Crews , 1223 28th Avenue, Suite #2 , Greeley, Colorado 80631 , to amend a Special Review permit for oil and gas production facilities in the R-1 (Low Density Residential) Zone District on the following described real estate, to-wit: Si SW} and the SEi , Section 34 , Township 5 North, and the NW$ of Section 3 , Township 4 North, both in Range 66 West of the 6th P.M. , Weld County, Colorado WHEREAS , said applicant was represented by Mike Morgan, Attorney, and WHEREAS , Section 24 . 4 . 2 of the Weld County Zoning Ordinance provides standards for review of said Special Review permit , and WHEREAS , the Board of County Commissioners heard all of the testimony and statements of those present, has studied the request of the applicant and the recommendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter and, having been fully informed, finds that this request shall be approved for the following reasons: 1 . The submitted materials are in compliance with the application requirements of Section 24 . 7 of the Weld County Zoning Ordinance. 2 . It is the opinion of the Board of County Commissioners that the applicant has shown compliance with Section 24 . 4 . 2 of the Weld County Zoning Ordinance. The attached Development Standards for the Special Review permit be adopted and placed on the Special Review plat prior to recording the plat. 2 . Prior to recording, the Special Review plat shall be amended to show the "J" sand wells and to show that all wells shall be drilled south of the Big Thompson River. 3 . The applicants shall enter into a road agreement with the Weld County Engineering Department. Said agreement shall be approved by the Board of County Commissioners prior to recording the Special Review plat. The permitted uses on the herein described parcel shall be oil and gas production facilities including "J" sand wells as permitted by the Colorado Oil and Gas Commission located in accordance with the submitted plat on file with the Department of Planning Services . 2 . Any proposed tank battery cluster or flaring of wells associated with oil and gas production shall be located south of the Big Thompson River and a minimum of 800 feet from any existing residence in the Dos Rios Subdivision. Any tank battery cluster shall be screened from public right-of-way and adjacent residences. 3 . Any proposed oil and gas well shall be located south of the Big Thompson River and a minimum of 700 feet from any existing residence in the Dos Rios Subdivision. 4 . In compliance with Section 26 . 2 of the Weld County Zoning Ordinance, the owner and/or operator shall furnish the Department of Planning Services a certificate from a registered engineer that any of the development within the Use by Special Review permit area will not change the direction of flow of water in a river or stream; that said development will not result in a change of ten percent or more in the intermediate regional floodwater flows; and that said operations will not channelize a river or stream. The applicant shall comply with Section 26 .4 . 9 and 26 .5 . 2 of the Weld County Zoning Ordinance in the event any of the above conditions will occur. 5 . All oil and gas wells shall be cased in accordance with applicable rules and orders of the Colorado Oil and Gas Conservation Commission in order to protect ground water from pollution. 6 . Tiedowns shall be provided for all tanks located within the £loodplain. Bulkheads shall be placed in front of wellheads located in the floodplain, facing upstream, to protect them from flood debris damage. 7 . Brine water produced at the site during oil and gas production shall be disposed of by formation injection or into a commercial brine disposal site . 871564 Page 2 DEVELOPMENT STANDARDS - COLTON AND SUNSHINE VALLEY 8 . A "special transport" permit is required for moving oil rigs on County Road. 9 . Once well drilling activity is initiated, the drilling rig shall be removed within 30 days of the start of said activity. 10 . Flaring of the wells shall take place only during daylight hours except for a 30-day period following the completion of the fracking operation. 11 . The designated haul route for production equipment, tank trucks , and heavy truck traffic shall exclude those portions of Weld County Road 396 within Sections 34 and 35 , Township 4 North, Range 66 West of the 6th P.M. , Weld County, Colorado. Signs shall be posted at points of access from the production facilities onto County Roads directing -traffic away from the restricted area. The applicants shall advise all contractors in writing of this requirement. 12 . Petroleum products and compressed flammable gases are hazardous substances per C.R.S . 29-22-107 (2) (a) . Prior to drilling, the applicant shall provide a list of the maximum quantities of hazardous substances expected at the site and emergency phone numbers to the State Health Department, Division of Waste Management; the Weld County Emergency -Response Coordinator; and the La Salle Fire Proection District. Evidence of this listing and emergency phone numbers shall be provided to the Department of Planning Services prior to the issuance of building permits. 