RE: DETERMINATION OF THE BOARD CONCERNING PROBABLE CAUSE - ROAD
54 E-VAP PARK, LTD.
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Department of Planning Services requested that
the Board consider probable cause against Road 54 E-Vap Park,
Ltd. , alleging noncompliance of Amended Operation Standards 7 .J. ,
15 , 16 , and 17 contained in Use by Special Review Permit #540 , and
WHEREAS , at the Board meeting of June 2 , 1986 , the Board was
informed by the Department of Planning Services that Road 54 E-Vap
Park, Ltd. is now in compliance of said Amended Operation
Standards , and
WHEREAS, upon hearing testimony from interested parties and
studying the evidence presented in this matter, the Board
determined that no probable cause exists at this time to revoke
Use by Special Review #540 issued to Road 54 E-Vap Park, Ltd.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the Board hereby
determines that no probable cause exists at this time to revoke
Use by Special Review Permit #540 , issued to Road 54 E-Vap Park,
Ltd. , for noncompliance of the hereinabove stated Amended
Operation Standards.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 2nd day of
June, A.D. , 1986 .

It is the opinion of the Department of Planning Services staff, that the
following standards as approved for USR-540:83:3 are not in compliance:
7. J. "An aeration system shall be installed and operated on the
four evaporative ponds. In the event of an odor problem
emanating from the ponds, an odor abatement program shall be
instituted."
An aeration system is not installed or operated on the four evaporative
ponds.
15. "The Use by Special Review shall be limited to the plans
shown hereon and governed by the Standards as stated above
and all applicable Weld County Regulations. Any material
deviations from the plans and/or Standards as shown or stated
above shall require the approval of an amendment of the
Permit by the Weld County Planning Commission and the Board
of County Commissioners before such changes from the plans
and/or Standards are permitted. Any other changes shall be
filed in the office of the Department of Planning Services."
The Department of Planning Services has not approved an amendment for
deviations from these Standards.
16. "The property owner and/or operator of this operation shall
be responsible for complying with all of the above stated
Standards. Noncompliance with any of the above stated
Standards may be reasons for revocation of the Permit by the
Board of County Commissioners."
All of the stated standards are not in compliance at this time.
17. Prior to starting the operation, the applicant shall plant
and maintain the following landscaping and shelter belt:

The northern boundary of the Use by Special Review area
shall contain two rows of Evergreen and/or Russian Olive
trees;
The east and west boundaries shall contain one row of
Evergreen and/or Russian Olive trees;
All trees shall be spaced at 10 feet apart and a minimum
of 10 feet from the chain link fence.
The landscaping and shelter belt has not been maintained. The dead trees
have not been replaced at this time.
Based upon the information, the Department of Planning Services staff
recommends that the Board of County Commissioners schedule a "Show Cause"
public hearing on June 18, 1986, to consider revocation of USR-540:83:3.

12-12-83 USR-540:83:3 was approved by the Board of County
Commissioners with 18 Operation Standards.
7-10-86 Mr. Martensen was contacted about the trees that were dying
out in the landscaping and shelter belt around the Evap
facility.
7-15-86 A letter was received from Mr. Martensen about his plan to
maintain the landscaping and shelter belt around the Evap
facility.
3-19-86 A memorandum was received from the Health Protection
Services indicating noncompliance of the Operation Standards
for USR-540.
3-20-86 The property was inspected. Operation Standards 7.J. , 15,
and 16 are not in compliance. Notice of the noncompliance
was mailed to Mr. Arvin Martensen allowing 30 days for
compliance.
3-27-86 Received a letter from Mr. Martensen. This letter stated
that a "complete aeration will be operational not later than
April 30, 1986."
4-11-86 Mr. Martensen requested that an inspection be conducted to
observe the proposed aeration system operating on a pond.
4-18-86 A letter was mailed to Mr. Martensen stating that the
aeration system that was observed operating on the northeast
lagoon was an acceptable system, but would need to be
installed on all lagoons to meet the Operation Standards.
5-9-86 The property was resinspected. Operation Standards #7.J.,
15, 16, and 17 are not in compliance.
5-13-86 Mr. Robert Dragich, Operations Manager for Evap Limited,
submitted a plan for the maintenance of the greenbelt around
the property.
AMENDED
OPERATION STANDARDS
Road 54 E-Vap Park, Limited
U.S.R. - 540:83:3
1. The use shall be an oil and gas brine water disposal and oil recovery
facility as described in the submitted application materials. No
hazardous wastes or nonhazardous industrial waste shall be allowed at the
site. The facility shall be designed, constructed and operated to comply
with the Colorado Department of Health Solid Wastes Disposal Sites and
Facilities Act, Title 30-20, Part 1, CRS 1973, as amended.
2. The facility shall consist of the following:
A. One (1) office/residence located as shown on the Use by Special
Review Permit Plan Map.
B. Three (3) skim tanks and one (1) dump tank. The tanks shall be
located as shown on the Use by Special Review Permit Plan Map.
C. Four (4) evaporative ponds located as shown on the Use by Special
Review Permit Plan Map.
D. One (1) heater treater and two (2) storage tank batteries as shown
on the Use by Special Review Permit Plan Map.
3. There shall be one (1) point of ingress and egress to the facility from
Weld County Road 54. The point of access shall be located, designed and
constructed in accordance with the submitted application materials and
Use by Special Review Permit Plan Map.
4. The access road to the dump tank shall be constructed and maintained in
accordance to the application materials and Use by Special Review Permit
Plan Map.
5. Entrance to the facility shall be controlled by electronic gate,
activated by credit card as described in the submitted application
materials. The State Health, County Health and Planning Department shall
be issued a card for entry to the facility.
6. A six (6) foot chain link fence with three (3) strand barbed wire top
shall enclose the Use by Special Review area.
7. Evaporative Ponds:
A. The four (4) evaporative ponds shall be engineer designed and
operated in accordance to the submitted application materials and
Use by Special Review Permit Plan Map.
B. During the construction phase, a full—time professional
engineering/geologic consultant must be retained for continuous
inspection of the evaporation ponds. The consultant shall certify by
letters addressed to the State Health, County Health and Planning
Departments that the design, materials, construction and operation
of the evaporation ponds comply with the specifications as listed in
the submitted application materials and on the Use by Special Review
Permit Plan Map.
C. Any areas of highly pervious soils encountered in the bottom of the
evaporation ponds during excavation shall be removed to a depth of
one (1) foot and replaced with clays equivalent in composition and
compaction density to those used for liner construction.
D. A representative of the State Health Department or Weld County
Health Department must inspect the final evaporation pond
excavations prior to liner placement.

