RESOLUTION RE: APPROVE MINOR SUBDIVISION S #272 - MILTON L. AND EDWIN S. KAHN AND WATERFORD RANCH COMPANY WHEREAS , the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter , is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS , on the 31st day of December, 1986 , the Board reviewed the request of Milton L. and Edwin S. Kahn and Waterford Ranch Company for a Minor Subdivision for two lots in a C-3 (Commercial) Zone District, pursuant to the requirements of Section 12-3 G. of the Weld County Subdivision Regulations , and WHEREAS , said request is for property being described as follows: Part of the W1 SWa of Section 2 , Township 2 North , Range 68 West of the 6th P.M. , Weld County, Colorado WHEREAS , the Board deems it advisable to approve said request for a Minor Subdivision for the following reasons: 1 . The Minor Subdivision conforms with the requirements of Section 12-3 G. of the Weld County Subdivision Regulations. This section incorporates the review criteria of Section 5-4 A. of the Weld County Subdivision Regulations . a. The water taps from Central Weld County Water District are capable of supplying water of sufficient quality, quantity and dependability. b. The Saint Vrain Sanitation District , when operational, will be able to supply public sewage disposal for these lots. c. No danger to human life or structure will result from soil erosion, soil instability, or air pollution. d. No unreasonable burdens will he placed on educational or local governments to provide services. e. WHEREAS, the approval of the Board is subject to the following conditions: 1 . No structures shall be located less than two hundred feet from the centerline of 1-25. 2 . The property shall be served by a public sewage disposal system. 3 . Access permits shall be obtained before the construction or use of the access onto the I-25 Frontage Road . 4 . All construction on the property shall be designed and built using the best techniques available to prevent radon gas from entering the structures and shall be in accordance with the requirements of the Weld County Building Code Ordinance. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the request for S #272 , Minor Subdivision for two lots in the C-3 (Commercial) Zone District, submitted by Milton L. and Edwin S. Kahn and Waterford Ranch Company be, and hereby is , approved , subject to the conditions hereinabove listed. BE IT FURTHER RESOLVED by the Board that prior to the issuance of building permits, the following shall be completed: 1 . An on-site improvements agreement shall be approved by the Board of County Commissioners for the parcel that building permits have been applied for. 2. The plat shall be delivered to the Department of Planning Services Office and shall be recorded in the office of the Weld County Clerk and Recorder. 3 . A site plan review shall be approved for the parcel that building permits are being applied for. BE IT FURTHER RESOLVED by the Board that prior to the recording of the minor subdivision plat in the office of the Weld County Clerk and Recorder, the following shall be completed: 1 . We have recently received an advance copy of a "Special Review Permit Plan Map" for a church to be located on Lot "A" of this amended recorded exemption. This plan has addressed our comments regarding access to the I-25 frontage road, building noise setbacks from I-25, and control of surface runoff. However, it does not identify the location of the future frontage road re-alignment. This re-alignment has been discussed with this applicant and the Grant Brothers ownership south of County Road 2!+. We have been informed that an agreement has been reached among the affected property owners to establish an intersection location approximately —�' 600 feet east of the existing frontage road intersection. This office has been contacted by representatives of this property regarding this subdivision. The following areas of concern • were discussed: future re-alignment of the Interstate 25 east frontage road; access to the frontage road; noise setbacks from I-25; and control of surface runoff. The re-alignment of the east I-25 frontage road will become necessary as the area around I-25 and State Highway 119 develops and traffic increases at the interchange. We point out the need to allow for the relocation of the frontage road to achieve the minimum 300—foot separation from the ramp intersection. Since a frontage road relocation was previously proposed by the Commercial 3 Subdivision immediately to the south, we suggested coordination on the location of a future intersection. We strongly recommend that both properties agree on a location for this intersection before this subdivision is approved. Based on our reviews of the Commercial 3 Subdivision in 1983, it appears that their intersection location approximately 600 feet east of the existing ramp intersection would have the least impact on this subdivision. Direct access to the existing or future frontage road is controlled by the State Highway Access Code. One access can be provided to each individual parcel or to contiguous parcels under the same ownership. Application for the Access Permit to construct an access is made to this office. rw C KEITH A. SCHUK'rr October 30, 1986 Kahn/Waterford Page Two In order to avoid an adverse noise impact on residential or commercial buildings within this subdivision we recommend the following setbacks: 410-foot residential and 200-foot commercial. These setback distances are based on the I-25 centerline, but can also be measured from the east right of way line, which is 165 feet from the centerline. Although the topographic contours for this property indicate that surface runoff flows to the northeast and away from I-25, the Sketch Plan note on Storm Drainage states that some water flows along the 1-25 frontage road. It should be noted that drainage to the highway right of way shall not exceed the undeveloped historical flow. Thank you for the opportunity to review this sketch plan. We would like one traffic and master plan from I-25 to the end of the New Creation Ministries property. We also feel that this should be the same on the cross section (curb and gutter, widened right-of-way, turn lanes , etc. ) as SH 119 on the opposite side of I-25. 