13 . Fired vessels shall be a minimum of 75 feet from any well head, and any occupied building shall be a minimum of 200 feet from any heater treator. 14 . All tank batteries shall be designed to meet the following Standard: The tank battery cluster shall be bermed to contain the greatest amount of liquid that can be released from the largest tank, assuming a full tank. 15 . No permanent disposal of wastes shall be permitted at this site . 871564 Page 3 DEVELOPMENT STANDARDS - COLTON AND SUNSHINE VALLEY 16 . If and when low density residential development takes place within 300 feet of any well drilled hereunder, the Operator shall muffle any gas powered motors used in connection with pumping units to a noise level no greater than the level of an electric motor. 17 . All construction on the property shall be in accordance with the requirements of the Weld County Building Code Ordinance. 18 . The property owner or operator shall be responsible for complying with the Design Standards of Section 24 . 5 of the Weld County Zoning Ordinance. 19 . The property owner or operator shall be responsible for complying with the Operation Standards of Section 24 . 6 of the Weld County Zoning Ordinance . 20 . Personnel from the Weld County Health Department and the Weld County Department of Planning Services shall be granted access onto the property at any reasonable time in order to insure the activities carried out on the property comply with the Development Standards stated herein and all applicable Weld County Regulations . 21 . The Special Review area shall be limited to the plans shown herein and governed by the foregoing Standards and all applicable Weld County Regulations. Any material deviations from the plans or Standards as shown or stated shall require the approval of an amendment of the permit by the Weld County Planning Commission and the Board of County Commissioners before such changes from the plans or Standards are permitted. Any other changes shall be filed in the office of the Department of Planning Services. 22 . The property owner or operator shall be responsible for complying with all of the foregoing Standards. Noncompliance with any of the foregoing Standards may be reason for revocation of the permit by the Board of County Commissioners. 871564 HEARING CERTIFICATION DOCKET NO. -87-80 RE: AMEND SPECIAL REVIEW PERMIT FOR OIL AND GAS PRODUCTION - ACILITIES IN THE R-1 (LOW DENSITY RESIDENTIAL) ZONE DISTRICT - H & C COLTON COMPANY AND SUNSHINE VALLEY PETROLEUM CORPORATION A public hearing was conducted on December 16, 1987, =t 2:O0 -P.M. , -with the following present: Commissioner Gordon E. Lacy, Chairman Commissioner C.W. Kirby, Pro-Tem Commissioner Gene Brantner Commissioner Jacqueline Johnson Commissioner Frank Yamaguchi Al-so present: Acting Clerk to the Board, Mary Reiff Assistant County Attorney, Lee D. Morrison Planning Department representative, Lanell Swanson The following business was transacted: I -hereby certify that pursuant to -a notice dated November 23, 1987, and duly published December 3, 1987, in the Johnstown Breeze, a public hearing was conducted to consider the request of H & C Colton Company -and Sunshine Valley Petroleum Corporation to amend a Special Review permit for oil and gas production facilities in the R-1 (Low Density Residential) Zone District. Lee Morrison, Assistant County Attorney, made this matter of record. Lanell Swanson, Planning Department representative, read the favorable recommendation of the Planning Commission, which was subject to 2 Conditions and 22 Development Standards, into the record. Mike Morgan, Attorney, came forward to represent the applicants. He said the Special Review permit was originally granted in 1982, and this request will amend the permit in three ways: add the N}SE} of Section 34, Township 6 North, Range 65 West of the 6th P.M. , Weld County, Colorado, to the Special Review mite; allow drilling on all legal locations in the area and allow Codell and Niobrara drilling; and amend five Development Standards of the original permit. Mr. Morgan explained the requested amendments to the Development Standards and said the Conditions and Development Standards recommended by the Planning Commission are acceptable. After Mr. Morgan answered questions of the Board, comments were offered by Hugh Arnold; Randall Connett; Doug Malcom; Everett Hoff; Dora Gibson; and Gene Ohlemeier. They expressed concerns about the traffic that will be created, the proximity of the proposed well locations to residences in the Dos Rios Subdivision, the noise problem, and requested that the tank battery cluster be screened. Discussion was also held about ways to recover the costs of road maintenance. (Tape Change #87-121) Tom Reed, of Tower Drilling Company, explained the procedures used by drilling