Nz WHEREAS , the Board finds that the property described herein
o as all lots of all blocks of Northmoor Acres, Replat of Lots 4 and
(A 5 of Block 1 of Northmoor Acres, and all lots of all blocks in
Northmoor Acres Subdivision, Second Filing, have specifically
benefitted from the proposed improvements for the following

a. The market value of the property will increase;

b. The improvements have adapted the property for a
more profitable use; and
c. The proposed improvements will facilitate access to
each of the properties and thereby increase the
convenience of use of said property, and
WHEREAS, the Resolution shall be prima facie evidence of the
fact that the property assessed is benefitted, the amount of the
assessment, and that the assessment has been lawfully levied.

the sixth day of July, 1988 . Said local

1988-1" and all proceedings heretofore taken by the
o Board of County Commissioners and the County staff
CJ CC and adopted in connection with the District are
a 0 hereby ratified, approved, and confirmed.
HI m HI c. That the Statement of Expenses and Apportionment
r-i has been submitted based upon the fact that there
mg has been completion of the entire local improvement
as previously authorized.
d. The total cost of the improvements has been
determined to be $96 , 609 . 76 , not including the cost
borne by the County for improvements to the gravel
road, engineering, and administrative fees . There
has been a voluntary contribution in the amount of
$2, 337 .33 from owners of properties adjacent to the
District, equivalent to three lots ' assessment.
The Statement of Expenses and Apportionment
advises, and this Board ratifies, the finding that
each of the lots described belonging within the
Local Improvement District has been specifically
benefitted and each lot shall be assessed equally
on a per lot basis the cost for materials and labor
in the amount of $779 . 11 .

g. Failure to pay the whole assessment within the
thirty-day period from the date of this Resolution
shall be conclusive determination and held to be an
election on the part of all persons interested,
whether under disability or otherwise, to pay in
such installments. All persons so electing to pay
in installments shall be conclusively held and
considered as consenting to said improvements.
Said election shall be conclusively held and
considered as a waiver of any right to question the
power or jurisdiction of the County to construct
the improvements, the quality of the work, the
regularity or sufficiency of the proceedings, the
validity or correctness of the assessments , or the
validity of the lien thereof.
h. That all Resolutions or parts thereof in conflict
with this Resolution are hereby repealed.

Dear Property Owners:
The Weld County Board of County Commissioners, on November 16, 1988,
approved the Weld County Northmoor Local Improvement District Number 1988-1.
Pursuant to the attached Resolution, each lot in the District has been
assessed $779.11 and you will be allowed to pay the amount due to the Weld
County Treasurer prior to the close of business on December 16, 1988. When
making your payment, please advise the Treasurer's Office that the payment
is for the assessment concerning the Northmoor Local Improvement District.
Should you choose not to pay in full by December 16, 1988, you will pay in
ten (10) equal annual installments at simple interest rate of ten percent
(10%) per annum, with the first payment due on May 1, 1989. This amount
will be separately billed to you after December 16, 1988.

