HomeMy WebLinkAbout870275.tiff RESOLUTION RE: APPROVE USE BY SPECIAL REVIEW FOR A RECREATIONAL TRAIN FACILITY - CHARLES HOBDAY WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners held a public hearing on the 15th day of April , 1987, at the hour of 2: 00 p.m. in the Chambers of the Board for the purpose of hearing the application of Charles Hobday, 1443 South Harlem, Forest Park, Illinois 60130 , for a Use by Special Review for a recreational train facility on the following described real estate, to-wit: Part of the SE4 of Section 30 and the E' Ek of Section 31 , Township 2 North and the Ek E1/2 NE' of Section 6 , Township 1 North, all in Range 65 West of the 6th P.M. , Weld County, Colorado WHEREAS, said applicant was represented by Don Drawer, and WHEREAS , Section 24 . 4. 2 of the Weld County Zoning Ordinance provides standards for review of said Use by Special Review, and WHEREAS , the Board of County Commissioners heard all of the testimony and statements of those present, has studied the request of the applicant and the recommendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter and, having been fully informed, finds that this request shall be approved for the following reasons: 1. The submitted materials are in compliance with the application requirements of Section 24 . 7 of the Weld County Zoning Ordinance. 2 . It is the opinion of the Board of County Commissioners that the applicant has shown compliance with Section 24. 4 . 2 of the Weld County Zoning Ordinance as follows: a . The proposal is consistent with the Comprehensive Plan in that the proposed use does not infringe on continued agriculutral use in the vicinity or County. The attached Development Standards will minimize impacts on surrounding land uses to the greatest extent possible. ?" 870275 Page 2 RE: USR - HOBDAY b. The proposal is consistent with the intent of the Agricultural Zone District and is provided for as a Use by Special Review. c. The use is both compatible with surrounding land uses and with future land uses which are contemplated to be agricultural in the Comprehensive Plan. d. This proposal was reviewed by the Town of Hudson ' s Planning Board . In its referral response it indicated that this proposal does comply with the Town of Hudson ' s Comprehensive Plan. e. No overlay districts affect this site. f. The Use by Special Review Development Standards will provide adequate protection of the health , safety and welfare of the neighborhood and County. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the application for a Use by Special Review for a recreational train facility on the hereinabove described parcel of land be , and hereby is , granted subject to the following conditions: 1 . Prior to recording the Use by Special Review plat: a. The Use by Special Review plat shall be amended to show a parking area on the north end of the Use by Special Review site, adjacent to Weld County Road 39 , and show the right-of-way on Weld County Road 39 . b. Development Standards adopted shall be placed on the Use by Special Review permit plat. c. The plat shall show a 75-foot right-of-way reservation on the north side of State Highway 52 from the center line of the Highway. d. A copy of a soil erosion control plan and landscaping plan , approved by the Platte Valley Soil Conservation District, shall be submitted to the Department of Planning Services. 870275 Page 3 RE: USR - HOBDAY e. Evidence shall be submitted to the Department of Planning Services that the State Division of Water Resources has approved an industrial water supply for this facility. f. Plans concerning construction and maintenance of a six-foot-high solid wooden fence used for screening of a storage area shall be submitted to the Department of Planning Services staff for approval . The screened storage area, as approved by the Department of Planning Services staff , shall be designated on the Use by Special Review plat. 2 . The Use by Special Review activity shall not occur nor shall any building or electrical permits be issued on the property until the Use by Special Review plat has been delivered to the Department of Planning Services Office and the plat is ready to be recorded in the office of the Weld County Clerk and Recorder. 3 . An inventory of all items located on the property shall be submitted to the Department of Planning Services designating which items will remain on the property as salvageable material and which items are considered trash and will be removed from the property. 4 . Within 90 days of approval of the Use by Special Review permit by the Board of County Commissioners , all trash shall be removed from the property. 