RE: CONDITIONAL APPROVAL OF SERVICE PLAN - JOHNSTOWN-MILLIKEN
PARKS AND RECREATION DISTRICT
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, pursuant to Section 32-1-204 , CRS, as amended, a
Service Plan concerning the proposed Johnstown-Milliken Parks and
Recreation District was filed with the Weld County Board of County
Commissioners, and
WHEREAS, pursuant to Section 32-1-108 , CRS, as amended, the
Board of County Commissioners scheduled a public hearing on the
Service Plan to be held at 10 : 00 a .m. on November 16 , 1988 , and
WHEREAS , notice of the date, time and location and purpose of
said hearing was duly published in the Platteville Herald, the
County legal newspaper, on October 26 , and November 2 and 9 , 1988 ,
and in the Johnstown Breeze, a newspaper of general circulation in
the area , on November 3 , 1988 ; notice was provided to the Division
of Local Affairs of the name and type of the proposed District;
and notice of the date, time and location of said hearing was
provided to the Petitioners, to the governing body of each
municipality and of each special district which had levied an ad
valorem tax within the next preceding tax year and which had
boundaries within a radius of three (3) miles of the District, and
to said Division, as required by Sections 32-1-202 (1) and
32-1-204 (1) , CRS, as amended, and to the Weld County Planning
Commission as required by Section 32-1-204 , CRS, as amended, and
WHEREAS, the Weld County Planning Commission studied and
considered the Service Plan at its meeting on November 1 , 1988 , at
which time said Commission adopted a Resolution recommending
approval of the Service Plan for various reasons as more
specifically stated therein, which recommendation was subsequently
presented to the Board of County Commissioners at its hearing on
this matter by a representative of said Commission, as required by
Section 32-1-204 (2) , CRS , as amended, and
WHEREAS , the Board did, on November 16 , 1988 , conduct a full
public hearing on this matter, taking evidence establishing the
jurisdiction of the Board to hear this matter and further taking
evidence regarding the substantive issues set forth in Section
32-1-203 , CRS , as amended, at which hearing all interested parties
were afforded an opportunity to be heard, and

WHEREAS , the Board fully considered the Service Plan and all
testimony and other evidence presented to it in this matter
relating to said Service Plan, including the favorable
recommendation of the County Department of Planning Services, and
WHEREAS, the Board, after consideration, finds that the
Service Plan and the evidence and testimony presented to the Board
meets the criteria contained within Section 32-1-203 , CRS, as
amended, and
WHEREAS, no written requests for exclusion were submitted to
the Board, and
WHEREAS, no tract of land more than forty acres used
primarily and zoned for agriculture is to be included within the
District without the expressed consent of the property owner,
pursuant to Section 32-1-307 , CRS, as amended.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that:
Section 1 . The Board hereby determines that all of the
jurisdictional and other requirements of Sections 32-1-202 and
32-1-204 , CRS, as amended, have been fulfilled, including those
relating to the filing and form of the Service Plan, the form and
publication of the public notice of the hearing on the Service
Plan and the type of public hearing held herein, and that,
pursuant to Section 32-1-204 (1 .5) the petitioners did give proper
and timely postcard notification of the hearing to the property
owners within the district.
Section 2 . The Weld County Planning Commission has
considered this matter as required by law and has recommended
approval of the Service Plan.
Section 3 . Based upon the information contained within the
Service Plan and evidence presented to the Board at the hearing,
the Board hereby finds and determines as follows:
a . There is sufficient existing and projected need for
organized services of the nature proposed in the Service Plan
in the area to be serviced by the proposed District;
b. The existing services in the area to be served by
the proposed District are inadequate for present and
projected needs;

