HomeMy WebLinkAbout850615.tiff RESOLUTION RE: POLICY FOR ALTERNATIVE RELOCATION WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the County of Weld has received a Community Development Block Grant (CDBG) from the State of Colorado' s Department of Local Affairs, and WHEREAS, two of the activities of said CDBG Program are Housing Rehabilitation and Relocation, and WHEREAS, certain substandard units are not suitable for rehabilitation, and WHEREAS, estimated costs for rehabilitation of said substandard units are in excess of $10 ,000 .00 , and WHEREAS, said substandard units have been condemned, and WHEREAS , the homeowners will work with the County of Weld and the Weld County Housing Authority to secure suitable replacement housing, and WHEREAS, said homeowners do not have the financial resources to relocate themselves, and WHEREAS , the relocation is not subject to the Uniform Relocation Assistance and Real Property Acquisition Act of 1979 (Uniform Act) , and WHEREAS , the recipient (County of Weld) of the State administered CDBG funds may provide relocation payments and assistance for individuals, families, businesses , non-profit organizations and farm operations by an activity that is not subject to the Uniform Act. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that relocation payments and assistance will be made available to said homeowners, working with the County of Weld and the Weld County Housing Authority to secure suitable replacement housing assistance not to exceed $25 ,000 .00 . 850615 Page 2 RE: POLICY FOR ALTERNATIVE RELOCATION The above and foregoing Resolution was , on motion duly made and seconded, adopted by the following vote on the 1st day of May, A.D. , 1985 . (9551 r La y / County Attorney //y9l�ei Frank Yama hi WELD COUNTY COMMUNITY DEVELOPMENT BLOCK GRANT PROGRAM ALTERNATIVE RELOCATION POLICY GENREAL This policy has been developed for the sole purpose of implementing the relocation program as funded by the U.S. Department of Housing and Urban Development (HUD). In order that the County will not be subject to the Uniform Relocation Assistance and Real Property Acquisition Act of 1970 (Uniform Act), the policy shall be voluntary in nature. ELIGIBILITY In order to qualify for voluntary relocation assistance with State administered CDBG funds an applicant must; 1. Apply for housing rehabilitation with the County's Housing Authority. 2. Meet the CDBG income requirements for rehabilitation assistance. 3. Be owner of the property with a unit unsuitable for rehabilitation and be willing to work with the Weld County Housing Authority to secure suitable replacement housing. 4. Reside in, and provide proof of ownership of the unit he/she is living in. 5. Reside in the CDBG approved Target Area. The Weld County Housing Authority in order to qualify a potential voluntary relocation applicant must: 1. Determine that the unit is nt:Y suitable for rehabilitation in accordance with local housing codes. 2. Determine that the estimated cost for rehabilitation is in excess of $1U,000.00. 3. Determine that the unit is unsafe, unhealthy, unsanitary, dangerous, etc. in accordance with Section 8 standards. 4. Determine that the replacement housing unit meets HUD Section 8 standards. 5. Determine that the relocation activity is not subject to the uniform act. /Y,94G)// RELOCATION ASSISTANCE The Alternative Relocation program snail provide funds, not to exceed 425,000.00 to; 1. Provide down payments or purchase price of replacement housing. 2. Pay taxes on property to be cleared. 3. Pay taxes on property on which replacement housing is to be placed. 4. Provide funds to rehabilitate the replacement unit. 5. Purchase necessary appliances needed for relocation, ie. stove, refrigerator and furnace. 6. .-tent necessary items to relocate family, ie. storage, moving van, etc. 7. Pay any other Division of housing and MUD approved expenses. APPROVAL POLICY Requests for relocation must be approved by the Weld County Housing Authority Board and appropriate advisory committee.
