AR2033439 RESOLUTION RE: GRANT CHANGE OF ZONE FROM C-1 (NEIGHBORHOOD COMMERCIAL) AND R-1 (LOW DENSITY RESIDENTIAL) TO A (AGRICULTURAL) FOR ED LOLOFF CONSTRUCTION, INC. WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, a public hearing was held on the 25th day of September, 1985 , at 2 : 00 p.m. for the purpose of hearing the application of Ed Loloff Construction, Inc. , 145 3rd Street, Kersey, Colorado 80644 , requesting a Change of Zone from C-1 (Neighborhood Commercial) and R-1 (Low Density Residential) to A (Agricultural) for a parcel of land located on the following described real estate, to-wit: The SEa NW4 and the Sz NEa NWq of Section 4 , Township 5 North, Range 65 West of the 6th P.M. , Weld County, Colorado WHEREAS, Section 21 . 6 .2 of the Weld County Zoning Ordinance provides standards for review of such a Change of Zone, and WHEREAS , the Board of County Commissioners heard all the testimony and statements of those present, has studied the request of the applicant and the recommendations of the Weld County Planning Commission, and, having been fully informed, finds that this request shall be approved for the following reasons: 1 . The applicant has complied with all the application requirements listed in Section 21 . 7 et seq. , of the Weld County Zoning Ordinance. 2. The request is in conformance with Section 21 . 6 of the Weld County Zoning Ordinance as follows: a. It is the opinion of the Board of County Commissioners that the proposed zone change is consistent with the Weld County Comprehensive Plan. The Comprehensive Plan states that extraction of commercial mineral deposits shall take place prior to residential , commercial or industrial development of the site in question. Lee Morrison, Assistant County Attorney, made this matter of record. Gloria Dunn, Planning Department representative, read the favorable recommendation of the Planning Commission into the record. Vern Nelson, of Nelson Engineers, came forward to represent the applicant and answer questions of the Board. He stated that this Change of Zone is requested to allow the possible extraction of sand and gravel located on this property. (TAPE CHANGE #85-81) Robert Francis, a neighbor, came forward to ask questions concerning this request. Following discussion, Commissioner Lacy moved to approve this request for a Change of Zone, based upon the recommendation of the Planning Commission. The motion was seconded by Commissioner Kirby and carried unanimously. This Certification was approved the 30th day of September, 1985. Under the present zoning, the land cannot be used efficiently. The land is underlayed with much sand and gravel. The Weld County Comprehensive Plan states that sand and gravel must be used before the land is available for any other use. The change of zone will allow proper use of the land in a manner approved by the Colorado Mined Land Reclamation Board. This is a fifty-five acre site and the mining operation would be a wet pit. The Chairman called for discussion from the audience. Kay McElroy, Surrounding Property Owner, spoke on the affect the mining operation could have on the domestic and irrigation wells in the area. She is also opposed to this request because of the dirt and noise. Robert Frances, Surrounding Property Owner, felt the current zoning agreed with the surrounding area. He is against any change of zone to agriculture unless the land were used only for farming enterprises. Ed McPheney, Manager, Burris Company, felt a sand and gravel operation is - not compatible with commercial and industrial uses in the area and will curtail any future growth in the area. The Mineral Resources Policies of Weld County state that no development may occur which blocks access to such deposits. The current C-1 and R-1 zoning is therefore faulty zoning, in that no building development is allowed under the Mineral Resources Policies, and no mining is allowed under C-1 or R-1 zoning. As currently zoned, the land cannot be productively used. The southern three-quarters of the parcel is overlain with a soil unsuitable for structural development. The Weld County Soil Survey rates this soil as imposing severe limitations on building construction. The southern one-third of the parcel is within the flood zone. These two conditions greatly restrict any C-1 or R-1 development on the parcel. The proposed Zone Change to Agricultural will allow an appropriate and valuable land use. The soil survey rates these soils as presenting slight to moderate limitations on building construction design. The southern three-quarters of the parcel is covered with Aquolls-Aquents and Bankard soil. These soils present severe limitations on building construction. Y MEMBER OF CONSULTING ENGINEERS COUNCIL .7 !a REPORT OF A MINERAL EVALUATION SCOPE This report presents the results of a mineral evaluation prepared for an approximate fifty-five (55) acre site located north of the Cache La Poudre River east of Greeley, Colorado. The evaluation was carried out by means of test borings, engineering evaluation, and preparation of this report. The objectives of this evaluation were to (1 ) determine the depth of overburden and thickness of sand and gravel encountered at the site and (2) determine the approximate quantities of overburden and sand and gravel encountered. SITE INVESTIGATION The field investigation, carried out on February 4, 1981 , consisted of drilling, logging, and sampling nine (9) test borings. The locations of the test borings are shown on the Test Boring Location Plan included in Appendix A of this report. Boring logs prepared from the field logs are shown in Appendix A. These logs show soils encountered, location of sampling, and