JEFFERSON WHEREAS , the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners held a public hearing on the 28th day of May, 1986 , at the hour of 2: 00 p.m. in the Chambers of the Board for the purpose of hearing the application of Joy A. Jefferson, 35 Martin Lane, Englewood, Colorado 80110 , for a Use by Special Review for a horse training and boarding facility on the following descri-bed real estate, to-wit: Part of the 4F14, Section 32 , Township 7 North, Range 67 West of the 6th P.M. , Weld County, Colorado WHEREAS, Section 24. 4. 2 of the Weld County Zoning Ordinance provides standards for review of said Use by Special Review, and WHEREAS, the Board of County Commissioners heard all of the testimony and statements of those present, has studied the Bequest of the applicant and the recommendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter and, having been fully informed, finds that this request shall be approved for the following reasons: 1 . The submitted materials art in compliance with the application requirements of Section 24 . 7 of the Weld County Zoning Ordinance. 2. It is the opinion of the Board of County Commissioners that the applicant has shown compliance with Section 24. 4. 2 of the Weld County Zoning Ordinance as follows: a. The proposal is consistent with the intent of the Weld County Comprehensive Plan. The Comprehensive P. / O:f 'D f 860523 Page 2 RE: USR, JEFFERSON Plan encourages the development of agribusiness and agriculturally oriented industry provided these enterprises do not adversely affect the local economy or environment. b. The proposed use is an agricultural activity which is consistent with the intent of the Agricultural Zone District. c. The uses permitted will be compatible with the existing surrounding land uses and with future development of the surrounding areas. d. The Windsor Planning Commission recommended no objection to the proposal. e. No overlay districts affect the site. f. Use by Special Review Development Standards will provide adequate protection of the health, safety and welfare of the neighborhood and County. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the application for a Use by Special Review for a horse training and boarding facility on the hereinabove described parcel of land be, and hereby is, granted subject to the following conditions: 1. The attached Development Standards for the Use by Special Review permit be adopted and placed on the Use by Special Review plat prior to recording the plat. 2. The Use by Special Review activity shall not occur nor shall any additional building or electrical permits be issued on the property until the Use by Special Review plat has been delivered to the Department of Planning Services Office and the plat is ready to be recorded in the office of the Weld County Clerk and Recorder. 860523 Page 3 RE: USR, JEFFERSON The above and foregoing Resolution was, on motion duly made and seconded , adopted by the following vote on the 28th day of May, A.D. , 1986 . The Use by Special Review permit is for a horse training and boarding facility as submitted in the application materials on file in the Department of Planning Services and subject to the Development Standards stated herein. 2. Odor, insects, and fugitive dust generated by the Use by Special Review activity shall be controlled in accordance with Weld County Health Department Regulations. 3 . The waste stockpiled on the Use by Special Review site shall be removed on a monthly basis. 4. All construction done of the property shall be in accordance with the requirements of the Weld County Building Code Ordinance. 5. The property owner or operator shall be responsible for complying with the Design Standards of Section 24. 5 of the Weld County Zoning Ordinance. 6. The property owner or operator shall be responsible for complying with the Operation Standards of Section 2-4 . 6 of the Weld County Zoning Ordinance. 7. Personnel from the Weld County Health Department and Weld County Department of Planning Services shall be granted access onto the property at any reasonable time in order to insure the activities carried out on the property comply with the Development Standards stated herein and all applicable Weld County Regulations. 8 . The Use by Special Review area shall be limited to the plans shown herein and governed by the foregoing Standards and all applicable Weld County Regulations. Any material deviations from the plans or Standards as shown or stated shall require the approval of an amendment of the Permit by the Weld County Planning Commission and the Board of County Commissioners before such changes from the plans or Standards are permitted. Any other changes shall be filed in the office of the Department of Planning Services. 