HomeMy WebLinkAbout860270.tiff RESOLUTION RE: APPROVE AMENDMENT OF INTER-GOVERNMENTAL AGREEMENT BETWEEN WELD COUNTY, COLORADO, AND CITY OF GREELEY REGARDING COUNTY BRIDGE 391/62A WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, on the 16th day of January, 1985 , the Board did, by Resolution , approve an Inter-Governmental Agreement between Weld County, Colorado, and the City of Greeley regarding the replacement of County Bridge 39162A, also known as the 6th Avenue Bridge , and WHEREAS, said approved Agreement stated that Weld County would provide fifty percent of the local matching funds , not to exceed $54 ,000 , and WHEREAS, the Board has received a request to amend the Agreement to state that the level of funding shall be 10% of the total project cost, not to exceed $85 ,000 , and WHEREAS , after study and review, the Board deems it advisable to approve said amendment. DLS/bf 8602.70 RESOLUTION RE: APPROVAL OF INTER-GOVERNMENTAL AGREEMENT BETWEEN WELD COUNTY, COLORADO, AND CITY OF GREELEY REGARDING COUNTY BRIDGE 391/62A WHEREAS , the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS , the Board has been presented with an Inter-Governmental Agreement between Weld County, Colorado, and the City of Greeley regarding the replacement of County Bridge 391/62A, also known as the 6th Avenue Bridge over the Cache La Poudre River, which is located one-half in the City and one-half in the County, and WHEREAS, said Agreement states that Weld County will provide fifty percent of the local matching funds , not to exceed $54 ,000 , and WHEREAS , the further terms are as stated in the Agreement, a copy being attached hereto and incorporated herein by reference, and WHEREAS, after review, the Board deems it advisable to approve said Agreement between Weld County and the City of Greeley. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the Inter-Governmental Agreement between Weld County, Colorado, and the City of Greeley regarding County Bridge 391/62A be , and hereby is , approved. La y County Attorney / nk Ya guch ' 06W)4:70 COUNTY OF WELD, STATE OF COLORADO INTER-GOVERNMENTAL AGREEMENT THIS AGREEMENT, made and entered into this 16th day of January 1985, by and between the COUNTY OF WELD, State of Colorado , hereinafter called "County" and the CITY OF GREELEY, hereinafter called "City" . WHEREAS,' County Bridge 391,/62A also known as the 6th Avenue Bridge over the Cache La Loudre River is located one-half in the City and one-half in the County, and WHEREAS, the bridge is deficient in load carrying capacity and river channel capacity, and WHEREAS, the replacement of the bridge is a vital part of the Poudre River channel improvements proposed by the City, and WHEREAS, the City and the County jointly applied to the Special Highway Committee for funds to replace the bridge at the request of the City, and WHEREAS, on December 20, 1984, $432,000 in Federal Bridge Replacement Funds was granted, and WHEREAS, $108,000 was the estimated total local matching funds needed for the project at the time of application, anticipated to be provided equally by the City and the County, and WHEREAS, it is in the best interests of the citizens of the City and County to replace the bridge. NOW THEREFORE, in consideration of the mutual covenants and conditions hereinafter set forth, the County and City mutally agree as follows : 1. The County will provide fifty percent of the local matching funds not to exceed $54,000. This amount to be paid upon receipt of an invoice from the City accompanied by the certification of start of construction. Should costs of the project increase due to changes in the scope or complexity of the 'project to facilitate flood plain improvements anticipated by the City, the additional costs will be borne by the City. 2. The City shall be the lead agency and have jursidiction over the structure upon execution of this agreement, allowing for full authority in contractural arrangements during the prosecution of the project. 3. The City shall be responsible for the design, construction and administration of the project. 4. The City will inspect and maintain the replacement structure subsequent to construction of the new bridge and include it in any required bridge inventory. s t'2?O 5 . City agrees to indemnify the County from any and all liability, loss or damage the County may suffer as a result of claims , demands , costs or judgments against it arising out of the design, construction, inspection, inventory or maintenance of the replacement structure except for liability, loss or damage arising from the negligence or intentional torts of the County or its employees while acting in the course of their employment. Box 758 Greeley , Colorado 80632 RE : 6th Avenue Bridge Dear Drew: Thank you for supporting the City of Greeley's request for additional Weld County funding for the 6th Avenue bridge. The City of Greeley is hereby asking that you proceed to have the Commissioners pass a resolution amending the original January 16, 1985 , agreement . Please note that in your letter dated March 3 , 1986, you refer to the level of funding to not exceed 10% of the federal funds up to a maximum of $85 ,000. This should be clarified in the resolution to read 10% of the total project cost, not to exceed $85 ,000. Again, thank you for your assistance in obtaining the additional funding. Box 758 Greeley , Colorado 80632 RE : 6th Avenue Bridge - BRO 0003( 3) Dear Drew: The City of Greeley is currently designing the new 6th Avenue Bridge over the Poudre River. As you are aware , the City and Weld County had entered into an agreement on January 16 , 1985 , whereupon Weld County agreed to pay a maximum share of $54 ,000 for the construction. This project is being funded 80% by Federal BRO bridge funds, so the State of Colorado is required to review all the plans and to bid and inspect the project. We are experiencing the same problem that occurs in many Federal projects in that the cost estimate for the project , including all engineering , construction, inspection, and contingencies, is now approaching $850,000. The original estimate of $540 ,000 was mutually arrived at by your staff and me in late 1984 when the application for funding was made. At that time , we felt that these funds would be adequate. It is still my opinion that the final cost will be somewhat less than $850,000. In order for this project to proceed , the City of Greeley has requested that additional Federal funds be allocated to bring the budgeted funds up to $850 ,000. It appears that these funds are currently available, and the City is pursuing acquisition of the additional monies. In order to receive the additional funds, the City of Greeley is required to commit $ 183,333 in local funds to provide the 20% match plus additional non -matching funds required . The City of Greeley realizes that the original agreement stipulates that Weld County would pay a maximum of $54 ,000 in matching funds. Because of the apparent excessive cost increase projected for this project , the City of Greeley is requesting that Weld County consider amending the agreement to revise Weld County's contribution to a maximum of one-half of the local match needed , not to exceed $91 , 650 . �-� 06 1'2i9O J Mr . Drew Scheltinga January 29 , 1986 Page Two The City of Greeley recognizes that Weld County as well as the City of Greeley is experiencing budget constraints and that funding of projects is tight. We do feel this project is important , and we have agreed to design , construct , and assume ownership of the bridge along with providing local funding.