contractors. Chairman Lacy reviewed the amendments to the proposed Development Standards discussed in this hearing: Development Standard #2 to state that any proposed tank battery cluster will be located south of the Big Thompson River and at least 800 feet from any existing residence in the Doe Rios Subdivision and shall be screened; Development Standard #3 to state that wells shall be a minimum of 700 feet from any existing residence in the Dos Rios Subdivision and south of the Big Thompson River; and proposed Development Standard #11 to be deleted. After further discussion, it was the consensus of the Board that a new Development Standard #11 should be added establishing a haul route and that Condition #3 should be added providing for a road repair agreement. Commissioner Brantner suggested that the Engineering Department should review the condition of Weld County Road 396 and perhaps _post -a weight limit on the bridge. Commissioner Johnson moved to approve this request to amend a Special Review permit, subject to the Conditions and Development Standards as amended in the discussion. The motion, seconded by Commissioner Kirby, carries unanimously. This Certification was approved on the 21st day of December, 1987. Re also explained the length of time and amount of traffic _during the actual drilling process, and the approximate amount of traffic following location of the tank battery. Ton Reed, -Sunshine Valley Petroleum, stated vertical tanks will be used at this location because of their low profile. 3ill Sheel, Dos Rios property owner, asked that this case be continued to enable the property owners time to see if there is a problem with this request. Lanell Swanson explained the Planning Commission is not a decision making body in this instance. _They will make a recommendation to the Board of County Commissioners. Before the Board cf County Commissioners hear this request, surrounding property owners will be notified of the date of the meeting. Qualified personnel representing the developer shall submit a letter to the County Department of Planning Services indicating that each well has been constructed according to this development standard. 871.5 PROPOSED BY APPLICANT: All oil and alas yells shall be cased in • • accordance with applicable rules and orders of the Colorado Oil and -Gas Conservation Commission in order to protect groundwater from -pollution. The applicant is suggesting groundwater protection requirements are in place at the state 1avel and further that pressure testing -may weaken well casings. The original application, including existing development standards, was approved in 1982- State Oil and Gas Commission standards as referenced in the USR Amendment proposed (Order A-1-3) were adopted in March, 1985. Weld County Road 396 in the area of Dos Rios Subdivision is a narrow gravel road with poor horizontal alignment. It is not suitable to serve heavy truck traffic. It should be verified that the Oil and Gas Commission regulations are so restrictive that the proposed well north of the Big Thompson River cannot be relocated to the south a few hundred feet to opposite side of the Big Thompson River. The proposed well could then be connected to the other existing and proposed wells by private access roads. It should be verified that moving the well to the south and angle drilling will not satisfy the regulations of the Oil and Gas Commission. Use by Special Review 533:82:48, granted by the Weld County Board of County Commissioners (the "Board") to H & C Colton Company on December 13, 1982, authorizes the drilling of six specific oil and gas wells, subject to 16 Development Standards and 6 Operation Standards (the "Standards") , within the NW; of Section 3 and that portion of the Sh of Section 34 lying south of County Road 396 (the "Current U.S.R. Area") . In accordance with this U.S.R. , H & C Colton Company ("Colton") drilled and completed the UPRR Camenisch- uammerzell well in the NE;NW; of Section 3; Sunshine Valley Petroleum Corporation ("Sunshine") , after receiving an assignment of Colton's interest in the E%,SE; and SE;SW1 of Section 34, drilled and completed the Rumsey #16-34 well in the SE',SE1/2 of Section 34 and the Dos Rios #14-34 in the SE;SW', of Section 34. By this Application, Colton and Sunshine seek to amend the U.S.R. as follows: 1. to add to the U.S.R. that portion of the SE; of Section 34 not now included in the U.S.R. (the Current U.S.R. Area, as enlarged by this portion of Section 34, referred to as the "Enlarged U.S.R. Area") , subject to all of the Standards; 2. to permit drilling and completion at legal locations of all wells necessary or convenient to fully develop all oil and gas horizons within the NW; of Section 3, the S1 SW; of Section 34 and the SE; of Section 34 (collectively, the "Amendment Area") , subject to all of the Standards; 3. to amend Standards 2, 3, 5, 11 and 16, insofar as such Standards are applicable to the Amendment Area only, to minimize