RE: APPROVAL OF USE -3Y SPECIAL REVIEW FOR A HORSE TRAINING AND
BOARD FACILITY - JOY A. JEFFERSON
WHEREAS , the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners held a public
hearing on the 28th day of May, 1986 , at the hour of 2: 00 p.m. in
the Chambers of the Board for the purpose of hearing the
application of Joy A. Jefferson, 35 Martin Lane, Englewood,
Colorado 80110 , for a Use by Special Review for a horse training
and boarding facility on the following descri-bed real estate,
to-wit:
Part of the 4F14, Section 32 , Township 7 North,
Range 67 West of the 6th P.M. , Weld County,
Colorado
WHEREAS, Section 24. 4. 2 of the Weld County Zoning Ordinance
provides standards for review of said Use by Special Review, and
WHEREAS, the Board of County Commissioners heard all of the
testimony and statements of those present, has studied the Bequest
of the applicant and the recommendations of the Weld County
Planning Commission and all of the exhibits and evidence presented
in this matter and, having been fully informed, finds that this
request shall be approved for the following reasons:
1 . The submitted materials art in compliance with the
application requirements of Section 24 . 7 of the Weld
County Zoning Ordinance.
2. It is the opinion of the Board of County Commissioners
that the applicant has shown compliance with Section
24. 4. 2 of the Weld County Zoning Ordinance as follows:
a. The proposal is consistent with the intent of the
Weld County Comprehensive Plan. The Comprehensive

Plan encourages the development of agribusiness and
agriculturally oriented industry provided these
enterprises do not adversely affect the local
economy or environment.
b. The proposed use is an agricultural activity which
is consistent with the intent of the Agricultural
Zone District.
c. The uses permitted will be compatible with the
existing surrounding land uses and with future
development of the surrounding areas.
d. The Windsor Planning Commission recommended no
objection to the proposal.
e. No overlay districts affect the site.
f. Use by Special Review Development Standards will
provide adequate protection of the health, safety
and welfare of the neighborhood and County.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the application for a
Use by Special Review for a horse training and boarding facility
on the hereinabove described parcel of land be, and hereby is,
granted subject to the following conditions:
1. The attached Development Standards for the Use by
Special Review permit be adopted and placed on the Use
by Special Review plat prior to recording the plat.
2. The Use by Special Review activity shall not occur nor
shall any additional building or electrical permits be
issued on the property until the Use by Special Review
plat has been delivered to the Department of Planning
Services Office and the plat is ready to be recorded in
the office of the Weld County Clerk and Recorder.

1 . The Use by Special Review permit is for a horse training and
boarding facility as submitted in the application materials
on file in the Department of Planning Services and subject to
the Development Standards stated herein.
2. Odor, insects, and fugitive dust generated by the Use by
Special Review activity shall be controlled in accordance
with Weld County Health Department Regulations.
3 . The waste stockpiled on the Use by Special Review site shall
be removed on a monthly basis.
4. All construction done of the property shall be in accordance
with the requirements of the Weld County Building Code
Ordinance.
5. The property owner or operator shall be responsible for
complying with the Design Standards of Section 24. 5 of the
Weld County Zoning Ordinance.
6. The property owner or operator shall be responsible for
complying with the Operation Standards of Section 2-4 . 6 of the
Weld County Zoning Ordinance.
7. Personnel from the Weld County Health Department and Weld
County Department of Planning Services shall be granted
access onto the property at any reasonable time in order to
insure the activities carried out on the property comply with
the Development Standards stated herein and all applicable
Weld County Regulations.
8 . The Use by Special Review area shall be limited to the plans
shown herein and governed by the foregoing Standards and all
applicable Weld County Regulations. Any material deviations
from the plans or Standards as shown or stated shall require
the approval of an amendment of the Permit by the Weld County
Planning Commission and the Board of County Commissioners
before such changes from the plans or Standards are
permitted. Any other changes shall be filed in the office of
the Department of Planning Services.
9 . The property owner or operator shall be responsible for
complying with all of the foregoing Standards. Noncompliance
with any of the foregoing Standards may be reason for
revocation of the Fermit by the Board of County
Commissioners .

The following business was transacted:
I hereby certify that pursuant to a notice dated May 12, 1986, and duly
published May 15, 1986, in the Johnstown Breeze, a public hearing was
conducted to consider the request of Joy A. Jefferson for a Use by
Special Review for a horse training and boarding facility. Lee
Morrison, Assistant County Attorney, made this matter of record.
Gloria Dunn, representing the Planning Department, read the favorable
recommendation of the Planning Commission into the record, and said
this recommendation is subject to two Conditions and nine Development
Standards. Mike Jefferson, representing the applicant, came forward to
answer questions of the Board. There was no public comment offered
concerning this request. Commissioner Lacy moved to approve this Use
by Special Review for Joy A. Jefferson subject to the recommended
Conditions and Development Standards. Commissioner Kirby seconded the
motion and it carried unanimously.
This Certification was approved on the 2nd day of June, 1986.