c. The proposed District is capable of providing
economical and sufficient services to the area within its
proposed boundaries;
d. At this time, it is not anticipated that the
District will incur indebtedness;
e. Adequate services are not and will not be available
to the area through Weld County, or other municipal or
quasi-municipal corporations, including special districts,
within a reasonable time and on a comparable basis;
f. The facilities and service standards of the
proposed District are or will be compatible with the
facilities and service standards of Weld County and of each
municipality and special district which is an interested
party hereto;
g. The Service Plan is in substantial compliance with
the Weld County Master Plan; and
h. The creation of the proposed District will be in
the best interest of the area proposed to be served.
Section 4 . The Service Plan of the proposed District, be,
and hereby is, conditionally approved, subject to amendment of the
budget to reflect the deletion of agricultural parcels 40 acres
and larger; the pattern of delinquent taxes in the proposed
District; and the anticipated revenue from lottery funds.
Section 5 . The amended budget is to be presented to the
Board for consideration at the regular meeting of the Board on
December 19 , 1988 .
Section 6 . The Clerk to the Board is hereby directed to
advise the Petitioners in writing of this action and to attach a
certified copy of this Resolution for the purpose of filing the
same with the District Court of Weld County.
Section 7 . All Resolutions, or parts hereof, in conflict
with the provisions hereof, are hereby repealed to the extent of
such conflict only.
Section 8 . This Resolution, immediately upon its passage,
shall be authenticated by the signatures of the Board of County
Commissioners and the County Clerk and Recorder and sealed with
the corporate seal of the County.

RE: SERVICE PLAN OF THE PROPOSED JOHNSTOWN-MILLIKEN PARKS AND
RECREATION DISTRICT
A public hearing was conducted on November 16, 1988, at 10:00 A.M.,
with the following present:
Commissioner Gene Brantner, Chairman
Commissioner C.W. Kirby, Pro-Tem
Commissioner Jacqueline Johnson
Commissioner Gordon E. Lacy
Commissioner Frank Yamaguchi
Also present:

The following business was transacted:
I hereby certify that pursuant to a notice dated October 26, 1988, and
duly published October 26, and November 2 and 9, 1988, in the
Platteville Herald, a public hearing was conducted to consider the
Service Plan of the proposed Johnstown-Milliken Parks and Recreation
District. Lee Morrison, Assistant County Attorney, made this matter of
record and noted that the required postcard notification had been
mailed by the proponents of the District. Keith Schuett, Planning
Department representative, entered the favorable recommendation of the
Planning Commission into the record. John Perrott, Attorney for the
proposed district, introduced Carl Yost, chairman of the
Johnstown-Milliken Recreation Committee. Mr. Yost reviewed the
recreation program presently available in the area and said two public
hearings were held concerning this matter and there had been no
negative response at either. Mr. Morrison reviewed the possible
actions of the Board and the criteria which are to be considered. He
said that the final decision will be made by a Court-directed vote.
Those who came forward to testify in opposition to this plan were Gary
Lebsack; Guy Brenckle, who requested exclusion of all properties
outside of the Johnstown and Millken city limits; Ida Valdez; Joe Elms;
David Espinoza; Abran Herrera; Wilbur Schmuhl; and Albert Jeffers.
Harold Fahrenbruch submitted the 1987 delinquent tax list as an exhibit
and stated that another taxation district will create more delinquent
taxes. Speaking in favor of the district were Don Davis and Sandra
Davis. Greg Brown asked for a clarification of who would be able to
vote concerning this proposal. Mr. Morrison stated that owners of
property and residents within the district could vote. He also pointed
out that State statute provides that parcels of agricultural land
greater than 40 acres are to be excluded from Parks and Recreation
Districts. (Tape change #88-58) In response to questions from the
Board concerning the proposed budget, Mr. Yost explained that they had
used the 1987 assessed valuation of the RE-5J School District, not
deleting any agricultural land, and had not included any lottery
dollars which would be made available to them at the expense of the
County and the towns within the District. Mr. Yost stated that they
did not intend to borrow any monies, and it is anticipated that the
volunteer committee will continue to function until tax monies are
available for the District. After discussion, Commissioner Johnson
moved to approve the Service Plan for the proposed Johnstown-Milliken
Parks and Recreation District, subject to amendment of the budget to
reflect deletion of agricultural parcels greater than 40 acres; the

pattern of delinquent taxes; and the addition of lottery funds.
Commissioner Lacy seconded the motion, and it carried by a 4-1 vote,
with Commissioner Yamaguchi voting nay. Mr. Perrott said they may be
able to have the budget updated in 30 days. It was the consensus of
the Board that the revised budget will be considered during the regular
Board meeting on December 19, 1988.
This Certification was approved on the 21st day of November, 1988.