E. A representative of the State Health Department or Weld County
Health Department must inspect the seepage detection system p!:ior to
placement of gravel and compacted material on the :system.
R. u the event it is concluded that the evaporation ponds ore !king
orliquid waste is detected in the seepage detection system, the
County and State Health Departments shall he notified immediately.
Receipt of all waste at the facility shall be discontinued until it
can he determined by the State or County Health Department, from
evidence presented by the operator or State/County Health
Departments, which pond(s) is leaking. The defective pond(s) shall
be drained and repairs completed immediately in accordance with
Operation Standard Seven (7)8.
C. Operation Standard Seven (7)r ^hall apply to any evaporation pond
liner left in a dry condition for a period of thirty (30) days of
more.
H. A gauge height indicator shall be installed in the evaporation
ponds. The gauge must clearly indicate the depth of brine water
waste.
I. The evaporation pond(s) shall be kept free and clear of oil skims.

S. Dump and skim tanks:
A. The dump and skim tank shall be engineer designed in accordance to
the submitted application materials and Use by Special Review Permit
Plan Map.
B. During the construction phase, a full-time professional

addressed to the State Health, County Health and Planning
Departments that the design, materials, construction and operation
of the tanhs comply with the specifications as listed in the
submitted application materials and on the Use by Special Review

C. Shelters shall cover all dump tanks. In the event water fowl gain
access to the dump tanks one (1) inch square wire mesh shall cover
the tanks.
9. All operating records shall be made available to the State Health and
County Health Departments upon request. Operating records shall be
maintained as described in the submitted application materials and
available at the time of request. The facility shall be closed in
accordance with the Solid Waste Disposal Sites and Facilities Act.
10. A responsible employee, trained to differentiate between brine water and
other drilling fluids, shall be at the facility during receipt of all
brine water.
11. A dust abatement program shall be implemented on the access road leading
to the dump tank.
12. The applicant shall comply with the design standards for the Use by
Special Peview, Section 24. 5 et r-eq. , of the Weld County Conine
Ordinance.
13. The applicant shall comply with the Operation Standards for Uses by
Special Review, Section 24.6 et seq. , of the Weld County Zoning
Ordinance.

14. Representatives or members of the Weld County Health Department and Weld
County Department of Planning Services shall be granted access onto the
site at any reasonable time in order to insure the operations carried out
on the site comply with the Development Standards stated hereon and all
applicable Weld County Regulations.
15. The Use by Special Review shall be limited to the plans shown hereon and
governed by the Standards as stated above and all applicable Weld County
Regulations. Any material deviations from the plans and/or Standards as shown
or stated above shall require the approval of an amendment of the Permit by
the Weld County Planning Commission and the Board of County Commissioners
before such changes from the plans and/or Standards are permitted. Any other
changes shall be filed in the office of the Department of Planning Services.
16. The property owner and/or operator of this operation shall be responsible
for complying with all of the above stated Standards. Noncompliance with
any of the above stated Standards may be reason for revocation of the
Permit by the Board of County Commissioners.
The Operation Standards are to be amended to include Operation Standard No. 17
and Operation Standard No. 18 as follows:

