RE: SET HEARING DATE FOR CONSIDERATION OF LEFT HAND WATER
DISTRICT SERVICE PLAN
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, a Service Plan and a processing fee have been filed
relating to the proposed Left Hand Water District, Weld County,
Colorado, and
WHEREAS, the law requires that a hearing be called and held
within thirty days concerning the adequacy of said Service Plan
and related documents.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that:
Section 1 . A hearing on the Service Plan, as filed, for the
proposed Left Hand Water District, is called and the same is
hereby set for 10 : 00 A.M. , at the Chambers of the Board, in the
Centennial Building, 915 10th Street, in Greeley, Colorado, the
regular meeting place of the Board of County Commissioners, on
Wednesday, the 4th day of October, 1989 , which date is not more
than thirty days after this meeting.
Section 2 . The Clerk to the Board is hereby directed to
cause a notice of the date, time, location, and purpose of the
hearing to be published in The New News , the legal newspaper of
the County, once each week for a period of three successive weeks,
by three publications, the first of which shall be at least twenty
days prior to the date of the hearing.

Section 3. The Clerk is hereby further directed to provide
written notice of the date, time and location of the hearing to
the petitioners, to the Division of Local Government, and to the
governing body of any existing municipality or special district
which has levied an ad valorem tax within the next preceding tax
year and which has boundaries within a radius of three miles of
the proposed district.
Section 4 . Said notice shall be in substantially the
following form:

PUBLIC NOTICE IS HEREBY GIVEN that there were filed with the
County Clerk and Recorder of Weld County, Colorado, a Service Plan
and related documents for the proposed Left Hand Water District.
The Service Plan and related documents are now on file in the
office of the Clerk to the Board of County Commissioners, 915 10th
Street, Third Floor, Greeley, Colorado, and are available for
public inspection between 8:00 A.M. and 5:00 P.M. , Monday through
Friday.
NOTICE IS FURTHER GIVEN that, by Order of the Board of County
Commissioners of Weld County, a public hearing on said Service
Plan and related documents will be held at the Centennial
Building, 915 10th Street, Greeley, Colorado, at 10 : 00 A.M. , on
Wednesday, the 4th day of October, 1989 .
The purpose of the hearing shall be to consider the adequacy of
the Service Plan of the proposed Left Hand Water District and to
form a basis for adopting a Resolution approving, conditionally
approving, or disapproving the Service Plan.
The proposed Left Hand Water District is located within Weld
County, Colorado, and also Boulder County, Colorado. That portion
located within Weld County is generally described as follows:
That area of Weld County lying South of WCR
26 , west of I-25, north of WCR 10 , and east of
County Line Road (WCR 1) ; and

The West 1/2 of the Northwest 1/4 of Section
18, Township 1 North, Range 68 West of the 6th
P.M. , but excluding any lands lying within the
limits of the Town of Erie; and
Portions of Sections 15 , 16 , 21, 22, 27 , 28 ,
33, and 34, Township 1 North, Range 68 West of
the 6th P.M.
Pursuant to Section 32-1-202, C.R.S. , the Service Plan may not be
approved if a petition objecting to the Service Plan and signed by
the owners of taxable real and personal property, which property
equals more than fifty percent of the total valuation for
assessment of all taxable real and personal property to be
included in the District, is filed with the Board of County
Commissioners no later n ten days

such property has been excluded by the Bo
Commissioners under Section 32-1-203 (3 .5) , C.R.S.
Pursuant to Section 32-1-305 (3) , C.R.S. , the owners of real
property within the proposed District may file a petition with the
District Court in and for Weld County, stating reasons why said
property should not be included with the proposed District and
requesting that such real property be excluded therefrom. Such
petition shall be duly verified and shall describe the property
sought to be excluded. The District Court will hear said petition
and all objections thereto at the time of the hearing on the
petition for organization and shall determine whether, in the best
public interest, said property should be excluded or included in
the proposed District. Such petition may be filed any time after
the petition for the organization of the District is filed with
the District Court, but not later than ten days before the day
fixed for the hearing on the organizational petition.

Section 5 . The Clerk is hereby further directed to refer the
Service Plan to the County Planning Commission, with the direction
that the Commission shall study the Service Plan and that a
representative thereof shall present its recommendations to the
Board of County Commissioners at the hearing described in Section
1 above.
Section 6 . All Resolutions, or parts thereof, in conflict
with the provisions hereof, are hereby repealed to the extent of
such conflict only.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 6th day of
Septmber, A.D. , 1989.
