Organizations receiving or intending to receive indirect costs are subject to one of four guides, all of which are entitled, "Cost principles and procedures for establishing indirect cost and other rates for grants and contracts with the Department of I ealth and Human Services. Office of DEPARTMENT OF HEALTH &HUMAN SERVICES Human Development Services Yy r"^° Assistant Secretary Washington DC 20201 NOTICE: GRANT FUNDS MAY NOT BE USED TO ATTEMPT TO INFLUENCE LEGISLATION PENDING BEFORE CONGRESS We direct the attention of HHS grantees to the fact that the following statutory provision (part of Sec. 407 of Pub. L. 95-480, 92 Stat. 1589) has applied to the Department's appropriations beginning with those for fiscal year 1979 and that such a provision is likely to continue to apply to its appropriations: "No part of any appropriation contained in this act shall be used to pay the salary or expenses of any grant or contract recipient or agent acting for such recipient to engage in any activity designed to influence legislation or appropriations pending before the Congress." This means that the costs of attempting to influence legislation pending before Con- gress may not be charged either as direct or indirect costs to any HHS Grant awarded from funds subject to the provision. Attempting to influence legislation is com- monly called lobbying. This notice concerns only the charging to HHS grants of certain costs. Nothing in this notice is intended in any way to inhibit or discourage any party from exer- cising its lawful rights to attempt to influence legislation pending before Congress as long as the costs are not charged to an HHS grant or cooperative agreement. HDS Grants Management 1"es PLACING PURCHASES WITH SMALL, MINORITY AND WOMAN-OWNED FIRMS "It is a national policy to place a fair share of purchases with small, minority, and woman-owned business firms. The Department of Health and.Human Services is strongly committed to the objectives of this policy and encourages all recipients of its grants and cooperative agreements to take affirmative steps to ensure such fairness. In particular, recipients should: 1 . Place small, minority, and woman-owned firms on bidders mailing lists. 2 . Solicit these firms whenever they are potential sources of supplies, equipment, construction, or services. 3 . Where feasible, divide total requirements into smaller needs, and set delivery schedules that will encourage participation by these firms. 4 .
