RE: APPROVE MEMORANDUM OF AGREEMENT FOR TEMPORARY EASEMENT WITH
ROBERT B. AND CECELIA K. MASSEY AND AUTHORIZE CHAIRMAN TO
SIGN
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with a Memorandum of
Agreement for temporary easement concerning property located in
the E} of Section 18 , Township 4 North, Range 67 West of the 6th
P.M. , Weld County, Colorado, with Robert B. and Cecelia K. Massey,
and
WHEREAS, the terms and conditions are as stated in said
Agreement, a copy of which is attached hereto and incorporated
herein by reference, and
WHEREAS, after study and review, the Board deems it advisable
to approve said Agreement.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the Memorandum of
Agreement for temporary easement with Robert B. and Cecelia K.
Massey be, and hereby is, approved.
BE IT FURTHER RESOLVED by the Board that the Chairman be, and
hereby is, authorized to sign said Agreement.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 28th day of
December, A.D. , 1988 .

MEMORANDUM OF AGREEMENT
THIS AGREEMENT, made and entered into this 1S day of December,
1988, by and between the County of Weld, State of Colorado, hereinafter
called "County" and Robert B. and Cecelia K. Massey, owner of the property
described below, hereinafter called "Owner" is for the purpose of Temporary
Easement No. TE2, TE2A and TE2B, Department of Highways, State of Colorado,
Project No. BRO 0003(5).
WHEREAS, the Owner's property, of which Temporary Easement No. TE2,
TE2A and TE2B are a part thereof, is more particularly described as
follows:
Part of the E 1/2 of Section 18, Township 4 North,
Range 67 West of the Sixth Principal Meridian,
County of Weld, State of Colorado.
WHEREAS, the description of Temporary Easement No. TE2 within the
Owner's property is more particularly described as follows:
A rectangular 40' X 35' area from station 16+45, left,
to station 16+85, left, and extending 35' west from
the County right-of-way as part of the Department of
Highways, State of Colorado, Project No. BRO 0003(5).
WHEREAS, the description of Temporary Easement No. TE2A within the
Owner's property is more particularly described as follows:
A rectangular 45' X 85' area from station 17+60, left,
to station 18+05, left, and extending 85' west from
the County right-of-way as part of the Department of
Highways, State of Colorado, Project No. BRO 0003(5).
WHEREAS, the description of Temporary Easement No. TE2B within the
Owner's property is more particularly described as follows:
A rectangular 15' X 120' area from station 19+00, left,
to station 20+20, left, and extending 15' west from
the County right-of-way as part of the Department of
Highways, State of Colorado, Project No. BRO 0003(5).
WHEREAS, the Owner herein agrees to grant the County and contractor
engaged by the Department of Highways, State of Colorado, permission for
ingress and egress to Temporary Easement No. TE2, TE2A and TE2B for the
purpose of construction of road approaches and channel improvements.
WHEREAS, the amount of fifty dollars and no cents ($50.00) is agreed
to by the Owner as just compensation for damages due to Temporary Easement
No. TE2, TE2A and TE2B. Compensation shall be paid to the Owner by the
County.
WHEREAS, Temporary Easement No. TE2, TE2A and TE2B shall be null and
void thirty (30) days after completion of construction.
IN WITNESS WHEREOF, the Owner has duly executed the above and
foregoing agreement the day and year first above written.

Subject Agreements for WCB 15/44B, Little Thompson Bridge
Attached please find originals of the agreements for acquiring
fee title for Parcel No. 1 and Temporary Easements TE1, TEIA,
TE1B, and TE1C, for above-captioned project from the Winds, along
with agreements for Temporary Easements TE2, 1h2A and TE2B from
the Masseys, and TE2B and TE3 from the Carlson.
Please present these at the next mooting of the Board of Weld
County Commissioners for their approval of payment.