PUBLIC NOTICE IS HEREBY GIVEN that a Service Plan for the proposed
Johnstown—Milliken Parks and Recreation District has been filed with
the County Clerk and Recorder of Weld County, Colorado, the Service
Plan and related documents are now on file in the office of the Clerk
to the Board of County Commissioners, 915 10th Street, Third Floor,
Greeley, Colorado, and are available for public inspection between 8:00
A.M. and 5:00 P.M. , Monday through Friday.
NOTICE IS FURTHER GIVEN that, by Order of the Board of County
Commissioners of Weld County, Colorado, a public hearing on said
Service Plan and related documents will be held in the Centennial
Center, 915 10th Street, Greeley, Colorado, at 10:00 A.M. , on
Wednesday, the 16th day of November, 1988.
The purpose of the hearing shall be to consider the adequacy of the
Service Plan of the proposed Johnstown-Milliken Parks and Recreation
District and to form a basis for adopting a Resolution approving,
conditionally approving, or disapproving the amendment.
The proposed Johnstown-Milliken Parks and Recreation District is
located entirely within Weld County, Colorado, and includes all of
School District RE-5J as described in Exhibit "A", excepting that
portion laying within the County of Larimer, Colorado.
Pursuant to Section 32-1-202, C.R.S. , the Service Plan may not be
approved if a petition objecting to the Service Plan and signed by the
owners of taxable real and personal property, which property equals
more than fifty percent of the total valuation for assessment of all
taxable real and personal property to be included in the District, is
filed with the Board of County Commissioners no later than ten days
prior to the hearing, unless such property has been excluded by the
Board of County Commissioners under Section 32-1-203 (3.5) , C.R.S.
Pursuant to Section 32-1-305(3) , C.R.S. , the owner of real property
within the proposed District may file a petition with the District
Court in and for Weld County, stating reasons why said property should
not be included with the proposed District and requesting that such
real property be excluded therefrom. Such petition shall be duly
verified and shall describe the property sought to be excluded. The
District Court will hear said petition and all objections thereto at
the time of the hearing on the petition for organization and shall
determine whether, in the best public interest, said property should be
excluded or included in the proposed District. Such petition may be
filed any time after the petition for the organization of the District
is filed with the District Court, but not later than ten days before
the day fixed for the hearing on the organizational petition.

November 1, 1988, in the County Commissioners' Hearing Room, First Floor

APPEARANCE:
Carl Yost, Chairman, Johnstown/Milliken Parks and Recreation District, asked
that their attorney, John Perrott, represent the proposed district.
Mr. Parrott explained the purpose of the proposed district. At the present
time, there will be no senior citizen activities scheduled, but these are
planned for the future. Some services are designed to make money, some will
break even and some will require additional funding, but allowances have
been made for this.

The Chairman asked the applicant if the recommendation of the Department of
Planning Services had been reviewed, and if they had any comments or
objections to it? The applicant had no comments or objections.
The Chairman asked that the recommendation be filed with the summary as a
permanent record of these proceedings.
MOTION:
Lynn Brown moved the Johnstown/Milliken Parks and Recreation District
service plan review pursuant to Section 32-1-201 et seq. , C.R.S. for a
proposed park and recreation district be forwarded to the Board of County
Commissioners with the Planning Commission' s recommendation for approval
based upon the recommendation of the Department of Planning Services' staff
and the testimony heard by the Planning Commission. Motion seconded by
LeAnn Reid.

POSSIBLE ISSUES SUMMARIZED FROM APPLICATION MATERIALS:
The criteria for review of this proposal is listed in Section 32-1-203 (2) ,
C.R.S. as amended. This information is included in this land-use packet.
The purpose of the parks and recreation district is to provide additional
recreational services, programs, and facilities. Referral agencies
contacted have no objections to the service plan as submitted. In a
referral response dated September 1, 1988, Stephen Mullally, Mayor of
Milliken, recommended changes in the location and distribution of capital
facilities and the administration of funds. These concerns are addressed
with the amendment to the application.