2. We recommend denial of the access to Weld County Road 242. A previous road maintenance agreement with Siegrist allows mining both sides of Weld County Road 242 and access to the frontage road. We see no reason why church patrons need access beyond the I-25 frontage and Weld County Road 24. If the access is granted to Weld County Road 242 the owner would be responsible for improvements including realignment, paving and shoulders to meet Weld County standards to accommodate the increase in traffic. The following comments address the respective issues mentioned in the referral comments and are intended to assist the Staff in review of the final minor subdivision plat of Kahn Subdivision. Weld County Engineering Department This property is zoned C3 Commercial District, however, there are no specific plans for development at this time. Prior to development, a site plan will be designed for use of the property. The site plan will include design of storm drainage detention and run-off according to Weld County standards. Development in the C3 District requires site plan review which includes review of drainage design by the Engineering Department. Access to these sites is from the I-25 frontage road and County Road 24. Property owners will enter into an Improvements Agreement regarding participation in improvements to Weld County Road 24 adjacent to this property. State Highway Department Site plans for development of these sites shall be designed to allow for the relocation of the I-25 frontage road to standards of the State Highway Department. The future alignment of the frontage road will intersect County Road 24 at the location proposed by the Commercial 3 Subdivision south of County road 24. This intersection is approximately 600 feet east of the existing ramp location. Access from these sites to the frontage road (existing or future alignment) will be based on an approved Highway Department access permit. When site plans for development are prepared, an application for an access permit will be submitted to the State Highway Department. Longmont Soil Conservation Service A subsurface soils investigation has been completed and foundation designs will be in accordance with recommendations of this report. Please see enclosed Soils Report. Colorado Geological Survey Review of the Flood Insurance Rate Map of the Federal Emergency Management Agency shows that this property is not in the 100-year flood boundary of St. Vrain Creek. This map shows the 100-year flood boundary north of County Road 24#. This property is within the area mapped as Fl sand and gravel deposits. A thorough analysis of the potential for removing the sand and gravel deposits reveals that it is not economically feasible. Please see attached letter from Kenneth Rollin. No tests have been conducted on the presence of radon at this location. Such tests should be performed by developers prior to building construction on the site. The presence of radon is a problem in buildings with crawl spaces or areas of occupancy below grade. If radon is detected, it is recommended the buildings with enclosed areas subject to radon gas infiltration be designed with proper ventilation systems which provide appropriate air exchanges. Weld County Health Department The house on the property north of this subdivision will be removed if a Special Use Permit is approved for a church on that site. Sanitation service is planned from St. Vrain Sanitation District and water service from Central Weld County Water District. This application is for two lots with a total acreage of approximately 10 acres. These are located at the northeast intersection of I-25 and Weld County Road 24. We have done no drilling on this site to evaluate the minerals, although it would appear that there is a sand and gravel resource in this area because of the proximity of operating gravel pits. However, with a site as small as 10 acres and with the proposed changes in the I-25, Colorado 119 interchange, there would be very limited amount of this 10 acres (approximately 1 acre) which could be mined at all . The proposed changes in the interchange would isolate this parcel from the surrounding properties and make it unmineable. Currently, 10 acres is generally not considered a large enough parcel for a mining operation. Therefore, although the resource probably does exist , it could not be mined practically or economically in light of its size and the current plans by the Colorado Highway Department . Therefore, it would be my opinion that this land should be exempt from any need to mine this resource. If I can be of further assistance, please do not hesitate to contact me. REPORT OF A PRELIMINARY GEOTECHNICAL INVESTIGATION SCOPE This report presents the results of a Preliminary Geotechnical Investigation prepared for the proposed commercial building site to be located on County Road No. 24 at Del Camino in Weld County, Colorado. The investigation was carried out by means of test borings and laboratory testing of samples obtained from these borings. SITE INVESTIGATION The field investigation, carried out on November 13, 1986, consisted of drilling, logging and sampling three ( 