WELD COUNTY NORTHMOOR LOCAL IMPROVEMENT DISTRICT NO. 1988-1,
STATEMENT OF COST: AND PORTION TO BE ASSESSED UPON EACH LOT
Docket No. 88-27
All owners of real estate and property hereinafter described and all persons
generally, are hereby notified that the Board of County Commissioners of
Weld County, Colorado has received a Notice of Completion, Statement of
Expenses, and Apportionment regarding the Local Improvement District within
unincorporated Weld County, Colorado, designated as Weld County Northmoor
Local Improvement District No. 1988-1, all in accordance with the laws of
the State of Colorado, and that the improvements have been completed and
conditionally accepted. The property within the Local Improvement District
is described as follows:
All of Northmoor Acres Subdivision and Northmoor Acres Second
Filing, which are located in the SW} of Section 24, Township
4 North, Range 68 West of the 6th Principal Meridian, County
of Weld, State of Colorado, more particularly described as
all lots and blocks in both Northmoor Acres Subdivision,
recorded at Reception #1550063, Envelope 397, re-recorded at
Reception #1576284, Envelope 456, and as Lots 4 and 5 of
Block 1 were replatted at Reception #1812605, Envelope 1794,
and Northmoor Acres Second Filing, recorded at Reception
#1585866, Envelope 480, in the records of the Weld County
Clerk and Recorder. The District also includes the
rights-of-way for the improved roads namely: Weld County Road
44 between Interstate 25 and Weld County Road 11; Weld County
Road 11 between Weld County Roads 42 and 44; and Weld County
Road 42 between Weld County Roads 11 and 13.
1. All persons are further notified that the entire cost of the
improvements as have been completed is to be $96,609.76, which excludes
any costs which have been assumed by the County in terms of
improvements to the gravel road, engineering, and administrative fees.
The costs to be apportioned to the landowners are the costs for
materials and labor for the paving base preparation and installation of
traffic control devices which is to be apportioned equally among the
121 lots in an apportionment of not more than $798.43 per lot.
2. Any owner of the affected lots may file a complaint or objection in
writing addressed to the Weld County Board of County Commissioners, 915
Tenth Street, P.O. Box 758, Greeley, Colorado 80632, which objection
must be filed within twenty (20) days from the publication date of this
Notice. Any complaint or objection properly made will be heard and
determined by the Board of County Commissioners before the passage of
any Resolution assessing the costs of the improvements.
3. The hearing where such complaints or objections will be heard will be
on the 16th day of November, 1988, at 10:00 A.M. in the First Floor
Meeting Room of the Centennial Center, 915 Tenth Street, Greeley,
Colorado.

As we anticipated, Wilson Farms has forwarded a check for $2,337.33 as a
contribution to the Northmoor Local Improvement District. The check was
received by this department and delivered to Claud Hanes, Weld County
Comptroller.
The cost to be borne by the district was $96,609.76. Subtracting the
Wilson's contribution, the revised cost to the district should be
$94,272.43. With the 121 lots in Northmoor, and the apportionment to be
divided equally among each lot, the revised assessment for each lot should
be $779. 11.
Don Carroll will be present at the final assessment hearing on November 14,
1988, should there be any questions.

payment of the cost of improvements provided for in the Contract
executed by Coulson Excavating Co. and Payee on or about
September 1 , 19 88 , together with all amendments, change
orders, and additions thereto, the sum of
One Hundred Five Thousand, Eight Hundred
and Nine Dollars ($ 105,809.00 ),
by checking, being the remainder of the full amount accruing to the
undersigned by virtue of said contract and extra work performed
thereunder, said payment covering and including full payment for the
cost of all extra work and material furnished by the undersigned in
the construction of said improvements, and all incidentals thereto,
for the additional consideration of One Dollar ($1.00) for the
execution hereto, and the undersigned hereof releases THE BOARD OF
WELD COUNTY COMMISSIONERS from any and all claims whatsoever resulting
from said contract and all work performed thereunder.

The undersigned by these presents certifies that all persons doing
work upon or furnishing materials for said improvements under the
foregoing contract and all additions thereto have been paid in full.
The undersigned further certifies that all work has been completed in
a workmanlike manner in conformity with the plans and specifications.
That should any portion of said work or material prove defective
within one (1) year from the date of final acceptance of the entire
project by the County, the undersigned shall replace any such
defective material and remedy any such defective work to the
satisfaction of THE BOARD OF WELD COUNTY COMMISSIONERS and shall
defend, indemnify, and save harmless THE BOARD OF WELD COUNTY
COMMISSIONERS from all damages, claims, demands, expenses and charge
of every kind which may arise as a result of any such defective
material and workmanship during said period. The Performance and
Payment Bonds for this contract shall remain in effect for the period
of the guarantee.