SERVICE PLAN
31-2-203. Action on service plan - criteria (1)
(1) The Board of County Commissioners of each county which has territory
included within the proposed special district. Other than a proposed
special district which is contained entirely within the boundaries of a
municipality, shall constitute the approving authority under this part
2 and shall review any service plan filed by the petitioners of . any
proposed special district. With reference to the review of any service
plan, the Board of County Commissioners has the following authority:
(a) To approve without condition or modification the service plan
submitted;
(b) To disapprove the service plan submitted;
(c) To conditionally approve the service plan subject to the
submission of additional information relating to or the
modification of the proposed service plan.
(2) The Board of County Commissioners shall disapprove the service plan
unless evidence satisfactory to the board of each of the following is
presented:
(a) There is sufficient existing and projected need for organized
service in the area to be serviced by the proposed special
district;
(b) The existing service in the area to be served by the proposed
special district is inadequate for present and projected
needs;
(c) The proposed special district is capable of providing
economical and sufficient service to the area within its
proposed boundaries;
(d) The area to be included in the proposed special district has,
or will have, the financial ability to discharge the proposed
indebtedness on a reasonable basis.
(2.5)The Board of County Commissioners may disapprove the service plan
if evidence satisfactory to the board of any of the following, at the
discretion of the board, is not presented:
(a) Adequate service is not, or will not be, available to the
area through the county, other existing municipal or
quasi-municipal corporations, including existing special
districts, within a reasonable time and on a comparable
basis;

(b) The facility and service standards of the proposed special
district are compatible with the facility and service
standards of each county within which the proposed special
district is to be located and each municipality which is an
interested party under Section 32-1-204 (1) ;
(c) The proposal is in substantial compliance with a master plan
adopted pursuant to Section 30-28-106, C.R.S. ;
(d) The proposal is in compliance with any duly adopted county,
regional, or state long—range water quality management plan
for the area;
(e) The creation of the proposed special district will be in the
best interests of the area proposed to be served.
(3) The Board of County Commissioners may conditionally approve the service
plan of a proposed special district upon satisfactory evidence that it
does not comply with one or more of the criteria enumerated in
subsection (2) of this section. Final approval shall be contingent
upon modification of the service plan to include such changes or
additional information as shall be specifically stated in the findings
of the Board of County Commissioners.
(3.5)The Board of County Commissioners may exclude territory from a
proposed special district prior to approval of the service plan
submitted by the petitioners of a proposed special district. The
petitioners shall have the burden of proving that the exclusion of such
property is not in the best interest of the proposed special district.
Any person owning property in the proposed special district who
requests that his property be excluded from the special district prior
to approval of the service plan shall submit such request to the Board
of County Commissioners no later than ten days prior to the hearing
held under Section 32-1-204, but the Board of County Commissioners
shall not be limited in its action with respect to exclusion of
territory based upon such request. Any request for exclusion shall be
acted upon before final action of the County Commissioners under
Section 32-1-205.
(4) The findings of the Board of County Commissioners shall be based solely
upon the service plan and evidence presented at the hearing by the
petitioners, planning commission, and any interested party.
(5) In the case of a proposed hospital district, submission to the Board of
County Commissioners by the petitioners of a certified copy of an
approved certificate of public necessity issued by the health
facilities review council of the department of health shall constitute
compliance with subsections (2) and (2 .5) of this section.

