HomeMy WebLinkAbout881190.tiff RESOLUTION RE: RATIFICATION OF LETTER FROM PEST INSPECTOR TO ASSESSOR WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, Ronald J. Broda, Weld County Pest Inspector, sent a letter to Richard W. Keirnes , Weld County Assessor, concerning landowner non-compliance with the Pest Control Districts Law, Section 35-5 , C.R.S. , a copy of said letter being attached hereto and incorporated herein by reference, and WHEREAS , the Pest and Weed Department enforced control of noxious weeds on private property, pursuant to Section 35-5-108 (1 ,2) , C.R.S. , and notices for payment were submitted to the landowners on October 21 , 1988 , giving them 30 days to respond, and WHEREAS, to date, five landowners have not responded to said notices , nor have said landowners requested a hearing with the Commissioners, the names of those landowners are as stated on Exhibits A-G, copies of which are attached hereto and incorporated herein by reference, and WHEREAS, said notices for payment are being submitted to the Weld County Assessor, pursuant to Section 35-5-108 (5) , C.R.S. , for addition of said payments to the landowners tax rolls, said notices being attached hereto and incorporated herein by reference. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the letter from the Weld County Pest Inspector to the Weld County Assessor regarding non-compliance with the Pest Control Districts Law, Section 35-5 , C.R.S. , be, and hereby is, ratified. 881190 Page 2 RE: RATIFICATION OF LETTER TO ASSESSOR The above and foregoing Resolution was , on motion duly made and seconded, adopted by the following vote on the 14th day of December, A.D. , 1988 . COLORADO December 8, 1988 Dick Keirnes County Assessor Centennial Building Dear Mr Keirnes: I am writing you regarding landowner non-compliance with the Pest Control Districts Law, CRS 35-5. The Pest Control Districts Law CRS 35-5-108(1,2) gives the Pest Inspector the ability to enforce control of noxious weeds on private property if the landowner does not comply with the pest inspector notice. The Weld County Pest & Weed Department enforced on 22 properties this year, and bills for the work performed were sent to the landowners. Five landowners did not pay their bills. In compliance with CRS 35-5-108(3), bills were sent by certified mail on October 21 to all five landowners, and they were given 30 days to respond. The bills have not been paid by the landowners nor have there been any requests for a hearing with the Commissioners. I am submitting the bills to you, as per CRS 35-5-108(5), for addition of the bills to the landowners tax rolls. Please find enclosed the bills as exhibits A-G. I have discussed this matter with Mike Loustalet and Lee Morrison, and it was decided that I submit this information to you in writing. If you have any questions, please call me at extension 4465.