interference with surrounding agricultural lard unr-, minimize rnssible duplication of or conflict with regulations of the Colorado Oil and Gas Conservation Commission, maintain the Board's land use goals, and protect public health, safety and welfare. Colton and Sunshine do not seek any change in previously approved drilling locations in the NSW'-, of Section 34 or any of the Standards applicable thereto; for this reason, Colton and Sunshine respectfully request that all current terms and conditions of the U.S.R. continue to apply without change to development of the NSW'-,. Colton and Sunshine believe it important that all fee property owners within the Anerdnent Area and within 500 feet of the Amendment Area (collectively, 871.5611 the "Notice Area") receive notice of this Application. Such persons include the fee property owners of all lands in the SE; of Section 34 not now included within the Current U.S.R. Area, all fee property owners within the Current U.S. R. Area who are within the Amendment Area, and all fee property owners within 500 feet of the Amendment Area. The proposed amendments should not, however, affect fee property owners more than 500 feet from the Amendment Area; for this reason, the names of such owners have been omitted ft am the exhibits attached to this application. The Amendment Area and surrounding land are located southwest of the City of Greeley and have been used for agriculture (nubLly pasture and sane irrigated crops) and for oil and gas production. The entire U.S.R. area, including both the Current U.S.R. Area and all lands in the SE' of Section 34 not now included within the Current U.S.R. Area, was zoned R-1 by the Board at a time when residential zoning seemed prudent to protect the Dos Rios subdivision north of the area from uses feared to be incompatible with the desires of its residents. Much of the U.S.R. area lies within the flood plains of the Big Thomson River and the North Platte River, so that it is unlikely that low density residential housing will ever be permitted in the U.S.R. area itself. The soils within the U.S.R. Amendment Area are classified as follows in Soil Survey of Weld County, Colorado, Southern Part published by the Soil Conservation Service, United States Department of Agriculture: Agpolls and Aquents, gravelly substratum (3) Bankard Sandy Loam, 0 to 3 percent slopes (10) Ustic Torriorthents, moderately steep (68) Vona loamy Sand, 0 to 3 percent slopes (72) When Colton applied for and received this U.S.R. , the lands were not spaced for Codell and Niobrara production by the Colorado Oil and Gas Conservation Commission ("O3CC") . The only spacing order then in effect was for "J" Sand production on units of 320 aeies, with the right to drill an infill well on the undrilled 160 acre tract. This order remains in effect today and requires, among other things, that each "J" Sand well be located no closer than 900 feet to a lease line. In December 1983, the OGCC entered a further spacing order for Codell and Niobrara production on units of 80 aese , with the right to drill an infill well on the undrilled 40 acre tract. This order remains in effect today and requires, among other things, that each Codell/Niobrara well be located within 200 feet of the center of a 40 acre quarter-quarter section. Compliance with the (CC spacing order may reg»re that rndell/Niobrara wells drilled in the N'SE1/4 of Section 34 (or equipment in connection therewith) be located north of County Road 396 on lards which are not now within the Current U.S.R. Area. For this reason, Colton and Sunshine seek to add such lands to the U.S.R. area. While all drilled locations and previously approved or proposed Codell/Niobrara locations are indicated on the accompanying mylar plat, locations for pnssible "J" Sand wells have been omitted to avoid confusion. All "J" Sand wells drilled within the Amendment Area under this U.S.R. would, in accordance with OGCC requirements, be located within 420 feet of the center of a 160 acre quarter section. Under the government survey, a "J" Sand well drilled a full 420 feet from the center of a quarter section will not be located within 200 feet of the center of a section; consequently, a legal "7" Sand well location can never be a legal c'niell/Niobrara well location. For this reason, Colton and Sunshine seek to amend the U.S.R. to permit oil and gas drilling and production -not only at the Codell/Niobrara locations designated on the plat, but at all locations within the Amendment Area which may be necessary to develop all oil and gas horizons in compliance with OGrC rules and orders. In addition, Colton and Sunshine wish to amend the U.S.R. to modify Standards 2, 3, 5, 11 and 16, insofar as they apply to the Amendment Area only, as follows: 2 8715fA AMENDMENT TO STANDARD 2: EXISTING: Any proposed tank battery cluster or flaring of wells ascoriated with oil and gas production shall be located a minimum, of 1,200 feet from any existing residence in the 6C/ Dos Rios Subdivision. The tank battery shall be located south of the Big Thompson River. PROPOSED: Any proposed tank battery cluster or flaring of wells ascrriated with oil and gas production shall be located a minimum of 600 feet from any existing residence in the Dos .