3) test borings. The locations of the test borings are shown on the Test Boring Location Plan included in Appendix A of this report. Boring logs prepared from the field logs are also presented in Appendix A. These logs illustrate the soils encountered, depth of sampling and elevations of subsurface groundwater at the time of the investigation. All borings were advanced with four-inch diameter, continuous-type, power-flight auger. The test borings were drilled to depths of fifteen ( 15) feet. The drilling operations were performed under the supervision of a geotechnical engineer from Empire Laboratories, Inc. , who made a continuous visual observation of the soils encountered. SITE LOCATION AND DESCRIPTION This site is located at the northeast 1/4 of County Road No. 24 and Frontage Road in Weld County, Colorado. More particularly, this site may ( 1) be described as a portion of the Kahn Subdivision and is situated in the southwest 1 /4 of Section 2, Township 2 north, Range 68 west of the Sixth P.M. , Weld County, Colorado. The site is an open harvested corn field. The property is bordered on the west by Frontage Road and on the south by Weld County Road No. 24 and on the north and east by agricultural land. The property is bordered on the south by an irrigation ditch. This site slopes gently downward to the north and exhibits poor drainage toward the north. LABORATORY TESTS AND EXAMINATIONS Laboratory testing and examination were performed on samples obtained from the test borings in order to determine the physical characteristics of the soils encountered. Moisture contents, dry unit weights and unconfined compressive strengths were determined. A summary of the test results is included in Appendix B . SOIL AND GROUNDWATER CONDITIONS The soil profile at the site consists of strata of materials arranged in different combinations. In order of increasing depth, they are as follows: (1) Topsoil : The site is overlain by a layer of silty topsoil approximately one ( 1) foot thick. The upper four (4) to six (6) inches of topsoil has been penetrated by root growth and organic matter and should not be used as backfill or foundation bearing. (2) Sandy Silty Clay: Light brown sandy silty clay underlies the topsoil and extends to the underlying clayey sand at depths of four (4) to five (5) feet. This stratum exhibits low bearing characteristics. ( 3) Clayey Sand : Light brown clayey sand exists beneath the clay stratum and extends to the underlying sand and gravel stratum (2) at depths of five (5) to six (6) feet. This stratum has moderate bearing characteristics and moderate shear strengths. (4) Sand & Gravel : Sand and gravel mixed with some cobbles under- lies the clay stratum and extends to the depths explored. The sand and gravel stratum is well graded and in a saturated condition. This stratum exhibits moderate bearing characteristics and shear strengths. (5) Groundwater: At the time of our investigation, free groundwater was encountered at depths ranging from four (4) to five (5) feet. Water levels in this area are subject to change due to seasonal variations and irrigation demands. RECOMMENDATIONS AND DISCUSSION It is our understanding that this property will be used for commercial construction. Geology The proposed site is located within the Colorado Piedmont section of the Great Plains physiographic province. The Colorado Piedmont, formed during Late Tertiary and Early Quaternary time (approximately sixty-five million (65, 000, 000) years ago) , is a broad, erosional trench which separates the Southern Rocky Mountains from the High Plains. Structurally, the property lies along the western flank of the Denver Basin. During the Late Mesozoic and Early Cenozoic Periods (approximately seventy million (70, 000, 000) years ago) , intense tectonic activity occured, causing the uplifting of the Front Range and the associated downwarping of the Denver Basin to the east. Relatively flat uplands and broad valleys characterize the present-day topography of the Colorado Piedmont in this region. The site is overlain by alluvial deposits of Modern Time. The alluvial deposits are underlain by ( 3) siltstone and claystones of either the Pierre, Laramie or Fox Hills Formations. The contact of these three formations underlie the site. No bedrock outcrops were encountered at the site, and the bedrock exists in this area at a depth of approximately twenty (20) feet below the surface. The regional dip of the bedrock in this area is anticipated to be relatively flat and in an easterly direction. Seismic activity in the area is anticipated to be low; therefore, from a structural standpoint, the site should be relatively stable. Due to the relatively flat nature of the site, geologic hazards due to mass movement, such as landslides, mudflows, etc. , are not anticipated. With proper site grading around the structures and adequate drainage for streets and paved areas, erosional problems should also be minimal. The property lies within the drainage basin of the St. Vrain Creek but according to Rocky Mountain Consultants, Inc. , does not lie within the one hundred ( 100) year floor plain of the creek. Therefore, the site should not be subject to extensive flooding by the St. Vrain Creek. The property is underlain by sand and gravel. Approximately three (3) to five (5) feet of overburden material overlies the gravel, and the gravel layer extends to the bedrock below at depths of approximately twenty (20) feet. In general, th'e sand and gravel material encountered consists of hard, durable fragments suitable for use in construction materials. Due to the relatively small size of the property, it is our opinion that the site is not feasible for the economic extraction of