Subject: Non-Financial Coordination Agreement Between the City of Fort Lupton
and Employment Services of Weld County
Enclosed for Board approval is a non-financial coordination agreement
between Employment Services of Weld County and the City of Fort Lupton.
The agreement outlines employment services to be provided by Employment
Services of Weld County to Four Seasons Manufacturing, Inc. These
services will be provided on behalf of the City of Fort Lupton in order
to meet their requirements in providing Community Development Block Grant
funds to assist Four Seasons Manufacturing, Inc. in relocating to Fort
Lupton.
The agreement will remain in effect until the terms of the Community
Development Block Grant are met.

COORDINATION AGREEMENT
FOR CDBG-1987
THIS AGREEMENT, made and entered into this 20th day of July, 1987, by and
between the City of Fort Lupton, hereinafter referred to as the "City" , and the
Board of County Commissioners of Weld County, Colorado, by and on behalf of the
Employment Services of Weld County, hereinafter referred to as "Employment Services
or ESWC."
WITNESSETH:
WHEREAS, the City desires to use Community Development Block Grant Funds to
assist Four Seasons Manufacturing, Inc. , hereinafter referred to as Employer, in
relocating to Fort Lupton which will create new, permanent jobs; and
WHEREAS, the City desires to target at least 75 percent of the jobs for low
and moderate income households; and
WHEREAS, the ESWC has experience in providing screening and referral services,
and data collection for persons from low and moderate income households within the
Fort Lupton area; and
WHEREAS, this Coordination Agreement is to the mutual benefit of the City and
ESWC, and ESWC is authorized to enter into this agreement pursuant to Section 2-3
of the Weld County Home Rule Charter and Section 29-1-203, CRS.
NOW, THEREFORE, in consideration of the promises and mutual covenants
contained herein, the parties hereto agree as follows:
SECTION 1. ESWC will provide the following services to the City:
1. Have each person reported as hired by the Employer complete the "Four
Season's Applicant Survey." A copy of this survey is attached hereto and
incorporated herein (Exhibit "A").
2. Establish if employee meets low or moderate income standards for reported
household size per "Income Guideline" attached as Exhibit "B".
3. Maintain the surveys by date monthly and deliver them to the City by the
eighth (8th) day of each succeeding month.
SECTION 2: The City will provide the following services relating to the CDBG
Program for the Employer:
1. Advise ESWC of changes or amendments to data requirements regarding
income guidelines and classification criteria (e.g. , maximum income
levels and number in household for low and moderate households).
2. Require Employer to provide to ESWC data on all employees hired pursuant
to the CDBG Program, and all other information and documentation as
requested by ESWC.
3. Ensure that Employer is aware of the requirements and responsibilities for
complying with their Community Development Block Grant.

SECTION 3. This agreement shall remain in effect until the terms of the grant
concerning hiring requirements are met and data is received and reported to the
City, unless extended or terminated as provided herein. This agreement may be
terminated without cause by either the City or ESWC by serving thirty (30) days
written notice. This agreement may be extended or amended; however, provided all
extensions or amendments shall be in writing and approved by both the City and
ESWC.
SECTION 4: City agrees to indemnify, hold harmless, and defend the Board of
County Commissioners of Weld County, Employment Services, and its officers and
employees from any and all loss and/or liability caused by the actions or omissions
of City, its employees, volunteers, and/or agents while performing the duties as
described in this agreement. The City has no power or authority to enforce any of
this agreement. The City cannot accept any responsibility unless there is
commensurate authority.
SECTION 5: ESWC does not guarantee or warrant the accuracy of the information
provided by ESWC to the City pursuant to this agreement. ESWC also does not
guarantee or warrant that the information provided pursuant to this agreement is
all inclusive.