18. In the event the U.S.R. area is still in operation at the end of a fifteen
(15) year period from the date of final approval by the Board of County
Commissioners the applicant shall submit a new U.S.R. and Certificate of
Designation application. The U.S.R. and Certificate of Designation appli-
cation shall be presented to the Weld County Planning Commission and the
Weld County Board of Commissioners. The U.S.R. and Certificate of Desig-
nation would require approval by the Board of County Commissioners in
order to continue the operation for a period longer than fifteen (15)
years from the date of approval by the Board of County Commissioners.

Dear Mr. Schuett:
This letter is to document our phone conversation of
this same date wherein we discussed the perimeter trees
at Road 54 , E-VAP Park.
As you noted, quite a number of the evergreen trees
have turned brown from dry-freeze damage last winter.
We now are irrigating them from the farmland irrigation
system . however, and many brown trees are extending green
growth. Mr. Gene Kammerzell of Arborland Nursery has ad-
vised that trees with new growth will recover if continually
irrigated and pruned.
It is our plan to continue the irrigation , and tag all
trees this fall that do not have such new growth. Next
spring , all trees that do not show such signs of recovery
will be replaced. Mr. Kammerzell has confirmed that re-
placement trees must be planted early in the growing
season for them to develop root growth , or they will not
survive the winter season.

our intention and plan to provide the County with a well -
maintained , as well as expertly planned and constructed ,

This department has received numerous complaints about an
ongoing odor problem with the disposal facility. We have requested
that the operator of the facility initiate an odor abatement program.
They have started some treatment of the ponds using borate to control
bacterial growth.
In reviewing the development standards, I noticed that 7-J re-
quires the aerator system be installed and operated. This system is
not being operated and therefore, the facility is not in compliance
with the development standards of the USR. I would like a )notification
of this non-compliance sent to the operator.

operational at this time.

Personnel from the Department of Planning Services conducted an on-site
inspection of your property on March 20, 1986 to determine whether you were
in compliance with the Operation Standards placed on your property at the
time USR-540:83:3 was approved. The inspection revealed violations of
Operation Standards 7 J, 15 and 16. I have enclosed a summary of the items
that appear to be in violation of the foregoing Operation Standards.
You are hereby requested to comply with the requirements of the Operation
Standards within thirty (30) days from the date of this letter. Failure to
comply will result in our office scheduling a Probable Cause Rearing before
the Board of County Commissioners. If the Board determines that there is
sufficient probable cause to warrant further action, a Show Cause Hearing
will be scheduled to consider revocation of the Use by Special Review
Permit.
If you have information that may clear up this matter, please telephone or
write. If you have no additional information, please let me know and I will
schedule an appointment with you to discuss the procedures and requirements

Dear Mr. Schuett :
In response to your letter of March 20 , 1986 , wherein
you expressed concern that the aeration system at the E-VAP
disposal site has not been in operation to date , please con-
sider the following .
1 . The major reason for the aeration system being added
to the Operating Standards was to assure sufficient evaporation
and subsequent continued operational capacity of our site .
Capacity has proven to be the least of our problems , in fact
throughout the summer of 1985 , we pumped considerable irrigation
water into the ponds to have sufficient coverage to protect the
clay liners . Please note that Operational Standard 7G requires
reinspection and certification of those liners if they are left
dry for more than 30 days .
Therefore , to operate our currently installed system as
originally designed would now prove to be self-defeating ,
particularly if the volume of brine intake should continue
to decline due to falling oil prices . The system was designed
to spray water into the air from the top of each post that now
supports the 4 or 6- inch supply line throughout our 17 acres
of evaporation ponds . A slight modification of our system
can accomplish the secondary function of aeration .
2 . The secondary function of the aeration system is to
put additional oxygen into the water to assist in odor control .
The first evidence of an unpleasant smell arose in late summer
of 1985 . This was some nine months after our operations began .
The cooler temperatures of fall and winter eliminated the
gaseous activity in the ponds , and consequently any odors . We
did however , have a complete study made by a microbiologist
from Colorado State University . His recommendation was to first
treat our ponds with a borate compound and later aerate the
ponds for greater effectiveness of its odor-controlling qualities .
The unusually early warming period this spring , and then inclement
conditions did start the gaseous activity sooner than anticipated ,
and then made the spreading activity from a boat extremely
difficult for a few days . We did complete Ov nl spread g

36 ,000 pounds of Borax last Saturday however , and the result
is increasingly evident ! Any continued complaints from the
neighborhood will be fermented by their original "sour grapes"
and not by our ponds ! Our facility will always have an oil -
field related scent , which should be understandable , but it
has never been in violation nor been substantiated as being
obnoxious . The Borax has "softened" the sulfur-type bite
of the scent . We will continue to add Borax as a maintenance
procedure , now that its effectiveness has become evident .
To accelerate the control activity we do plan to operate
the aeration system as shown on the enclosed drawings . This
will utilize a great volume of air at low pressure . This air
will be injected onto the concrete bases of each post on the
currently installed system. The result will be aeration of
the water with little additional evaporation .
We are in the process of purchasing the required equip-
ment and materials at this time . Complete aeration will be
operational not later than April 30 , 1986 .