5 . Within 120 days of approval by the Board of County Commissioners , a solid six-foot-high wood fence shall be erected on all four sides of the storage yard area as identified on the Use by Special Review plat. 6. Within 150 days of approval by the Board of County Commissioners, all items identified as salvageable materials shall be located within the screened storage yard. 7 . The Use by Special Review permit is for a recreational train facility as submitted in the application materials on file in the Department of Planning Services and subject to the Development Standards stated herein. 2. The Use by Special Review area shall have two accesses, one from Weld County Road 39 and the other from State Highway 52 as shown on the Use by Special Review plat. An access permit from the State Highway Department shall be obtained prior to the construction and use of the access onto State Highway 52. If Weld County Road 39 is to be constructed along the east side of the property, the direct access to State Highway 52 shall be closed and permission shall be obtained from the Weld County Engineering Department for access onto Weld County Road 39 . 3 . The owner and/or applicant shall implement and maintain the soil erosion control and landscaping plans approved by the Platte Valley Soil Conservation Service. -4. The Use by Special Review site shall be maintained in a neat -and orderly condition. Inoperable equipment, materials, and parts shall be kept in the enclosed , six-foot-high wooden _fence identified on the Use by Special Review plat. 5 . All septic systems are required to be designed by a Colorado registered professional engineer according to the Weld County Individual Sewage Disposal Regulations and shall be installed according to the regulations. 5. The water supply shall be properly disinfected and shall be tested monthly in accordance with the Colorado Primary Drinking Water Regulations. a. Bottled drinking water shall be provided by an approved certified bottled water source in quantities of no less than three gallons per person per day for all persons participating in the recreational train facility-school. b. Evidence shall be provided to the Department of Planning Services staff that a public water supply has been approved by the Weld County Health Department prior to providing a food service or housing any persons participating in the recreational train facility-school . 870275 Page 2 DEVELOPMENT STANDARDS - HOBDAY c. A cistern may be used as a source of water for flushing of toilets and for filling the steam engine. Quantities of not less than 75 gallons a day per person and a quantity sufficient for filling the steam engine shall be maintained. The cistern shall be clearly labeled , "not suitable for public consumption. " Evidence shall be provided to the Department of Planning Services staff that adequate sewer service has been approved by the Weld County Health Department to serve the use permitted prior to beginning the use. 7 . The food service establishment shall be constructed, equipped , and licensed according to the State rules and regulations governing the sanitation of food service establishments. 8 . Appropriate permits required from the Colorado Air Pollution Control Commission for the oil-fired locomotive shall be approved prior to the start-up of the operation. 9 . Evidence shall be submitted to the Department of Planning Services staff that the required boiler inspections have been made and approval has been given for operation of the steam locomotive prior to opening the recreational facility to the public and at required intervals thereafter as required by the Colorado Boiler Inspection Department. 10 . The applicant/operator shall be required to comply with all State and County Health Department regulations regarding the disposal of industrial wastes. This also includes the wastewater used in the process of this Use by Special Review activity. 11. No permanent disposal of wastes shall be permitted at the site. Used cleaning solvents, oil , paint, and other associated wastes shall not be stored on the property, but handled and removed to an approved sanitary landfill on a weekly basis in accordance with the Weld County Health Department regulations. 12. All construction on the property shall be designed and built using the best techniques available to prevent radon gas from -entering the structures. All buildings constructed and maintained on the property shall be in accordance with the requirements of the Weld County Building Code Ordinance. 870275 Page 3 DEVELOPMENT STANDARDS - HOBDAY 13. At such time as the facility is open to the public, the applicant shall supply evidence to the Department of Planning Services that liability insurance for a minimum amount of $500,000 . 00 has been purchased and shall be kept in force. 14. The applicant shall be responsible for -complying with the Design Standards of Section 24 . 5 of the Weld County Zoning Ordinance. 15. Three years following approval of the Use by Special Review permit by the Board of County Commissioners , the recreational facilities shall be in operation. If the facility is not operating, it shall be considered discontinued as identified in Section 24. 