RE: APPROVE GRAVEI, PIT IMPACT MITIGATION PROPOSAL FROM 'PUPA
ASSOCIATES, INC. , AND AUTHORIZE CHAIRMAN TO SIGN
WHEREAS , the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with a Proposal for
Wetland Impact Identification and Mitigation for Weld County
Hokestra Pit #2 , Weld County, Colorado, from Tupz. Associates ,
Inc . , and
WHEREAS, the cost estimate for the Scope of Work in the
Proposal is $12 ,400 .00, and
WHEREAS, after study and review, the Board deems it advisable
to approve the Proposal from Tupa Associates, Inc. , a copy of
which is attached hereto and incorporated herein by reference, and
WHEREAS, said approval is conditional upon Tupa
Associates, Inc. , submitting a preliminary report to Weld County
after the completion of Task #3 of the Proposal before being
authorized to proceed with any further Tasks.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the Proposal from
Tupa Associates, Inc. , for Wetland Impact Identification and
Mitigation for Weld County Hokestra Pit #2, Weld County, Colorado,
with a cost estimate of $12 , 400 . 00 be, and hereby is, approved,
subject to the hereinabove stated condition.
BE IT FURTHER RESOLVED by the Board that the Chairman be, and
hereby is, authorized to sign said Proposal.

Dear Lee,
Thank you for the tour of the Hokestra Pit location and the opportunity to dis;uss wetland
impact mitigation stratagies at the site.The tour was most informative and we believe that
we can be of assistance to the County in the inventory of existing wetlands,preparing miti-
gation alternatives and agency coordination needed to gain ACE and EPA approval of work
at this site.
Attached is a Scope of Work for professional assistance discussed during ow tour of the
site. Basically, we will prepare an inventory of existing wetlands, overlay the mining opera-
tions map to determine acres of impact,develop mining operation alternatives to minimize
wetland impacts and prepare construction documents for wetland mitigation work. Addi-
tionally we will provide professional assistance in coordination with the various agencies
that have expressed interest in this project.
Upon receipt of your notification we will begin inventory work. It is important to note that
inventory work should begin almost immediatly as it will be difficult to identify wetland
species with snow on the ground.

PROPSOAL
WETLAND IMPACT
IDENTIFICATION AND MITIGATION
WELD COUNTY HOKESTRA PIT#2-WELD COUNTY COLORADO
WORK SUMMARY
Due to gravel pit operations,wetlands are to be disturbed primarily along the St.
Vrain Creek floodplain.Gravel pit plans currently developed were reviewed by the
ACE and the EPA and found to be lacking an adequate inventory of wetland condi-
tions and needing a more comprehensive wetland reclamation plan. A. 100 foot levee
is also to be constructed to contain flood flows of the St Vrain. Additionally,prop-
erty owners desire an end product with ample wildlife habitat and large water
acreage.
The following work scope addresses those needed additions to the submitted 404
permit and offers an alternative analysis procedure which will allow us to present to
EPA various mining plans which minimize wetland impact and insun:successful
wetalnd restoration.
SCOPE OF WORK
1. Inventory Wetland Conditions
This initial work task involves identification of wetland areas on the site. Identifi-
cation is made from aerial photographs and varified on-site. Since the wetland
conditions are relative to the topographic features on this site mapping should be
relatively easy. Vegetation, soils and hydrology will be noted as part of the three
levels of identification needed for determining wetland conditions.
Areas will be quantified showing acres of specific wetland types. inventoried
wetlands will be mapped on the provided 1"=60' topographic base. Site wetland
conditions and mapping will be prepared in report form for inclusiDn with the
ACE permit submittal.
2. Analyze Impact Mitigation Levels
This work task involves studying the proposed gravel mine phasing plans to de-
termine impacts to identified wetlands. Acres where wetlands will be disturbed
will be identified and mitigation needs outlined. Opportunities for mitigation are-
as will also be explored.
3. Develop Mine and Mitigation Alternatives
This work task will develope alternatives which the County can eviluate for pos-
sible development. It is our intent to maximize use of the gravel resource while
minimizing the impact to wetlands.
At this time there are three alternatives to consider.The are:
A. Full Mine with Mitigation per Original Plan
Involves full 17.5 acre extraction plan as submitted to MLRB with mitiga-
tion of impacted wetlands nearby.
B. Partial Mine to Protect Existing Wetland
Involves protection of existing wetland as staked by EPA. Requires a reduc-
tion in available gravel extraction since the wetlands would not be disturbed.
C. Modified Full Mine with Full Mitigation Replacement in Place
Involves full 17.5 acre extraction plan with modification to the mining plan

to install the levee in such a location to protect future wetland replacement ar-
eas. Existing gravel resources under existing wetlands would be extracted
and the wetlands replaced in the same location as they exist.
An additional alternative may surface once the site is inventoried aid we have a
better understanding of the opportunities and constraintes of the site.
A draft alternative analysis report will be submitted to the County :'or review and
comment. Adjustments to the analysis will be made prior to on-site discussion
with the appropriate agencies.
4)Final Report
We will prepare a final report for Weld County use and for inclusion with the
ACE and MLRB permit submittal. The Final Report will cover the wetland find-
ings, an evaluation of alternatives and recommended alternative. Agency coordi-
nation letters,comments and responses to those will also be within the report.
5)Agency Coordination
Considering the value of the gravel resource below the wetlands we felt that ex-
ploring other options might be of some benefit to Weld County. With this in
mind we contacted Brad Miller at EPA to see where he stood about considering
alternative development plans.He indicated that while he still wanis to protect ex-
isting wetlands he is open to consider alternative mining plans.Hence, we feel it
is appropriate to present development options as described above.
We may have some presenting to do to sell anything other than their recommend-
ed layout since EPA would rather not impact existing wetlands. We would have
to convince them of: 1) value of gravel resource, 2)our ability to restore dis-
turbed wetlands, and 3) short term impact to wetland for long term gain in river-
side habitat
We also understand that some coordination with the Division of Wildlife, ACE
and the property owner will be necessary.
6) Construction Documents
Adjustment of the alternatives design work will be needed to convert the mitiga-
tion plans to construction documents which can be used by the contractor. We
will prepare construction plans and specifications which will direct contractor
work in the mitigation of wetland impacts.
TIME FRAME
Upon receipt of your written notification to proceed,we will begin in ventory work.
It is important to note that once snow flys it will be difficult to identify wetland spe-
cies and soil conditions. Ideally, if work begins this month we will have the invent-
ory and alternative analysis work completed before Thanksgiving and you can get
this project underway. At that time we should be able to submit the modification to
your permit application and would expect some favorable reaction from the various
agencies.

We estimate the following work level for the above discussed work tasks.

Associated materials including reproduction costs and other direct project costs will
be billed at cost.Milage will be billed at$0.30 per mile. It is not expected that these
direct project costs will exceed 10%of project costs. Additional time and work on
this project for additional coordination will be billed at the rate of$50 per hour.We
will be in contact with you on any work which will result in billings not outlined
above prior to beginning that work.
Billings are monthly and payment is expected at receipt of billing. Accounts over 30
days will be billed 1.5% (18%per annum)on the outstanding balance.
Working on this project will be Dr. Erik Olgerison, Botonist and Michael J. Tupa,
Landscape Architect/Environmental Planner.
