The applicant has complied with all the application o o requirements listed in Section 21 . 7 et seq. , of the Weld County Zoning Ordinance. mw 2 . The request is in conformance with Section 21. 6 of the Weld County Zoning Ordinance as follows: a. The proposed Change of Zone is consistent with the Weld County Comprehensive Plan and is appropriate for this location along 1-25. b. Changing conditions in the area warrant a Change of Zone . c. Lacy, Pro-Tem Commissioner Gene Brantner Commissioner C.W. Kirby Commissioner Frank Yamaguchi Also present: Acting Clerk to the Board, Mary Reiff Assistant County Attorney, Lee D. Morrison Planning Department representative, Debbie de Besche The following business was transacted: I hereby certify that pursuant to a notice dated February 3, 1986, and duly published February 6, 1986, in the Johnstown Breeze, a public hearing was conducted to consider the request of Janet W. Betz and Linda Botterill for a Change of Zone from A (Agricultural) to C-4 (Highway-Commercial) . Lee Morrison, Assistant County Attorney, made this utter of record. Debbie de Besche, Planning Department representative, stated that the Planning Commission forwarded this matter to the -Board without recommendation. Vern Nelson, -of Nelson Engineers, same forward to represent the applicants. He stated that rezoning will allow a more productive and appropriate use of the land because this land is not prime agricultural land and cannot be economically farmed. He also commented on the recommendation for denial which the Planning staff presented to the Palanning Commission. Mr. Nelson showed a map indicating the service areas on I-25 in Weld County end extending north into larimer County to Fort Collins. This map indicated -only three service areas in Weld County, -with five in Larimer County. Clifford Betz spoke in favor of the request, stating that there was formerly a truck stop in the area and cited growth around Carter Lake and in the Berthoud area and other changing conditions in the area. At the request of Chairman Johnson, Ms. de Besche read the description of C-4 zoning, -with the uses allowed, into the record. Gary Baird, also spoke in favor of this request. After further discussion, Commissioner Lacy moved to approve the Change of Zone from A (Agricultural) to C-4 (Highway-Commercial) and gave the reasons on which he based his motion. Commissioner Brantner seconded the motion. Chairman Johnson stated that she will vote against the motion, stating her reasons for this decision. Commissioners Kirby end Brantner gave additional reasons why they will vote in lavor of the motion. On a roll call vote, the -motion carried with Commissioners Lacy, Brantner, Kirby and Yamaguchi voting aye and Chairman Johnson voting nay. Ann Garrison - yes, when she did the field check, and then read over the Development Standards she feels the Balderas' will improve the situation that already exists. Paulette Weaver - No; however, she does appreciate the Balderas' desire to make a success of this business. She is not voting based on the fact that they do not need a permit to carry on what is existing, but this will be an expansion of use, and the expansion of the use will not be compatible with existing or future land-uses in the area. Jack Holman - No, because this particular area has great possibilities for a future housing development because this is high ground and because of the location, and this operation will be a detriment to the development of this area for housing. He stated he -had read the staff's comments and he will not review the application comments, but this is a request for a change of zone from Agricultural to C-4. He feels the property does comply with the Weld County Comprehensive Plan because C-4 should be highway commercial. The Agricultural zoning currently on the property is faulty because the farm is not a productive farm. There has been a four hundred percent increase in traffic in the last twenty years. The Soil Conservation Services states the land is marginal farmland. More C-4 zoning is needed and the best place to put it is along a major highway. Tape 228 - Side 1 Mr. Nelson presented a Front Range Geological Map showing highway facilities along I-15 through Larimer and Weld Counties. It was his feeling that tourists will not be spending in Weld County because we are not providing the places for them to spend their money. Clifford Betz, who was born and raised on this farm, reported this particular piece of ground was very difficult to farm and was not very productive. He explained what living next to a major highway is like. Some of the neighbors in this area have moved to town and are commuting to their farms to be able to have a good night's sleep and no intrusions from those traveling on the highway. Gary Baird, whose wife is a Betz, reported he has been in the food service business for twenty years and they would like to put a restaurant on this property. Don Johnson - yes; Louis Rademacher - No, there are still undeveloped areas along I-25 that have already been zoned C-4 and then not developed. Ann Garrison - no; Paulette Weaver, No, and she would like to reiterate the staff's comments on this subject. Also, when we look at the changes on standards that are required by the Comprehensive Plan we can see that the request is not consistent with the Comprehensive Plan. We have not been shown that the zoning on the property is faulty, and continued conditions do not warrant a change of zone in this particular area. We have not seen a specific need for this particular site and it has not been shown that there are not other sites that cannot handle what the applicant is proposing that are already zoned. Jack Holman - Yes, he agrees with what Doug Graff has said. He does have a few reservations about it because of the additional other areas that have been zoned commercial but haven't been developed yet. At present, there are numerous facilities along I-25 from Denver north to Fort Collins catering to the traveling public. The large Del Camino service area is approximately 10 miles south and Johnson's Corner is approximately 4} miles to the north. Given the existing physical facts about the zoning surrounding the subject site and existing commercial services, approval of this request would constitute unjustified spot zoning and encourage development to "leap -frog" outside of a projected town growth area. - The Comprehensive Plan encourages auto-oriented commercial services to locate either within existing municipalities or at well planned areas along the major highways and thoroughfares." Weld County Road L4 is designated as a rural arterial which is incapable of handling a 30 acre C-4 (Highway Commercial) development as stated in referral responses from the Weld County Engineering Department and the State of Colorado Division of Highways. 