1. 5 of the Weld County Zoning Ordinance. 16 . 'The applicant shall be responsible for complying with the Operation Standards of Section 24 . 6 of the Weld County Zoning Ordinance. 1'7 . Representatives or members of the Weld County Health Department and Weld County Department of planning Services shall be granted access onto the property at any reasonable time in order to ensure the activities carried out on the property comply with the Development Standards stated herein and all applicable Weld County Regulations. 1-8. The Use by Special Review area shall be limited to the plans shown herein and governed by the foregoing Standards and all applicable Weld County Regulations . Any material deviations from the plans or Standards as shown or stated shall require the approval of an amendment of the permit by the Weld County Planning Commission and the Board of County Commissioners before such changes from the plans or Standards are permitted . Any other changes shall be filed in the office of the Department of Planning Services . 19 . The property owner or operator shall be responsible for complying with all of the foregoing Standards. Noncompliance with any of the foregoing Standards may be reason for revocation of the permit by the Board of County Commissioners . 870275 HEARING CERTIFICATION DOCKET NO. 87-9 -RE: USE BY SPECIAL REVIEW FOR A -RECREATIONAL TRAIN FACILITY - CHARLES HOBDAY A public hearing was conducted on April 15, 1987, At 2:00 P.M. , with the following present: Commissioner Gordon F. Lacy, Chairman Commissioner C.W. Kirby, Pro-lem Commissioner Gene Brantner Commissioner Jacqueline Johnson Commissioner Frank Yamaguchi Also present: Acting Clerk tothe Board, Mary Reiff Assistant County Attorney, lee D. Morrison Planning Department representative, Keith Schuett The following tusiness was transacted: I hereby certify that pursuant to a notice dated February 11, 1987, and duly published February 19, 1987, in the Johnstown Breeze, a public hearing was conducted to consider the request of Charles Hobday for a Use by Special Review for a recreational train facility. Lee Morrison, Assistant County Attorney, made this matter of -record, stating that this hearing was _continued from March 4 and March 25 to Allow for the submission of certain items. Keith Schuett, Manning Department representative, gave the Board copies of pictures and a list of the major items to be kept and items to be removed from the property. lion Drawer came forward to represent the applicant and answer questions of the -Board. Mr. Morrison reviewed the changes to the Conditions And Development Standards which were approved At the previous hearings. Commissioner Johnson reviewed the time schedule outlined in Conditions #4, #5, and #6, and Mr. Drawer asked that each of these deadlines be extended thirty days, because he is to have surgery soon which may hinder the timely completion of these various tasks. Commissioner Johnson moved to extend the time limits contained in Conditions #4, 113, and #6 by thirty days, with the understanding that there will to no further extensions of time. Commissioner Kirby seconded the motion and it carried unanimously. It was the consensus of the Board that the list submitted by Mr. Schuett is sufficient to meet Condition #3. After discussion regarding the water situation, Commissioner Johnson -moved to delete the fourth item under Condition #1. The motion was seconded by Commissioner Brantner and carried unanimously. ,Jimmie Miller, an adjacent landowner, came forward to ask questions concerning this application -and requested that the various deadlines be strictly enforced. Commissioner Johnson moved to approve the request for a Use by Special Review, subject to the Conditions and Development Standards As amended. Seconded by Commissioner Brantner, the motion carried unanimously. They plan to open the railroad as -soon as the trackage is laid to Weld County Road 52. They have had the engine's boiler inspected by the State Boiler Inspection Department with the flues out and it passed inspection. These were -retained by the staff as Evidence. Also, Mr. Hobday has the financial ability to Complete and maintain this railroad. Some of the buildings moved onto the -site are historical, such as Rattle Snake Kate's house, the first lefferson County Court House, etc. The Chairman asked Mr. Drawer if he had reviewed the recommendations, conditions, and Development Standards as outlined by the Department of Planning Services staff. -He stated -he has no objections other than those expressed at the December 16, 1986, hearing--as long as the tern "screening" did not mean fenced. Lee Morrison explained that once an applicant is granted a Use by _Special Review permit, the applicant loses all of his grandfathered rights and the whole -package of use is that which is in the permit. If the permit is revoked, the land goes back to use that is applicable by sight in that zone and any grandfathering that might -have -existed prior to the Use by Special Review could be lost. It is the opinion of the Weld County Planning Commission that the applicant has shown compliance with Section 24.3 of the Weld County Zoning Ordinance as follows: The proposal is consistent with the Comprehensive Plan in that the proposed use does not infringe on continued agricultural use in the vicinity or County. The Attached Development Standards will minimize impacts on surrounding land uses to the greatest extent possible; - The proposal is consistent with the intent of the Agricultural Zone District and is provided for as a Use by Special Review; - The use is both compatible with surrounding land-uses and with future land-uses which are contemplated to be agricultural in the Comprehensive Plan; - This proposal was reviewed by the Town of Hudson's Planning Board. Prior to recording the Use by Special Review Plat: - The Use by Special Review plat shall be amended to show a parking area on the north end of the Use by Special -Review site, adjacent to Weld County Road 39; - Development standards adopted shall be placed on the Use by Special Review permit plat; - The plat shall show a seventy-five (75) foot right-of-way reservation on the north side of State -Highway 52 from the center line of the Highway; - Evidence shall be submitted to the Department of Planning Services that a well permit has been approved for the proposed uses on the property; A copy of a soil erosion control plan and landscaping plan, approved by the Platte Valley Soil Conservation District, shall be submitted to the Department of Planning Services; - Evidence shall be submitted to the Department of Planning Services that the State Division of Water Resources has approved an industrial water supply for this facility; and - Plans concerning construction and maintenance of a six (6) foot high solid wood fence used for screening of a storage area shall be submitted to the Department of Planning Services staff for approval. The Use by Special Review area shall have two accesses, one from Weld County Road 39 and the other from State Highway 52 as shown on the Use by Special Review plat. An access permit from the State Highway Department shall be obtained prior to the construction and use of the access onto State Highway 52. If Weld County Road 39 is to be constructed along the east side of the property, the direct access to State IHighway 52 shall be closed and -permission shall be obtained from the Weld County Engineering Department for access on to Weld County Road 39. 3. The owner and/or applicant shall implement and maintain the soil erosion control and landscaping plans approved by the Platte Valley Soil Conservation Service. 4. The Use by Special Review site shall be maintained in a neat and orderly condition. Inoperable equipment, structures, materials, -and parts shall be kept in the enclosed, six (6) foot high - wooden fence identified on the Use by -Special Review plat. 5. All septic systems are required to he designed by a Colorado registered professional engineer according to the Weld County Individual Sewage Disposal Regulations and shall be installed accoring to the regulations. 6. The water supply shall be properly disinfected and shall he tested monthly in accordance with the Colorado Primary Drinking Water Regulations. 7. The food Service establishment shall be constructed, equipped, and licensed according to the State rules and regulations governing the sanitation -of food service establishments. 8. Appropriate permits required from the Colorado Air Pollution Control Commission for the oil fired locomotive shall be approved prior to the start—up of the operation. 9. The applicant/operator -shall be re-quired to comply with all State and County _Health Department regulations regarding the disposal of industrial wastes. This also includes the wastewater used in the process of this -Use by Special Review activity. 11 . No permanent disposal of wastes shall be permitted -at the site. All used cleaning solvents, oil, paint, and other associated wastes shall not be stored on the property, but handled and removed to an approved sanitary landfill on a weekly basis in accordance with the Weld County Health Department -regulations. 12. All _construction on the property shall be designed and built using the best techniques available to prevent radon gas from entering the structures. All building -constructed and -maintained -on the property shall be in accordance with the requirements of the Weld County Building Code Ordinance. 13. The applicant shall supply evidence to the Department of Planning Services that liability insurance for a minimum amount of five hundred thousand dollars ($50D,000.00) has been purchased and is kept in force. 