sand and gravel. Geologic conditions at the site are such that, in our opinion, the site is not underlain at economic depths by coal, limestone or quarry rock. Radiation hazards at the site may be higher than normal rates in the area due to the fact that the site is under- lain by sand and gravels. The sand and gravel is composed of igneous and metamorphic rocks derived from the mountains to the west and may contain (4) uranium-related minerals. A detailed study of radon gas or radiation hazards at the site is beyond the scope of this report. It is suggested that a more detailed study be made prior to construction to more accurately determine radiation hazards at the site and make recommendations regarding remedial actions if needed. Foundations Based on anticipated loads and the subsurface conditions encountered at the site, it is our opinion that this site is suitable for the proposed construction. The type of footings recommended for the proposed structures will be dependent upon the size of the structures. A lightly loaded building may be supported on conventional continuous and/or spread footings. These footings should bear on undisturbed natural soil and all exterior footings should be placed a minimum depth of thirty (30) inches below grade for frost protection. Based on preliminary data, foundations placed on this site may be designed for maximum allowable soil bearing pressures of seven hundred and fifty (750) to one thousand five hundred ( 1, 500) pounds per square foot (dead load plus maximum live load. ) Minimum dead load pressures of up to five hundred (500) pounds per square foot may be recommended for conventional footings. A pier and grade beam foundation alternative could be used on this site for heavily loaded buildings because of the low bearing upper soils which are present. With this alternative piers would be drilled a minimum of three ( 3) feet into the firm bedrock stratum and grade beams would span the piers. Based on test data from the northern portion of this subdivision, bedrock is at a depth of approximately twenty (20) feet below the surface. Temporary casing will be required for the piers to prevent sloughing of the granular overburden materials and to permit dewatering prior to placement of the concrete. Garden level construction is feasible providing complete dewatering systems are installed. The soils at this site are adequate for supporting normal slab on grade construction. GENERAL COMMENTS It should be noted that this was a preliminary investigation and the bearing capacities recommended in this report are based on preliminary tests. Due to variations in soil conditions it is recommended that additional test borings be made prior to construction. Samples obtained from these test borings should be subjected to testing and inspection in the laboratory to provide a sound basis for determining the physical properties and bearing capacities of the soils encountered. SOILS DESCRIPTION 4—Aquolls and Aquepts, flooded. This nearly level map unit is in depressions in smooth plains and along the bottoms of natural drainageways throughout the survey area. Aquolls, which have a dark colored surface layer, make up about 55 percent of the unit. Aquepts, which have a lighter colored surface layer, make up about 25 percent. About 20 percent is soils that are well drained and soils that have sandstone or shale within 48 inches of the surface. These are deep, poorly drained soils that formed in recent alluvium. No one pedon is typical. Commonly the soils have a mottled, mildly to moderately alkaline loamy or clayey surface layer and underlying material that ex- tends to a depth of GO inches or more. In places they have a-gleyed layer in the underlying material. Most of Lhe acreage is subject to excessive runoff. The water table is at or near the surface in spring and during the peak of the irrigation season. These soils are used for rangeland and wildlife habitat. Some small areas are irrigated pasture. The potential native vegetation is dominated by switchgrass, prairie cordgrass, saltgrass, alkali sacaton, big bluestem, indiangrass, western wheatgrass, slender wheatgrass, sedge, and rush. Cattails and bullrush grow in the swampy spots associated with these range sites. Potential production ranges from 4,000 pounds per acre in favorable years to 3,000 pounds in unfavorable years. As range condition deteriorates, the tall and mid grasses decrease, production drops, and saltgrass, sedge, and rush increase. The farming and irrigation in adjacent areas has increased the amount of salts on much of the acreage. Management of vegetation on this soil should be based on taking half and leaving half of the total annual produc- tion. Switchgrass, big bluestem, indiangrass, western wheatgrass, pubescent wheatgrass, intermediate wheat- grass, tall wheatgrass, and tall fescue are suitable for seeding. The plants selected should met the seasonal requirements of livestock. For successful seeding, a firm prepared seedbed is needed. A grass drill should be used. Seeding early in spring has proven most successful. Til- lage is needed to eliminate the undesirable vegetation. Wetland wildlife, especially waterfowl, utilize this unit. The wetland plants provide nesting and protective cover as well as some food. The nearby irrigated cropland, where wildlife obtain much of their food and find protec- tive cover, makes this unit valuable to both wetland and openland wildlife. Openland wildlife, especially pheasant, use this unit for cover and nesting. Deer find excellent cover in sonic areas. These valuable wildlife areas should be protected from fire and fenced to prevent encroachment and overuse by livestock. They should not be drained.