0632 33 - - USR-425:85:11 Janet W. Betz and Linda Boterill January 7, 1986 Page 2 Commercial development along major transportation arteries impedes the rapid and safe movement of large volumes of traffic which is the primary purpose of transportation arteries. The proposed ingress and egress to the subject site is located at the intersection of Weld County Road 44 and Interstate 25. The increased amount of traffic associated with commercial development from the subject site would disrupt the functioning of this interchange, which was not designed as a commercial crossroad. At the present time, no commercial activity exists at this location. 2. The Weld County Zoning Ordinance states that the intent of the C-4 (Highway Commercial) district is to establish and preserve areas located with access to major thoroughfares that provide essential goods and services to the traveling public. It is the opinion of the Department of Planning Services staff that the applicant has failed to show how the proposed rezoning will provide essential goods and services to the traveling public. The applicant has failed to identify the uses proposed _on the property to accomplish this task. The applicant has submitted information attempting to indicate that existing service capacity along 1-25 is inadequate because of increased traffic and that additional highway commercial services are necessary at some new location. These same arguments were presented for a similar C-4 (Highway Commercial) rezoning request one mile south of the property under consideration on the west side of I-25. A C-4 (Highway Commercial) zoning classification was approved for 160 acres on February 8, 1984 by the Board of County Commissioners. Now, almost two years after the rezoning approval, the property is still undeveloped. No C-4 (Highway Commercial) uses exist on the property. The availability of vacant C-4 (Highway Commercial) property for development would indicate that there is insufficient reasons to approve the proposed rezoning under consideration. Further, it is the opinion of the Department of Planning -Services staff that the County -should not encourage the proliferation of C-4 (Highway Commercial) zoned properties that remain vacant and undeveloped. The premature approval of zoning of property to higher zoning classifications -in the unincorporated areas of the county outside of the planning areas of municipalities only benefits the property owner and not the County or its citizens. This rezoning would increase traffic at the Interstate 25 - State Highway 56 interchange. Since this interchange was not , designed to accommodate adjacent commercial development, turning conflicts may occur due to the limited distance between the ramp and frontage road intersections. A traffic study should be able to identify the extent of this problem based on projected traffic volumes. A method for alleviating this situation is the relocation of the frontage road intersection further away from the ramps, usually 300 - 500 feet. This provides an adequate separation for the installation of turn lanes and safer vehicle weaving movements. This property is sufficiently large to allow for the relocation of the frontage road. We encourage the enclusion of this concept in the plans for this commercial development. State Highway Commission approval would be required prior to the actual reconstruction of the I-25 frontage road. Please contact Wally Jacobson if you have any questions or need further information. Depending on the type and intensity of development, it may be necessary to have a traffic impact study to evaluate the impacts. This rezoning request does not indicate specifically how access is to be obtained, but we anticipate that direct access to the I-25 frontage road will be requested. In general , the 55 m.p.h. posted speed limit will require a 550-foot spacing between accesses and intersections. Please refer any future development plans to use for review and comment. This intersection provides a a access point for metropolitan residents going to and from Carter Lake and other fishing and recreational facilities in the area, as well as access to surrounding communities and farmsteads. The proposed zoning provides for the needs of this type of traveling public. The applicant respects the objectives of the Weld County Comprehensive Plan regarding the preservation of prime agricultural land; however, the subject parcel is not prime agricultural land and cannot be economically farmed. ph-mical . properties of the soil limit crop production, and the steepness of the parcel causes a major problem with erosion under agri- cultural use. The applicant believes that highway commercial service development would lead to a more productive and more appropriate use of the land. The proposed use would better serve the needs of the County and of the public. The need for highway commercial services is obvious due to the tremendous increase of traffic along I-25 (see Exhibit "B" ) . The traffic volume has increased nearly 400% during the past 21 years. In fact, in the last 10 years traffic has nearly doubled on U.S. Interstate 25 and State