14. The applicant shall be responsible for complying with the Design Standards of Section 24.5 of the Weld County Zoning Ordinance. 15. Three (3) years following approval of the Use by Special Review permit by the Board of County Commissioners, the recreational facilities shall be in operation. J Proposed uses: 1 . Week long classes will be held on operation of steam locomotives. Students would stay in motel in Fort Lupton originally, later in quest rooms on the property. 2. We have had two offers to shoot movies using the train and town. This would be offered after the train is operational . 3. Due to the number of antiques, old trains, etc , we would display these to the public as an operating museum. Access to the town would only be allowed from the train , boarding it on Highway 52. 4. Possibly a restuarant and lounge at some time in the -future with access the same as in item 3. 5. We do have the shops, tools and equipment to duplicate parts from the old train cars and have been asked by other railroads to supply them with hand made pieces. The main theme of the project is the recreation of our visitors. The uses of the property to the west and north of us is a private airport.. To the east is a chicken farm. The remaining neighbors farm and raise crops. The closest residental structure is a quarter mile to the north. The classes would be limited to twenty students. Employees would be hired to insure adaquate control of the operation. The train would run for the school 5 days -a week and the museum on the week ends. Most all of the train operations would be in daylight hours, but a few hours each week would be at night. The operation at its peak usages as mentioned above would probably have a total of twenty full and part time employees. Arrangements have been made with AS<W Water Service to furnish and haul water from their industrial water well to Sundown. This water will be stored in our 50,000 gal water tank and will be used for the steam engine and -fire fighting. (see attached letter from A&W Water Service Inc. ) Access to the property is from the north on CR 39 and from the south on Colo Hwy 52. All visitors will arrive to ride the train from Hwy 52. Students will be picked up and returned once a day -to the motel from road 3 . An engineered sewer facility will be constructed before students 870275 are housed on the property. (See attached _plan) . We are in the Hudson Fire -Protection District -for Fire Protection and as mentioned _earlier will hav_e water v_eilable in the water tank for small fires. • We feel that with the acreage involved and its moor dryland farming abilities that this is a good use for the property. It has had trackage and railroad equipment on it since 1966 end has not i-nt-er-fered with the surrounding land uses. it will be compatibl_e with the fictur_e development of the surrounding area as permitted by the exiting zone and with future dev_elopment as projected by the comprehensive plan of the county. There is adequate provision for the protection of the health, safety -and welfare of the inhabitants of the neighborhood and the county. At this time it is planned to limi-t -the number of students to -four per steam engine. In the b_eginninq the students would be staying at the mot-el in Ft Lupton _and -transported to the train site. A permit has been issued for a rest room to the existing stepic tank which would be compl-eted before operation comences. Trash pickup is available in dumpsters or cans and would be hired and used as necessary. Bottled water would be used for drinking until a well could be drilled. P-ermit *100610 was issued and would _be renewed when we are ready to drill . A cistern with hauled in water is presently on the -site. The surrounding property usages include a private _eirpnrt , a poultry h-at-chery, farming operations, and dry land grazing. Our property is for the most part in buffalo grass. The following Summary Statement -and development -crit-eria that follow pretain to -the development of the old town. 87027 SUMMARY STATEMENT The south end area wilt be the -starting -point for visitors to -the 125 acres of the Sundown & Southern -Railroad. Parking will be in the area next to Rt 32 as shown. The lot will be gravel originally and later paved. There is one 35' access from the state highway located closest to the crest of a hill . Signs identifying -the operation will be of a size and nature that are in accordance with the We lid County size regul a- tions. The depot, water tank, side -tracks and main trac-k will be located at the perk• Ing area, along with any necessary support buildings. Landscaping will he -on a contir uing basis using native trees and shrubbs, hardy enough to survive without constant irrigation. The area north of the parking area will contain the app 2 miles of track- a ge that will take visitors to the town.