Dear Sirs:
The Town of Milliken has reviewed the recreation plan that will
form the basis for an independent tax supported recreation district. Upon
initial review, the Town identified two areas that are unacceptable:
1. Location and distribution of capital facilities.
2. Percentage of monies in administrative overhead.
Milliken met with the recreation committee on Tuesday, August 30,
1988 to discuss their concerns. The committee was amenable to reviewing
these issues and, as a result, has modified the plan that was submitted to
you. The modifications call for:
1. A director's salary of $12,000.00
2. Placement of a softball field in Milliken with an understanding
that the District, if created, will determine where the lighting
will be placed at a later date.
With these modifications, the Town of Milliken supports the
creation of a recreation committee and urges support from Weld County.

and Recreation District Service Plan. Amendments to Part II-B

In summary, Part II-B is amended whereunder the expenditures
of the "Director" are changed to $12 , 000 . 00, rather than
$20, 000. 00 , and "Capital Expenses" is $20, 000 . 00 , rather than
$12 , 000. 00. As you can see the total remains the same.
The amendment to Part II--F is in the second sentence of para-

We , the undersigned, submit herewith a Service Plan for the
organization of the Johnstown-Milliken Park and Recreation
District, to be located in the Johnstown-Milliken area of Weld
County. It is our hope you will look favorably upon the proposed
District.
Anticipated revenues and expenditures over the coming years are
designated to provide much needed playground, park and
recreational facilities for this particular area of Weld County.
We feel wholesome, planned and available recreation shall be of
enormous benefit to the area involved.

Part II - A
Proposed Johnstown-Milliken Parks and Recreation District
The proposed district boundaries would follow those of Re-5J
School District except for the small area which is in Larimer
County, thereby limiting the proposed district to Weld County. It
will be composed of an area of about 58, 000 acres , a map and legal
description may be found in Section D. A mill levy tax of the
properties within its boundaries would establish a fundamental
monetary base from which the district could operate more
effectively.
The recreation committee has determined the only way in which our
communities can further expand and enhance our programs is through
the establishment of a special park and recreation district , and
the tax to be gained therefrom to finance the services .
Currently, the recreation programs are for the most part
organized, financed and operated by the groups having an interest
in that activity. These groups work with the recreation committee
in finding coaches and managers , group buying of equipment ,
finding and scheduling playing fields and courts . The recreation
committee also acts as the bookkeeper and banker for all
activities . As the system is set up, participant fees have been
kept very minimal . This is to encourage the broad participation
in the recreation program from a community area which has a large
percentage of participants who may not have otherwise been able to
participate.
Because of the current system of fees and the desire for as many
people to participate in the program, the recreation committee
sees that to better maintain and promote new activities , a
recreation director is needed to enhance the program .

Currently the Johnstown-Milliken Recreation Committee is directed
by an intergovernmental agreement that provides for 7 directors to
be chosen as follows :
Two members from the elected Milliken Town Board
Two members from the elected Johnstown Town Board
One member from the elected Re-5J Board of Education
Two members appointed at large
The proposed district will be governed by elected parks and
recreation director and a board, pursuant to law made and
provided.
The Johnstown-Milliken Parks and Recreation District would
encompass the same area serviced by the Re-5J School District, and
all persons located in this area would be participating members
of the recreation district .

ESTIMATE OF POPULATION AND VALUATION FOR ASSESSMENT OF THE

The recreation district has approximately 6 , 000 people living in
its proposed boundaries with approximately 2 , 500 separate
properties . Assuming one hundred percent property participation
which has a 1987 appraised value of $35, 011. 40 and at a proposed
one mill levy, the special Park and Recreation District may expect
an operation revenue of $35, 011. 40 based on 1987 appraisals .

FACILITIES TO BE CONSTRUCTED, STANDARDS OF CONSTRUCTION
AND PROPOSED SERVICES

The recreation committee sees that to better maintain and promote
new activities , a recreation director is needed to enhance the
program. Secondly, there is need for expensive special equipment,
such as batting practice machines , and special coaches brought in
for specialized training seminars . Third, to improve the program,
several projects need to be set in motion, such as : transporation
between the towns of Johnstown and Milliken, and to meets and
games ; a daylight tournament sized softball field built on land
donated by the Town of Milliken, and upgrading of both Milliken
and Johnstown fields .
Future plans would include the possible construction of a
recreation facility containing classrooms, administration offices,
and combination basketball and volleyball courts . Many of the
above-described projects are projects which lay as far out as 10
years for completion . Presently, many projects are underway even
with our small resources , such as a walking path behind Re-5J High
School being constructed with grant money obtained by the
recreation committee.

