RESOLUTION RE: APPROVE RESUBDIVISION OF LOT 4 , BLOCK 2 , OLINGER SUBDIVISION - MARLENE D. HARDING AND CLIFTON D. HARDING WHEREAS , the Board of County Commissioners of Weld County , Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS , on the 29th day of October , 1986 , in a public meeting, the Board considered the request of Marlene D. Harding and Clifton D. Harding for the resubdivision of Lot 4 , Block 2 , Olinger Subdivision , located in part of the 141/2 NWQ of Section 18 , Township 3 North , Range 66 West of the 6th P.M. , Weld County, Colorado, and WHEREAS , the Board reviewed the submitted evidence and heard the testimony of those present, and WHEREAS, the Board, having considered the recommendation of the Weld County Planning Commission , finds that the resubdivision request concerning Lot 4 , Block 2 , Olinger Subdivision , shall be approved for the following reasons : 1 . The submitted materials are in compliance with application requirements of Section 6-4 B. of the Weld County Subdivision Regulations. 2 . It is the opinion of the Board of County Commissioners that the resubdivision conforms with the requirements of Section 6-4 E. of the Weld County Subdivision Regulations for the following reasons : a. The lots involved in this request meet the minimum requirements for area and dimension as established by the Weld County Subdivision Regulations . b. Drainage easements or rights-of-way reserved for drainage will not be altered. c. The proposed plat will not adversely affect the character of the Olinger Subdivision , as filed . 3. The staff also recommends that since there are no improvements fur the subdivider to install or guarantee that the requirement to submit a subdivision improvement agreement required by Section 11 of the Weld County Subdivision Regulations be waived by the Planning Commission and the Board of County Commissioners. It is my opinion , based on CPS, 30-28-101 (10) (c) (II) , as amended in 1977 , does it not create two valid lots unless they otherwise qualify by reasons of size. In ' this circumstance, there is no indication in the Stipulated Order that notice was ever given to Weld County that this partition was proposed to take place and an indication of consent by the Board of County Commissioners or an indication that they failed to respond within the required time. Therefore, this Order would not create a new lot. This could be corrected by a replat.
