HomeMy WebLinkAbout850869.tiff RESOLUTION RE: ACTION OF THE BOARD CONCERNING DETERMINATION OF PROBABLE CAUSE HEARING - FARMOIL AND HUGASCO (REPLACED BY THOMPSON VALLEY GAS) AND EDITH WOELFLE, PROPERTY OWNER WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, on the 13th day of July, 1983 , the Board approved a Use by Special Review for a natural gas processing plant on the following described real estate, to-wit: Part of the SEa, Section 13 , Township 4 North, Range 68 West of the 6th F.M. , Weld County, Colorado WHEREAS, the Department of Planning Services has informed the Board that Operation Standards #1 , 2 , 4 , 5 , 8 , and 9 of said Use by Special Review are not being complied with, and WHEREAS , the Board was advised that Hugasco has been replaced by Thompson Valley Gas and Hugasco is no longer a party to this action, and WHEREAS , Thompson Valley Gas has requested thirty days in which to apply for and obtain the proper permits and come into compliance with the Operation Standards, and WHEREAS , after review, the Board deems it advisable to allow Thompson Valley Gas thirty days in which to apply for and obtain the proper permits and come into compliance with the Operation Standards. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that Thompson Valley Gas be, and hereby is, allowed thirty days, until September 12 , 1985 , to apply for and obtain the proper permits and come into compliance with the Operation Standards for said Use by Special Review. It is the opinion of the Department of Planning Services that the following Operation Standards as approved for USR-558 are not in compliance: #1 The uses of the property have been expanded to include equipment storage;; #2 The Board of County Commissioners approved the following facilities: A. Skid mounted gas compressor unit B. Refrigeration unit C. Skid mounted processor D. 18,000 gallon gas storage tank A 300 (more or less) barrel storage tank and 3 meter houses are in addition to the approved facilities located on the property. 114 Operation Standard 1/24.6. 1.6 of the Weld County Zoning Ordinance is not in compliance, the growth of noxious weeds are over 12 inches tall and cover a large portion of the USR area; #5 The design and construction of the facility have not been in accordance with the submitted application materials, recorded plat, and Weld County Building Code Regulation. (USR-558:83:21) LEGAL DESCRIPTION OF PROPERTY: SEA SEA, Section 13, T4N, R68W of the 6th P.M. , Weld County, Colorado DATE: March 20, 1985 TIME: p.m. CASE NUMBER: ZCH-6:85:6 I made an inspection of the above mentioned property to determine if the Operation Standards for USR-558 were in compliance. The inspection revealed the noncompliance of Operation Standards l{1, 2, 5, and 8. #1 The use of the property goes beyond that of a natural gas processing (compression) station. It is also being used to store assorted equipment, such as a tractor with a flatbed trailer, trailer, and pipe. #2 There are more facilities located or the property than the three skid mounted units (gas compressor, refrigeration unit, and compressor) and 18,000 gallon storage tank. A large storage tank and two other clusters of equipment that contained buildings, a compressor, and other assorted equipment. #5 The design and construction of the facility have not been in accordance with the submitted application materials, recorded plat, and Weld County Building Code Regulations. The original building permit (BP-21395) has not been finaled. #8 The uses of the property have not been limited to the plot plan.
