RE: SUBDIVISION EXEMPTION AND AMENDED
RECORDED EXEMPTION APPLICATION
1. We acquired the property by purchases .in 1957 and 1.958. On May 6, 1986 a
Recorded Exemption (0709-16-2-RE 855) was filed to separate a 3- Acre tract,
with improvements, lying North and East of..Lione, Tree Creek from the main
farm, 200± Acres.. The main farm has several residences, including our
present residence. At this time we are requesting to separate our resi-
dence on a 1 .00 Acre tract from the main farm with a Subdivision Exemption.
This would leave Lot A of RE 855 "as is" and leave Lot B with a residence
and the farm improvements on 1991 Acres. An Amended RE 855 showing the
above .Subdivision Exemption and lot revisions are filed concurrently to
complete the proposed division of our property.
2. The integrity of the policies of the Weld County Comprehensive Plan would
not be jeopardized by this proposal since it does notappreciably alter
the nature, use, or make-up of this agricultural land. The future sale of
Lot B would leave the main farm in agricultural production and any new
construction would only be single family dwellings or other agricultural
related structures (i .e. , corrals , fences, barns, shops, etc. ). Further-
more, this proposed split is in compliance with applicable state and county
regulations.
3. The lots created by this proposal will remain agricultural in use as well
as agriculturally zoned, and thus this proposal is consistant with the
intent of the zone district in which they are located.
4. To remain compatible with the existing land uses, only those uses presently
permitted on the surrounding properties will be permitted on the proposed
parcels.
5. In applying for the Subdivision Exemption and Amended Recorded Exemption, we
are not seeking a land use variance or any change in zoning so the proposed
split would not hinder future development as projected by with the county of
nearby municipalities.

6. This.. proposal- is consistent. with efficient and orderly development in
that..it .easily blends in with what is currently permitted or taking
place in the area. .
7. Each uni.t. being. .created has an existing residence. Lot B - (199- Acres)
has an existing set of farm improvements and a residence- that will
remain as the main farm unit. The existing .residence .on Lot A (3t Acres)
may be remodeled or a. new home built in the future. Application will be
made to the County for building perriits .for new construction and septic
systems. North Weld County Water District is presently providing water
service to all residences.
8. The property under consideration .is not located in a geological hazard area
or the Weld-County Airport Overlay.
Lot A is located in a general Flood area as defined by the Flood Insurance
Rate Map, Community. Panel Number 080266-0480-C, . effective date September
28, 1982. The lot is included in Zone A in which the actual flood elevations
have not been determined. A Flood Hazard Permit will be required as part
of the Building Permit Application.
9. This recorded. exemption request will not adversely affect the ability to
farm or. irrigate any portion of.Lct :B.