portion of our operating budget and would be spread over several

INTERGOVERNMENTAL AGREEMENT
This Agreement entered into this 20-k, day of October, 1983 by and
among the Town of Johnstown, Colorado, a municipal corporation, herein-
after referred to as "Johnstown" ; the Town of Milliken, Colorado, a
municipal corporation, hereinafter referred to as "Milliken" ; and Weld
County School District RE-5J, a body corporate organized and existing by
virtue of the laws of the State of Colorado, hereinafter referred to as
"School District. "
WITNESSETII:
WHEREAS the parties hereto have an obligation to provide recrea-
tional and physical education facilities and programs to their citizens
and students; and
WHEREAS Colorado Revised Statutes, 1973, 29-1-201 et seq. authorizes
units of local government, including school districts, to cooperate and
contract with one another to provide any function, service or facility
lawfully authorized to each of the cooperating or contracting units; and
WHEREAS Colorado Revised Statutes, 1973, 29-21-101 authorizes
municipalities that have created trust funds pursuant to statute, to
cooperate or contract with any other goverrnmental unit or political
subdivision, pursuant to CRS, 1973, 29-1-201 et seq. ; and
WHEREAS Johnstown and Milliken have created a conservation trust
fund pursuant to Article 21 of Title 29; and
WHEREAS Colorado Revised Statutes, 1973, 22-32-122 provides that
the School District may contract with other governmental entities or
private persons for the purpose of any service, activity or undertaking
which it may authorize by law to perform or undertake; and
WHEREAS the School District currently owns a swimming pool , and the
School District does not have capital funds to reconstruct said swimming
pool and owns certain other recreational facilities which could be made
available to the community for recreational purposes; and
WHEREAS Milliken, Johnstown and the School District, working to-
gether will seek certain grant funds which may be available to recon-
struct the swimming pool owned by School District and maintain and
operate recreation facilities and programs on school property for the
benefit of their respective communities , within the financial capabilities
of each party and on an equal basis.
NOW, THEREFORE, in consideration of the covenants and obligations
expressed herein, it is agreed by and among the parties hereto as
follows:
1 . Mutual Cooperation. Within •the constraints and authority
granted to .each by the laws of the State of Colorado, the parties shall
cooperate in the scheduling and coordination of the use of recreational
facilities now owned and operated by each of the parties.

2. Maintenance of Recreational Facilities. Within the constraints
and authority granted to each by the laws of the State of Colorado, the
parties shall cooperate in the maintenance of recreational facilities
and sites now located on public sites and which are owned by any of the
parties and used by the parties for connunity recreation purposes. Said
maintenance shall be limited to the financial capabilities of the parties
hereto and all financial obligations shall be shared equally by the
parties hereto. This shall exclude maintenance on all recreational

3. New Conservation Sites or Recreation Facilities. Within the
constraints and authority granted to each toy the laws of the State of
Colorado, the parties agree to cooperate im the acquisition, development
and maintenance of sites to be used for park or recreational purposes,
open space or for any scientific, historic, scenic, recreational ,
aesthetic or similar purpose.
4. Contribution for the Purpose of Coordination.
A. Milliken and Johnstown agree, insofar as Colorado law will
permit, to donate up to 85% of monies received by them from the Colorado
Conservation Trust Fund for the purposes which are authorized by the
Conservation Trust Fund Statute.
B. Johnstown agrees to provide up to 4 hours of legal services
per month to carry out those purposes stated in Paragraphs 1 , 2 and 3
above.
C. Milliken agrees to provide up to 4 hours of services of a
circuit rider/town manager per month for the purposes of organizing and
coordinating the activities described in Paragraphs 1 , 2 and 3 above and
for the purpose of administering grants the parties may receive in
connection with the purposes stated in Paragraphs 1 , 2 and 3 above.
D. School District agrees to provide a minimum of 4 coaches
for athletic events of a team nature and such other staff, services or
funds, not to exceed a value of $20,000.00 per year, as the Board of
Education deems appropriate to carry out those purposes stated in Para-
graphs 1, 2 and 3 above.
5. Advisory Committee. The parties agree that there shall be an
advisory committee of seven members, two appointed by Milliken , two ap-
pointed by Johnstown, one appointed by the School District, one appointed
by the Northmoore Homeowners Association and one appointed by the Indian
Head Homeowners Association. The committee shall be responsible for
devising programs and making recommendations to the parties as to funding
and acquisitions in order to implement the provisions of Paragraphs 1, 2
and 3 above. Each person appointed to the advisory committee shall
serve at the pleasure of the party appointing said person. The initial
advisory committee shall prepare Bylaws which shall set forth the manner
of operation and procedure for the committee. The Bylaws shall not
be adopted nor become operative until and unless they have
been approved in writing by each •member of the advisory

