RE: APPROVE CONTINUANCE OF HEARING TO SHOW CAUSE FOR REVOCATION
OF AMENDED SPECIAL USE PERMIT #345 - MS CORPORTION
WHEREAS , the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, on June 3 , 1987 , a hearing was held to show cause
for revocation of Amended Special Use Permit No. 345 , held by MS
Corporation , and
WHEREAS, after hearing the testimony presented, the Board
deems it advisable to continue said hearing to June 24 , 1987 , at
9 : 00 a.m. , in order to conduct an on-site inspection prior to said
date and request representatives of the Greeley Soil Conservation
District to determine which areas along the greenbelt required by
Development Standard #2 of said Amended Special Use Permit are
unsuitable for planting.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County , Colorado , that the hearing to show
cause for revocation of Amended Special Use Permit No. 345 , held
by MS Corporation , be , and hereby is , continued to June 24 , 1987 ,
at 9 : 00 a.m. , to allow the Commissioners to conduct an on-site
inspection of the property and to allow representatives of the
Soil Conservation District to prepare the abovementioned
determination .
The above and foregoing Resolution was , on motion duly made
and seconded , adopted by the following vote on the 3rd day of
June , A.D. , 1987 .

RE: HEARING TO SHOW CAUSE FOR REVOCATION OF AMENDED SPECIAL USE PERMIT
#345 - MS CORPORATION
A public hearing was conducted on June 3, 1987, at 2:00 P.M. , with the
following present:
Commissioner Gordon E. Lacy, Chairman

The following business was transacted:
I hereby certify that pursuant to a notice dated September 3, 1986, and
duly published September 25, 1986, in the Johnstown Breeze, a public
hearing was conducted to consider revocation of Amended Special Use
Permit #345, granted to MS Corporation. Lee Morrison, Assistant County
Attorney, made this matter of record, stating that this hearing was
continued from October 20, 1986. Keith Schuett, representing the
Planning Department, stated that the Planning staff feels this property
is not in compliance with Development Standard #2, regarding the
planting of trees along the southern boundary, and Mr. Miller is
requesting a change to the landscaping plan. Mr. Schuett presented
copies of a diagram outlining those areas along which the greenbelt has
been completed, and said the Greeley Soil Conservation District has not
determined which areas are unsuitable for planting. Mike Miller,
president of MS Corporation, stated that the areas which have not been
planted are not fit for planting at the present time and he is still
trying to fill up some swampy areas. He also stated that he has
purchased the required number of trees for planting when the area has
been sufficiently filled. Mr. Miller presented photographs of areas
which he considers as unsuitable for planting. In the ensuing
discussion, Commissioner Johnson stated that, in her opinion, a third
party needs to determine which areas are unsuitable for planting, and
Commissioner Kirby suggested that an on-site inspection might be
advisable. Commissioner Kirby moved to continue this hearing to June
24, 1987, at 9:00 a.m. , with the Commissioners to conduct an on-site
inspection and the Soil Conservation District to make a determination
as to which areas should be planted with trees as required in
Development Standard #2. The motion was seconded by Commissioner
Brantner and carried unanimously.

the 6th P.M. , Weld County, Colorado.
LOCATION: Approximately 1 mile east of Greeley on 16th Street.
It is the opinion of the Department of Planning Services staff, that the
following standard as approved for Amended SUP-345:85: 10 is not in
compliance:
2. A greenbelt shall be planted and maintained along the entire
length of the southern boundary. The greenbelt shall be a minimum
of ten feet in width. The greenbelt shall consist of two parallel
rows of trees acceptable to the Department of Planning Services.
The trees shall be a minimum two feet in height at the time of
planting. The entire greenbelt shall be planted by the 1986
spring planting season, identified as between April 15 and May 30,
1986. The owner or operator does not have to plant those areas
along the greenbelt which have been determined by representatives
of the Greeley Soil Conservation District as unsuitable for
planting.
The Greenbelt is not complete along the southern boundary of the Special Use
Permit area. The map attached identifies the areas that do not meet the
requirements.
The applicant submitted a letter dated June 2, 1987, requesting that a
change be approved to the landscaping plan. This request would change the
placement of the trees along the field farmed by John McNamara.

Re: MS Corp greenbelt SUP 345
Dear sirs,
I have planted the majority of the trees in the greenbelt described on the
[ plan submitted to your office. The section behind the Anderson property has not
been planted yet due to ongoing reclamation. The trees are on site and will be
planted as soon as reclamation of the swamp is completed this summer.
I would like to request a change in the placement of the greenbelt east
of the McNamara property. Jack McNamara farms the field where the greenbelt
is shown on the map. He cuts hay within 5 feet of the fence which would not
leave room for trees. I propose to plant trees along the north edge of the
field. This would accomplish the same effect as the other plan. If approved I
could have these trees planted by 6-5-87. I have purchased enough trees to
provide for planting according to either plan but feel that the proposed change
would be a much simpler solution without consuming valuable field space.

The property was reinspected to determine if it is in compliance with the
approved standards for Amended SUP-345:85: 10.
Standard #2 states in part that a greenbelt shall be planted and maintained
along the entire length of the southern boundary. This area is further
identified on the Use by Special Review plat. Standard #2 is not in
compliance at this time.
All areas that are identified as greenbelt on the Use by Special Review plat
map have not been planted with the required trees.
Mr. Mike Miller was present during this inspection. Mr. Miller stated that
he would complete the trees by June 3, 1987.