groundwater at the time of the investigation. All borings were advanced with a four-inch .diameter. _continuous- type, power-flight auger drill . During the drilling operations, a soils engineer from Empire LaboratorRes, Inc. was present and made a con- tinuous visual inspection of the soils encountered. SITE LOCATION AND DESCRIPTION `, The proposed site is located on Weld County Road 41-1/2 south of County Road 62 east of Greeley, Colorado. More particularly, the site is described as a tract of land situate in the southeast 1/4 of the northwest 1/4 and the south 1/2 of the northeast 1/4 of the northwest 1/4, Section 4, Township 5 North, Range 65 West of the Sixth P.M., Weld County, Colorado. The site consists of irrigated pasture land and numerous irrigation ditches criss-cross the site. The property is fenced, relatively flat and has minor drainage to the south toward the Cache La Poudre River. Existing feedlots are located directly north of the property along with several farm houses and outbuildings. There are fields located east and west of the property. Single-family residences exist to the south. The property is located along the north edge of the Cache La Poudre flood plain and a bluff rises above the flood plain north of the property. SOIL AND GROUNDWATER CONDITIONS The soil profile at the site consists of strata of materials ar- ranged in different combinations. In order of increasing depths, they are as follows: (1 ) Silty Topsoil and F111 Material : The majority of the site is overlain by a six (6) inch layer of silty topsoil . The topsoil has been penetrated by root growth and organic matter. A two and one-half (2-1/2) foot layer of fill consisting of a mixture of clay, sand, and manure is located at the surface in Boring B. (2) Sandy Silty Clay: This stratum underlies the topsoil in Boring 5 and extends to a depth five (5) feet below the sur- face. The silty clay is plastic, contains varying amounts of sand, and is damp to moist in its in situ natural condition. (3) Sandy Silt: The sandy silt stratum underlies the topsoil in Borings 1 , 2, 4, 6, and-9 and extends to the gravel stratum below. The sandy silt is slightly plastic in its moist, dense, in situ condition. -2- (4) Sand and Gravel : The gravel stratum was encountered at the surface and below the topsoil , upper clays, and silts at depths one-half (1/2) to five (5) feet below the surface and extends to the bedrock below. The sand and gravel is gen- erally poorly graded. The upper portion of the gravel stratum above the groundwater table contains minor amounts of silt and less coarse material. Thin lenses of clay were encountered within the gravel stratum in Borings 1 and 7. In general , the gravel contained is a maximum size of one and one-half (1-1/2) inch, and a few small scattered cobbles ranging in size to six (6) inches in diameter were encountered in Boring 9. (5) Sandstone-Siltstone Bedrock: The bedrock was encountered in Borings 1 through 5 at depths forty-one (41) to forty-six (46) feet below the surface. Bedrock was not encountered in the remaining test borings to depths eight (8) to nine (9) feet below the surface. The upper two (2) feet of the bedrock is highly weathered; however, the underlying interbedded sandstone and siltstone is firm to dense. (6) Groundwater: At the time of the investigation, free ground- water was encountered at depths three (3) to fifteen (15) feet below the surface. Water levels in this area are subject to change due to seasonal variations and irrigation demands on and adjacent to the property. RECOMMENDATIONS AND DISCUSSION The test borings at the site indicate that the sand and gravel stratum varies in thickness from thirty-six (36) to greater than fifty- eight and one-half (58-1/2) feet and has an average thickness of greater than forty-eight (48) feet. The-site is overlain by overburden which varies in thickness from one-half (1/2) to five (5) feet and has an average thickness of approximately three (3) feet. Based on the test -3- borings drilled at the site, the property contains approximately four million (4,000,000) cubic yards of sand and gravel. Approximately two hundred seventy thousand (270,000) cubic yards of overburden will have to be removed to obtain the sand and gravel . The majority of the gravel en- countered is below groundwater. The area being quarried will have to be dewatered or the gravel will have to be excavated by use of a dragline and/or dredge. Based on a visual inspection of the sand and gravel 1n the test borings, it is our opinion that material is good quality aggregate. The majority of the aggregate appears to have a maximum size of one and one-half (1-1/2) inch with only minor amounts of cobbles ranging in size to four (4) to six (6) inches. It is felt that this material would be suitable for use as pit-run gravel and/or structural fill and with extensive screening may be used in concrete or asphaltic concrete or as a base course material or for other construction uses. However, additional expense may be required to meet these more rigid specifications due to the lack of coarse material in the granular layer. GENERAL COMMENTS Variations in soil and groundwater conditions may exist between test borings. These variations may not become evident until quarrying operations take place. It should be noted that the quantities presented in this report are based on an average thickness of overburden and sand and gravel interpolated between test borings at the site. Additional test borings, test pits, and laboratory analysis may be required prior to any proposed quarrying operations to more accurately determine the quantity and quality of the granular materials encountered at the site.