The property was inspected at the request of Mr. Martensen. Mr. Martensen
had installed an aeration system on the north east pond. The aeration
system appeared to operate fine. Mr. Martensen stated that he would be able
to have the aeration system installed on all ponds, within three days after
reaching an agreement with Travelers Insurance Companies on the ownership of
the operation.

As per our conversation Friday May 9th at the
E-VAP site , regarding upgrading our approved land-
scaping plan .
It is our plan to replace all dead stock this
Spring and Fall planting season. The first phase
will be completed by May 30th , which is to include
the replacement of dead Russian Olive growth , on
the North side of E-VAP Park. We have approximately
38 Russian Olive trees to replace.
Due to the currant short-term availability of
cedars and the limited time and water to plant same ,
we propose to replant the dead evergreen trees at
the best replanting time suited for Burke Red Cedar ,
or a comparable replacement. . . approximately 160 trees
of this type.
As you well know, we are currently changing
tentative owners at the site and all decisions are
being temporarily handled by Drexel Cloos , Receiver
for Blehm Land & Cattle Co . We intend to comply with
our requirements , but please understand the current
circumstances .

The property was reinspected to determine if the property is in compliance.
The inspection was conducted with Mr. Drexel Cloos, a court appointed
receiver for Travelers Insurance Companies, and Mr. Robert Dragich, manager
of the facility.
The aeration systems for all four ponds have not been installed, the air
compressor that was observed on the April 11 demonstration has been removed.
Mr. Cloos stated that air compressors are on order, and should be installed
to aerate all ponds within several weeks.
A copy of the case file was given to Mr. Cloos. We discussed the Greenbelt
and what was needed to maintain it. Mr. Dragich stated that he would submit
a proposal to the Planning Department concerning the maintenance of the
Greenbelt and on the replacement of the dead trees by May 12, 1986.
The operation standards 7.J. , 15, 16, and 17 are not in compliance at this
time.

Dear Sirs:
Notice is hereby given that on May 28, 1986, at 9:00 am, or as soon
thereafter as the agenda of the Board of County Commissioners permits, the
Board of County Commissioners of Weld County will hold a Probable Cause
public hearing pursuant to Section 81 of the Weld County Zoning Ordinance.
This meeting will take place in the Commissioners' Hearing Room, Weld County
Centennial Center, 915 Tenth Street, Greeley, Colorado.
The purpose of this public hearing will be to review case number
USR-540:83:3 for compliance with the Operation Standards as approved by the
Board of County Commissioners on December 12, 1983, to determine if probable
cause exists to hold a hearing on revocation of USR-540:83:3.
Inspection by representatives of this office have identified that you are
not in compliance with Operation Standards 7.J. , 15, 16, and 17 of
USR-540:83:3.
If it is determined at the public hearing that there is probable cause that
you are not in compliance with USR-540:83:3 the Board of County
Commissioners will schedule a Show Cause public hearing to consider
revocation of the Use by Special Review permit.

The property was inspected due to a request of Mr. Robert Dragich. Mr.
Dragich stated that the aeration system was in operation.
An aeration system was observed operating on, all lagoons. Mr. Dragich
stated that the oder abatement program would be reinstituted as soon as a
determination is made on the effectiveness of the aeration system.
Mr. Dragich stated that he would have all trees replanted by May 27, 1986.

system is operating on all ponds and trees have been replanted. It appears
at this time that the operation is in compliance with the approved standards

Subject : Odor Abatement Program

Mr . Potter, as you know, we have instituted our aeration
system that was inspected by your department and Weld County
Planning and Zoning .
A. We propose to aerate all four evaporation ponds for
3 to 4 weeks . To monitor disolved oxygen levels in brine
water in these ponds, aeration was started full time May 17 , 1986 ,
8 a .m.
B. Application of approved chemical oxidizers , if necessary,
example H202 after 4 weeks if necessary. To be determined if
necessary by Weld County Health Department .
C. Application of Borate after oxygen level is increased ,
to cut bacteria count.
Note: 36 ,000 lbs . of Borate were applied in two
applications in April of this year . Documented
by letters to Health Department ( twice the rec-
ommended dose ) .
As you can see , we are complying with the current operation
standards in this matter.