Highway 56 . This rate of increase is expected to continue in the future. Th existing establishments serving highway users are very heavily used, and at times their service capacity appears to be inadequate. It is obvious that additional highway commercial services are necessary at some new location. This subject parcel can provide that service without jeopardizing the preservation of prime agricultural farm land, and without creating a need for new access facilities. The existing interchange and service road arrangement at the site is fully capable of handling service traffic without affecting traffic flow along I-25 or State Highway 56 . This site is the most logical and least disruptive location for the additional highway service that is needed in this vicinity. Therefore, due to the increased traffic and its resultant need for highway services at a convenient access for on and off traffic at this location, the original zoning of the property has become faulty. This is true also because the land is not highly productive and has been declared uneconomic in today' s market from an agricultural evaluation. Public Water and Sewer - Domestic water is available by the Little Thompson Water District. Sanitary sewer service will be provided by a private collection and treatment system. Actual utility designs will be developed commensurate with the type of development proposed at the time it occurs. The proposed treatment facility will require an application for site approval as per the Regulations for Site Application for Domestic Wastewater Treatment Works prior to development. The sewage system will be developed and operated in accordance with all applicable regulations of Weld County and the State of Colorado. As development occurs in the area, and as the demand for sewage treatment increases, a public or private collection system can be developed for the area surrounding this site and the proposed site can be tied to this system. Soils - Please find enclosed guideline excerpts from the Soil Survey of Weld County, Colorado published by the United States Department of Agriculture, Soil Conservation Service (SCS) . As can be seen by Exhibit "C" , the dominent soil for the subject property is Unit 17 Colby loam, 5 to 9 percent slopes. The report states, "This soil is suited to limited cropping. Intensive cropping is hazardous because of erosion. " The report also indicates that there may be some limitations for development on this soil. Any actual construction of buildings or roads must be preceded by extensive soil surveys and tests in the specific material which will result in development of exact specifications for foundation and roadway designs. Roadway Accesses - The proposed highway commercial development is located at the northeast corner of Interstate 25 and State Highway 56 interchange. The I-25 frontage road and Weld County Road 44 will give direct access to the property. The existing interchange has been designated for on-off traffic from I-25 to a state designated highway. This facility is designed in accordance with Federal Interstate and Colorado Highway 136`4'2213 Department Standards. As a result, traffic to and from this site via the described interchange can be accommodated without interference with the ongoing traffic. In conjunction with the interchange, there is also an existing frontage road that is designated and designed to accommodate commercial users in accordance with state and federal highway design standards. Fire Protection - The proposed highway commercial development is located within the Johnstown Fire Protection District. The developer and/or his engineer will work with the Fire District to meet all rules and regulations of said District. Plans of the development, including all permanent structures, sizes of pipes, intended occupancy, and contents shall be provided to the Fire District for review and approval prior to construction. School District - The proposed highway commercial development does not allow any residential development and there- fore should not affect the school district. Overlay District - The proposed highway commercial property is not located in a geologic hazard, and/or Weld County airport overlay district area. The property is also not located in a flood plain area, according to the Flood Insurance Rate Map (FIRM) . According to the Weld County Extraction Plan Map there may be a small area in the southeast corner of the subject property that may contain some sand and gravel deposits. It is the opinion of the applicant' s Professional Engineer that there could be a minimal amount of sand and gravel underlying the Aquolls and Aquents Soil Group No. 4, which has an area of .5± acres (see Land Use Map) , but since the area of possible mineral deposit is small and the quantity of minerals is probably a minimum, the sand and gravel cannot be economically extracted for commercial use. Prior to any actual development of the subject property an extensive soil study will be completed. In the latter part of August 1985 you visited the District office and discussed this matter with the undersigned. At that time you stated that your future water requirements were not yet defined to provide the type of information we had requested. The District' s current water service to that area includes the following : 1 ) A 2i" water main running north and south on the east side of Interstate Highway 25 . 2) A 2?r" water main running on the south side of Highway 56/Weld County Road 44 and that line runs from the Interstate Highway east. The District does supply service to a residence in the area and we could provide additional service to a limited number of additional residential-sized taps. The capability or capacity needed for fire protection simply does not exist with the current water lines . I trust this will provide you with the additional information you have requested and as your requirements are further defined, it will assist us in determining whether we can meet your requirements .
