RE: APPROVAL OF SUBDIVISION EXEMPTION NO. 234 - JAMES WESTERVELT
AND HIGH COUNTRY TURF
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners has reviewed the
request of James Westervelt and High Country Turf for an exemption
from the definitions of "subdivision" and "subdivided land" in
Section 30-28-101 (10) (d) , CRS, as amended, and Section 2-1 A. (3)
o u of the Weld County Subdivision Regulations, and
• p WHEREAS, this Subdivision Exemption request from James
Westervelt and High Country Turf is to allow Mr. Westervelt to
a transfer a certain parcel to High Country Turf, and

exemption and a subdivision exemption on a parcel of land described as
part of the SE4, Section 26, T2N, R68W of the 6th P.M. , Weld County,
Colorado.
Dear Mr. Westervelt:
Your application and related materials for the request described above are
complete and in order at the present time. I have scheduled a meeting with
the Board of County Commissioners on Wednesday, April 24, 1985, at 9:00 a.m.
This meeting will take place in the County Commissioners' Hearing Room,
first floor, Weld County Centennial Center, 915 Tenth Street, Greeley,
Colorado. It is recommended that you and/or a representative be in
attendance to answer any questions the Board of Conty Commissioners might
have with respect to your application.
It is the policy of Weld County to refer an application of this nature to
any town or municipality lying within three miles of the property in
question or if the property under consideration is located within the
comprehensive planning area of a town or municipality. - Therefore, our
office has forwarded a copy of the submitted materials to the Tri—Area
Planning Commission for their review and comments. Please contact Rebecca
Marker at 740-7100 for further details regarding the date, time and place
of this meeting.

TO WHOM IT MAY CONCERN:
Enclosed is an application from Westervelt and High Country Turf for a
Subdivision Exemption. The parcel of land is described as part of the SEA of
Section 26, T2N, R68W of the 6th P.M. , Weld County, Colorado. The location
of the parcel of land for which this application has been submitted is one
mile west of Frederick; west of Weld County Road 11 and north of Weld County
Road 16.
This application is submitted to your office for review and recommendations.
Any comments or recommendations you consider relevant to this request would
be appreciated. Your prompt reply will help to facilitate the processing of
the proposal and will ensure prompt consideration of your recommendations.

The owners of the property described above have requested an exemption from
the Weld County Subdivision Regulations under Section 9-3A
The Department of Planning Services staff has reviewed this request and
recommends that the request be approved for the following reasons:

COMMENTS:
The subdivision exemption is being submitted in conjunction with Amended
Recorded Exemption 506. James Westervelt proposes to transfer 16 acres west
of the Godding Hollow Ditch to High Country Turf, an adjacent land owner.
The proposed subdivision exemption does not create a separate building site
for residential construction. The property is within a Geologic Hazard and
Floodplain area.
The Department of Planning Services recommendation is conditional upon Mr.
Westervelt or High Country Turf submitting a typewritten copy of the exact
legals required for the recording of a Subdivision Exemption.

Westervelt property slopes to the west, has access to Weld County Road 11
and has a single-family residence situated on Lot A of RE-506.

Application for Sub-Division Exemption
The purpose for this application is to correct an error which was made
by myself and High Country Turf. When I purchased my 143 acres from
High Country Turf, I did not purchase RE 506 in its entirety. To remedy
this error and to enable myself (Jim Westervelt) to acquire a building
permit for approximately 62.2 Acres which lies East of the Godding Hollow
Ditch, we High Country Turf and Jim Westervelt request that that portion
of RE 506 which lies West of the Godding Hollow Ditch be eliminated from
the legal description of RE 506 and reentered into the legal description
of the property which is presently owned by High Country Turf and which
is the SWa of Section 26, T.2N. , R 68 W.
