barn (approximately 40" x 150") . This structure would be adjacent to the existing buildings and consistant in design. The purpose would be to expand the facility and would be owned by up to ten parties.