The Chairman asked if they had reviewed the recommendation, conditions, and
Development Standards as outlined by the Department of Planning Services
staff. They stated they have and have no objections to conditions as
outlined.
The Chairman called for discussion from the audience.
Bob Fortner, applicant, reported he has helped Mr. Strubel put in another
access to his chicken house. He is the only one who used this street and
that was only on the far end.
The Chairman asked that reading of the recommendations, conditions, and
Development Standards as outlined by the Department of Planning Services
staff be dispensed with and that they be filed with the summary as a
permanent record of these proceedings.
MOTION:

APPEARANCE:
Mike Jefferson represented his wife, Joy _A. Jefferson. They plan to use
this property for boarding and training horses. There is about twenty acres
on this site and they have no plans to build any other buildings. The
application for a Use by Special Review permit does contain the request for
a mobile home, but the mobile home is already on the property. The town of
Windsor has recommended approved of this request.
The Chairman called for discussion from the audience.
Gus Schneider, surrounding property owner, stated he can see nothing wrong
with the horse boarding operation.
The Chairman asked if they had reviewed the recommendation, conditions, and
Development Standards `s outlined by the Department of Planning Services
staff. He stated they have and do not object to any of the requirements.
The Chairman asked that reading of the recommendation, conditions, and
Development Standards as outlined by the Department of Planning Services

THE DEPARTMENT OF PLANNING SERVICES STAFF RECOMMENDS THAT THIS REQUEST BE
APPROVED FOR THE FOLLOWING REASONS:
1. The submitted materials are in compliance with application
requirements of Section 24.7 of the Weld County Zoning Ordinance.
2. It is the opinion of the Department of Planning Services staff
that the applicant has shown compliance with Section 24.3 of the
Weld County Zoning Ordinance as follows:
- The proposal is consistent with the intent of the Weld
County Comprehensive Plan. The Comprehensive Plan
encourages the development of agribusiness and
agriculturally oriented industry provided these
enterprises do not adversely affect the local economy or
environment.
- The proposed use is an agricultural activity which is
consistent with the intent of the agricultural zone
district.
- The uses permitted will be compatible with the existing
surrounding land uses and with future development of the
surrounding areas.
- The Windsor Planning Commission recommended no objection
to the proposal.
- No overlay districts affect the site.
- Use by Special Review Development Standards will provide
adequate protection of the health, safety and welfare of
the neighborhood and County.

This recommendation is based, in _part, upon a review of the application
submitted by the applicant, other relevant information regarding the request
and the responses of the referral entities which have reviewed this request.
The Department of Planning Services staff recommendation for approval is
conditional upon the following:
1. The attached Development Standards for the Use by Special Review
permit be adopted and placed on the Use by Special Review plat
prior to recording the plat.
2. The Use by Special Review activity shall not occur nor shall any
additional building or electrical permits be issued on the
property until the Use by Special Review plat has been delivered
to the Department of Planning Services` office and the plat is
ready to be recorded in the office of the Weld County Clerk and
Recorder.

Department Regulations.
3. The waste stockpiled on the Use by Special Review site shall be removed
on a monthly basis.

Fire protection consists of existing water supply and fire
extinguishers in each building . The Winsor Fire department
services the area .
Waste generated by the proposed use would be stockpiled
on the S . E . corner of the property . Eighty percent of the waste
will be spread and disced into the arena and surrounding grass
areas . The balance to be given to area farmers and nurseries .
By using the existing facilities I believe we can up-
grade the property to be an asset to the surrounding . area .
The only addition would be a permanently located 14 ' x75 '
mobil home to be used as a managers office and residence.
The existing equipment barn would be converted into a 14 stall
horse barn . The pen would be divided into runs using existing
automatic waterers .
Since the purchase of the property we have continued to
up-grade the buildings , painting , weed control , tree and grass
planting .
With regard to the Weld County Comprehensive Plan , this
property was a feed lot , all agricuitural land was separated
from this property prior to our purchase . It is our understanding
that the North West quarter section 32 is to be zone resiiiential .
All property surrounding ours has been annexed for industrial
use by the Town of Windsor.
Concerning the protection of the health , safety , and
welfare of the inhabitants of the neighborhood and county .
By providing a safe and secure location for horse boarding and
a safe arena for riding and training we are insuring the safety
and welfare for the area .
This property was purchased with the intent of providing
a place for our son and his wife to live while attending C . S . U .
Then possibly applying there knowledge to the training and
breeding of horses . The boarding operation will hopefully