6. Enforcement. It is the intent of the parties that this Agree-
ment be binding upon the parties and that any party hereto shall be
permitted to specifically enforce any provision of this Agreement in a
Court of competent jurisdiction.
7. Terms. This Agreement shall remain in force and effect for a
period of five years from the date of its execution. Thereafter, it
shall be automatically renewed for successive one-year terms unless , at
least 60 days prior to scheduled expiration, any party should notify the
other parties of its decision that the Agreement should not be renewed.
In addition, the parties agree to annually review all elements of the
programs, acquisitions and other matters which have been implemented
pursuant to Paragraphs 1 , 2 and 3 above.
8. Severability. In the event any party is prevented by Court
Order from performing any provisions of this Agreement, or enforcing any
portion thereof, the parties shall have the option of terminating this
Agreement upon mutual consent.
IN WITNESS WHEREOF the parties hereto have executed this Agreement
the day and year first written above.

GENERAL DESCRIPTION
The proposed Recreation District is located in the western part of
Weld County, approximately 46 miles north of Denver , and 15 miles
southwest of Greeley. It encompasses approximately 91 square
miles , and within its boundaries are located the Towns of Johnstown
and Milliken. Johnstown and Milliken are located on State Highways
60 and 257 , connecting to US 87 (Interstate 25 ) and US 34 .
The area of the proposed District is engaged primarily in
agricultural activities, including irrigated farming, dairying,
poultry raising , and stock feeding for packing plants . The major
crops produced are sugarbeets , wheat, beans and corn. Livestock
feeding is predominant within the area . Approximately 60 percent
of the agricultural land is irrigated.
Weld County has ranked high in agricultural production for many
years . This agricultural empire with approximately 85 percent of
its area devoted to irrigated and dryland farming and livestock
raising , is ranked among the nation ' s leaders in agricultural
production. There are approximately 33, 000 producing dairy cows
in Weld County, and the County ranks second in the nation with the
largest total number of livestock sold for market.
The historically stable economy of the District is changing from
predominately agricultural to a balance of agriculture - commerce
and industry - mineral exploration and production. Former Great
Western Sugar Refinery, located in Johnstown , has been purchased
by the Biotechnology Division of Adolph Coors Brewery Company, and
has been renovated and expanded. Approximatley 150 new Coors
employees are presently employed at the facility.
An increase in oil and gas activity within the District in recent
years has been evident , and has not only substantially raised the
mineral tax base, but has also resulted in a number of oil and gas
related service companies being in evidence in the District . Such
prominent ❑ames as Amoco Production - Company, 1-lalliburton, Energy
Minerals and Panhandle Eastern , lead the list of names of the
companies which own, operate or service oil and gas properties in
the District .
Some major employers , which are not within the boundaries of the
District , but are nonetheless important to the local ecomony, are
the manufacturing concerns which are located nearby. Two of the
most notable are Eastman Kodak which is located in Windsor and
employs about 2 , 900 people and manufactures film, and Hewlett-
Packard, a high-tech computer and precision instrument
manufacturing firm located in Greeley, Loveland and Fort Collins .
Electricity and natural gas service are available in the District
through Public Service Company of Colorado. An adequate supply of
natural gas is available to serve the loads that may develop in this
area. This gas system is served primarily by two pipeline companies ,
Colorado Interstate Gas Company and Western Slope Gas Company, a
wholly-owned subsidiary of Public Service Company of Colorado.