9 . The property owner or operator shall be responsible for complying with all of the foregoing Standards. Jefferson for a Use by Special Review for a horse training and boarding facility. Lee Morrison, Assistant County Attorney, made this matter of record. Gloria Dunn, representing the Planning Department, read the favorable recommendation of the Planning Commission into the record, and said this recommendation is subject to two Conditions and nine Development Standards. Mike Jefferson, representing the applicant, came forward to answer questions of the Board. There was no public comment offered concerning this request. Commissioner Lacy moved to approve this Use by Special Review for Joy A. Jefferson subject to the recommended Conditions and Development Standards. Commissioner Kirby seconded the motion and it carried unanimously. This Certification was approved on the 2nd day of June, 1986. Jefferson. They plan to use this property for boarding and training horses. There is about twenty acres on this site and they have no plans to build any other buildings. The application for a Use by Special Review permit does contain the request for a mobile home, but the mobile home is already on the property. The town of Windsor has recommended approved of this request. The Chairman called for discussion from the audience. Gus Schneider, surrounding property owner, stated he can see nothing wrong with the horse boarding operation. The Chairman asked if they had reviewed the recommendation, conditions, and Development Standards `s outlined by the Department of Planning Services staff. He stated they have and do not object to any of the requirements. The submitted materials are in compliance with application requirements of Section 24.7 of the Weld County Zoning Ordinance. 2. It is the opinion of the Department of Planning Services staff that the applicant has shown compliance with Section 24.3 of the Weld County Zoning Ordinance as follows: - The proposal is consistent with the intent of the Weld County Comprehensive Plan. The property owner or operator shall be responsible for complying with the Operation Standards of Section 24.6 of the Weld County Zoning Ordinance. 7. Personnel from the Weld County Health Department and Weld County Department of Planning Services shall be granted access onto the property at any reasonable time in order to insure the activities carried out on the property comply with the Development Standards stated hereon and all applicable Weld County Regulations. 8. Convert existing feed lot to a horse boarding and training operation . 2 . Place a mobil home on the property for office and managers residence. The property was purchased August 1984. prior use had been a feedlot for approximately 2000 head of cattle . The property had not been used for several years and was in run- down condition . It had been seperated from the surrounding agricultural property . ( ref : Recorded Extension No . 0705- 32-4-RE-688 ) The property is irregular in shape of approx . 20 .5 acres . There are two wood frame houses , garage , large wood equipment barn , 100 , 000# scale and scale house , two metal storage sheds and misc . wooden buildings on the property . In the S . E . corner of the property there is a large concrete pad and feed mixing plant . The balance of the property , 15 ac . , consists of large pens . It is our hope to use the property for horse boarding , training , and riding . The property would adapt to this use with very little impact on the surrounding area . We think with the growing metro , area and the proposed Cache La Poudre Recreation Corridor horse trails , our location would fill a need . The surrounding property is mostly agricultural . The nearest residence is approx . 600 feet from our west property line , south and across WCR 74 approx . 800 feet , east and across state highway 257 approx . 1 mile , and north approx . 1 /2 mile to existing buildings . The operation would involve no more than 4 employees and a full time resident manager . The maximum number of users would be 45 to 50 with approx . 40 to 60 horses boarded . Access to the property is off WCR 74 . Daily use would consist of standard automobile , pickup trucks and horse trailers . Parking and trailer storage would be at S . E . corner of property . Water is supplied by the North Weld County Water District. The Winsor Fire department services the area . Waste generated by the proposed use would be stockpiled on the S . E . corner of the property . Eighty percent of the waste will be spread and disced into the arena and surrounding grass areas . The balance to be given to area farmers and nurseries . By using the existing facilities I believe we can up- grade the property to be an asset to the surrounding . area . The only addition would be a permanently located 14 ' x75 ' mobil home to be used as a managers office and residence. The existing equipment barn would be converted into a 14 stall horse barn . The pen would be divided into runs using existing automatic waterers . Since the purchase of the property we have continued to up-grade the buildings , painting , weed control , tree and grass planting . With regard to the Weld County Comprehensive Plan , this property was a feed lot , all agricuitural land was separated from this property prior to our purchase .