� ' Rios Subdivision. G REMARKS: In sane rasps (notably the NW1/2SE1/2 of Section 34) , the legal Codell/Niobrara well location prescribed by the OGCC will require that a well be located north of the Big Thompson River. A flow line crossing under the River would not only be economically unfeasible, but, with a total length approaching 1200 feet, likely would not function during winter months without excessive freezing. Applicants perceive no danger to the public health, safety and welfare if production equipment is located north of the River and believe that a 600 foot distance from existing dwellings provides a sufficient buffer. AMENDMENT TO STANDARD 3: EXISTING: Any proposed oil and gas well shall be located a minimum of six-hundred (600) feet from any existing residence in the Dos Rios Subdivision. All oil and gas production facilities shall be located a minimum of three-hundred (300) feet south of the Big Thompson River and located behind existing foliage when possible. PROPOSED: Any proposed oil and gas well shall be located a minimum of six-hundred (600) feet from any existing residence in the Dos Rios Subdivision. REMARKS: In sane c-asas (notably both locations in the N,SE;) , the legal Cod-11/Niobrara well location prescribed by the OGCC will require that wells be drilled nearer than 300 feet to the River. Not drilling such wells would be contrary to the stated policies of the legislature regarding waste and economic development of oil and gas, especially where, as here, the distance requirement from the River is unnecessary to protect public health, safety and welfare. Location behind foliage is prssible at certain of the requested well locations, but only if large cottonwood and other trees are destroyed to obtain amens to such locations. AMENDMENT TO STANDARD 5: EXISTING: All oil and gas wells shall be cased and pressure tested to protect groundwater from pollution. Qualified personnel representing the developer shall submit a letter to the Department of Planning Services indicating that each well has been constructed according to this Development Standard. PROPOSED: All oil and gas wells shall be cased in accordance with applicable rules and orders of the Colorado Oil and (as Conservation Commission in order to protect groundwater from pollution. REMARKS: Order A-1-3 (March 25, 1985) of the OGCC provides for groundwater protection by requiring that "A minimum of 200 feet of surface casing shall be run. In those areas where the barn of the Fox Hill aquifer, which shall include the transition zone, is five hundred (500) feet deep or less, surface casing shall be set at least fifty (50) feet below the haca of the aquifer." Pressure testing of casing to the pressures required during well stimulation may weaken 3 87i.5561 the casing and thereby cause a lack of structural integrity which might not crrnr but for such testing. AMENDMENT TO STANDARD 11: EXISTING: No production equipment or heavy truck traffic agsrriated with the applicant's/owner's U.S.R. prop:na1 shall travel Weld County Road 396. PROPOSED: (delete) REMARKS: As discussed in connection with Revised Standard 3, compliance with current OGCC Crrlell/Niobrara well location orders will require that sane wells be located north of the Big Thompson River. The only currently available aoress to most of these wellsites is County Road 396. Not drilling such wells for want of permitted arrpas along an established County Road would be contrary to the stated policies of the legislature regarding waste and the economic development of oil and gas, especially where, as here, use of such County Road would present no threat to public health, safety or welfare. Requiring construction of an alternate access route for oil and gas activities would result in needless scarring of the landscape. AMENDMENT TO STANDARD 16: EXISTING: If necessary, an electric pump shall be used in ascrr-iation with all oil and gas production on the subject site. PROPOSED: If and when low density residential development takes place within 300 feet of any well drilled hereunder, Operator shall muffle any gas powered motors used in connection with pumping units to a noise level no greater than the level of an electric motor. REMARKS: Given the agricultural nature of the surface use and the likelihood that no low density residential housing would be allowed in the U.S.R. area due to its flood plain location, there is no demonstrated need for restriction as to the type of pump. The substantial cost of purchasing and operating electric pumps may render certain proposed wells uneconomic or shorten their operating life, thereby reducing royalties paid to mineral owners who are, in sane cats, also surface owners.
